The Small Team agreed with the Board's assumptions, barring a few perceived textual imprecisions. The Small Team held a call with Becky Burr on Tuesday, 14 December, during which they discussed and clarified the Board’s assumptions. The draft letter to the Board captures the contents of that discussion, where Becky indicated the Small Team’s clarifications and proposed edits were acceptable. Dear Councilors, On behalf of the GNSO Council leadership, staff is circulating the proposed GNSO Council response, developed by the leadership team, to the ICANN Board regarding the request for continued deferral of IDN Implementation Guidelines v4.0. Taking into account the presentation by RySG Councilors on 16 December 2021, this letter provides a direct response to the Board questions and suggested approach to move forward with the IDN Implementation Guidelines v4.0. Highlight of the letter: * The IDN implementation guidelines that overlap with IDNs EPDP charter questions and should continue being deferred are: 6a, 11, 12, 13, and 18 * While the RySG did not identify 6a as an overlapping item, upon further review by the GNSO Council leadership, it in fact overlaps with IDNs EPDP charter question c6. See annex of the letter for details. * Based on the understanding that non-overlapping guidelines are part of the currently applicable IDN Guidelines 3.0 and/or additional non-mandatory guidelines not covered in IDNs EPDP’s charter, the letter provides support for Board’s suggestion that those non-overlapping guidelines should move forward for Board adoption. In the absence of objections by Thursday, 20 January 2022, this letter will be sent to the ICANN Board as the GNSO Council response. Thank you for your review. There is appreciation for the sharing of the high-level findings to date, but at the same time many have expressed the importance of being able to review the detailed information and analysis that underpin these high-level findings to better understand where possible costs and complexities arise before being able to form a position on what this means for the SSAD recommendations. At the same time, the Council recognizes the importance of continuing the dialogue with the ICANN Board on this topic and it would appreciate the opportunity to hear initial reactions of the Board during this upcoming meeting. In addition to potential concerns about costs, the Council would be interested to learn whether there are other concerns or risks that the Board has identified with the SSAD recommendations as these currently stand. As you know, procedurally the Council would have the ability to modify the recommendations prior to Board consideration, or if the Board decides to not adopt these recommendations, the Council will be requested to consider proving a Supplemental Recommendation. In either scenario it will be key for the Council to understand the specifics of the Board's concerns to determine a possible path forward. We appreciate that this may be unchartered territory, but we welcome this opportunity to work on this issue in collaboration with the ICANN Board and expect the upcoming meeting to be the starting point of an ongoing conversation that will hopefully result in an outcome that we are all willing and able to support and stand behind. On December 16, 2021, we had our second SubPro ODP Liaison call with ICANN’s SubPro ODP team. Much of what we covered was subsequently announced by ICANN on December 20, 2021 in its announcement<https://www.icann.org/en/announcements/details/icann-launches-new-gtld-subs…> on the formal launch of the New gTLD Subsequent Procedures Operational Design Phase. As the announcement stated, on December 17, 2021, ICANN org advised the Board<https://www.icann.org/en/system/files/correspondence/swinehart-to-botterman…> that it was formally commencing the Operational Design Phase as of this month (January 2022). During the call we spent some time discussing what this actually means – namely, to go from the preparation phase to the actual operational design phase. Over the past three months, ICANN Org has been transitioning resources (including personnel) from other projects to work on this ODP. In addition, Karen Lentz, who is responsible for the ODP from ICANN’s Global Domain Services group has expanded her team with at least one new hire (perhaps more by this point) to assist with the project. Chris Bare, an experienced project manager, who has been working on new gTLDs since the last round, has been developing a comprehensive project plan with milestones and deliverables to enable ICANN Org to meet the 10 month ODP timeline. In addition, as was discussed in the December 1, 2021 blog post by Karen<https://www.icann.org/en/blogs/details/update-answers-to-questions-related-…>, the ODP has been divided into 12 scoping areas that will involve virtually every division at ICANN, including Finance, HR, Global Engagement, Systems and Tools, and ICANN Procurement (to name a few). Now that the ODP has been formally kicked off (as of this month), members of each of these teams have been assigned to work with the ODP team so that ICANN will be able to complete the Operational Design. ICANN Org is waiting for the GNSO Council to respond to its Initial Set of questions<https://mm.icann.org/pipermail/subpro-odp/2021-November/000007.html> submitted on November 17, 2021. At its December GNSO Council meeting, the Council agreed to have all feedback on the responses [docs.google.com]<https://urldefense.com/v3/__https:/docs.google.com/document/d/1vpL6xHHVlmm5…> by no later than January 13, 2021. In addition, Council Leadership is finalizing a process to follow as we move forward so that we can respond to ICANN Org’s questions much more quickly than the two months it has taken us to date to respond. I believe that will be discussed at our Council meeting on January 20th. In addition, the Council still needs to decide whether it is happy with the current set of information that it is being provided (through the Liaison), or whether it is interested in more transparency as discussed during the December GNSO Council meeting. Sending on behalf of the Modifying gTLD Consensus Policies small team Dear Councilors, Following several conversations by the small team that was formed to review the Modifying gTLD Consensus Policies paper (see https://community.icann.org/x/qAWlCg) the small team would like to recommend that the Council requests a dialogue with ICANN org and interested Board members on this topic. The small team is of the view that this would result in a more constructive engagement than sending redline edits and/or comments back. If the Council agrees, the small team suggests that the letter below is sent to ICANN org. If there are any comments or concerns about this proposed approach, maybe these can be considered during the upcoming Council meeting as an AOB item? Best regards, Marika Dear Theresa, As you are aware, in response to your email of 23 October 2021, the GNSO Council formed a small team consisting of Council members as well as interested SG/C representatives to review the discussion draft and propose to the GNSO Council how to proceed. The Council and the small team appreciate the engagement with ICANN org on some of the procedural questions and welcomes the invitation to engage on this important topic. However, instead of sending papers and letters back and forth, the Council is of the view that this topic may benefit from a dialogue between Council, interested SG/C representatives, ICANN org as well as interested Board members. As such, we would like to propose to schedule a meeting, or a series of them, during which we can go into further details on topics and questions such as: 1. Ensuring a common understanding of the problem we trying to fix; 2. Is the “fixing” expected to require changes to existing procedures or do existing procedures provide for sufficient flexibility to address the problem should it arise again? 3. A common understanding of the urgency of the problem so we can decide how to prioritize this effort and ensure that community resources are available to work on this topic jointly; 4. [other themes/questions] The GNSO Council does wants to emphasize that it fully supports the notion that any modifications to existing gTLD Consensus Policies need to be clear and should be identified as part of any policy recommendations that are submitted to the GNSO Council and subsequently the ICANN Board. The Council realizes that because of the time constraints under which it and the ICANN Board operated in the context of the EPDP Phase 1, this clarity may not have been provided in all cases which resulted in delays and questions around the intended impact on some existing Consensus Policies. Fortunately, we have been able to resolve these issues through our existing processes and procedures, but obviously, we would have saved substantial time and frustration if we would not have found ourselves in this position. If you are supportive of this approach, we would suggest that you work with the GNSO Secretariat to identify a time / date that works for all those that should be part of this conversation.

Dear all, Further to our conversation last week about the SSAD, there does seem to be some concern from ICANN org that it will be extremely expensive both to establish and to run. I'd like to throw the attached back into our thinking; as you may remember, Alex Deacon presented this idea to the Board back in October 2020, showing that we can get a disclosure request ticketing system up and running with existing software and thus at minimal cost. Perhaps it's time to revisit this idea?
