Motion on New gTLD Recommendation

Dear councillors, after repeated discussion the ISPCP constituency still has the following concerns regarding the letter to be sent to Kurt Pritz. We understand that there are examples of string similarity which would not necessarily would cause detrimental confusion and that in this case - and only in this - an extended review should be granted to the applicant. However strict rules must be set under which the extended review is permitted ensuring the string similarity review is the normal case and the extended one an exception. These rules are to be worked out with participation of the community. The letter should express that the rules must immediately be worked out by a small expert group in order to achieve community acceptance. Best regards Wolf-Ulrich

If there are any questions or doubts please let me know Regards Olga *ccNSO update: (already sent to the list)* The comment period for the Delegation & Redelegation Working Group Analysis Report is now open: http://icann.org/en/announcements/announcement-2-16jun10-en.htm Comments can be submitted until the 15th September 2010. *Travel Drafting team:* Drafting team met with Kevin Wilson from ICANN staff during the Brussels meeting. Team expressed different concerns mainly focused on having more flexibility in selecting flights, dates and times. Also we requested the need for letting GNSO council members to stay for Friday´s Board meeting, allowing one more night of hotel expenses. Kevin and his team will try to minimize possible inconveniences caused by not being flexible with tickets booking, dates, times etc. He suggested also that GNSO should submit a written comment about the Friday participation requirement once the comment period is open for the travel guidelines. *Geographic Region Review Working Group* In the hopes of gathering additional community input and interest in its work, the community-wide Geographic Regions Review Working Group posted its Draft Interim Report for community review prior to the ICANN Brussels meeting – see http://www.icann.org/en/announcements/announcement-2-28may10-en.htm. The WG sponsored a public forum session in Brussels (see - http://brussels38.icann.org/node/12509. During the session, the WG Chair shared an updated presentation regarding the practical background for the WG’s effort posing several questions that the WG is currently considering during its deliberations (see - http://brussels38.icann.org/meetings/brussels2010/presentation-geo-regions-… . The Interim Report drafting effort will continue in the post-Brussels time period. *OSC CSG Status report* The Constituency and Stakeholder Group Operations Work Team (CSG-WT) was tasked with developing recommendations concerning Constituency and Stakeholder Group participation rules, operating principles, and member databases. Its recommendations are part of the overall GNSO Improvements effort and are designed to improve the GNSO Council Operating Procedures and enhance Constituency and Stakeholder Group operations. The Work Team consolidated recommendations on the three subtasks: * Subtask 1: Develop recommendations for a set of participation rules and operating procedures, to which all Constituencies should abide; * Subtask 2: Develop recommendations for clear operating principles for Constituencies to ensure that they function in a representative, open, transparent and democratic manner; * Subtask 3: Develop recommendations for creating and maintaining a database of all Constituency members and others not formally a part of any Constituency that is up-to-date and publicly accessible; and The recommendations are open for public comments and are detailed in the following report: Recommended Common Operating Principles and Participation Guidelines for GNSO Stakeholder Groups and Constituencies; and Recommendations on a GNSO Database of Community Members http://gnso.icann.org/drafts/draft-csg-recommendations-task-27may10-en.pdf Working team is working now on recommendatios about outreach and expects to finish a draft report by beginning of August.

