Faced with a number of different recommendations stemming from various independent reviews and GNSO and user-community group efforts, the Board continues to consider this issue and believes that comments from the community, especially stakeholders in the GNSO, ALAC and At-Large groups, and any relevant applicants for new constituencies, would be particularly helpful. Potential commenters are asked to consider addressing the inclusion of registrants and individual users in the GNSO in a manner that compliments the ALAC and its supporting structures and ensures that registrants' and individual Internet users' gTLD interests are effectively represented within the GNSO. A summary document has been prepared by the ICANN Staff to provide background on this issue and to outline a number of potential options being considered by the Board. Background: The independent reviews of the GNSO, the ICANN Nominating Committee (NomCom), the At-Large Advisory Committee (ALAC), and the ICANN Board of Directors (Board) have revealed a number of high-level issues that extend across the organization and represent fundamental issues for the Board to clarify and resolve in its responsibility for setting the strategic direction of the corporation. These various "meta-issues" require Board resolution in order to reconcile overlaps, conflicts, and differences of perspective among the GNSO, NomCom, and ALAC independent reviews as well as potential issues in the soon-to-be-completed Board review process. One of the most immediate of those issues is the need to clarify the proper strategic approach to representation of individual Internet user interests within ICANN and, specifically, the GNSO. The GNSO Improvements process, currently in the implementation phase and under active Board consideration, is driving the urgency of the issue as it affects implementation of the GNSO restructuring efforts. In recognition of this fact, the ICANN Board resolved at its 1 October 2008 meeting to open a community dialogue on this issue. The Board resolution states: It is, Resolved (2008.10.01.14), The Board requests additional community dialogue and input on the appropriate role and representation of individual Internet users, including individual commercial and non-commercial Internet users, in the GNSO. Input from the GNSO, the ALAC and At-Large community, and any relevant applicants for new constituencies, would be particularly helpful and should address the inclusion of registrants and individual users in the GNSO in a manner that compliments the ALAC and its supporting structures, and ensures that registrants' and individual Internet users' gTLD interests are effectively represented within the GNSO. The original English version of the document is being posted now and additional translations into Arabic, Chinese, French, Russian and Spanish will be posted as soon as they are available. RyC Recommendations for Whois Studies

Here are the Whois study recommendations from the RyC and also a slide presentation that I am happy to give in the GNSO Working Session on Saturday if it is useful. Warning: The complete recommendations document is 25 pages long but please don't be too intimidated because the recommendations themselves only 11 pages and one of the reasons for that is that we printed all the hypotheses associated with each recommendation so that readers would not have to look them up in separate documents; hopefully that makes the document easier and efficient to review. There is an executive summary at the beginning that provides a quick overview. Appendix A explains our methodology and Appendix B summarizes the results of the RyC decisions made that back up our recommendations. The PowerPoint was designed to be presented with comments so it may or may not be self-explanatory, but it might provide a quick way to get an overview of our recommendations. You will note that our recommendations are designed with some flexibility and that our approach might provide a model that the Council could use as we work together to make our decisions. I hope this is helpful and I apologize for the lateness of our input, but as you can probably tell, this was a fairly significant task. Chuck

Hi, I have sent the letter to Chris, ccNSO chair, as approved in the last meeting. Additionally, I have received the name of one council member who is interested in taking on this task. I ask anyone else who wishes to be considered to send me their name in the next 24 hours. i will send out the name of the candidates once the 24 hours period has ended. As we discussed in the meeting, if I receive more then one name, I will ask Glen to setup a formal vote. If I only have one name, I will ask for anyone who objects to the appointment of the named council member to send me email indicating that objection. If we have an objection, then I will call for an election process on the single individual where people will have the opportunity to vote for or against that person. Majority in favor will be required for appointment in any election process. thanks a.

