Attending council remotely

Best regards, Marika From: Karla Hakansson <karla.hakansson(a)icann.org> Date: Saturday, June 24, 2017 at 16:12 To: Marika Konings <marika.konings(a)icann.org> Cc: Cyrus Namazi <cyrus.namazi(a)icann.org> Subject: Verisign request to extend Thick Whois Implementation Date Hello Marika, Please communicate the following update to the GNSO: In the process of implementing the Thick Whois Policy for .com and .net, Verisign proposed certain Amendments to the COM/NET Registry Registrar Agreement (RRA) to fulfill their obligation to begin accepting Thick Whois data from the registrars beginning 1 August 2017. Per the published process<https://www.icann.org/en/system/files/files/rra-amendment-procedure-25aug11…>, ICANN forwarded the proposed RRA Amendments to the Registrar Stakeholder Group (RrSG) on 29 March 2017 to review and provide comments. On 21 April 2017 the RrSG formally objected to the proposed Amendment stating: “…the .com/.net amendments have raised serious questions in the RrSG around how we'll operate and interact with .com/.net under the upcoming European GDPR, and we feel we need clarity on these issues before the amendments can be accepted. Indeed, the RrSG is now looking towards the impact of the GDPR on the 1000s of registries we regularly work with, and it's clear that we need to ensure we have more clarity and understanding, as well as a solution for data handling that will work across ALL registries.” Following this communication, the RrSG submitted a letter to ICANN and Verisign on 4 May 2017 requesting Verisign to modify its proposed Amendment, and for ICANN to create a data protection policy in support of the RAA for both registries and registrars. Since the 4 May 2017 communication ICANN has facilitated multiple discussions between Verisign and the RrSG in an attempt to resolve the outstanding issues with the RRA Amendments. The goal of those discussions has been to resolve the concerns about the proposed RRA Amendments so they can be in place by 1 July 2017. This deadline is imposed by Verisign to provide registrars with a thirty-day period in order for changes to the RRA to become effective before Verisign begins accepting Thick Whois data in their production environment. As of 21 June 2017, the RRA Amendment has not been accepted by the RrSG. ICANN strives for consensus whenever possible before approving RRA amendments, and without further discussions, is not prepared to approve an RRA amendment that the RrSG has rejected. On 20 June 2017 Verisign formally submitted a request to ICANN<https://www.icann.org/resources/pages/correspondence> to extend the 1 August 2017 Thick Whois implementation enforcement date by at least 120 days, or 29 November 2017. The extension request, currently under review, is not expected to compromise the 1 May 2018 Thick Whois deadline for all new .COM and .NET registrations or the 1 February 2019 deadline for the completion of the Thick Whois transition. Dear All, Please find attached for your information the updated proposed implementation plan concerning the GAC-GNSO Consultation Group Final Status Report Recommendations. As you will note, the implementation of recommendation #3 (“The CG recommends to make the QLM a standard feature of the PDP, factoring in the possible simplification/generalization of the process proposed in the ‘GAC Quick Look Mechanisms Experiences to Date’ document”) is progressing following the publication of the revised GNSO Operating Procedures for public comment. The remaining recommendations for implementation (#2 and #7) are expected to be completed by ICANN60. If you have any questions, please do not hesitate to let me know. During these sessions, the GNSO Policy Support Team will provide a briefing that aims to assist attendees in their preparation for the GNSO topics that are on the agenda for that specific day. This session is intended to be informative and interactive. Please join us with any questions you may have. They will be held from 08:00 – 08:30 local time every day in Committee 4, except for Tuesday 27 June, when that particular session will be held in Ballroom 2. Remote participation is available. GNSO Council Activities for ICANN59 Johannesburg

Councilors – By now, I imagine most of you are finishing up some last-minute tasks from your day job, packing up, and preparing to head for Johannesburg. With this in mind, I wanted to drop a brief note on some key GNSO Council sessions next week at ICANN59. Monday Working Session: We’ll be in session for most of the day on Monday, 26 JUN. Our agenda is posted here: https://community.icann.org/display/gnsocouncilmeetings/GNSO+Working+Sessio… Please review and come prepared with any questions you might have for the leadership of the active PDPs, the PTI, GSE or Board Working Group. On Tuesday (27 JUN) morning, the Empowered Community Administration will convene its first ever Community Forum, to discuss potential changes to fundamental bylaws. Later that same day, we will have our informal prep session, and then proceed to our dinner together at Parc Ferme. Please be sure to RSVP to Terri Agnew if you have not done so already, and Carlos advises us to bring cash (but small notes!). Wednesday (28 JUN) we will meet with the GAC at 11:30, and hold our Public Meeting from 1300-1500. Please review the Council meeting agenda, and post any questions or updates to the list. Finally, we’ll have a wrap-up session on Thursday (29 JUN) at 13:30. Aside from these sessions, I expect most will have a full docket of meetings with their SG/C, or as part of a PDP. And please don’t forget the Cross-Community Discussions each afternoon, as many of these subjects directly affect the work of the GNSO. Safe travels, and see you in South Africa! Opening of public comment forum on revised GNSO Operating Procedures & ICANN Bylaws section pertaining to the GNSO

Dear All, As you may recall, the GNSO Council directed ICANN Policy Staff to draft proposed language for any necessary modifications or additions to the GNSO Operating Procedures and, if applicable, those parts of the ICANN Bylaws pertaining to the GNSO as a result of the work of the GNSO Rights & Obligations under Revised Bylaws Drafting Team back in December. The Drafting Team was tasked to identify the GNSO’s new rights and obligations under the revised ICANN Bylaws which were adopted following the IANA Stewardship transition. A redline version of the GNSO Operating Procedures incorporating these changes, as well as the section of the ICANN Bylaws pertaining to the GNSO have now been submitted to be posted for public comment shortly (the forum should open shortly here: https://www.icann.org/public-comments) In addition to the modifications resulting from the Bylaws DT recommendations, the redline version also includes the following updates: * Updated references to the ICANN Bylaws as many changed as a result of the post-transition Bylaws; * Updated the generalized schedule for board elections to align it with the timing as well as notification requirements outlined in the post-transition Bylaws; * Included references to the GAC Quick Look Mechanism in the PDP Manual as a result of the GAC-GNSO Consultation Group recommendations, and; * Included references to the inclusion of a draft PDP WG Charter in the Preliminary Issue Report in the PDP Manual as a result of the GNSO Improvements recommendations. Comments may be submitted until 10 August 2017. Staff will be available at ICANN59 to provide an update on the proposed changes and address any questions you may have. Following the close of the public comment forum, staff will prepare a summary of the comments received so that the GNSO Council can decide what should happen next (which could include further updates / changes and/or approval of the proposed changes to the GNSO Operating Procedures as well as the ICANN Bylaws, the latter of which will also need to be approved by the ICANN Board.
