I would prefer to delete no. 4 altogether, as inconsistent with 8. But I see Edmon's point about secondary meaning, and we should try to prevent any unfair advantage in that regard - so, how does this language work instead? If any IDN ccTLDs are proposed that are perceived by a substantial community outside of the territory, as relating to something other than the name of the ccTLD territory, then the technical, financial, and operational requirements should be similar to those for an IDN gTLD to ensure there is no unfair advantage. Also, in no. 8, I think the verb should be 'must' rather than 'should', in two places. Same with no. 10, verb should be must. Also should clarify 'confusingly similar to any existing TLD' to make consistent with our newTLDs principles. I think we have established the practice of using 'may', 'should' and 'must' in our various discussions and recommendations, and we should continue that practice so we keep consistency in our discussions and recommendations. I am an attorney licensed in California. I advise and represent entities and individuals with various commercial interests in domain names and other forms of intellectual property, and with varying interests in internet commerce. I am personally concerned about the security and stability of the Internet, as it is increasingly the backbone of our society, critical to global commerce, communications and safety. So I am interested in ICANN's role in managing and coordinating the technical and policy aspects of the Internet. I am mindful of the many enormous benefits of the internet that are fostered by ICANN policy, and seek for ICANN policy to develop in ways that will enhance the growth of internet commerce and communications. I am also concerned about various, serious harms enabled by policies of ICANN and its contracting registries and accredited registrars, or by lack of effective policy. Businesses and their customers are experiencing increasingly severe harm from phishing, malware distribution, hacking and other forms of online crime and intellectual property infringement. For many years I served as in-house counsel at Yahoo! Inc., working increasingly to protect Yahoo! users and their commercial and personal interests, as well as Yahoo!'s commercial interests, against these increasing worldwide threats. I believe that these harms will continue to rapidly grow, unless DNS policies are adapted to help fight them. So I strive for DNS policy that helps to mitigate those threats as much as reasonably possible. On occasion, I may have clients with similar concerns, or who have other policy interests at ICANN. As a representative elected to the GNSO Council by the collective members of the Business Constituency, I am required by the Constituency's Charter to support and otherwise remain faithful to approved positions of the Constituency as applicable, rather than my own views or those of any client I may have at any given time. Here is the final presentation for the New gTLD Workshop scheduled for Monday, 29 October, 1-7 pm. As previously communicated: * Chris Dispain will be the presenter for the Introduction slides. * In each of the three sessions, I will present the slides for the principles, recommendations and implementation guidelines and Kurt Pritz will present the implementation slides, most of which are in session 1. In our prep session on Sunday (12-1pm), we will go over the guidelines for the workshop again, answer any questions, and probably also talk about the estimated timeline contained on slide 35 to consider ways to move the timeline up a little if possible. Daylight Savings Time Changes

Daylight savings time changes around the world will be happening before and after the ICANN meeting. This is just to confuse all of us! Please be aware of the following: Daylight savings time will end in the United States on the first Sunday in November - November 4 - at that time the clocks will be set back one hour. Those of you flying home this day will want to pay particular attention to this change. Europe will end daylight savings time on the last Sunday in October - October 28 - if you are setting up any conference calls during the ICANN meeting, please be aware of this change. Australia will start daylight savings time on the last Sunday in October - October 28.