Follow-up on GNSO Restructuring/Improvements

Dear Community Members: In advance of the 16 Oct. GNSO Council meeting, I wanted to provide everyone with the follow-up action items from the Board's most recent draft GNSO Restructuring Resolution (see draft resolution below and at < http://www.icann.org/en/minutes/prelim-report-01oct08.htm>). I'd be happy to elaborate on these during the Council call, or feel free to email questions to <policy-staff(a)icann.org>. 1) COUNCIL CHAIR -- The Board adopted the WG-GCR recommendation that the GNSO Council Chair be elected by a vote of 60% of both voting houses and each voting house has the flexibility to create a process for selecting its own Vice Chair. To address questions on whether a "back-up" process was needed in the event that a vote did not yield a Chair, the Board decided to ask the Council to consider this matter. "The Board directs the Council to develop a process for subsequent balloting, if needed, until a Council Chair is duly elected. This process should be developed before the first Chair election of the newly structured Council." *ACTION: As the Council moves forward with GNSO Improvements implementation, this should be addressed and provided to the Board. 2) BOARD SEATS -- "The Board and General Counsel have outstanding questions about the WG-GCR recommendations regarding Board seat elections and directs Staff to share these with the community and seek additional input." *ACTION: Staff will post outstanding questions and solicit input shortly. 3) VOTING THRESHOLDS -- The Board adopted all voting thresholds proposed by the WG-GCR Report. Concerns that implementation of GNSO Improvements (e.g. new PDP, working group model, etc) might necessitate additions to, or clarifications of, thresholds, the Board requested that "the GNSO develop any additional voting thresholds or categories that may be needed as part of its proposed GNSO Improvements Implementation Plan to be submitted to the Board for approval." (Note: this draft wording likely will be changed to avoid confusion; the Board expects to receive an overall plan for implementing restructuring; this is separate from the GNSO's effort to create a structure of committees and teams to start the GNSO Improvements implementation work.) *ACTION: As the Council moves forward with GNSO Improvements implementation, this should be addressed and, if changes or additions are deemed necessary, they should be provided to the Board. 4) NEW/EXISTING CONSTITUENCIES -- The Board acknowledged Staff development of a "Notice of Intent" document for potential new constituencies (*see attached) and directed Staff "to develop a formal petition and charter template that will assist applicants in satisfying the formative criteria (consistent with the ICANN Bylaws) to facilitate the Board's evaluation of petitions to form new constituencies. Staff also is directed to work with the existing GNSO constituencies to design and develop a streamlined process along with appropriate mechanisms that will assist with the Board's timely recognition and approval of existing constituencies". *ACTION: Attached is a "Notice of Intent" to solicit and publicly share information on entities interested in forming new constituencies, along with a proposed petition and charter template. Staff would appreciate receiving any input you may have by 28 Oct. Staff also is developing for your consideration a draft template for constituencies to use to enable the Board to "renew" constituencies. Since this is a new endeavor, Staff is offering a draft as a starting point for discussion. Staff will collect and share input with the community during the Cairo ICANN meeting. 5) STAKEHOLDER GROUPS — The Board "reinforced its support for the following principles pertaining to the formation of the new Stakeholder Groups, and requests that all constituency members and other relevant parties comply with the principles included in the BGC Working Group's GNSO Improvements Report approved by the Board in establishing the newly formed structures, including: the need to better represent the wide variety of groups and individuals that compose the global ICANN community, in a structure that can change more easily with the gTLD environment and stakeholders; and the inclusion of new actors/participants, where applicable, and the expansion of constituencies within Stakeholder Groups, where applicable." Further, Staff was directed to work with the GNSO community to develop "a set of streamlined processes (along with appropriate templates, tools, or other mechanisms) that will assist in the formation of these new Stakeholder Groups and also facilitate the Board's subsequent review and approval of those structures." The Board directed that plans for each of the four new Stakeholder Groups be submitted to the Board for consideration at the ICANN Mexico City Board meeting, and the plans "must be reviewed and approved by the Board before a newly structured GNSO Council is seated in June 2009. The Board will consider the need for interim action to fill Council seats in the event that it finds any Stakeholder Group plans to be deficient or delayed." *ACTION: Staff will provide some initial draft material shortly to support community consideration and discussion. 6) ROLE/REPRESENTATION OF USERS — The Board requested additional community "dialogue and input on the appropriate role and representation of individual Internet users, including individual commercial and non-commercial Internet users, in the GNSO. Input from the GNSO, the ALAC and At-Large community, and any relevant applicants for new constituencies, would be particularly helpful and should address the inclusion of registrants and individual users in the GNSO in a manner that compliments the ALAC and its supporting structures, and ensures that registrants' and individual Internet users' gTLD interests are effectively represented within the GNSO." *ACTION: Staff will post a public comment solicitation and will provide background information to encourage community consideration and input to the Board. 7) IMPLEMENTATION TIMETABLE — The Board amended its previous implementation timetable and directs that the transition to a new bicameral GNSO Council voting structure take place over a phased implementation schedule that begins immediately and ends in June 2009 with the seating of the new Council. The implementation phases will be as follows: -Phase 1 - GNSO Council restructuring implementation plan submitted in advance of the December 2008 Board Meeting; - Phase 2 - Existing Constituencies submit confirmation documents to the Board for review in advance of the February 2009 Board Meeting; - Phase 3 - Stakeholder Groups submit formal plans for Board approval for consideration at the ICANN Mexico City Board meeting; and - Phase 4 - Stakeholder Groups with plans approved by the Board select Council representatives, and the newly structured GNSO Council is seated by the June 2009 Asia-Pacific ICANN Meeting. *ACTION — Staff will assist the GNSO in developing a restructuring implementation plan that the Board expects to receive later this year. =================== -- GNSO Restructuring -- (Membership and Leadership Selection:) It is, Resolved (2008.10.01.06), as recommended by the WG-GCR, the Board authorizes a third Council-level non-voting Nominating Committee Appointee to serve on the Council whose presence could preserve an independent aspect on the Council and could provide useful management support as the Council moves toward a working group management function. Public Comment: CRAI Report on gTLD Registries and Registrars

