newTLD issues

Hi all, Thanks to Kurt, Karla and others for the update on newTLDs in Paris, which I greatly appreciated. It did raise a couple questions for me though. 1.) If newTLD Base Contract must be accepted unless demonstrated 'need' for changes (i.e. IGOs or gov'ts, which would require Board approval of changes), this may create an unfair situation since many if not all incumbent gTLD registries negotiated their contracts individually. Should that situation be addressed upon incumbent's renewal, by forcing renewing registries into the revised base contract unless they have demonstrated 'need' for differences? I think this should be added as a Blue Sky issue, but meanwhile I am curious to hear Staff feedback on this issue (particularly if I've misinterpreted it). 2.) If two applicants contend for the same or confusingly similar TLD strings, one wants an open and unrestricted TLD like .com/net/org/biz/info, and another wants a "community based" TLD that has restrictions on who can register, like .travel/jobs/cat/museum/coop/aero. What are the criteria on which they would be compared to determine who wins? Thanks. Mike

GNSO Staff Support

I am pleased to announce that Marika Konings has joined ICANN's Policy Department as a Policy Director. Marika will be managing policy development activities in support of the GNSO. Initially, she will be picking up responsibility for policy development work on inter-registrar domain name transfers and fast-flux hosting and will be managing other GNSO policy issues as they arise. Olof Nordling has been promoted to Director, Services Relations, reporting to Kurt Pritz, Senior VP, Services. He is transitioning from support for the GNSO to support for ICANN's implementation efforts, including implementation of new gTLD and IDN-related policy, and will be helping Marika get up to speed on GNSO support. Marika is based in ICANN'S Brussels office and reports to me. She can be reached at marika.konings(a)icann.org. Marika has an extensive background in Internet policy issues including cyber-security, Internet privacy and other technology policy issues. Most recently she was Director of European Affairs for the Cyber Security Industry Alliance, an organization of security companies focused on promoting information security, online privacy and consumer protection policies in Washington and with the European Commission. As director of the European office, Marika represented the policy interests of cyber-security companies with the Commission and other European Union institutions. Previously, Marika spent seven years as senior consultant for Interel Public Affairs, a Brussels-based public affairs consultancy, where she represented health care and technology clients. Marika is a Dutch national, mother of two, and has a degree from the University of Maastricht, the Netherlands, in Culture and Sciences and a Master's Degree in European Political and Administrative Studies from the College of Europe in Bruges, Belgium. In addition to Dutch and English, Marika speaks Spanish, German, and better French than she admits. Please join me in welcoming Marika to ICANN and congratulating Olof on his new responsibilities. The document contains some initial documentation on methods that can be followed in beginning the work required to transition from the current GNSO organization to the type of organization ultimately recommended by the ICANN Board - including the areas of process, operations and collaboration with other ICANN entities. Before any methods can be put into practice, the plan needs to be reviewed by the GNSO and the ICANN community at large and approved by the GNSO Council and endorsed by the ICANN Board. Inter-Registrar Transfer Policy - Denial of Transfers (Reasons #8 and #9)

[To: council[at]gnso.icann.org; liaison6c[at]gnso.icann.org] [To: ga[at]gnso.icann.org; announce[at]gnso.icann.org] [To: regional-liaisons[at]icann.org] Reminder to submit public comments before 18 July 2008. http://www.icann.org/public_comment/#irtp-denial-89 Inter-Registrar Transfer Policy - Denial of Transfers (Reasons #8 and #9) Explanation: As part of its ongoing efforts to review the Inter-Registrar Transfer Policy (the rules for transfer of domain names between registrars) the GNSO Council seeks community review and comment on two proposed revisions to the IRTP regarding reasons for which a registrar of record may deny a request to transfer a domain name to a new registrar. The two revisions being considered by the Council are referred to as Reason # 8 and Reason # 9. They are part of a larger policy development process (PDP) that has involved a subset of four reasons (Reason # 5 and # 7 in addition to # 8 and # 9) for which a registrar could deny a transfer request. The overall IRTP review has become a considerable undertaking that could ultimately span as many as six separate policy development processes. A review of the current PDP involving Reasons # 8 and # 9 is set forth in the announcement for this comment forum. On 17 April 2008, the GNSO Council launched a drafting group to develop suggested text modifications for Reasons 5, 7, 8 and 9. The drafting group delivered a Final Draft Report [PDF, 48K] dated 4 June 2008, proposing new textual language for reasons 8 and 9, while suggesting that denial reasons 5 and 7 be considered within a separate proposed PDP or a future PDP that offers a stronger linkage with those issues. The Council agreed with the recommendations of the drafting group.