GNSO Chair and vice chair elections - officers should take their seats by the end of the ICANN meetings in Cartagena, Columbia. Chuck Gomes is term limited in the Registries Stakeholder Group, thus is not able to stand again for GNSO Council chair. Contracted and Non Contracted Parties Houses are urged to discuss this in their stakeholder groups and make sure that proposed candidates are eligible. 2. GNSO Working Sessions: Meeting scheduling - Stéphane van Gelder to take the lead, with Glen's assistance in preparing the schedule for the GNSO Working sessions at the Cartagena meetings on Saturday 4 and Sunday 5 December 2010. Council was happy with the interaction among stakeholder groups and constituencies in the planning process. 3. Meeting Logistics - Coffee breaks: not practical to have a central point of coffee in a spread out meeting facility. Coffee should be available in close proximity to the meeting rooms. Allowance should be made in the schedule for breaks between all the meetings. There should be short breaks between meetings to allow for transition. 4. GNSO Open Council Meeting critique Technology - make Adobe Connect work better with all operating systems or alternatives that allow participation from Linux based systems. Use the Adobe chat room facilities, jabber or instant messaging in a side channel during the meeting to interact with constituency/stakeholder group members Challenge with Adobe Connect that it does not support redline versions and other live editing tools do not have features like hand raising and chat. Procedural Discussions were too long and ways should be sought to come to a crisper consensus more quickly. Some of the suggestions for improvement were: * better preparation on the mailing list, * ensure that all councillors are familiar with procedural rules, * adhere to stricter time lines during the meeting. * previously the agenda was structured to avoid procedural issues during open meetings, but the challenging work load has made this difficult to continue. * do managerial work during teleconference calls. * use the open Saturday and Sunday sessions as preparatory sessions for the Council meeting so that participants can see how the Council interacts. * motions read during open meetings are time consuming and should rather be displayed on the screen for the audience. Low participation level at the Open Council meeting. Possible factors contributing to this are: § early start at 08:00 am. - late night networking is important in ICANN meetings and not conducive to early starts. § should perhaps consider moving the time of the meeting to the afternoon * the size of the room, the agenda topics, and the repetitive nature of the Working Group reports Action Items * Form a group to improve the running of the GNSO Open Council meetings Volunteers: Wendy Seltzer - leader, Tim Ruiz, Kristina Rosette Glen will send a message to the Council list requesting other volunteers. * Stéphane van Gelder and Glen to examine changing time of the Council meeting 5. Comments on the overall schedule for the week in Brussels - looking forward to Cartagena * Schedule time to discuss the Council's role during the next ICANN meetings in Cartagena * Council's involvement in cross community working groups. Address the concern expressed by the GAC on morality and public order. * GNSO Council/ICANN Board dinner - the new approach of table topics worked well. ICANN Board members suggested a communications session between the GNSO Council and the Board. The Council and Board held such a session on Vertical Integration in Brussels. Suggestions for this event going forward were to have two separate sessions, one, communications and informational, and a second social event. It was suggested that the social event take place without staff. Action Items: 1. Form a cross Supporting Organisation/Advisory Committee group to address the concern on morality and public order. Note, the group is not restricted to Councillors. Volunteers: Bill Drake, Caroline Greer, Zahid Jamil, Jaime Wagner, Olga Cavalli 2. Form a group to work on the GNSO Council interaction with the Board Volunteers: Terry Davis, David Taylor, Jaime Wagner, Zahid Jamil, Stéphane van Gelder 6. Liz Gasster informed the Council that ICANN would be phasing out during the next six months from the Social Text Wiki to the Confluence Wiki. Appropriate training is foreseen. Status report - Vertical Integration Working Group

Councillors, Please find below my status report on the VI WG for the upcoming GNSO Council teleconference. Stéphane Vertical Integration Policy Development Process (VI PDP) - Chairs Roberto Gaetano and Mikey O'Connor - Council Liaison - Stéphane van Gelder – July 8, 2010 The working group met face-to-face several times in Brussels, during the 38th International ICANN meeting. A presentation on the group's progress so far was given by the 2 co-chairs during the GNSO Council Open meeting on Wednesday June 23rd. Based on the revised deadlines driven by the September Board retreat referenced in the Brussels meeting Board Resolutions as a "new gTLD retreat only", the WG has developed an extremely short-interval schedule. A process has been launched to summarize the major proposals, including 2 new proposals stemming from Brussels. The WG is discussing areas of possible consensus and also looking at possible exceptions such as Single Registrant Single User TLDs and other niche TLDs. Full consensus may be difficult to reach, but the group remains hopeful of reaching partial consensus.

Except as otherwise specified in these Bylaws, Annex A hereto, or the GNSO Operating Procedures, the default threshold to pass a GNSO Council motion or other voting action requires a simple majority vote of each House. The voting thresholds described below shall apply to the following GNSO actions: 1. Create an Issues Report: requires an affirmative vote of more than 25% vote of each House or majority of one House; 2. Initiate a Policy Development Process ("PDP") Within Scope (as described in Annex A): requires an affirmative vote of more than 33% of each House or more than 66% of one House; 3. Initiate a PDP Not Within Scope: requires an affirmative vote of more than 75% of one House and a majority of the other House ("GNSO Supermajority"); 4. Approve a PDP Recommendation Without a GNSO Supermajority: requires an affirmative vote of a majority of each House and further requires that one GNSO Council member representative of at least 3 of the 4 Stakeholder Groups supports the Recommendation; 5. Approve a PDP Recommendation With a GNSO Supermajority: requires an affirmative vote of a GNSO Supermajority; and 6. Approve a PDP Recommendation Imposing New Obligations on Certain Contracting Parties: where an ICANN contract provision specifies that "a two-thirds vote of the council" demonstrates the presence of a consensus, the GNSO Supermajority vote threshold will have to be met or exceeded with respect to any contracting party affected by such contract provision. Appendix 2: Absentee Voting Procedures (Council Operating Procedures 4.4) Members that are absent from a meeting at the time of a vote on the following items may vote by absentee ballot: 1. Initiate a policy development process; 2. Forward a policy recommendation to the Board; 3. Recommend amendments to the ICANN Bylaws; 4. Fill a position open for election. The GNSO Secretariat will provide reasonable means for transmitting and authenticating absentee ballots, which could include voting by telephone, e- mail, or web-based interface. Absentee ballots must be submitted within 72 hours following the start of the meeting in which a vote is initiated, except that, in exceptional circumstances announced at the time of the vote, the Chair may reduce this time to 24 hours or extend the time to 7 days.
