Friendly amendment to the Motion - DNS Abuse Mitigation - PDP 1 and PDP 2

Thank you Feodora and staff team for making these corrections and also making sure the references in the Charters reflect the language used in the rest of the Final Issue Report. In light of this, I am suggesting a friendly amendment to the motion I brought to Council to align with this updated corrected language: https://icann-community.atlassian.net/wiki/spaces/gnsocouncilmeetings/pages… (original motion) Specifically in whereas clause 9: 9. Informed by the DNS Abuse Small Team`s recommendations, the Public Comment on the Preliminary Issue Report, the ICANN84 DNS Abuse working sessions, and the clear preference for narrowly scoped Policy Development Processes (PDP), the Final Issue Report recommends separate PDPs on: * Associated Domain Checks: A framework A reactive approach requiring registrars to proactively pivot to investigate domains linked to malicious actors, particularly in cases of high-volume domain registrations used for DNS Abuse campaigns; and, * Safeguards for Application Programming Interface (API) access to new customers: A proactive approach that seeks to introduce friction for new customer accounts, prior to gaining access to high volume registration tools until trust is established. Friendly amendment to the Motion - DNS Abuse Mitigation - PDP 1 and PDP 2

Dear All, Thank you everyone for your input and considerations on the DNS Abuse motion and draft charter. Based on careful review of the feedback and comments, attached please find the amended motion. Specifically, the proposal is that Council initiate the two separate PDPs during tomorrow’s meeting, while at the same time granting additional time for Council to continue its review of the charter. From the comments provided, the two main areas requiring further discussion within the charter are: Human rights considerations around registrant recourse and remedies in general (potential template language), the Working Group model. To this end, we propose to have a charter drafting team to look at these two main areas and bring back an updated draft charter to be presented to Council at the next meeting. We have had strong engagement from the entire Council and by extention the whole community throughout this process, and an exceptional opportunity to address many of the issues during Public Comment, at ICANN84, and during the last Council meeting. I cannot overstate the importance of ensuring that the charter is fit for purpose, and that Council has sufficient time to refine it so the PDP Working Group can begin its work with a clear and effective mandate. Sub Pro Implementation Review Team Update

Dear Council Members, By way of update, ICANN staff has advised the Sub Pro IRT that ICANN intends to finalize and publish the Applicant Guidebook on December 16. At this time, it's projected that the date for the opening of the next round will be published in the AGB with an April 30, 2026 opening and a a 15 week application period. We would like to advise the Council of a variance from Implementation Guidance 14.4 from the Final Report which recommended beta testing of the application system prior to launch. This was discussed at length in yesterday's IRT meeting. We understand that the risks associated with this approach are being shared with the Board and that ICANN Org plans to do thorough internal Quality Control testing of the system prior to launch. If any "bugs" appear during that internal testing, the April 30 launch date could be affected. I am attaching ICANN's rationale for the variance. During the Sub Pro ODA phase, Council asked to be advised whenever any given Implementation Guidance proved infeasible. Accordingly, it seemed appropriate to make the Council aware of this at the present time since the publication of the AGB is intended for next week.
