I won't comment other than to note that the deadline for minority statements was yesterday and the final Supplemental report is due today. This is most noticeable in the question of thresholds for board removal, however this is not an issue about removal or even thresholds, it is one part of the community being (or perceiving that it is being) sidelined. The Board's concerns with this issue are not about Board removal, but about maintaining the balanced multistakeholder model. The Board is against any changes to the long established equilibrium and fairness among the different stakeholders within ICANN. The Board has long supported a threshold of four participants for Board removal in the ultimate escalation method proposed by the CCWG. Selecting one portion of the ICANN community and removing them from the equation - just through the ability to say that the community is unhappy with the acceptance of GAC advice that is within ICANN's bylaws - raises significant concerns about how the multistakeholder model, and the ultimate stability of ICANN as an organization, can be maintained. This carved out exception undercuts the established role of governments within the multi stakeholder process, and could introduce new issues with the acceptance of ICANN's model undermining the work of the CCWG. We understand that there are concerns with this path from within other parts of ICANN community, including members of the GAC and ALAC. The best course, in our opinion, would be a careful and objective discussion of the whole matter of how advice from ALL parties is appropriately considered within ICANN. If there is a graceful way to remove this matter from the immediate pressure of the deadline of submitting this proposal and make it a priority matter for either the implementation phase or Work Stream 2, we think there will be a solution which is genuinely good for everyone. We encourage you to share the CCWG's proposal with the Chartering Organizations while the dialog on this outstanding point continues. Special Session - 29 FEB

Councilors - Thanks for your effort, dedication and patience as we work through all of the issues currently on our agenda, while in parallel delivering on our responsibilities as a Chartering Organization for the CCWG-Accountablity. As discussed on today's call, we will go forward with the proposed Special Session on 29 FEB to consider and discuss the Supplemental Report from the CCWG-ACCT (expected publication: tomorrow). On this call, we will not vote on any of the Recommendations, or the report itself. There is no associated motion on the table. Instead, we will use this opportunity to exchange views on the Report, update the Council on the ongoing work within the various SGs/Cs in preparation for Marrakesh, and highlight any problem areas or "red flags" that have been identified in our discussions. Additionally, we will invite the Appointed Members and several key Participants from the CCWG-ACCT to join our discussions. These will include: Becky Burr, Steve DelBianco, Robin Gross, and Thomas Rickert. I would ask that each House send along a list of 5-7 other key participants who should be invited to attend as well, with the goal of incorporating the diverse spectrum of GNSO positions, but not overloading our call. Finally, we agreed to re-purpose some of our time on Saturday in Marrakesh as a Public Session of the Council. I'll work with the Vice Chairs and Staff to adjust our published agenda to reflect this. Revised GNSO Operating Procedures Posted

Dear GNSO Chairs and Councilors, As reported at today's GNSO Council meeting, Version 3.1 of the GNSO Operating Procedures was posted on 17 February 2016 at http://gnso.icann.org/en/council/procedures. This is a combined revision as a result of GNSO Council actions occurring on 24 June 2015, 24 September 2015, and 21 October 2015, and following ICANN Bylaws changes posted on 16 February 2016. Specifically, these revisions cover the following four areas: 24 June 2015: 1) Addition of the GNSO Expedited Policy Development Process and the GNSO Guidance Process as Annexes 4 and 5, and 2) Addition of New Section 4.3.5 in Section 4.3 Motion and Votes 24 September 2015: 3) New Proposed Process for the Selection of Board Seat #13 by the Contracted Parties House as Annex 6 21 October 2015: 4) Revisions to Annex 1 GNSO Working Group Guidelines and Annex 2 Policy Development Process Manual per the Data and Metrics Working Group Recommendations Please see the attached annotated guide for further details as well as the GNSO Policy Processes Cheat Sheet. Dear Councillors, Please find the resolution that passed unanimously at the GNSO Council meeting on 18 February 2016. Initiation