In order to get initial public feedback that can serve as the basis for further improvements before full implementation, the 2009 resolutions have been loaded on the wiki. Each resolution has a "work-in-progress" wiki page that provides basic information, including when it was approved, what it's about, the status of the resulting implementation actions, and links to additional information. Each wiki page contains a comment box to allow individuals to share information about the resolution and its implementation. Interested individuals are encouraged to use this wiki and provide feedback to help build a more useful service. FWIW I agree with Bill and Caroline that the motion, as it stands (or is that stood?) does NOT prevent the Council from proposing/supporting/endorsing a different process for future RTs. What it seems to me to do is to endorse a baseline/default starting point that has the benefit of being uniform, clear and resulting from the thoughtful efforts of the DT (on which all SGs were represented). I find it somewhat ironic - and perhaps a testimony to those who have mentioned elsewhere that the question of what we as Councillors are meant to do or be - that the question of whether (and to what extent) the Council is acting as a "managerial" versus a legislative top-down body in the new GNSO environment seems to be arising in various contexts recently. Regardless, I'm having a bit of a hard time believing that Councillors elected by their SGs would not do their best to fully represent that SG's interests, while respecting the role of the Council and the need for consensus among the whole ICANN community (even if this means, as is often the case, questioning or proposing amendments to motions, as happened here. I fully believe that the differences of opinion we are seeing on this issue is the result of various Councillors balancing the demands and needs of their particular SGs/constituencies with the overall effect to the community and the work of the Cou I understand that this may be more difficult - depending on the issue, for instance - for certain SGs at certain points in time. However, and in this particular context, I'm inclined to give greater weight to the deliberations and recommendations of the DT, especially as it was a broadly representative team and it remains open to us at a future date to require and/or justify a different process. In other words: where the council competences are not in question we won't have such a discussion. Determining whether the GNSO as a whole supports or opposes a particular decision on our plate would be an interesting new requirement for Council action. We could, for example, henceforth require a consultation and consensus formation on http://gnso.icann.org/mailing-lists/archives/ga-200709 before taking any action. I'm sure there are some folks there who'd like to weigh in. But in lieu of such a requirement, Council representatives act in accordance with the norms and customs of their respective communities and of the democratically elected Council. An interesting question then is whether other SGs and the Council as a whole should set aside that approach, redefine its role, and base its actions on any one SG's internal norms and dynamics. Board/GNSO/Staff dinner

Councilors, I want to give you advance warning that we are going to try something new in the Board/Staff/GNSO meeting Sunday evening. In an effort to attempt to increase the value of the session to Board members we are planning to do the following: 1. Assign discussion topics by table 2. Pre-assign Councilor and Staff members to tables 3. Give Board members the choice of topic/table on a first come, first served basis. To facilitate this, Olga, Stéphane, Glen, Gisella & I took a first crack at assigning a subset of Councilors and all of Staff to tables according to discussion topic. We tried to do this in a manner that we hope will maximize the discussion at each table. I won't try to explain all of the rationale we used but want to at least say that we tried to make sure that there are at least two Councilors at each table who are well versed in the topic and, where applicable, might have some different views on the subject. In our brief planning session tomorrow afternoon to prepare for the dinner meeting, our main focus will be to assign the remaining Councilors to tables. The attached document lists the table topics and the seat assignments we made thus far. I would hope that we won't have to make many, if any, changes to these because we probably will not have enough time to do so, but we may consider a few changes if we have time. Please review the table topics and pre-assigned seat assignments before the planning session, which is now scheduled after the New gTLD session (~ 4 pm). For those of you who are not yet assigned to a table, please identify what topics (tables) you would prefer. Note that there will be two tables each for two of the topics and that there will be two open tables where any topic may be discussed, with the intent to let Board members express their preferences. During the dinner meeting, I encourage everyone to encourage Board members to ask questions they have about the topic or to express what concerns they have about it. I fully recognize that this is a dramatic change from what we have done in the past and ask all of you to indulge your leadership team in our 'decision by committee' approach. GNSO Work Prioritization Group Discussion - June 19 in Brussels

