Hi all, Apologies for the late request, but I have attached an updated draft of the GNSO Council comments on ICANN's FY20 Budget and Operating Plan. I took Ayden's most recent proposed draft and edited it down to where I believe the Council as a whole can support the comments. Please review and let me know if anyone has any objection, and, if you do, be very specific about what you want removed to secure your non-objection. I want to take this opportunity to thank Ayden and the SCBO for all the hard work over many weeks they put into developing the initial draft. Many of us, myself included, could have done a better job of providing more timely feedback to the SCBO on the expectations of Council related to these comments. That said, I think it's important for the Council to submit comments, so I hope we can achieve that. The deadline is today, but I will hold off until Monday to submit. Thanks, Keith

Note this is different from the FY20 Budget comments I just circulated a few minutes ago. These comments are due on Monday, so please let me know if you have any comments or concerns. I took the latest version from the SCBO and edited them down to what I believe can be supported by the Council as a whole. Dear all, The Standing Committee on Budget and Operations has prepared a new draft of a proposed GNSO Council comment on the FY20 Budget and Operating Plan. Please find attached, both clean and redlined versions. There are two key changes from the previous version. First, we have worked with Councilors who raised concerns around the bullet point about the fellowship program, and in this draft this language has been refined. Second, we have inserted a new bullet point calling for an upgrade to the GNSO's website to be prioritized, following the resourcing discussion at the Strategic Planning Session. Absent any objections from a member of the Council we are seeking to submit this comment on behalf of the GNSO Council on 8 February 2019. Dear all, Please find attached a potential, alternative comment for the Council to submit on the budget. Note that given the urgency with which this was prepared, it has not been shared with and reviewed by the SCBO, and so cannot be presented as a comment prepared by the SCBO. I feel quite uncomfortable presenting this, because it is not fully the work that the SCBO had produced over the past six weeks in a bottom-up fashion, but it is an attempt to rapidly respond to the feedback that has been shared on our list over the past 24 hours. This proposed Temporary Specification provides an interim solution until the community completes a policy development process on the temporary specification which is expected to complete within a one year period. On 17 May 2017, the ICANN Board approved<https://www.icann.org/resources/board-material/resolutions-2018-05-17-en> the proposed Temporary Specification for gTLD Registration Data<https://www.icann.org/resources/pages/gtld-registration-data-specs-en>, which establishes temporary requirements for how ICANN and its Contracted Parties will comply with both ICANN contractual requirements and the European Union’s General Data Protection Regulation (GDPR). On 12 June 2018, the Council held an Extraordinary Council Meeting to discuss next steps on addressing the Temporary Specification. There, the Council agreed in principle that an EPDP was the right way to address the issue and took steps to draft the charter and prepare for EPDP initiation. Here, the Council will receive an update on the Final Report from the EPDP Team Chair, Kurt Pritz, and discuss next steps. 3.1 – Status update (Kurt Pritz, Chair of the EPDP on the Temporary Specification for gTLD Registration Data) 3.2 – Council discussion 3.3 – Next steps Item 4: COUNCIL DISCUSSION – IGO-INGO Access to Curative Rights Protection Mechanisms (50 minutes) The IGO-INGO Access to Curative Rights Protection Mechanisms PDP WG worked to resolve a final recommendation relating to IGO jurisdictional immunity and registrants’ rights to file court proceedings. The WG reached agreement on a single recommendation amongst several options for their final recommendation on this area, as well as for all other recommendations. The WG Chair proposed his determination of consensus levels for all recommendations, which the WG has affirmed. On 27 June 2018, the GNSO Council passed a resolution<https://gnso.icann.org/en/council/resolutions#201806>, thanking the PDP WG for its efforts and requesting that it submit its Final Report<https://gnso.icann.org/sites/default/files/file/field-file-attach/igo-ingo-…> in time for the 19 July 2018 Council meeting. After having agreed on consensus levels for its final recommendations, the WG has considered the text of its Final Report<https://gnso.icann.org/sites/default/files/file/field-file-attach/igo-ingo-…>. On 9 July 2018, the PDP WG submitted its Final Report<https://gnso.icann.org/sites/default/files/file/field-file-attach/igo-ingo-…> to the GNSO Council for its consideration, which contains five consensus recommendations and three Working Group member minority statements, documenting their disagreement either with one or more of the final recommendations or other parts of the Final Report. On its 19 July Council meeting, the Council resolved to accept the Final Report<https://gnso.icann.org/sites/default/files/file/field-file-attach/igo-ingo-…> from the IGO-INGO Access to Curative Rights Mechanisms PDP Working Group, where it noted that it would consider the topic of curative rights protections for IGOs in the broader context of the appropriate overall scope of protection for all IGO identifiers. On 9 October 2018, the Council held a question and answer webinar to review the recommendations and to ask itself a series of questions, 1) Does the Council believe that the PDP has addressed the issues that it was chartered to address (i.e. What questions/topics was the Working Group chartered to consider, did it consider those charter topics/questions, and did it do so in a legitimate way)?; 2) Has the PDP followed due process?; and 3) Did the PDP Working Group address GAC advice on the topic? A motion to consider the Final Report was originally submitted on the 24 October 2018 Council meeting agenda but was withdrawn due to concerns around both the process followed by the PDP, as well as the substance of the PDP WG’s recommendations. Hi all, Last Tuesday, the GNSO Council Leadership and EPDP Leadership held a joint call to discuss timing and progress of the EPDP WG and planning for Council consideration and our vote on the Final Report. Following that call, I requested feedback from ICANN on the timing required for public comment and Board consideration, with an eye toward finding some extra time for the WG if needed. Attached is the response from Goran, which provides the potential for an additional 2 weeks for the EPDP to finalize its work, assess levels of consensus, and ensure the SG/Cs and other groups can consider a stable document before the Final Report is delivered to the Council for action. I have communicated this to Kurt (copied here) and I believe he will discuss this with the EPDP WG during today’s plenary call. If all goes according to plan, the GNSO Council will have two opportunities to vote – first, during our 21 February regular meeting, or during a 4 March special meeting, if needed.
