WG: EURALO Petition to extend the At-Large voting slate

Dear all, thanks for your participation and support on our recent request for your opinions on the options for a EURALO petition to extend the At Large slate. Until yesterday PM, we had the following result: Option A: Stefan, Annette, Werner, Rena, Wolfgang, Yjrö, Sandra, Wolf = 8; Option B: Patrick, Adam, Manuel, Rudi = 4; Option C: Dessi, Monique (Sébastien) = 2 (3). Christopher told me that as a BCEC member he prefers to abstain from positioning – what I understand and support. This means, we had a strong majority for petitioning (Options A and B). And it was difficult for Olivier and me to decide on our course of action among the two options. Therefore, we tried to find a compromise – to be as inclusive as possible – by sending our EURALO petition for two candidates: Avri Doria and Jean-Jacques Subrenat who explicitly asked us for support. The other suggested candidate for option B Jordi was not seeking contact and support from us. I hope that our final compromise and course of action is acceptable for all those (12 members) at least who expressed themselves for petitioning. Please be aware that the member consultation for the directed vote of the Chair in this matter will start soon, and I am counting on a strong participation and your support again. Dear all, as you may have realised (according to our previous mailings), there was much and controversial discussion on the recent Announcement of At-Large selected voting Board Director candidates and the fact that the EURALO suggested candidate (Avri Doria) was not considered. The EURALO Board is therefore discussing to take action and to petition on behalf of her -- and perhaps other suitable candidates from Europe who were not considered neither. We now need to know your opinions and comments on the following course of action – on the three options: a. EURALO to include petition for Avri ONLY. b. EURALO to include petition for Avri AND other qualified European candidates like Jean-Jacques Subrenat and Jordi Palet Martinez. c. EURALO not to petition at all. Notice of administrative error in posting of two SOIs for At-Large Board Director

Dear All, Due to an administrative error, the statement of interest of John Yunker (available at: At-Large <https://community.icann.org/download/attachments/2265195/At-Large+Director+…> Director Applicant - John Yunker.pdf) for the position of the At-Large selected Board Director was not posted on the At-Large Director Candidate Workspace (see: https://community.icann.org/display/DirCan/At-Large+Director+Candidate+2010…) along with the other applicants that had not been selected for the slate of candidates on 28 October. At the same time, the statement of interest of Ahmad Al‐Shagra, which the Board Candidate Evaluation Committee had judged to be too incomplete to merit further consideration prior to its first round of evaluations, was posted in error. The error has now been corrected on the At-Large Director Candidate Workspace. Please note that this administrative error occurred after the slate of candidates was announced on 28 October. The BCEC reviewed John Yunker’s SOI during their selection process. Staff have informed both parties and the BCEC. We sincerely apologize for this oversight. Three of those SOIs were from current and sitting members of the ALAC; forty were not. By an amazing coincidence only current and former ALAC members were selected for the candidate slate. On this basis alone, there are some that might wonder whether the at-large director selection process has, in fact, been captured. Others will look at the fact that the BCEC was entitled to select as many as 7 candidates (which would have allowed for more than one gender to be considered, or would have allowed for some "non-insiders" to be considered), and yet the BCEC for some unfathomable reason decided to narrow the field of otherwise qualified candidates down to only the three that were sitting or prior ALAC members... still another reason to suspect capture. We know that the ICANN Board Governance Committee had concerns about capture; their meeting minutes state: "Reviewed the proposed At-Large Board member selection process and potential risks of capture identified within the process." While their assessment was that the risk of capture was low, the preliminary election results tendered can readily lead one to a different conclusion. One also has to look at the fact that 49% of all SOIs were rejected before the process even began (ostensibly because they were deemed to be too incomplete to proceed further). In what other election process are that many candidates rejected out of hand before the election even begins? Clearly there is something seriously wrong with this picture. If the Statement of Interest application form was so poorly written that almost half of all applications were improperly completed, then it is an inescapable conclusion that the process itself was seriously flawed. We know as well that ICANN Staff has provided a certain degree of support to some of the 22 candidates that hadn't fully completed their SOIs. At issue is why Staff didn't offer comparable support to the other 21 applicants who were initially rejected. Additionally, we are confronted with the fact that the at-large director selection process was announced on the internal ALAC-related lists on 21 July, but press releases in Arabic, Chinese (Simplified), French, German, Portugese (Brazilian), Russian and Spanish weren't issued until 26 August -- you will note that the deadline for applications was only 11 days thereafter (on 6 September). One has to wonder how many SOIs weren't received owing simply to the the short time span between the international press release date and the final application deadline. One also has to wonder about how much of an advantage was thereby given to "insiders" that were aware of the process for a full month longer than applicants who first heard about the election when the Press releases were issued in languages other than English. Recently, the ABSdt announced a revised timeline that requires the RALO petition process to be completed on or before 7 November, yet no e-mail notices have gone out to any of the candidates to advise them of the timeline changes. Is this fair to the bulk of the candidates that may not even know of the existence of the ABSdt mailing list? All of us intuitively understand that a flawed process can certainly yield a flawed outcome. So what do we do at this point? While I understand the rush to have an at-large director seated (just as I understand the rush to have new gTLDs launched), I also understand that as a community we are better served by "doing it right" than by adhering to the results of what may be perceived as a tainted or seriously flawed election process. Yes, I recognize that it is always exceedingly difficult to stop a moving train, but I remain of the view that this election process has already been damaged to the degree that it should be stopped dead in its tracks for the good of the at-large community. I understand that these views may not be popular with some, but this election process, in my opinion, has proven to be not as fair and properly orchestrated as it could have been. best regards, Danny Younger