GNSO Council Members and Liaisons: In preparation for the GNSO Work Prioritization group discussion (Step 3) scheduled for Saturday, 19 June in Brussels (1100-1300; Room 311/312), Councilors are encouraged to review the following material, in advance, so that a maximum amount of the two hours available can be devoted to the ratings discussion. I am pleased to report that, at the conclusion of Step 2 (9 June), Staff received 19 individual ratings (90% response rate) and was able to aggregate the data successfully at the Council level. Due to the variability among Councilor ratings, no projects could be exempted from the discussion; therefore, all 15 Eligible Projects will be covered during the Brussels session. If we can limit preliminaries to 15 minutes or less, that will leave 105 minutes for 15 projects or approximately 7 minutes each! In order to complete the work in that short timeframe, it will be important for all participants to be prepared and aware of time. The following material contains basic information so that these matters do not delay us during the Brussels session: Participant Preparation: * The Work Prioritization procedures (Chapter 6.0 and ANNEX <http://gnso.icann.org/drafts/wpmg-section-6-and-annex-09apr10-en.pdf> ) may be reviewed although it is not required. Each step of the process will be explained during the session (see Setup below). * The Work Prioritization Model Drafting Team (WPM-DT) learned, during its testing, that it is useful to briefly discuss each project to deepen participants’ knowledge and to establish a common level of understanding. Since time is short, it will be helpful if all participants are familiar with the 15 Eligible Projects and Descriptions <http://gnso.icann.org/drafts/work-prioritization-project-list-30apr10-en.pdf> (See Table 1 & Glossary). A printed copy of this document will be made available to each Councilor on Saturday morning. * Participants should also review the Value definition (below) and their individual ratings submitted during Step 2. Please note that the ratings, as defined by the WPM-DT, are intended to reflect perceived benefit/value to ICANN/GNSO and do not attempt to incorporate factors such as cost, difficulty, complexity, timing, or working group progress. Those concerns, among others, will be addressed subsequently when the Council begins to manage the project workload based on the Value prioritization. Definition: “Value … this factor relates to perceptions of overall value, benefit, importance, and criticality primarily for the GNSO, but also considering ICANN’s stakeholders and the global Internet community. Components of this dimension may include, but are not limited to: new opportunities for Internet growth/expansion, enhanced competitiveness, resolution/improvement of serious performance or infrastructure problems, increased security/stability, and improved user experience.“ Setup: * To take maximum advantage of the tools, everyone participating (Councilors and Liaison) should join the Adobe Connect room (URL link will be provided) which has been designed to facilitate the group discussion, polling, and recording results. * Voice communication will be handled via telephone conference for anyone not attending the session in person (details to be released by the GNSO Secretariat). * Ken Bour, a Consultant to the ICANN Policy Staff and primary support to the WPM-DT, will facilitate the session. In the interest of time, Ken will spend only a few minutes explaining how the Adobe Room is organized and making sure everyone understands how to take advantage of the tools. It will be appreciated if attendees arrive a few minutes early to complete computer setup and other logistics. Discussion Overview: * 19 participants provided individual ratings (Step 2) and those results will be displayed in the Adobe Connect room along with color-coding to show the most popular ratings as well as top/bottom 10%. A printed handout will also be provided. * There were no projects that had a Range (Highest minus Lowest Rating) less than or equal to 2, which was the minimum required to bypass the discussion; therefore, all 15 projects will be taken up during the session. * The goal of the discussion is to reach greater agreement, where possible, in the time allotted and to note cases where divergent views remain. Although simple statistics will be utilized as part of the process, there is no requirement to achieve any particular numerical value. When the group has completed discussing a particular project, whatever final ratings variability exists will be accepted and recorded. * Participants should be mindful that there is an average of 7 minutes available per project. Concise statements and brief explanations (1-2 minutes) will be appreciated in order to complete the task in the time allotted. Process Flow: There will be no more than 3 rounds of discussion and polling for each project. Round 1: As Ken introduces each project, he will start by asking the lowest and highest raters to provide brief rationale for their selections followed by group interaction. When the discussion has reached some level of perceived closure, Ken will invite all participants to vote in the Adobe room, choosing a value between 1 and 7. When everyone has voted, the poll will be closed and the results displayed (not individually identified). If the resulting Range is <= 2, the median will be calculated as the final group rating for that project. If the Range > 2, an additional round of discussion will take place by asking those furthest from the median to provide rationale. Round 2 (if needed): after another brief discussion, participants will be polled again as in Round 1. If the Range <=3, the median will be computed and accepted as the group rating. Round 3 (if needed): same process as Round 2 except that, regardless of the Range outcome, the median will be computed and accepted as the group’s final rating. Guiding Principles: * The group discussion approach is built upon the foundation that all participants come to the session willing and able, in principle, to change their understandings and ratings (as submitted in Step 2) if persuaded by rationale and learning. * During the discussion, no one should feel challenged to defend any position, rather explain his/her reasoning for the purposes of group learning and building agreement. As some of you may recall, the NOIF document is an informal expression of interest that does not require any action. The intent of this first step is simply to spur community dialogue and reaction to the proposal. The NOIF, accompanying cover letter and additional supporting documents are being posted on the GNSO