Dear Councillors, As reflected in the minutes for our 7 January Council meeting, "The Council agreed to include the following two topics in the Joint ccNSO-GNSO IDN Working Group (JIG) work and agreed that this could be done without modifying the charter: 1) selection of scripts for which single character IDN TLDs should be allowed; 2) method for allocation of single character IDN TLDs." In that meeting the question was raised whether new members could join the JIG. Note the following in that regard: - The JIG charter says, "The ccNSO Council will appoint no more than 5 members to the WG in accordance with its own rules and procedures. The GNSO Council will appoint no more than 5 members to the WG in accordance with its own rules and procedures. The chairs of the ccNSO and the GNSO, or somebody they appoint as an alternate, will be ex-officio members of the WG." Also note that the JIG allows observers. - At the Council meeting on 3 September (http://gnso.icann.org/meetings/minutes-03sep09.htm) the Council confirmed the following GNSO co-chair and volunteers for the Joint ccNSO-GNSO IDN Working Group (JIG): Edmon Chung - gTLD Registries (co-chair); Terry Davis - Nominating Committee Appointee; Stéphane van Gelder - Registrars; Avri Doria - GNSO Council chair (Observer ex-officio); Chuck Gomes - GNSO Council vice-chair (Observer ex-officio). - In the 7 Jan Council meeting, Rafik Dammak volunteered to serve on the JIG. - After the 7 Jan. meeting: i) Stéphane communicated that he would be willing to become an observer if his seat was needed for another volunteer; and ii) Avri communicated that she would be interested in continuing to serve on the JIG if that was possible. If we accept Stéphane's offer and consider Avri an observer, the currently approved GNSO participants in the JIG are as follows: GNSO JIG members 1. Edmon Chung, Co-Chair (RySG) 2. Terry Davis (NomCom Appointee) GNSO JIG observers 1. Stéphane van Gelder (RrSG) 2. Avri Doria (NCSG) 3. Chuck Gomes (Ex-Officio) Assuming the above, we have three slots open for regular JIG members. Rafik already volunteered for one slot. That would leave two seats available, which could be filled by any combination of new volunteers, Avri and Stéphane. If anyone else would like to volunteer to serve as a regular JIG member from the GNSO, please communicate your desire not later than Wednesday, 20 Jan. If there are no new volunteers, I would recommend that Avri and Stéphane serve as regular JIG members in addition to Rafik. Whatever happens, we will need to approve new members on 28 January and action will be taken in that regard then. Thank you. Please note agenda item 2 for our 28 Jan Council meeting: "Item 2: Decision regarding initiation of a PDP about vertical separation of Registries and Registrars (30 minutes) 2.1 Refer to Issues Report on Vertical Integration: http://gnso.icann.org/issues/vertical-integration/report-04dec09-en.pdf 2.2 Summary of and rationale for Issues Report recommendations (Margie Milam) 2.3 Discussion 2.4 Motions " It would greatly facilitate our discussion and action in the meeting if there was some advance discussion about this topic in the next few days. As everyone knows, the Issues report recommends that a PDP not be initiated at this time. Are Councilors and your respective groups comfortable with this recommendation? If not, would you recommend initiating a PDP at this time? Or would you recommend delaying the decision again? Whatever we decide, we need to prepare a motion or motions and post them by next Wednesday, 20 January. Chuck

Update on Whois studies

All, Attached and following, please find an update on the Whois studies that the policy staff has been working on. I. Background: The GNSO Council concluded that a comprehensive, objective and quantifiable understanding of key factual issues regarding the gTLD Whois system would benefit future GNSO policy development efforts. In March 2009, the GNSO Council asked ICANN staff to conduct research on feasibility and cost estimates to study several high priority aspects of WHOIS, and to report back to the Council with that information for further decision-making. Staff has categorized these studies into three areas (the first three areas listed in the attached chart), and is soliciting bids from independent researchers to help determine costs and feasibility issues in each area using an RFP approach. The GNSO Council resolution making this request can be found here: http://gnso.icann.org/resolutions/#200903. II. Update: Following is a list of the study RFPs that are being issued (may include more than one study), with a short update on each: 1. WHOIS Misuse -- Studies will assess extent of misuse of public Whois data to generate spam or for other illegal or undesirable activities. One Misuse study will survey registrants about specific acts they have experienced that they believe occurred using Whois contact data; survey registrars about how Whois can be queried, and survey others about reported incidents from cybercrime, research and law enforcement organizations. A second Misuse study will measure a variety of harmful acts by classifying messages sent to unpublished test domain names registered specifically for the study using a representative sample of registrars. The study will compare harmful acts associated with public vs. non-public addresses and examine impact of public Whois and anti-harvesting measures. An RFP was released on 28 September and closed on 27 November 2009. 3 responses were received. Staff review and analysis is underway. 2. WHOIS Registrant Identification - Study will explore Whois registrations and the extent to which domains used by legal persons (commercial entities) or for commercial purposes are: 1) not clearly identified as commercial entities in Whois (perhaps their identity is obscured or suggests the registrant is a non-commercial entity); and 2) are correlated to use of privacy and proxy services. An RFP was released October 23 and closed on 23 December 2009. 5 responses were received. Staff review and analysis is underway. 1. Whois Proxy and Privacy Services - Studies will look at: 1) the extent to which domain names used to conduct illegal or harmful Internet activities are registered via proxy and privacy services to obscure the perpetrator's identity; and 2) the degree to which proxy and privacy services impede or delay timely identification of perpetrators. More information about these studies will be available in the coming weeks. III. Next steps and timeframe: There is a significant amount of work involved in drafting RFP terms of reference for the third set of studies at the same time that we are analyzing responses for the first two study areas. Staff is taking great care with the analysis and budget implications, and the third set of studies is complex. Due to delays in preparing an RFP for the third set of studies, we have been delayed in our review of the RFP responses. We are just beginning that analysis now, and following that review, we will then be presenting information to the GNSO Council for its consideration and action. For these reasons, the staff analysis on the first two sets of studies will likely take several more weeks to complete. Please let me know if you have any questions or would like more information. In particular, we are seeking the views of the community on the following issues: 1.What should be the three to five year high level strategic objectives for each of the four areas of work? 2.What would be the specific metrics for each of the four areas of work? The comment period will close on 21 January 2010. The draft plan will be revised based on the comments received and the responses to the community survey posted earlier this month. A final version of the Strategic Plan will be submitted to the Board for approval at their February meeting.
