[To: council[at]gnso.icann.org] Dear Council Members, REMINDER: Part 1: A council wide call for nominations from 7 - 14 October Clarifications: nominees must be members of the council at the time the election is held and not necessarily at the time that the nominations are made. This means that: - a current council member who will not be in the new council is not eligible to run for chair - an incoming council member who is not currently in the council is eligible to run for chair Only current GNSO Council members are eligible to make nominations and second nominations. Also clarified is the two part nature of the process. The entire nomination process lasts 2 weeks. (7 to 21 October 2009) - Week one is dedicated to council wide nominations - Week two is dedicated to each House's section of their single candidate from the pool of nominees. ----- - Pursuant to the ICANN bylaws http://www.icann.org/en/general/bylaws-amendments-27aug09.pdf 7. The GNSO Council shall select the GNSO Chair for a term the GNSO Council specifies, but not longer than one year. Each House (as described in Section 6 of this Article) shall select a Vice-Chair, who will be a Vice-Chair of the whole of the GNSO Council, for a term the GNSO Council specifies, but not longer than one year. The procedures for selecting the Chair and any other officers are contained in the GNSO Operating Procedures. The GNSO Chair shall be elected by a 60 percent vote of both houses. b. Each house will be allowed one candidate for GNSO Council Chair. A candidate for GNSO Council Chair does not need to be a member of a house but must be a member of the GNSO Council. Should a Chair be elected outside the houses that Chair will be a non-voting Chair. i. All ballots will include the "none of the above" option. In the event that this option gets 60 percent of both houses, each house will commence a new nomination period of not longer than 15 days. The election will be rescheduled for no sooner than 30 days. ii. In the case of a tie the election will be rescheduled no sooner than 30 days. In the case of a second tie, each house will commence a new nomination period of not longer than 15 days. The election will be rescheduled for no sooner than 30 days. iii. The leading candidate will be defined as the one with the highest score. For each candidate, determine the percentage of vote received in each house; add these percentages to determine the score; the leader is the one with the higher score. (Maximum score equals 200.) iv. In case neither candidate reaches the 60 percent of both houses threshold, a second ballot will be held between the leader and "none of the above." v. If the single candidate does not reach the 60 percent of both houses threshold, then each house will commence a new nomination period of not longer than 15 days. The election will be rescheduled for no sooner than 30 days. c. Each house shall select a Vice Chair within their respective houses. d. A Chair and Vice Chair may not be elected from the same Stakeholder Group. e. The Chair or Vice Chair shall retain their votes in their respective houses. f. In the event that the GNSO Council has not elected a GNSO Council Chair by the end of the previous Chair's term, the Vice-Chairs will serve as Interim GNSO Co-Chairs until a successful election can be held. g. The Council shall inform the Board and the Community appropriately and post the election results on the GNSO website within 2 business days following the election. (Note: this is an interim procedure because the GNSO Operating Procedures are pending approval and currently submitted for public comment http://www.icann.org/en/public-comment/#gnso-operating-procedures-2009) -------------- A formal nomination period, for the election of GNSO Council chair for the period 28 October 2009 until the end of the 2010 Annual meeting is now open for two weeks from Wednesday, 7 October to Wednesday 21 October 2009, ending at 23:00 UTC. The process of nominations for GNSO Council chair is divided into TWO parts: Part 1: A council wide call for nominations from 7 - 14 October Part 2: A House specific process to determine the house candidate form the pool of nominees 15 - 21 October Part 1 _Council Wide Nominations for Council chair_ Wednesday 7 October 2009 to Wednesday 14 October 2009 at 23 UTC. All nominations should be accepted and seconded within the period 7 - 14 October 2009. Only GNSO Council members are eligible to make nominations and second nominations. Only GNSO Council members who will be in the newly seated council at the time of the election (28 October) may be nominated. Any council members who will be in that council may be nominated, even if they do not currently sit in the council and irrespective of House placement. Nominations and seconds should be sent to: gnso.secretariat [at] gnso.icann.org Nominations and seconds will be acknowledged and posted to the Council list. Nominees shall submit a candidacy statement in writing to the Council not later than 14 October 2009. Part 2 _Each House determines a Candidate_ After council wide nominations are closed, each house will be allowed to select one candidate for GNSO Council Chair from the pool of nominees. A candidate for GNSO Council Chair does not need to be a member of the house selecting the candidate. Should the non voting NCA be elected as chair he/she would be a non-voting chair. Each house must announce their chosen candidate by 21 October 2009 at 23 UTC. The two houses may, separately, select the same candidate from the nominee pool if they so wish. The candidates from each of the houses shall have the opportunity of meeting