Improvements web page at http://gnso.icann.org/en/improvements/newco-process-en.htm. I cannot post to the Council list, so I ask you to post my reply. I appreciate your sentiments, but I think the language is too broad and may be used by some for purposes other than which you intended. Perhaps these things do not need to go out for a “public comment” period as we normally think of those words, but there should be time to discuss with our stakeholder groups especially if it relates to policy. The fact that your proposed amendment was discussed by the NCSG prior to meeting is great for your SG, but it was never discussed with our SG and in fact, the resolution does not even really relate to the substance of string similarity. If anything, it should not have been an amendment, but rather should have been a wholly new motion and separately addressed. We need to focus on issues as a community. We need to have a cross stakeholder group list where these issues can be discussed in the open rather than being surprised at a Council meeting that one SG wants an amendment added to a motion. I will ask, as I do every year, for a new mailing list to be set up that facilitates true cross-community communication. The other issue is that when the GNSO Council sends a letter, or even the Chair sends a letter, there is an assumption and perception that the entire GNSO Community supports the substance of what has been communicated. One only needs to look at ICANN staff reports that refer to letters that have been submitted in the past to see this is the case. So, if others non-GNSO community members are going to assume that when such a letter is sent that it is supported by the GNSO community, isn’t there an obligation by the GNSO Council to make sure that it actually is. My goal is not to impede the Council, but rather to ensure the appropriate level of feedback from each of the SGs. Does that mean things may take more time? Sure. But I have yet to see any circumstance the Council has acted on that was of sufficient urgency that at least some time period of consultation could not be afforded. Thanks for your consideration. Jeff and everyone, as the person who proposed the "FURTHER RESOLVED" language in the resolution, let me explain that my intent was most definitely not to elevate the Council's role, much less to lessen the importance and input from the community that the Council represents. Although this particular resolution (and accompanying letter) dealt with an issue of huge importance to everyone, I was concerned that it could be taken in the future as an indication that everything the Council sends out to any ICANN Board/staff member, constituent or other body must necessarily first be subject to a public comment period. In other words, my thought was that the Council should not be impeded in its discussions or decisions by a "requirement" that, while not mandated by any bylaw or operating rule/procedure, becomes - through time and/or practice - a rule, especially as Council letters may concern a wide variety of topics (from coordination with other ACSOs to substantive major issues like this particular one). I fully agree that the Council not only represents the GNSO community, but must act in full consultation with it and that each Councillor ought to act in the best interests of the community he/she represents. This is especially so in the new GNSO environment, where the Council is clearly not supposed to be a legislative body but more of a management team. Finally, you may be interested to know that my addition to the resolution was discussed among, and approved by, the NCSG prior to the Council meeting. As such, it was something I proposed as a representative of the views of the community that I was elected by! I hope this clarifies matters somewhat. More specifically, at the last minute, and without any discussion by the community, the GNSO Council included the following language: “FURTHER RESOLVED, that this motion shall not serve as a precedent requiring the GNSO Council to adhere to a public comment period requirement for any future GNSO Council letters.” Not only has no explanation been given for this last minute addition, but I believe the statement is fundamentally flawed on a number of different levels. It is not the GNSO Council’s role to decide what does and does not go out for public comment when it relates to policy (as this letter clearly does). That role should be specifically reserved for the GNSO community. The GNSO Council’s authority, as documented in the Bylaws, is generated from the people and communities in which it serves. This has been said over and over again, but the Council is NOT a legislature that has the right to make proclamations, policy decisions, etc., without having to go back to the GNSO community. This is supposed to be a bottom-up organization where policy is developed through individuals, working groups, experts, etc. and then brought to the Council for it to manage, not the other way around. To the extent that any “letters” are submitted by the Council to any external party, and those letters relate to policy, then yes they do need to go out for community input. If they merely relate to administrative of true coordination matters, then they do not need to go out for comment. As one of the main catalysts for getting this letter out for public comment, I thank the Council for doing the right thing and posting this for comment. I cannot post to the Council list, so I ask you to post my reply. I appreciate your sentiments, but I think the language is too broad and may be used by some for purposes other than which you intended. Perhaps these things do not need to go out for a “public comment” period as we normally think of those words, but there should be time to discuss with our stakeholder groups especially if it relates to policy. The fact that your proposed amendment was discussed by the NCSG prior to meeting is great for your SG, but it was never discussed with our SG and in fact, the resolution does not even really relate to the substance of string similarity. If