Update re Privacy and Proxy Services Accreditation Implementation

All, Below is the latest update on this IRT. I believe ICANN staff will cover this in our Sunday working session at 10:30. The IRT is scheduled to meet in Barcelona on October 24 to discuss IRT members' feedback about this new approach. The other open item for this IRT is the issue of privacy/proxy registrations and IRTP Part C as outlined in the annex to the GNSO Council letter (see https://gnso.icann.org/en/correspondence/bladel-to-crocker-01dec16-en.pdf) This was referred to the IRT in December 2017 and was intended to be addressed following publication of the IRT's Initial Report. I expect staff will want to consider if this work should be moved up given the latest update. After much consideration, ICANN org believes that work toward implementation of the Privacy and Proxy Service Provider Accreditation Program should be slowed, pending the completion of work on the EPDP and related efforts, which are expected to provide greater clarity about third-party access to non-public registration data. ICANN org believes that we should slow our work toward final implementation of PP Accreditation Program requirements until the results of the EPDP are known. Proceeding to implementation of privacy/proxy at this stage may result in establishing requirements for third-party access to nonpublic registration data held by privacy and proxy service providers that would be inconsistent with the policies developed for registry operators and registrars in the EPDP. In the interim, ICANN org will continue work on unfinished items that are not directly related to data privacy issues in consultation with the IRT (e.g. final reviews of the accreditation program materials, consideration of data escrow-related arrangements for registrar affiliates, etc). I want to reiterate how much we appreciate your hard work on this IRT. I’ll update you as I know more about how ICANN org plans to proceed on this project. We have at 1410 on our Sunday working agenda some time with Keith and Rafik to hear their visions for the Council Chair role and ask questions. The question time works best (I speak from experience!) when the candidates have the questions in advance and can reflect upon those. We have no objection to a public airing of the various issues raised by this matter as they go to the enforceability of a Board-adopted accountability measure within the context of the GNSO policymaking process. Apart from the merits of the original Expected Standards of Behavior (ESB) complaint, those issues include: • Whether co-chairs are obligated to recuse themselves in an ESB matter when the subject of the complaint has alleged bias on the basis of previous actions he has taken toward them. • Whether Section 3.4 of the GNSO WG Guidelines is presently enforceable. • Whether the parties to an ESB complaint may invoke direct intervention of outside legal counsel, and what procedural framework should be followed in that situation. • Whether co-chairs determining the merits of an ESB complaint shall be indemnified under Section 20.1 of the Bylaws if the subject of the complaint subsequently files legal or other adverse action against them in the event that a decision finding an ESB violation is rendered; and what Guidelines can be consulted by them to assure “good faith” conduct of the proceedings. Given the complexity of these interrelated issues we would like to inquire what advance information will be provided to members of Council concerning the situation, and be permitted to review it so as to be fully informed. Also, as members of the ICANN community are not presently aware that this situation exists, and as a 15-minute session cannot be expected to lay out the facts in a completely clear and comprehensive fashion, we wonder what follow-up explanation will be provided to the community as well as interested media if follow-up questions are subsequently raised. We look forward to Sunday’s discussion so that the Council and community can start to learn as much as possible from this situation and take responsive steps. Dear Councilors, To add a bit of additional context to this message, note that amongst several public comment proceedings managed by the IDN Program team, one of the most recent was called Recommendations for Managing IDN Variant Top-Level Domains (here: https://www.icann.org/public-comments/managing-idn-variant-tlds-2018-07-25-…) which is a proposed framework for implementing IDN Variant TLDs. While the Root Zone Label Generation Rules (RZ-LGR) are responsible for deriving IDN Variants, this proposed framework could be the mechanism by which those IDN Variants are then allocated to registries, second-level domains are treated underneath the IDN variants, and other rules. I am far from an expert on this subject, but my understanding is that if the GNSO agrees with this proposed framework (and ideally the ccNSO as well, so the implementation is harmonized), there may not be additional work needed from the GNSO, beyond perhaps work done in the New gTLD Subsequent Procedures PDP WG, which has discussed the topic (with Council’s very own Rubens Kuhl at the helm), but not in regards to IDNs from the 2012 round of the program. However, if there are substantive disagreements with the proposed framework, the GNSO may want to engage further on this topic. Again, Sarmad and Pitinan are the experts, so please let them know if you have questions.
