All, Not sure you saw this announcement on Friday. These represent the Drafting Team's current thinking on protecting the IOC/Red Cross names at the second level which was posted on Friday. So, notwithstanding the previous posts on this list on Friday, I do not believe the Board's resolution influenced the work of the Drafting Team, but rather, it is my belief that Board members following the work of the Drafting Team were influenced by the work we on the Drafting Team were doing. We can discuss whether we believe the ICANN Board was proper in its recent resolution on the IOC/RC names, but I just wanted you to know that the Drafting Team's recommendations were not changed by the Board's resolution. Board resolution on IOC / RC

Councilors -- In reviewing the IOC/RC issue in preparation for Toronto, the Board's activity on the IOC/RC issue prompts a question I'd like the IOC/RC team to consider asking the Board. Specifically, in its recently published rationale behind the decision to not follow council advice on IOC/RC protection at the top level, the Board said it believed sufficient protections were already in place and thus there was no reason to seek a change to the guidebook. The Board, to my knowledge, has not given an opinion on whether or not existing (to be implemented) second-level protections are equally sufficient. Their language suggests an opinion of sorts, by saying: "Whereas, the Board favors a conservative approach, that restrictions on second-level registration can be lifted at a later time, but restrictions cannot be applied retroactively after domain names are registered." Though the Board says it's not seeking to influence policy work, it does seem to convey a preference in the outcome of the IOC/RC work. I find that troubling. Further, considering the difficult timing of the publication of the last set of rationale, perhaps the drafting team could ask the Board if the new gTLD committee or staff have carried out any review of second-level protections (as they did for top-level). If so making those findings known to us during deliberation would save us time and work.

Councillors, FYI. This email is more specifically meant for the two candidates for the Chair position, as on Thursday it is my hope that one of them will have been elected. If that's the case, then they may want to attend this. If no Chair has been elected, than the newly nominated Vice Chairs will be taking over the leadership positions until a new election can be held. It is therefore important that each house be in a position to inform Glen and I of their choice for Vice Chair by Wednesday in Toronto. Let me also take this opportunity to inform the Council that, although technically Chair until the end of the Toronto meeting, I will of course not be expecting to continue Chairing after the first meeting of the new Council on Wednesday (the one where we will hold the Chair election). I would therefore expect the new Chair, or the Vice Chairs if no Chair is elected, to lead the Council's Thursday wrap-up session. In any event, the new position I am moving on to will require me to be in another meeting on Thursday.