with Council Members at the GNSO Working Group sessions in Seoul on Saturday morning, 24 October 2009. PROPOSED SCHEDULE FOR THE VOTING For this election, the voting will take place at the public Council meeting in Seoul on Wednesday, 28 October 2009. Avri Doria, current GNSO Council chair, will serve as non-voting chair of the bicameral Council meeting on 28 October until such time as a new chair is elected, at which time the new chair will assume the chair responsibilities. If an absentee ballot is required to complete the chair's election, this will be a 24 hour ballot scheduled to end on 29 October. If no chair has been elected by the end of the Annual meeting on 30 October, the vice-chairs will assume the chair responsibilities as defined in the Bylaws and a runoff will be scheduled as determined in the Council Procedures. The winning candidate needs 60% of the votes of each house. The Council shall inform the Board and the Community appropriately and post the election results on the GNSO website within 2 business days following the election. In the event that the GNSO Council has not elected a GNSO Council Chair by the end of the previous Chair's term, the Vice-Chairs will serve as Interim GNSO Co-Chairs until a successful election can be held. ICANN Comment periods due soon after Seoul

In reviewing open ICANN comment periods with the ALAC officers today, we were somewhat taken aback by the number and importance of ICANN comment periods that had just opened in the last several days and are scheduled to end soon after the Seoul meeting. Posted 01 Oct, Due 01 Nov, Expedited Registry Security Request (ERSR) Posted 02 Oct, Due 06 Nov, Domain Names Registered Using a Privacy or Proxy Service Posted 05 Oct, Due 04 Nov, NomCom Review Draft Working Group Report Posted 05 Oct, Due 04 Nov, SSAC Review Draft Working Group Report Posted 05 Oct, Due 04 Nov, Board Review Draft Final Working Group Report Although we seemed to recall that a commitment had been made to not "count" the time during an ICANN meeting against one month comment periods, that is clearly not being done here. For the Seoul meeting, many of us will spend 7-8 business days in transit or at the meeting, significantly cutting into the time available to comment. And we noted that although all of these topics are quite important, only the ERSR one could really be viewed as very time-sensitive. The ALAC will likely request a 2 week extension on all five comment periods. The GNSO Council may wish to consider a similar move. Alan

Dear All, Please take part in the Webinar organized to call for Comments on the proposed redesign of GNSO.ICANN.ORG web site on Wednesday 14 October at 1300 UTC http://gnso.icann.org/announcement/announcement-07oct09-en.htm As part of the GNSO Improvements Project, one of the tasks given the Operations Steering Committee's (OSC's) Communications Coordination Team (CCT) was to make the GNSO web site "more usable." The CCT has expedited progress on this task and, after extensive research with GNSO users and the ICANN community, has developed a proposed re-design of gnso.icann.org. The CCT's research indicates that the three most common user tasks on the GNSO site are: trying to find a document; managing activities via the Master Calendar; and seeking to learn the latest regarding a policy issue. The CCT proposed redesign to GNSO.ICANN.ORG simplifies those three tasks, and also makes the site friendlier to newcomers. Scott Pinzon and Ken Bour, ICANN Staff supporting the CCT, are presenting an overview and some wireframe diagrams of the proposed redesign. The goal is to gain your input, advice, and suggestions on further refinements. The overview will describe: .What it means to move from a static website to a dynamic website .The reasoning behind the proposed changes .Whose input influenced the proposed changes .Proposed new features, such as the Acronym Helper .How non-English content could be handled .Where to send comments and suggestions The webinar will be held on Wednesday 14 October at 1300 UTC using Adobe Connect and the dial-in bridge. All are welcome to participate, but members of the GNSO are especially encouraged to participate. Forwarded From: Julie Hedlund As directed by the ICANN Board in its 26 June resolution, the Security and Stability Advisory Committee (SSAC) and the Generic Names Supporting Organization (GNSO) are convening an Internationalized Registration Data Working Group (IRD WG) that will be comprised of individuals with knowledge, expertise, and experience in these areas to study the feasibility and suitability of introducing display specifications to deal with the internationalization of Registration Data. The creation of the Working Group is in response to increasing community concerns that the current WHOIS service is deficient in a number of ways, including technical areas as noted in a recent SSAC report titled SAC037 "Display and usage of Internationalized Registration Data" (SAC037) located at http://www.icann.org/committees/security/sac037.pdf. Issues identified in the report include the accessibility and readability of WHOIS contact information in an internationalized domain name (IDN) environment. On 16 September 2009, ICANN held an online presentation (a "webinar") on the "Display and Usage of Internationalized Registration Data" The presentation is available here: http://www.icann.org/en/committees/security/ssac-presentations.htm. Not unexpectedly, I have some questions, which I have listed below. (I am copying Kurt in the event that he or other ICANN staff is best placed to answer them.): 1. If the Board has sent the GNSO Council a letter that provides any further information, detail, instruction, or the like on this consultation, would someone please post that letter to this list? 2. If the Board has not yet sent such letter, does it still intend to do so? 3. If the Board does not intend to send such a letter, will it provide guidance/clarification to the GNSO as to: i) How will consensus be measured? A Council vote? Number of public comments? Number of signatories to public comments? Other (and, if so, what)? ii) What constitutes "consensus"? Unanimity? If not, what? iii) What is the default? In other words, what action will the Board take if the GNSO is unable to reach consensus? 