Results of At Large Board Selection design team (ABSdt) conference call

Dear European At Large Structures, the At Large Board Selection design team (ABSdt) met virtually by teleconference this afternoon to discuss the proposals which were sent to the ALAC by EURALO, asking for a delay in the At Large Board Seat 15 selection process. A copy of EURALO's original message was sent to the EURALO List by Wolf Ludwig and is archived at: http://atlarge-lists.icann.org/pipermail/euro-discuss/2010-October/001927.h… The ABSdt conference call, originally due to last one hour, finally lasted two full hours, from 13:00-15:00 UTC, such was the intensity and thoroughness of the debate taking place. --- cut here --- Consensus was reached on the following: * seating of the At Large selected candidate on the Board The candidate should be seated at the end of the Cartagena Meeting, as originally planned. * new time-line for the selection process: 28 October: BCEC to announce slate of 3-7 candidates and SOI details; 28 October - 15 November: Campaigning period for candidates; On or before 7 November: RALO petition processes to be completed; 12 - 15 November (early UTC time on ): A community call with the final slate of candidates will be held; 15 - 22 November (RALOs can extend this deadline until 25 November if desired) : RALO discussions on candidates 22 - 25 November: First round of online voting on final slate of candidates; 26 -- 28 November: Second round of online voting on final slate of candidates (only if necessary) * VISA issues All candidates on the final slate are expected to be already proceeding with VISA formalities, should they be required in their case. The delay to the final vote is therefore not a problem for VISAs. --- cut here --- Petitioning: We therefore have until the end of this week, plus the week-end for petition processes. Bearing in mind this process has started on 28th October, this provides EURALO with 10 days for petitioning - in-line with the 10 day time-line which was desired by some of our members. May I remind everybody too, that the BCEC's selection process has been very thorough indeed. It was always the ABSdt's aim that addition of candidates by petition should be an exceptional occurrence, therefore requiring the support of three or more RALOs. It is therefore imperative that any petitioning candidate's) should follow-up directly with RALOs and that RALOs announce their support for any petitioning candidate(s) no later than 7 November, in time for the petitioning candidate(s) to be included in the community call line-up. RALO selection process: An election process will be taking place at EURALO for members to direct the vote(s) of our Chair Wolf Ludwig. This will start on 15 November, and will be open all the way until 25 November assuming Wolf casts his vote on the last possible voting day for the first round. This gives European At Large Structures 10 days of voting - in-line with the 10 day time-line which was desired by some of our members. Should additional rounds of voting be required, Wolf Ludwig will already have full instructions in his hand thanks to ALSes voting by "preference", that is, their No.1 candidate, No.2, etc. I am also now including, for the sake of completion and in order to fully explain to you how the process will take place, the new ALAC Rules of Procedure Version 11 which explain the election process. The Reference for this document is: https://community.icann.org/download/attachments/2950983/AL-2007-1-1-Rev11+… The voting process to be followed by the 15 ALAC voting delegates and the 5 RALO Chairs is explained in that document as follows: --- cut here --- 27.8 Voting Process a) All votes shall be by secret ballot. Votes may be cast electronically, in person, telephonically or some combination thereof. For votes cast in person or telephonically, the services of a trusted third party will ensure the secrecy of the ballot. Proxies are allowed only in accordance with explicit ALAC Rules of Procedure governing their use, or with explicit BSPC rules governing their use. b) If there is only one candidate on the Final Candidate List, that candidate shall be acclaimed the winner. c) If there are more than three candidates on the Final Candidate List, the first vote shall be using an accepted voting method which allows the three most preferred candidates to be selected. d) When there are three candidates remaining, there shall be vote of the electorate. Should one candidate receive greater than 50% of votes cast, that candidate shall be declared the winner. If not, the candidate with the least votes shall be removed. If there is a tie for last position, a random selection by a method determined in advance by the BSPC shall be used to identify the candidate to be removed. e) When there are two candidates remaining, there shall be vote of the electorate. Should one candidate receive greater than 50% of votes cast, that candidate shall be declared the winner. If there is a tie, a random selection by a method determined in advance by the BSPC shall be used to identify the winner. f) In any cases where a random selection is called for in sub-sections d) and e), if sufficient time remains, the BSPC, will run the tied election over again in case voter positions have changed. Petition Candidacy

Hi, I have been asked about a rumor that indicated I did not want to petition for candidacy for the ALAC BoD. _Nothing_ could be further from the truth. I saw that Wolf was starting one and had communicated with him indicating my appreciation. Or at least I though I had. I also sent notes to the chair's of all the other RALO telling them I would appreciate a petition candidacy. In one case, that note was forwarded to the RALO, and in another I was asked to send a note to the RALO, which I did. I did not send a note to EURALO because I had already communicated with Wolf. I only approached the chairs, or in one case the person I thought was chair, and in one case the chair and the vice chair, because I did not have a good idea about the process involved in requesting a petition candidacy and figured I would petition the leadership and then leave it up to them and you all to figure out what I should do next. I am, however, both appreciative and supportive of any efforts EURALO and the other RALOs may take on behalf of my petition candidacy. thanks a.
