Update on ICANN org work on the IGO Program (on aspects other than implementation of the Curative Rights policy)

Dear all, Ahead of your meetings at ICANN79, I am writing to follow up on an action item for ICANN org from the ICANN78 Annual General Meeting. This was for ICANN org to share a preliminary timeline for all the current work streams relating to IGO protections, including preparatory work towards the release of the temporarily-reserved IGO acronyms. The IGO Program team had originally thought we could include this update during the GNSO Council’s session with the Global Domains & Strategy (GDS) team at the GNSO Working Session on Sunday 3 March. However, given the number of topics to be covered in that session, which we also understand will be focused on current GDS policy implementation projects, we thought it might be more appropriate to provide an email update. To recap, ICANN org’s ongoing work streams relating to IGO second-level protections are: 1. implementing the Board-adopted recommendations from the two completed GNSO policy efforts * These are the four GNSO Council-approved recommendations from the 2019 PDP on IGO-INGO Access to Curative Rights Protection Mechanisms and the five recommendations from the 2022 EPDP on Specific Curative Rights Protections for IGOs. 2. work directed towards releasing the currently-reserved acronyms of those IGOs on the list that the GAC submitted to ICANN in 2013 * This includes the development of a permanent system to notify IGOs on the GAC’s list when a third party registers a second-level domain name that matches that IGO’s acronym as well as work to ensure that the IGO contact list for this purpose is updated and accurate. Our GDS colleagues will cover item (1) as part of their implementation updates at the GNSO Working Session this Sunday. On item (2), the IGO Program team continues to support the Board in its discussion and review of the GAC’s advice in the ICANN76 Cancun Communique<https://gac.icann.org/advice/communiques/icann76-cancun-communique-es.pdf> (March 2023) to “maintain the current moratorium on the registration of IGO acronyms as domain names in New gTLDs presently in place until the full implementation of the recommendations of the EPDP on Specific Curative Rights Protections.” This advice follows from the GAC’s ICANN71 Communique<https://gac.icann.org/contentMigrated/icann71-gac-communique> as well as subsequent correspondence<https://gac.icann.org/contentMigrated/gac-response-to-board-clarifying-ques…> where the GAC clarified its intention that the IGO acronyms should remain reserved until implementation of the Curative Rights policy recommendations is completed. At this time, we are therefore not in a position to provide an estimated timeline for when the IGO acronyms can be released from reservation. We do, however, wish to let you know that ICANN org’s work on the proposed<https://www.icann.org/en/board-activities-and-meetings/materials/approved-r…> IGO notification system continues. and we are also working to ensure that the IGO contact list is updated and accurate, as this will be necessary to ensure effective operationalization of the planned notification system when it is launched. The team is confident that we will complete these work streams in a timely manner, such that they will not delay any expected action by the Board to release the IGO acronyms from the reserved list. In this regard, we note that ICANN org has stated<https://newgtlds.icann.org/sites/default/files/new-gtld-next-round-implemen…> publicly that developing the notification system is a strategic dependency for delegating the first new gTLDs in the next round. Furthermore, while the “.quebec” TLD issue has become the de facto case study, the issue is much broader in that it identifies a substantial gap in policy that is counter to the narrative of supporting multilingual internet. French, Spanish, German, Italian, Portuguese, etc. languages could all face related issues in the future. 1. Standing Predictability Implementation Review Team (SPIRT) charter The GAC welcomes a GNSO Council’s update on the SPIRT Charter Drafting Team, recognizing a meeting took place to date. The GAC finds this cross community work to be extremely important and is looking to appoint GAC representation to the SPIRT Charter Drafting Team as soon as possible. Could the GNSO Council provide an overview on the SPIRT Charter Drafting Team for GAC membership (e.g. timeline, output and approval process, expectations from members including cadence of meetings and time commitment)? GNSO Statements of Interest (SOIs) status and next steps * ICANN’s processes should be fair and transparent to ensure the trust and confidence of all stakeholders, including governments, in the multistakeholder system of Internet governance. The importance of transparency is enshrined in ICANN’s Bylaws. * In its ICANN76 and ICANN78 Communiqués, as an issue of importance, the GAC addressed the exception within the GNSO’s Operating Procedures that permits participants to refrain from disclosing the individuals or entities that they represent at ICANN. * These exceptions ignore globally established norms in policymaking, where representatives are required to disclose client identities when engaging in policymaking processes. * The GAC firmly supports transparency at ICANN and, in its view, considers this exception in conflict with the ICANN Bylaws. * The GAC hopes to see further opportunities to review this issue so community members can advocate for changes that promote greater transparency at ICANN. DNS Abuse Mitigation a. Potential post contractual amendments policy developments on DNS Abuse, including botnets and phishing The GAC was pleased to hear that the DNS Abuse amendments to the RA and RAA were approved by the Board and will become effective on April 5th. In the GAC’s public comment<https://itp.cdn.icann.org/public-comment/proceeding/Amendments%20to%20the%2…> on the amendments, the GAC noted several potential areas for further work on DNS abuse, including, for example: * Guidance on Key Terms in the Amendments, such as “appropriate,” “prompt,” “actionable,” and “reasonable;” * Due Process Considerations, in the event that a registrant maintains that registrar/registry action taken pursuant to the new obligations was unwarranted; and/or * Policy options designed to address registrants that are “repeat offenders” in the DNS abuse category, which could include identifying thresholds of abuse complaints at which compliance inquiries are automatically triggered, or positive incentives for registrars to achieve positive results in DNS abuse mitigation. The GAC also understands that interest has been expressed in exploring different policy approaches for addressing maliciously-registered domains versus compromised domains. Recognizing that some time must pass in order to observe the effect and impact of the new provisions, what are the thoughts of the GNSO on any prospective Policy Development Processes pertaining to DNS abuse which build upon the foundation created by the new contract obligations, and in advance of the next round of new gTLD applications? How can GAC representatives participate in future discussions on potential policy work and PDPs on DNS Abuse issues? 1. Update on GNSO Council Small Team on DNS Abuse Could the GNSO kindly provide an update on the Small Team on DNS Abuse? Is any further work envisioned? WHOIS/Data Protection a. To leverage the “Community Forum” format of the ICANN79 Public Meeting, GAC Members have created the opportunity for members of the ICANN community to gather in the GAC meeting room on Tuesday March 5 at 13:00 UTC (09:00 local San Juan time) to share their news and views with committee delegates in-person and on-line during the meeting. This session will serve as an ‘open hour’ where individuals from different constituencies across the ICANN community are invited to register for a short remark time slot and "take the mic" to present questions or comments to the GAC. The GAC will be in "listening" mode during this session and may then reflect on any particular points raised in a subsequent session at ICANN79 or at a future ICANN Public Meeting.