ICANN requested CRAI to perform economic research pursuant to two resolutions of the ICANN Board of Directors: 1) the 18 October 2006 resolution of ICANN's Board of Directors seeking more information relating to the registry and registrar marketplace; and, 2) the 26 June 2008 resolution of ICANN's Board, directing the development and completion of a detailed implementation plan for the new gTLD Policy. CRAI's report makes certain recommendations regarding the relationship between registries and registrars. In particular, the CRAI report makes two proposals that might apply to the implementation of the new gTLD program. First, CRAI proposes that, for single organization TLDs, that organization be permitted to operate both the registry and the registrar that sells second-level domain name subscriptions. Second, CRAI proposes that a registry may own a registrar so long as the wholly-owned registrar does not sell second-level domain names subscriptions in the TLDs operated by the registrar. ICANN would like to solicit public comment on these proposals, which if implemented, would have an immediate effect on applications under the new gTLD program. Comments on the CRAI report are welcome via email to crai-report(a)icann.org. An archive of all comments received will be publicly posted at http://forum.icann.org/lists/crai-report/. NOTE: CRA International (CRAI) is a highly respected economic consulting firm. The Draft Implementation Plan can be found here [PDF, 297K]. The IDN Fast Track Process is a mechanism recommended by the IDNC Working Group, focused on the introduction of a limited number of non contentious IDN ccTLDs, associated with the ISO 3166-1 two-letter codes, to meet near term demand, while an overall IDN ccTLD policy is being developed. At the ICANN meeting in Paris (June 2008) the IDNC Working Group submitted the Final Report to the ICANN Board, including statements of the GAC and ccNSO on the proposed methodology for introduction of a limited number of IDN ccTLDs. At its meeting in Paris the ICANN Board Resolved (2008.06.26.04), the Board thanks the members of the IDNC WG for completing their chartered tasks in a timely manner. Resolved (2008.06.26.05), the Board directs staff to: (1) post the IDNC WG final report for public comments; (2) commence work on implementation issues in consultation with relevant stakeholders; and (3) submit a detailed implementation report including a list of any outstanding issues to the Board in advance of the ICANN Cairo meeting in November 2008. Subsequently, ICANN staff posted the IDNC WG Final Report for public comments, and commenced the implementation work as directed. In order to provide the community with an overview of what actions (if any) staff took in their implementation work on the received comments, a consolidated overview of the comments received and document containing staff considerations regarding the comments received is made available here http://www.icann.org/en/topics/idn/fast-track/staff-considerations-idnc-wg-… [PDF, 269K]. As part of the implementation process staff also submitted letters to relevant public authorities and ccTLD managers to seek information on their interest in participating in the Fast Track process. ICANN is still receiving responses to these letters and will provide a public report on these before the ICANN meeting in Cairo, Egypt (November 2008). The Draft Implementation Plan provides the roadmap and many implementation details for the Fast Track process. The plan is presented in modules that later will be further detailed and finalized for the IDN ccTLD Fast Track process. The modules are: Module 1: general Introduction and background Information Module 2: Fast Track Eligibility Requirements Module 3: TLD String Criteria and Requirements Module 4: Technical Committee Considerations Module 5: Fast Track Request and Evaluation Process Module 6: TLD Delegation Process Module 7: Discussion of Additional Topics Included in the Draft Implementation Plan are some open issues that will be reworked through additional community consultation and that need to be resolved, to complete the implementation. These topics are presented in Module 7. ICANN staff is encouraging and looking forward to these discussions at the ICANN meeting in Cairo, Egypt, 1-7 November 2008 and beyond. Liaison to ccNSO Council

Dear Councillors, May I remind you of an action item arising from the Council meeting on 16 October where it was decided to appoint a liaison to the ccNSO Council. "Avri Doria summarised that the selection procedure before Council for a liaison to the ccNSO Council could be either a Council member or a member of the broader GNSO community and the vote could be taken in an open meeting or could follow the full voting procedure by secret ballot." The incumbant of this role would be expected to attend a monthly ccNSO Council teleconference meeting and be available for 2 days during ICANN meetings to attend the ccNSO sessions.
