Update on timetable for staff WHOIS studies assessment

All, As you discuss which WHOIS studies to pursue, I thought it might be helpful to share my best guesstimate on the timetable for next steps with regard to the WHOIS Proxy/Privacy "Abuse" study and the WHOIS Proxy and Privacy "Reveal" study. As you know the staff has completed its analysis of two other study areas - WHOIS "Misuse" and WHOIS "Registrant Identification". Regarding the WHOIS Proxy/Privacy "Abuse" study: The deadline for responses to the RFP we issued was 20 July, and we received three responses. I will be analyzing these over the next couple of weeks and I hope to share that analysis with the Council by mid-August. Regarding the WHOIS Proxy and Privacy "Reveal" study: We are drafting the Terms of Reference now and we will be circulating this draft to the Council, hopefully within the next week. I will ask for Council feedback and any edits or changes within say, two weeks from that point. We will then incorporate those suggestions, if any, and then post the RFP by the end of August. We will allow 60 days for responses (as with the other RFPs), bringing us to November 1. Staff would then likely complete that analysis and share it with the Council by 1 December at the latest. I've updated the WHOIS studies chart accordingly for your reference. Please let me know if you have any questions, or if I can provide any further assistance to the Council as you deliberate on this matter. Best, Liz

Motion regarding WHOIS studies for 5 Aug 2010 meeting

I make the following motion for consideration at our upcoming meeting 5 August. Tim ----- Begin Motion ----- Whereas: On 23-Mar-2010, Staff presented its latest report on feasibility and cost estimates for WHOIS Studies (http://gnso.icann.org/issues/whois/whois-studies-report-for-gnso-23mar10-en…) requested by Council on 04-Mar-2009 (See Motion 3 at https://st.icann.org/gnso-council/index.cgi?04_mar_2009_motions) This report included a Staff analysis for two of the four study areas – WHOIS Misuse, and WHOIS Registrant Identification. A full Staff analysis of the feasibility and cost of the third and fourth study areas, WHOIS Privacy and Proxy Abuse and Reveal, is still outstanding: According to the above report the estimated costs of the first studies is significant, approximately $300,000 and likely significantly more once the outstanding analysis is completed. While ICANN has allocated some budget for WHOIS studies, that sum is likely insufficient to fund all proposed studies at this time. Considering such costs, the time to complete each study, and other resources involved, Council will be better able to make a fully informed decision as to which, if any, studies to pursue once the Staff analysis of all four study areas is complete and delivered to Council. Resolved: Council thanks Staff for its work so far in producing the requested analysis of these studies and requests Staff to complete its analysis as soon as practical. Council shall defer votes on any WHOIS studies until all are ready for simultaneous consideration and prioritization, when responses to RFPs for all four studies have been received and analyzed. ------ End Motion ------

This Report is intended to be a stocktaking of the policy issues regarding the introduction of Single Character IDN TLDs and some viewpoints on possible policy implementations that could address those issues. The JIG solicits input and comment from the community on these policy issues and viewpoints. The working group identifies the following policy issue area's: 1. Possible confusion with reserved single character ASCII TLD strings 2. Whether special financial considerations should be considered 3. Whether due to the relatively smaller pool of possible names that special allocation methods should be considered 4. Whether due to the relatively shorter string, it may be easier for users to make mistakes, and that special policies should be considered 5. Whether additional criteria should be introduced to qualify a Single Character IDN TLD as an IDN ccTLD or IDN gTLD 6. Background and Next Steps The ccNSO and GNSO Councils recognized there may be topics and/ or issues related to the introduction of IDN TLDs which are of common interest to both the GNSO and ccNSO, and which are preferably addressed in a collaborative effort through the GNSO and ccNSO. For that matter the Councils established a joint IDN working group. The charter of the working group can be found at: http://ccnso.icann.org/workinggroups/jiwg.htm. According to its charter the purpose of the joint working group is to identify and explore issues and topics of common interest, if any, and of relevance to both the cNSO and GNSO, report on such an identified issues to the ccNSO and GNSO Councils and propose a methodology to address the issue. To date the JIG identified the following areas of common interest: 1. Single Character IDN TLDs 2. IDN TLD Variants 3. Universal Acceptance of IDN TLDs After closure of the comment period, the working group will finalise the Initial Report taking into account the public comments and input and publish a Final Report to be submitted to the ccNSO and GNSO Councils for their consideration. During the public comment period the Working Group will continue its work on the other topics identified by the working group as of common interest to both the ccNSO and GNSO.