anything, it should not have been an amendment, but rather should have been a wholly new motion and separately addressed. We need to focus on issues as a community. We need to have a cross stakeholder group list where these issues can be discussed in the open rather than being surprised at a Council meeting that one SG wants an amendment added to a motion. I will ask, as I do every year, for a new mailing list to be set up that facilitates true cross-community communication. The other issue is that when the GNSO Council sends a letter, or even the Chair sends a letter, there is an assumption and perception that the entire GNSO Community supports the substance of what has been communicated. One only needs to look at ICANN staff reports that refer to letters that have been submitted in the past to see this is the case. So, if others non-GNSO community members are going to assume that when such a letter is sent that it is supported by the GNSO community, isn’t there an obligation by the GNSO Council to make sure that it actually is. My goal is not to impede the Council, but rather to ensure the appropriate level of feedback from each of the SGs. Does that mean things may take more time? Sure. I would think that the RrSG would be interested in this effort, but I also think we need to figure out how it fits overall on the priority list. I put this proposal to the ccNSO council on our call of 8 June and confirm that the council has agreed that in the event of the proposal also being agreed by the gNSO council, a small joint drafting team should work before Brussels to draft the charter for the establishment of a Working Group comprising representatives of ICANN’s Security and Stability Advisory Committee, Root Server System Advisory Committee, GAC, ALAC, CERT operators and ccTLD and gTLD managers to draw upon their collective expertise and to solicit their input on: · the broad concept of a DNS-CERT; · the current work being undertaken to mitigate DNS-related threats; · the actual level, frequency and severity of these threats; · the gaps (if any) in the current security response to DNS issues; · whether or not a DNS-CERT is a proposal they support; and · if so, the logistics of the proposal. The goal would be to have the charter approved by the ccNSO and gNSO in Brussels if possible so that we can announce the formation of the working group. I’m guessing that formally the working group will need to be a joint gNSO ccNSO group (as the 2 relevant supporting organisations that can actually make policy) with the charter mandating the involvement of the relevant ACs and outside experts. In the event that the gNSO council does approve the proposal then the action items will be a) to call for some volunteers to do the drafting along with Bart Boswinkel as ccNSO staff and an equivalent gNSO person and b) to approach the other ACs to inform them that this is occurring. I have included a sampling of some of the comments and rationale provided by various Councilors below. Note that most of these comments were reinforced by multiple Councilors and that there was overall agreement in the Council meeting for the position. Chuck General Comments · I'm not sure that an additional 2 GNSO reps will be detrimental to efficiency, and I should think it would actually add to the credibility of the process - which leaves "budgetary limitations" as the remaining (relatively unconvincing) reason. · It seems to me that the ramifications of the selectors rejecting GNSO input as to participant number are potentially significant. In particular, the irony of doing so while the accountability and transparency review is underway is pretty amazing. I think that would play pretty well (against ICANN, that is) in a number of important fora. · It'd be a lot easier if they'd just default to four across the board in order to ensure community representation and diverse skill sets at the table, rather than turning RT size into a needless source of angst. · It is perfectly reasonable to allow one seat each to the SSAC, GAC, and ASO. But I think it's totally implausible to assume a well represented RT with only two for the GNSO and one each for the ccNSO and the ALAC. I believe we make a very strong statement insisting that each of those are doubled - four for the GNSO (one for each SG, no less), two each for the ccNSO and the ALAC due to the size of their memberships. That would make the RT 14 members, and that is certainly workable and more realistic. SSR RT · All three (SSR) are already huge issues and will directly affect all the rollout and use of TLD’s, IDN_TLDs, and ccTLDs and some of the issues that could be coming would include: - Punycode storage of IDN names – Neither any human nor most existing security mechanisms (anti-virus, firewalls, etc) can read it directly. It is the main reason you need “standard script” usage. - DNSSec – Can it and should it be pushed to all TLDs? (After a demo of DNS hacks a couple weeks back, I’m not sure I will ever trust a wireless hotspot fully again.) - DNSSec – Credentials – Key distribution chains and processes, rollover mechanisms, and there will likely be some of revocation process needed for bad behavior. - DNSSec – Operational issues yet to be determined too. DNSSec generates a 30x increase in response traffic for instance plus signature processing overhead. - Network management systems likewise will likely have initial issues with IDNs too. - Increased discussions of “network cyber identity requirements” and how these might work in an IDN environment. - Routing reliability as IPv6 vastly increases the route table sizes - IPv6 reachability and initial usage rollouts. (Outside of Microsoft, I could not say that anyone on the globe has a large scale IPv6 infrastructure working yet.) - New “whois” issues that could be created by fact that more, maybe most, IPv6 addresses will be indirectly assigned through an ISP to the end user or organization rather than directly assigned via IANA and the RIRs. · From an operational point of view, with implementation of TLDs, ccTLDs, IDN_TLDs, DNSSec, and