of a Policy Development Process (PDP) on a Review of All Rights Protection Mechanisms (RPMs) in All Generic Top-Level Domains (gTLDs) Whereas 1. In December 2011 the GNSO Council had requested that an Issue Report on the current state of all rights protection mechanisms (RPMs) implemented for both existing and new gTLDs, including but not limited to the Uniform Dispute Resolution Policy (UDRP), be delivered to the GNSO Council no later than eighteen (18) months following the delegation of the first gTLD in ICANN's New gTLD Program; 2. In January 2014 the GNSO Council agreed to extend the timeline for delivery of the Issue Report by six (6) months; 3. ICANN staff published the Preliminary Issue Report on a Policy Development Process to Review All RPMs in All gTLDs for public comment on 9 October 2015, with the public comment forum closing on 30 November 2015; 4. ICANN staff have reviewed the public comments received, published a Report of Public Comments on 10 December 2015 and updated the Issue Report accordingly; 5. The Final Issue Report on a Policy Development Process to Review All RPMs in All gTLDs was delivered to the GNSO Council on 11 January 2016 (see http://gnso.icann.org/en/issues/new-gtlds/rpm-final-issue-11jan16-en.pdf) 6. The Final Issue Report includes a recommendation that the GNSO Council proceed with a two-phased Policy Development Process (PDP) that will first review the RPMs that were developed for the New gTLD Program, followed by a subsequent second phase that will review the UDRP, with the overall goal of developing a uniform and consistent framework for any future review of RPMs; and 7. The General Counsel of ICANN has indicated that the topics recommended for review are properly within the scope of the ICANN policy process and the GNSO. RESOLVED: 1. The GNSO Council hereby initiates a two-phased PDP to review all RPMs in all gTLDs, to review and determine whether modifications to the existing RPMs (including but not limited to the UDRP) are needed and, if so, what they should be. The outcome of the PDP may lead to (i) amendments or replacement of existing policies, principles or procedures; (ii) the development of new or additional policy recommendations; and/or (iii) the creation of new implementation guidance to supplement existing policies or procedures. 2. The GNSO Council requests that the PDP Working Group be convened as soon as possible after the adoption of the PDP Working Group Charter in order to fulfill the requirements of this PDP. These have been incorporated into the sections that were noted. The graphics are being revised and will be placed in the final version of the text per the suggestions that have been submitted to date. We have also posted a documents that tracks all the comments - and subsequent changes made - between the 12 February and 17 February documents. The schedule presented on the 16 February call that we are following to conclude our current work on Work Stream 1 has been updated. 12 Feb - Report sent by 22:00 UTC to the CCWG Leadership Team and CCWG Legal Counsel for review with all materials posted on the Wiki (https://community.icann.org/x/iw2AAw) for everyone to view. 15 Feb - Report updated (if needed) to incorporate edits from CCWG Leadership Team and Legal. 17 Feb- Report sent to CCWG for 48-hour review (and posted on the Wiki at https://community.icann.org/x/iw2AAw) To ensure that all comments from our CCWG Leadership Team and Legal counsel were accurately incorporated for the full group review period, distribution to the CCWG was updated to 17 Feb. To maintain the 48-hour review period, all subsequent proposal finalization dates have been extended one day. All other dates have been retained. 18 Feb at 17:00 UTC - Minority statements due for incorporation into Final Report. 19 Feb - Final Report sent to Chartering Organizations for consideration and approval. Once the Final Report is in the hands of your organizations, these are the expected dates for the final steps, as we discussed on the Transition Program Facilitation<https://www.icann.org/resources/pages/transition-facilitation-2015-09-23-en> call this past Tuesday: 25 Feb - CWG-Stewardship sign-off letter delivered to Chartering Organizations, then to ICG. By 9 Mar at the latest - Sign-off on Final Report by Chartering Organizations at ICANN55 in Marrakech (in time for the Board to consider). 10 Mar - Public Board Meeting and hand over from ICANN Board to NTIA. Based on the updated schedule, minority statements must be submitted no later than 18 February at 17:00 UTC to allow for the final supplemental proposal to be produced and ready for distribution to the Chartering Organizations on 19 February.
