I compliment you on the initiative to create a CCWG to develop inputs on the use of the auction funds. The Board has explicitly committed to a full consultation process. Input from the CCWG will be quite welcome, but so will inputs from other sources. The Board has not chartered any group to make decisions about the auction funds, and we plan to proceed very deliberately. We will proceed very shortly with a call for inputs on general ideas and concepts, not specific projects. We make a point of reaching outside the usual ICANN SO and AC structures to include the rest of the Internet community. We will, of course, be glad to mention the CCWG effort as one of the ways for people to be involved. I hope this is consistent with your understanding and expectations. The Council reviewed the feedback received from all the GNSO Stakeholder Groups and Constituencies as well as other Supporting Organizations (SOs) and Advisory Committees (ACs) (see <http://gnso.icann.org/en/drafts/new-gtld-auction-proceeds-recs-responses-19 mar15-en.pdf> http://gnso.icann.org/en/drafts/new-gtld-auction-proceeds-recs-responses-19m ar15-en.pdf). On the basis of that review, the GNSO Council decided to move forward with the creation of a CCWG by, as a first step, forming a drafting team to develop a proposed charter for such a CCWG, which could then be considered by all SO/ACs interested in participating. As such, I would like to invite your SO/AC to designate one or two members to this drafting team effort. Please note that even if your SO/AC is not intending at this stage to become a chartering organization of the CCWG, if there are members interested to assist in this effort, they are more than welcome. In preparing the charter to address this issue, the Drafting Team is expected to develop the framework under which the future CWG will operate. This includes elements such as the mission, purpose, deliverables, as well as the guidelines for formation, staffing, organization, and overall rules of engagement. Following the completion of the work of the drafting team, the proposed charter for the CCWG will be submitted to all interested SO/ACs for their consideration. ICANN Draft FY16 Operating Plan & Budget

Dear fellow coucillors, noting that ICANN has a few weeks ago posted the Draft budget for the FY 16 for public comment. In as much as it may affect our role as the manager of the policy development process, there may be potential for the council to participate as well. At the last meeting, we noted that the funding of the staff support for the policy making function of ICANN, i.e. the main role of the GNSO seemed rather low. I also noted that the outreach for new stakeholder participation seems to focus on academic and educational targets, whereas I would suggest ore expert knowledge from more practically oriented fields might be helpful, such as inviting and offering to fund data protection officials for participatory roles. Dear Councilors, The new gTLD Subsequent Rounds discussion group is close to finishing its work. We currently expect to finish our discussion and have a final set of deliverables in the next few weeks. At that time, we will deliver to the Council a motion requesting an issue report, together with a table of issues for consideration and a draft charter for a future working group on subsequent new gTLD rounds. Given the breadth of the issues under discussion, I thought it might be useful for us to invite the co-chairs (me, Liz Williams and Jeff Neuman) to make a presentation to the Council at our 21 May 2015 meeting. If our work continues on schedule, we intend to present a formal motion to the Council for a vote at the Buenos Aires meeting. If we make an informational presentation in May, and invite questions from the Council at that time, my hope is that we will be prepared for a formal vote when we gather in person in June. Dear Councilors, I write on behalf of Graeme Bunton and Steve Metalitz, the co-vice-chairs of the Privacy & Proxy Services Accreditation Issues (PPSAI) Working Group. They and the rest of the Working Group members would like to inform the Council that the WG has decided that it would be more productive for it to hold an intensive working session during the week of the upcoming ICANN meeting in Buenos Aires, rather than a separate face-to-face full-day meeting either just before or after the ICANN meeting. The WG arrived at this decision after substantial internal discussion, the outcome of which was the conclusion that it would be difficult to ensure adequate representation across the different stakeholder groups, constituencies and interests currently represented in the WG at a separate face-to-face meeting. Conscious, however, of the need for effective progress on its work and in order to optimize its members¹ time during the Buenos Aires meeting, the WG decided instead to hold an intensive working session open to the community during the week itself. As the WG intends to publish its Initial Report for public comment within the next few weeks such that it will be in a position to review public comments received by the time of the Buenos Aires meeting, it believes that this intensive working session will serve to facilitate its timely progress toward a set of consensus recommendations in its Final Report. The WG thanks the Council for its continuing interest in the progress of the WG and for selecting it for a further face-to-face meeting in Buenos Aires, following a successful and productive initial session in Los Angeles last year. The WG chairs will be happy to provide the Council with further feedback concerning the effectiveness and use of such face-to-face meetings from their perspective as well. Beyond the Contract: Partnering to Strengthen Business and Consumer Protections

Recently ICANN received a formal letter [https://www.icann.org/en/system/files/correspondence/shatan-to-atallah-27ma… ] from Gregory Shatan, President of ICANN's Intellectual Property Constituency (IPC), on behalf of the IPC, asking us to halt the rollout of .SUCKS, a new gTLD operated by Vox Populi Registry Inc. In the letter, the IPC described the proposed business practices and actions of Vox Populi as "illicit" and "predatory, exploitive and coercive." As responsible stewards of the Internet, we take these allegations seriously. ICANN's enforcement ability lies within a contractual framework. We can enforce the terms and conditions of our contracts with registries, but it is the responsibility of governmental regulatory agencies, law enforcement and the courts to police illegal activity. ICANN is not a regulator and we have limited expertise or authority to assess the legality of Vox Populi's activities. Due to the serious nature of the allegations, we have sent letters [https://www.icann.org/en/system/files/correspondence/jeffrey-to-ramirez-knu… ] to both the U.S. Federal Trade Commission (FTC) and, because Vox Populi is a Canadian enterprise, Canada's Office of Consumer Affairs (OCA) asking them to consider assessing and determining whether or not Vox Populi is violating any of the laws or regulations those agencies enforce. ICANN is currently evaluating remedies available to us under the registry agreement. As we noted in those letters, if Vox Populi is not complying with all applicable laws, it may also be in breach of its registry agreement. ICANN could then act consistently with its public interest goals and consumer and business protections to change these practices through our contractual relationship with the registry. When I was appointed to the position of Chief Contract Compliance Officer last October, I made a commitment to look for ways that ICANN can help safeguard Internet users and registrants that may go beyond the contractual enforcement tasks for which we are responsible. Asking the FTC and OCA for their assistance in this matter is one example of how we can work with others to strengthen our consumer and business protections and enhance our ability to meet public interest goals. Let's continue to work together as a multistakeholder community to build trust and advance the reputation of our industry.
