For Consideration and Discussion: GNSO Obligations in the Revised ICANN Bylaws

Dear GNSO Councilors, Following the discussion at the GNSO Council meeting on 12 May on the draft revised ICANN Bylaws and the IANA Transition, staff conducted a detailed review and analysis of the final revised ICANN Bylaws with respect to GNSO obligations. This analysis, attached for your reference as a table (in Word and PDF), could provide guidance on where new GNSO operating procedures may be necessary, where it appears that existing procedures may apply, and where no action is necessary. Please note, however, that the attached table is subject to further updates pending final checks against the Bylaws. This analysis also could help guide a discussion at the Monday, 27 June GNSO meeting in Helsinki and for planning possible next steps. These steps could include approval of a follow-up mechanism, such as a Drafting Team that could work with staff to fully identify all the new or additional rights and responsibilities that the GNSO has, and develop new or modified procedures (as necessary) to fully implement the revised Bylaws. As noted in the attached analysis the revised ICANN Bylaws contain a number of new provisions that may require the GNSO Council and community to develop additional mechanisms to address certain new obligations and allow for the GNSO’s effective participation in the Empowered Community that is to be created as a result of the IANA stewardship transition, as well as to ensure continuity of GNSO processes in other matters. In the attached table, the staff analysis grouped the obligations as follows: 1. Obligations of the GNSO as a Decisional Participant of the Empowered Community; 2. Engagement in the new Customer Standing Committee; and 3. New or existing procedures relating to voting thresholds. The details concerning how the Empowered Community exercises its powers in all the areas where these powers apply are contained in Annex D Empowered Community Mechanisms of the revised Bylaws. This Annex provides step-by-step descriptions of these mechanisms. Because of the complexity of Annex D, staff is conducting a separate analysis of the Annex in order to determine whether possible new GNSO procedures may apply and whether they can be grouped according to type of obligation or procedure. RSVP Helsinki Informal Council dinner Tuesday 28 June at 18:30 EEST

Dear Councillors, Ed Morris has very kindly arranged the traditional informal Council dinner in Helsinki at the Restaurant Suomenliinna Brewery for Tuesday June 28th. 2016. Meet at 18:30 at the Helsinki Marketplace to catch the 18:40 ferry. The restaurant is on Suomenlinna, an island in Helsinki that is a UNESCO world heritage site. ( http://www.suomenlinna.fi/en/ ) (Short video: https://www.youtube.com/watch?v=f6bV6rbGVrc) This being Helsinki, the last sitting at the restaurant is 19:00 with closing time being 22:00. The sun shall still be out, however, and Councillors will of course be welcome to further explore the island if they wish following the dinner. We will get there by taking a ferry from the Helsinki Marketplace. It's about a 15 minute boat ride and costs a few euros: the same as any other form of Helsinki public transport. We should endeavour, if possible, to get the 18:40 ferry. There is a ferry every 20 minutes or so on the return so Councillors will have the option of returning as a group or individually. If we're not all there by 18:40 there is a19:00 ferry that should also be OK. Ed will arrange to repurchase the transportation tickets needed. Memo: GNSO Policy Development Process (PDP) Improvements End Report

Dear All, Starting in 2013, the Council, in collaboration with ICANN Staff, gathered a number of ideas and suggestions to be explored to improve and streamline the existing Policy Development Process. These ideas and suggestions were translated into 10 PDP Improvements (see http://gnso.icann.org/en/drafts/pdp-improvements-table-16jan14-en.pdf) Many of these improvements were also closely aligned with the recommendations of the ATRT2 in relation to the GNSO PDP. Staff was tasked to explore and implement next steps for each item, including in pilot format. Since then, Staff has been providing regular status updates to the GNSO Council in conjunction with ICANN meetings. The attached memo is intended to provide a final status update, including proposed next steps on how to transform some of the GNSO Improvements that have been determined successful into permanent features of the PDP and close out this project until such time the Council identifies new improvements that are deemed worth ! exploring and/or revamps some of the improvements that were not deemed suitable for implementation at this stage. ICANN56 - Helsinki Schedule Updated

All The latest version of the Helsinki Schedule is available. Following a call of the planning committee we were able to resolve a conflict with the Cross Community sessions on RPMs, which has been moved to Monday, and the ccNSO session on Country and Other Geographic Names stays on Wednesday. The Council meeting with the ICANN Board is scheduled for Monday, from 10.45am to 12.00 It is not anticipated that there will be any significant changes to the attached. ICANN will hold an interactive webinar on 16 June 2016 UTC to review findings of the study and their implications for the community. The Cycle 2 report acts as a follow-on to the Phase 2 Cycle 1 report published in December 2015. In Cycle 2, ICANN measured both the overall accuracy for syntax (formatting) and operability (e.g., does an email or telephone call go through?) of a sample of WHOIS records in gTLDs. The results include comparisons based on: * Registrar Accreditation Agreements (2009 RAA v. 2013 RAA) * Top-level domain types (e.g., new or "legacy" gTLDs) * Trends in data from Cycle 1 to Cycle 2 * Regional accuracy differences, including two new sub-analyses: reasons for error by region and language script type vs. accuracy The WHOIS Accuracy Reporting System is an ICANN initiative born out of recommendations from the 2012 WHOIS Review Team to improve oversight of the WHOIS Program. ICANN committed to proactively identifying potentially inaccurate gTLD WHOIS contact data and forwarding potentially inaccurate records to gTLD registrars for investigation and follow up. GAC Liaison - Update

Dear Council Colleagues - Recently we closed the nomination period for candidates interested in being considered for the role of GNSO Liaison to the GAC. Unfortunately, the response from the GNSO community was underwhelming. The Vice Chairs and I believe that this may be at least partly attributable to the timing of the announcement, as more candidates could be interested in the role if it coincided with the terms of other elected and appointed positions, which is the conclusion of the AGM in Hyderabad. Therefore, with this in mind, I'd like to propose that we postpone the selection of a new GNSO - GAC Liaison until later in the fall, with the (rough) timeline listed below. It is expected that the additional time will generate renewed attention to the role, additional expressions of interest from prospective candidates, and permanently align the term of this position with that of other terms, including most Councilors. Please let me know if you have any concerns or objections to this approach. On a related note, Mason Cole has graciously agreed to stay on a few extra months to ensure continuity. Thank you, Mason.
