Please provide comments! http://www.icann.org/en/announcements/announcement-28jun10-en.htm GNSO Council Operations Work Team and Constituency and Stakeholder Group Operations Work Team Recommendations Open: 28 June 2010 Closed: 18 July 2010 Explanation/Background: These recommendations are the product of two Work Teams (Sections A and B below) that were chartered by the GNSO's Operations Steering Committee (OSC) in March 2009 to review and recommend implementation proposals concerning certain sections of the Board's GNSO Improvements Report (3 February 2008). 1. The GNSO Council Operations Work Team was tasked with a cross-constituency effort to review the existing GNSO operating rules and procedures and to recommend changes consistent with the new GNSO Council's goal to become a strategic manager of the policy process. In June 2009, the Work Team developed a package of those recommendations, particularly those necessary to seat the new GNSO Council at the ICANN meeting in Seoul, South Korea in October 2009. The GNSO Council approved the recommendations for new GNSO Council Operating Procedures on 28 October 2009. Subsequently, the GNSO Council Operations Work Team identified additional recommendations for amending the GNSO Council Operating Procedures in accordance with the Board's GNSO Improvements Report. These additional recommendations are the subject of this announcement. In particular, the Work team completed and submitted certain documents that it recommends be incorporated into the GNSO Operating Procedures (GOP) as follows: Section 2.1-Council Member Term Limits [PDF, 132 KB] Section 2.4-Board Seat Elections [PDF, 85 KB] Section 3.8-Absences and Vacancies [PDF, 141 KB] Chapter 4.0-Voting [PDF, 297 KB] Chapter 5.0-Statements and Disclosures of Interest [PDF, 93 KB] [Note that two sections, 5.3.2 and 5.3.3, are not approved pending further Staff action to be determined. These sections are footnoted in the document as "inactive" until subsequently approved by the OSC and Council.] 2. The Constituency and Stakeholder Group Operations Work Team (CSG-WT) was tasked with developing recommendations on Constituency and Stakeholder Group participation rules, operating principles, and member databases. The Work Team divided this task into the following four subtasks: * Subtask 1: Develop recommendations for a set of participation rules and operating procedures, to which all Constituencies should abide; * Subtask 2: Develop recommendations for clear operating principles for Constituencies to ensure they function in a representative, open, transparent and democratic manner; * Subtask 3: Develop recommendations for creating and maintaining a database of all Constituency members and others not formally a part of any Constituency that is up-to-date and publicly accessible; and * Subtask 4: Develop a "toolkit" of in-kind staff support and/or services for all Constituencies. The Work Team completed the recommendations for Subtask 4 ahead of the other subtasks and submitted these recommendations separately to the OSC for review. The OSC approved the recommendations with modifications and submitted them to the GNSO Council, which voted to accept the recommendations on 17 December 2009 and staff work on implementation is underway. The consolidated recommendations on the three subtasks are detailed in the following report: Recommended Common Operating Principles and Participation Guidelines for GNSO Stakeholder Groups and Constituencies; and Recommendations on a GNSO Database of Community Members [PDF, 453 KB]. At its 23 June 2010 GNSO Council directed the Staff to post for public comment for a 21-day period the recommendations of the GNSO Council and Constituency and Stakeholder Group Operations Work Teams for public review and comment. Community members are invited to review the recommendations and comment on all aspects of the recommended procedures. The Process From Here: At the end of this Public Comment Forum period, ICANN Staff will review the comments submitted and prepare a summary analysis of the various submissions for Work Team and GNSO Council review. Thanks in advance, Chuck Gomes 6 July 2010 Ms. Heather Dryden Interim Chair ICANN Government Advisory Committee Heather.Dryden(a)ic.gc.ca Dear Heather, The GNSO Council is currently discussing which of several proposed WHOIS studies to initiate, and we would very much welcome input from the GAC as we consider this matter. As the GAC well appreciates, the Council is assessing which studies might be the most useful in providing a factual basis for further policy making on WHOIS. The FY 2011 budget which was approved by the ICANN Board in Brussels includes over $400,000 in funding for WHOIS studies. The GNSO has identified four key study areas as top priorities for consideration (combining a number of suggestions made by the GAC and others in 2008). Staff is in the process of providing a cost and feasibility analysis for all four study areas and, while not all costing information is available yet (see short descriptions and status below), we are at the stage where we hope to make some initial decisions on the first two study areas noting that more information will be forthcoming on the last two areas in the coming weeks. Following is a summary of the options we are considering. Staff's initial analysis to-date can be found here <http://gnso.icann.org/issues/whois/whois-studies-report-for-gnso-23mar1 0-en.pdf> . A chart displaying all the study options (and a cross reference to the original GAC proposals of April 2008) is attached. Please note that the first three proposed WHOIS study areas contain many elements originally suggested by the GAC. 1. WHOIS Misuse - These studies will assess the extent, nature, and impact of WHOIS public data misuse (i.e., harmful actions like spam, phishing, and identity theft taken using WHOIS contact information). Two types of studies would be conducted. One is referred to as an "experimental" study, which would register test