I have pointed out the previous decision made by Council, and provided a couple of options to start the discussion and seek the views of Council members. The Council is not limited to the two options I presented. I welcome discussion on this list on what the recommendation should be. With respect to when to vote - it depends on what level of consensus we have reached around the recommendation at the time of our meeting next week. Uses of WHOIS data

Hello Maria, In the past, the WHOIS task forces have surveyed the users of the WHOIS service and collected information on how the data retrieved from WHOIS is currently used by these users. TO assist the WHOIS task force to determine the purpose of the public display (via the WHOIS service) of data collected at the time of registration, please collate the current uses of WHOIS data as recorded in previous WHOIS policy work. The GNSO Constituencies can review the information and make any corrections or additions. I hope this can be done within 7 days. Once all the information is available, the WHOIS task force can begin to develop a policy that specifies a purpose for WHOIS in the context of the ICANN mission and core values. For the GNSO public forum in Luxembourg, the aim should be to provide the public with information on the current uses of WHOIS, and a proposed policy for the purpose of the WHOIS service. Reminder regarding proxy voting

Hello All, Just a reminder that if you cannot make the next Council teleconference, you should advise the Secretariat (and preferably post to the public list) of who you are appointing as a proxy. For procedural issues that arise during the meeting it would be appropriate to instruct your proxy to vote as they see fit. For policy related issues, a Council member should instruct their proxy on how they wish to vote. For all policy related issues, papers will be presented to Council at least 7 days prior to a meeting. Note that on all policy issues, Council members should vote on the basis of what they believe to be in the best interests of ICANN (and hence the Internet's addressing systems) as a whole, using their knowledge of issues related to their participation in a GNSO constituency or particular expertise, as well as using the reports and other information presented to the Council to assist Council members in making a decision. Voting rules for the combined WHOIS task force

Hello All, As part of presenting reports from the WHOIS task force to the Council, the task force must report on whether a supermajority vote has been reached on a particular task force recommendation. To do this we need to be clear on the method of voting. When we set up the individual task forces, the Council decided that each constituency would have only one vote on the task force, but that constituencies could appoint additional members to the task force. Part of the reasoning of one vote per constituency, was that some constituencies would have difficulty finding multiple people to participate in a task force and did not want to be disadvantaged. From: http://www.gnso.icann.org/meetings/minutes-gnso-20nov03.shtml "Decision 3: That for the purpose of the WHOIS task forces, constituencies be allowed to appoint more than one person to listen in on teleconferences and to participate in the mailing list, but in any single teleconference or physical meeting, there is only one person from the constituency to represent the constituency's views." Now that we have combined the three task forces we could either: - provide three votes per constituency, and allow three members per constituency to speak on a teleconference or physical meeting Or - operate with a single vote per constituency, and allow only one member per constituency to represent the constituency's views in a teleconference or physical meeting I would like the Council members to consider these options, and express a view on the mailing list if possible. Hello Maria, Great work. I accept that asking to check "compliance" with the RAA might be hard for you, but could you extract a quote from the terms and conditions for each registrar that appears to match the 3.7.7 requirement. The reason I am asking is that I would expect that the privacy policies may differ, but I would hope that the terms and conditions with respect to clause 3.7.7 were fairly consistent amongst registrars. E.g for Melbourne IT: From: http://www.melbourneit.com.au/policies/gtldtermcond.php3 22. Use of Information 22.1 Registrant acknowledges Information obtained from Registrant will be 22.1.1 transmitted to the registry administrator for registry use 22.1.2 publicly available as required by ICANN 22.1.3 used by Melbourne IT for inclusion in registers and data bases produced by Melbourne IT or its licensees. 22.2 Registrant may access data provided and rectify any incorrect data relating to Registrant through a registry key to be provided by Melbourne IT. Registrant may provide a written authorisation to an agent to hold and use the registry key.
