This proposed Temporary Specification provides an interim solution until the community completes a policy development process on the temporary specification which is expected to complete within a one year period. On 17 May 2017, the ICANN Board approved<https://www.icann.org/resources/board-material/resolutions-2018-05-17-en> the proposed Temporary Specification for gTLD Registration Data<https://www.icann.org/resources/pages/gtld-registration-data-specs-en>, which establishes temporary requirements for how ICANN and its Contracted Parties will comply with both ICANN contractual requirements and the European Union’s General Data Protection Regulation (GDPR). On 12 June 2018, the Council held an Extraordinary Council Meeting to discuss next steps on addressing the Temporary Specification. There, the Council agreed in principle that an EPDP was the right way to address the issue and took steps to draft the charter and prepare for EPDP initiation. On 19 July 2018, the Council voted to initiate an EPDP on the Temporary Specification<https://gnso.icann.org/sites/default/files/file/field-file-attach/temp-spec…>, as well as to adopt the EPDP’s charter<https://gnso.icann.org/sites/default/files/file/field-file-attach/temp-spec…>. The EPDP Team held its first meeting on 1 August 2018 and on 21 November 2018, the EPDP published its Initial Report for public comment<https://www.icann.org/public-comments/epdp-gtld-registration-data-specs-ini…>. After taking into account public comment received, the EPDP Team has worked to deliver its Final Report<https://gnso.icann.org/sites/default/files/file/field-file-attach/epdp-gtld…> to the GNSO Council for its consideration. Due to the unique circumstances concerning the deadline for implementation, and in order to minimize the transition period, the EPDP Leadership and Team informally recommends that discussion around implementation deliverables be initiated immediately. This preliminary work will inform the deliberations of the formal Implementation Recommendation Team upon Board approval of the Policy Recommendations. The EPDP team delivered its Final Report<https://gnso.icann.org/sites/default/files/file/field-file-attach/epdp-gtld…> to the GNSO Council on 20 February 2019. After a request for deferral, it was determined that the vote would, and must, take place on 4 March 2019. Here, the Council will vote to adopt the Final Report of the EPDP Team. 3.1 - Presentation of motion<https://community.icann.org/x/Wog2Bg> (Rafik Dammak) 3.2 - Council discussion 3.3 - Council vote (voting threshold: Supermajority) Item 4: COUNCIL DISCUSSION - Expedited PDP on the Temporary Specification for gTLD Registration Data - Phase 2 Work (45 minutes) As noted in the charter<https://community.icann.org/display/EOTSFGRD/EPDP+Team+Charter> for the Expedited PDP on the Temporary Specification for gTLD Registration Data, work on a System for Standardized Access to Non-Public Registration Data can only commence after the work on a series of gating questions are complete. With the EPDP Team’s delivery of its phase 1 Final Report to the GNSO Council, the work on the gating questions can be considered to be completed and the work on the System for Standardized Access to Non-Public Registration Data, or otherwise known as phase 2 of the EPDP, should be allowed to commence. However, per the EPDP Team Charter, beginning that work is dependent upon non-objection of the GNSO Council (which is captured and granted in the resolution language for item 4 of this agenda). As part of the resolved clause, “...The Council does request that the EPDP Team, as a first step, develops its work plan for phase 2 and, furthermore, identifies whether the GNSO Council should consider any updates to the EPDP Team Charter to facilitate the EPDP Team’s work.” The Council recognizes that suggestions to update the structure of the EPDP Team and any changes to the Charter are best delivered by the EPDP Team. However, the Council believes that it is constructive to have a preliminary discussion on the subject to see if there are any areas that Councilors believe will require revision for phase 2. With the recent resignation of the EPDP Team’s Chair, the Council may also briefly discuss next steps to fill this vacant position. Best Regards, Rafik Dear Constituency and Stakeholder Groups Chairs, *Questions from your Groups to the Board - Please reply no later than Monday 18 February 2019* On behalf of the Board, I would like to wish each and every one of you, a HAPPY NEW YEAR! In 2019, the Board and I are determined to work with you more closely than ever to make it a productive and successful year for ICANN’s future. We are very much looking forward to welcoming you and discussing with you during ICANN64 which will take place in Kobe between 9-14 March 2019. This time in particular, the Board would like to listen to your suggestions in order to make ICANN’s big plans successful. *What does it mean*? In 2018, besides GDPR, the Community, the Board and ICANN org have worked tirelessly on several key plans that are now or soon will be out for public comment: - the draft Strategic Plan 2021-2025 was published a little before Christmas; - the first consultation paper on a 2-Year budgeting process was also published before Christmas; - and the draft FY21-25 Operating Plan & Financial Projections will be posted before this summer. In addition, based on community feedback and discussions at ICANN 63, we will begin a consultation in Kobe on the status of ICANN’s governance’s model, including whether and how it should evolve to continue to serve the global ICANN community. In the aggregate, these plans are comprehensive and address the key challenges ICANN’s faces in the future in the areas of security; governance; unique identifier systems; geopolitics; and financials. Even great plans come with challenges, which we want to anticipate and address as a prelude to implementation. We pulled together once before, galvanized our resources effectively and achieved a successful transition. We need to do it again to address ICANN’s future challenges. Are we ready? Do we, for example, collectively have the leadership, skills, resources, knowledge and commitment required to implement these plans successfully over the next five years? We need your help for this. Specifically, as you prepare for Kobe, we would like your high-level input on: 1. What the Board, ICANN org, and the Community should be doing now to prepare for the successful implementation of these plans? Please make *three suggestions* as concrete as possible, providing one each for the Board, ICANN org, and the Community. 1. While the success of these plans lies primarily within ICANN, we all know that ICANN does not operate in a vacuum, and alliances and partnerships are important to our success. How can we increase the likelihood that important allies and partners in the space are on the same page and working together to achieve common/agreed upon goals? Please provide *one suggestion* of something that could be done externally to improve trust and collaboration. We are looking forward to hearing *your four suggestions* during our face-to-face meetings in Kobe so that we could then work jointly towards a successful implementation of ICANN’s future plans, that you have been involved in formulating. In the meantime, we would be very grateful if you could send to Board Operations (board-ops-team(a)icann.org) the questions you would like the Board to address during our face-to-face meetings. Given the finite time available for these meetings, we would appreciate it very much if you could list your questions in order of priority.