domains and measure harmful messages resulting from misuse. The other is a "descriptive" study of misuse incidents reported by registrants, researchers, law enforcement and others. WHOIS Registrant Identification - This study will explore WHOIS data and the extent to which domains used by legal persons (commercial entities) or for commercial purposes are: 1) not clearly identified as such in WHOIS (e.g., user's identity is obscured or implies non-commercial use); and 2) will correlate that information with use of Privacy and Proxy services. Estimated cost to conduct: $150,000 USD. 3. WHOIS Privacy and Proxy Abuse -- This study will look at the extent to which domain names used to conduct illegal or harmful Internet activities are registered via Privacy and Proxy services. An RFP to solicit costs and feasibility information was published on 18 May 2010, responses from independent researchers are due by 20 July 2010. Staff analysis to follow. WHOIS Privacy and Proxy Reveal - This study will consider the degree to which Privacy and Proxy registrant reveal handling impedes timely identification of parties allegedly involved in illegal or harmful activities. Development of study terms of reference is underway and staff hopes to publish an RFP in the late-July-August time frame. Staff is also completing a separate "Inventory of WHOIS Service Requirements <http://gnso.icann.org/issues/whois/whois-service-requirements-draft-fin al-report-31may10-en.pdf> " that was also requested by the GNSO Council last year. This "study" is a technical compendium of current WHOIS service requirements and potential "requirements" that have been suggested in past policy discussions. The GNSO Council will also be discussing how this information may also be useful, and GAC input on this related report would be of value. Again, we welcome your input. Recognizing that specific studies may take a year or more to complete and that the FY11 funds are available now, the GNSO Council will be trying to identify which studies to pursue in the next month or so. Therefore, timely GAC input, if possible, would be very much appreciated. Even input from one or more individual GAC members who are especially attuned to WHOIS studies, speaking in their personal capacities, would be welcome. Today a public comment forum opens for a twenty-day period as prescribed by the ICANN by-laws. The IRTP Part B WG is looking for your input on the Initial Report and in particular on the preliminary conclusions and recommendations put forward in the report, including a proposed Expedited Transfer Reverse Policy. All those interested are encouraged to provide their input so that the WG can take these into account when finalizing its report following the closing of the public comment forum. Background The IRTP Part B Policy Development Process (PDP) is the second in a series of five PDPs that address areas for improvements in the existing Inter-Registrar Transfer Policy. The Working Group was tasked to address five issues focusing on issues related to domain hijacking, the urgent return of an inappropriately transferred name and “lock status”. The Inter-Registrar Transfer Policy (IRTP) aims to provide a straightforward procedure for domain name holders to transfer their names from one ICANN-accredited registrar to another should they wish to do so. The policy also provides standardized requirements for registrar handling of such transfer requests from domain name holders. The policy is an existing community consensus policy that was implemented in late 2004 and is now being reviewed by the GNSO. Background/Explanation: As part of its program of Organizational Reviews, ICANN has undertaken a review of the Security and Stability Advisory Committee (SSAC), whose role is to advise the ICANN community and Board on matters relating to the security and integrity of the Internet’s naming and address allocation systems. Organizational Reviews are part of ICANN’s program of continuous improvement and are intended to ensure an in-depth examination of the role and operation of key structures of ICANN, with support from external, independent professional consultants. Oversight of the Organizational Review processes is exerted by the Structural Improvements Committee (SIC), which is a standing Committee of the ICANN Board. The SIC is authorized to set up specific Working Groups for each of the Reviews. In 2009, the ICANN Board appointed an SSAC Review Working Group (WG), which engaged in extensive consultations with the SSAC community. In its final report published 29 January 2010 http://www.icann.org/en/reviews/ssac/ssac-review-wg-final-report-29jan10-en… [PDF, 282 KB], the SSAC Review WG recommended SSAC membership appointments be for a term of three years renewable by the Board at the recommendation of the SSAC Chair indefinitely, and that the terms be staggered to allow for the terms of one-third of the SSAC members to expire at the end of every year. On 12 March 2010, the Board received the SSAC final report and directed the Structural Improvements Committee (SIC) to identify actions necessary to address the recommendations within the report, at http://www.icann.org/en/minutes/resolutions-12mar10-en.htm#1.6. Article XI, Section 2(2)(b) http://www.icann.org/en/general/bylaws.htm#XI of the Bylaws states that the SSAC chair and members shall be appointed by the Board, and does not state any term for such appointments. Staff supporting the SIC have identified that a Bylaws amendment is required in order to implement the recommended change to the SSAC membership appointments, and the SIC recommended that the Board approve that proposed Bylaws amendments to this effect are posted for public comment. On 25 June 2010 the Board approved resolution 2010.06.25.04 directing the ICANN CEO to have staff draft proposed Bylaws amendments addressing the recommendations arising out of the SSAC review WG and to post the proposed amendments for public comment for a period of no less than 30 days.