IPv6 plus the issues with route stability and huge growth in cybercrime; one could reasonably expect that many unseen/unknown operational issues will affect GNSO plans and policies. (and certainly keep the SSR busy!) · The economies and critical infrastructure (communications, power, financial, etc) of at least 50 nations around the globe are completely tied to the security, stability, and reliability of the Internet so SSR issues are considered very carefully by most governments. · The Commercial SG provides combined expertise in technical, operational and legal respect of security aspects of the DNS system. Whois RT · Whereas Internet users across the whole ICANN community are impacted by Whois policy, I don’t think there is any doubt that GNSO constituents are impacted the most. It is gTLD registrants whose data is displayed and used. It is gTLD contracted parties who are required to implement Whois and who best understand the customer service and operational issues related to Whois offerings. It is commercial gTLD registrants whose businesses are affected when IP rights are violated. It is noncommercial users who have most often pointed out the need for privacy of Whois information and noncommercial organizations that are impacted in similar ways as commercial businesses. · In addition, because of the GNSO’s long and belabored Whois policy development history and varied Whois operational offerings, the GNSO has the best source of Whois experts from various points of view. There is also good evidence that each SG provides a unique area of expertise and represents different points of view with regard to Whois policy. · Whois is one of the few areas where people who are generally like-minded can have VERY different positions. · There really has to be four for WHOIS, the perspectives of the SGs are just too variable for any two to represent the others, and the whole process could become a focal point of controversy. · I strongly oppose accepting only two seats on the Whois. New gTLDs RT · Similar arguments could be made for this future RT. Jeff, It seems to me that you should determine whether the RySG supports your concern just like Mary did with the NCSG. I, for one, think what you are proposing would impede the Council. If every time an amendment is made there needs to be comment period, where does it end? If we cannot trust our representatives with some common sense, then we have bigger problems. I appreciate your sentiments, but I think the language is too broad and may be used by some for purposes other than which you intended. Perhaps these things do not need to go out for a “public comment” period as we normally think of those words, but there should be time to discuss with our stakeholder groups especially if it relates to policy. The fact that your proposed amendment was discussed by the NCSG prior to meeting is great for your SG, but it was never discussed with our SG and in fact, the resolution does not even really relate to the substance of string similarity. If anything, it should not have been an amendment, but rather should have been a wholly new motion and separately addressed. We need to focus on issues as a community. We need to have a cross stakeholder group list where these issues can be discussed in the open rather than being surprised at a Council meeting that one SG wants an amendment added to a motion. I will ask, as I do every year, for a new mailing list to be set up that facilitates true cross-community communication. The other issue is that when the GNSO Council sends a letter, or even the Chair sends a letter, there is an assumption and perception that the entire GNSO Community supports the substance of what has been communicated. One only needs to look at ICANN staff reports that refer to letters that have been submitted in the past to see this is the case. So, if others non-GNSO community members are going to assume that when such a letter is sent that it is supported by the GNSO community, isn’t there an obligation by the GNSO Council to make sure that it actually is. My goal is not to impede the Council, but rather to ensure the appropriate level of feedback from each of the SGs. Does that mean things may take more time? Sure. But I have yet to see any circumstance the Council has acted on that was of sufficient urgency that at least some time period of consultation could not be afforded. Thanks for your consideration. Jeff and everyone, as the person who proposed the "FURTHER RESOLVED" language in the resolution, let me explain that my intent was most definitely not to elevate the Council's role, much less to lessen the importance and input from the community that the Council represents. Although this particular resolution (and accompanying letter) dealt with an issue of huge importance to everyone, I was concerned that it could be taken in the future as an indication that everything the Council sends out to any ICANN Board/staff member, constituent or other body must necessarily first be subject to a public comment period. In other words, my thought was that the Council should not be impeded in its discussions or decisions by a "requirement" that, while not mandated by any bylaw or operating rule/procedure, becomes - through time and/or practice - a rule, especially as Council letters may concern a wide variety of topics (from coordination with other ACSOs to substantive major issues like this particular one). I fully agree that the Council not only represents the GNSO community, but must act in full consultation with it and that each Councillor ought to act in the best interests of the community he/she represents. This is especially so in the new GNSO environment, where the Council is clearly not supposed to be a legislative body but more of a management team. Finally, you may be interested to know that my addition to the resolution was discussed among, and approved by, the NCSG prior to the Council meeting. As such, it was something I proposed as a representative of the views of the community that I was elected by! I hope this clarifies matters somewhat.