4. If the Board will not/does not intend to provide guidance/clarifications on the points noted in 3(i)-(iii), who makes those decisions? The change involves clarifying that nominees must be members of the council at the time the election is held and not necessarily at the time that the nominations are made. This means that: - a current council member who will not be in the new council is not eligible to run for chair - an incoming council member who is not currently in the council is eligible to run for chair Only current GNSO Council members are eligible to make nominations and second nominations. Also clarified is the two part nature of the process. The entire nomination process lasts 2 weeks. (7 to 21 October 2009) - Week one is dedicated to council wide nominations - Week two is dedicated to each House's section of their single candidate from the pool of nominees. ----- - Pursuant to the ICANN bylaws http://www.icann.org/en/general/bylaws-amendments-27aug09.pdf 7. The GNSO Council shall select the GNSO Chair for a term the GNSO Council specifies, but not longer than one year. Each House (as described in Section 6 of this Article) shall select a Vice-Chair, who will be a Vice-Chair of the whole of the GNSO Council, for a term the GNSO Council specifies, but not longer than one year. The procedures for selecting the Chair and any other officers are contained in the GNSO Operating Procedures. This was one of the 'yes-green, maybe-yellow, no-red' doodles. I set this up as hidden poll, so that consideration for each other's choices would not stand in the way of each of them stating, in the first instance, their personal preference. The idea was that once we saw the individual preferences, they could then negotiate a final list based on knowing what each other really wanted, or was willing, to do. I also made myself available for any of them who wanted to get more background information, but no one took me up on the offer. Note: I also told them that if they hated the idea of the poll we could start in another way, but I was looking for a way to reach a conclusion quickly. - The individual preferences, a snapshot of which is included below, showed that there was one possible solution from the beginning which would avoid any of them having to take a position they did not want. The results (depicted below): Olga and Andrey were both interested in the Contracted Parties House All three of them were willing to be placed in the Non-Contracted parties house. Terry indicated he was only willing to be placed the Non-contracted parties house Olga was the only one indicating willingness to take the Independent non voting role I suggested this as a starting position for their discussions, but also suggested they could ignore it, if they desired. - In the following conversation they all accepted the proposal, each for his/her own reasons: Andrey felt that his experience in managing a zone with 2.3 M domains, which is 99% compatible to a .COM environment, made him feel comfortable going into the Contracted Parties house. Terry felt that based on his experience in industry the Non Contracted parties house was the most appropriate. Olga was willing to take any of the roles, though she had a preference for the Contracted parties. - It is now up to the houses, to decide if they are willing to accept the input of the NCAs. If not, they will need to come up with another proposal. I invite the NCA's to add any comments to this they feel would be useful to the Houses in making their decision, but am not in any way obliging them to do so. I should mention that Andrey has been added to this list (as all newly appointed/elected council members will be), and I welcome him. Of course the incoming council members are observers on the list until 28 October. In keep with our normal processes, I invite the new council members to participate on the list as fully as they feel ready to with voting and the making of motions being the only exceptions. The Inter-Registrar Transfer Policy Part A Policy Development Process Working Group noted in its Final Report <http://gnso.icann.org/files/gnso/issues/transfers/irtp-final-report-a-19mar…> to the Generic Names Supporting Organization that some confusion may exist about the availability of "partial bulk transfers," where a registrar might wish to transfer all of its domain names in only one particular gTLD to another ICANN-accredited registrar. This advisory is intended to clarify that Part B of the Transfer Policy does permit ICANN to approve a bulk transfer of all of a registrar's names in a particular gTLD without requiring simultaneous transfer of its names in other gTLDs. Part B of the Transfer Policy (ICANN-Approved Transfers) makes available a bulk transfer of gTLD names between registrars "as the result of (i) acquisition of that Registrar or its assets by another Registrar, or (ii) lack of accreditation of that Registrar or lack of its authorization with the Registry Operator" where (a) the gaining registrar to the transfer is accredited by ICANN and has in effect a registry-registrar agreement with the registry operator for the affected TLD(s) and (b) ICANN certifies to registry operator that the transfer would promote the community interest, "such as the interest in stability that may be threatened by the actual or imminent business failure of a Registrar." Part B of the Transfer Policy additionally establishes a one-time registry fee of $50,000 charged to the gaining registrar for such transfers, where more than 50,000 names are transferred. The bulk transfer provision (Part B) of the Transfer Policy is most often invoked in instances where a registrar's Registrar Accreditation Agreement ("RAA") is terminated or expires without renewal. Part B of the Transfer Policy also allows for bulk transfers in cases where a registrar lacks authorization to continue management of domains within a registry, such as where its Registry-Registrar Agreement ("RRA") is terminated. In both cases, ICANN follows the De-Accredited Registrar Transition Procedure <http://www.icann.org/en/processes/registrars/de-accredited-registrar-transi…> to identify an ICANN-accredited registrar to take over management of the names and notifies affected registries that it has approved the bulk transfer. No distinction is made in either the Transfer Policy or the De-Accredited Registrar Transition Procedure between voluntary terminations (those initiated by the registrar) and involuntary terminations (those initiated by ICANN in the case of an RAA or the registry, in the case of an RRA). Furthermore, where a bulk transfer is approved by ICANN due to lack of a registrar's authorization within a registry, there is no requirement that domains in other TLDs be transferred as a result.

These important developments include the plan for deployment of Internationalized Domain Names (IDNs) in the next few months and significant progress in developing the model for delegating new generic top-level domains (gTLDs). Proposed Final Implementation Plan: IDN ccTLD Fast Track Process http://www.icann.org/en/topics/idn/fast-track/idn-cctld-implementation-plan… ICANN is pleased to announce the public posting of the Proposed Final Implementation Plan for the IDN ccTLD Fast Track Process. The IDN ccTLD Fast Track Process is an important step at making the Internet equally accessible for everyone. It will enable the introduction of a limited number of internationalized country-code top level domain names (IDN ccTLDs). As noted by ICANN CEO Rod Beckstrom, once implemented, this will be the first time that users can obtain a domain name with the entire string in characters other than ASCII (or Latin) characters, "this is one of the most exciting developments for the users of the Internet globally in years. IDNs will enable the people the world over to use domain name addresses in their own language." The process will be available to all countries and territories where the official language is based on scripts other than the Latin (extended) script. IDNs, like the Affirmation of Commitments announced last week (www.icann.org ) are another step towards making the Internet more truly global to achieve our goal of "one world, one Internet, everyone connected." The proposed final plan is scheduled for ICANN Board consideration at the ICANN meeting in Seoul, Korea, 26-30 October 2009. The proposed launch date for the IDN ccTLD Fast Track Process is 16 November 2009. ICANN is looking forward to feedback on the final plan in the public comment forum designated for that purpose. The proposed final plan has been developed based on responses to community comments and discussions. Responding to Public Comment: Version 3 of New gTLD Applicant Guidebook A Work In Progress http://www.icann.org/en/topics/new-gtlds/comments-3-en.htm The latest draft of the Applicant Guidebook that describes the process of applying for new generic top-level domains (gTLDs) was released today. New gTLDs are expected to bring innovative services and greater choice to Internet users through increased competition and engender broad participation through the introduction of IDNs and community-based TLDs into the Domain Name System. In the last three months, the community has joined in extensive collaborative efforts on technical, intellectual property, potential for malicious conduct, and other matters, with global consultations in New York, Sydney, London, Hong Kong and Abu Dhabi. The Guidebook has been changed significantly. As indicated by ICANN Chief Operating Officer, Doug Brent, "this third version of draft guidebook represents months of outstanding effort by many in the ICANN community - working to resolve the few, challenging remaining issues. This version is being released with materials that describe how public comment has influenced the changes presented in it." In all, there are over 50 areas of change, clearly indicated in the "redline" version of the Guidebook. In addition to specific trademark protections (described below) the new Guidebook includes: •Measures to prevent or mitigate potential for malicious conduct including a proposal to create high-security zones; •Enhanced stability / security measures, requiring DNSSEC deployment and prohibiting use of wildcards; •Protecting registrants by taking step to ensure registry viability: defining a financial instrument that will ensure ongoing registry operations in the event of failure, and specifying certain pre-delegation registry tests; and •Enhanced contractual tools through the development of post-delegation dispute procedures including one to ensure that community-based TLDs adhere to their self-described purpose. Like all previous versions, this draft is posted for public comment. It has been released prior to the ICANN meeting to be held in Seoul from October 25-30. During the Seoul meeting ICANN will conduct several sessions to facilitate discussion of this version of the Applicant Guidebook and finding solutions to the outstanding issues. Trademark Protection Measures – Where to next? http://www.icann.org/en/topics/new-gtlds/gnso-consultations-reports-en.htm Specific trademark protection mechanisms are still to be decided upon by the Board. After receiving trademark protection recommendations from the Implementation Recommendation Team and others, taking extensive comment and conducting consultation with the broad community, ICANN has drafted a set of implementation recommendations related to intellectual property protections for the new gTLD program. Additional rights protection included in the Guidebook are the: •requirement to maintain a "thick" Whois database, and •specification of a post-delegation dispute procedure so that trademark holders can lodge complaints of abusive behavior against registries when merited. For other proposed rights protection mechanisms, the Board is providing the Generic Names Supporting Organization (the policy organization that developed the new gTLDs policy) with the opportunity to offer focused input on this specific area of the proposed implementation plan that is being published now. Those proposed rights protection mechanisms are: •The creation of an IP Clearinghouse, which is a database of validated trademarks to be utilized by new gTLD registry operators in implementing either an IP Claims service or Sunrise process during TLD launch; and •The creation of a Uniform Rapid Suspension process for use in clear-cut, blatant cases of trademark infringement. The community at-large may also comment on these specific issues, and of course, any other new gTLD issues through comment fora found on the new gTLD pages. Is it just me or were we expecting the DAV v3 by September 30? In recent communications (Peter's letter to the GAC for example) this was the date quoted. Whilst I am not too bothered by the delay what does concern me is that ICANN staff have simply left us in the dark as to the progress. If ICANN knew it was going to be late why not make an announcement to clarify? Why keep us guessing? Very frustrating for the Community for which they serve. Perhaps they were too busy celebrating with the US Government to care? Is it [possible to request a response from staff? Adrian Kinderis

Hi, As part of the planning process, and as I believe was decided at our last meeting, I was wondering if the SGs could state who their representatives are for these discussions. I do not think it needs to be the same person in each case, but I do think we need a SG point of contact for each of the discussions (though the v-chair discussion will be inside the house designations) Before anyone asks, I am currently talking to the SIC about the issue of the formation of the NCSG Executive Committee. My current suggestion for these tasks, while waiting for the NCSG ExCom issues to work themselves out, is that the NCUC picks someone and that this person will be in contact with both the NCUC and the 3 incoming council members. I have yet to get buy-in on this. But as time is short, I am trying to get things moving along. thanks a.

See the latest status update at: http://www.icann.org/en/announcements/announcement-2-09sep09-en.htm As noted there are a number of outstanding topics that has been discussed in public comment on implementation proposals of the Fast Track Process since the initial version of the Draft Implementation Plan was released on 23 October 2008. These include: (i) the form of relationship between an IDN ccTLD manager and ICANN, (ii) cost considerations regarding contribution to processing and TLD support costs, (iii) management of variant TLDs. Solutions to these issues have been discussed, and while current opinions or positions of each community segment is well understood, it is believed that additional discussions on these topics will not facilitate further community agreement on these topics. In order to avoid delay to the launch of the Fast Track Process and its associated benefits these topics have been provided for ICANN Board consideration. Background The Fast Track Process is a mechanism to introduce a limited number of non-contentious internationalized country-code top level domain names (IDN ccTLDs). The initial version and three subsequent revisions of the implementation of the Fast Track Process were discussed at several meetings and online. That community input resolved a number of issues. As a result of the progress on the implementation effort, at the recent ICANN meeting in Mexico, Mexico City, the Board encouraged the community to "...continue its work so that the implementation plan can be finalized and considered by the Board no later than at its annual meeting in 2009". The release of the Proposed Final Implementation Plan is an effort to meet the goal set out in the ICANN Board resolution aimed at enabling positive consideration by the ICANN Board at their meeting in Seoul, Korea (30 October 2009), followed by launch of the process. The papers listed below are proposed only. Potential IDN ccTLD requestors should not rely on any of the proposed details as they remain subject to further consultation and revision. Please also note that it is expected there will be several updates to this announcement, as papers are released, finalized and translated.
