Dear Council Members, As we discussed over the weekend sessions, I have taken helpful suggestions from John Berard, Steve DelBianco and Avri Doria and revised the motion as follows. The additions are the 4th and 5th Whereas clauses, which are new, and Sections 3(b) and (d) of the Resolution section, which also are new. I also have taken Avri’s suggestion that we not obligate the Council as a whole to discuss this, and I have changed "new committee of the whole” in Section 1 to simply “new committee of the Council.” We can certainly all opt in to that Committee if we wish, but it won’t be obligatory. I look forward to discussing this issue in our meeting on Wednesday. Bret — START MOTION — Whereas, in 2005, this Council of the Generic Names Supporting Organization (GNSO) began a policy development process to consider the introduction of new gTLDs, which resulted in the creation of certain policy recommendations for the launch of a new gTLD application process; and, Whereas, in September 2007, this Council adopted the policy recommendations from the GNSO policy development process and forwarded them to the ICANN Board of Directors; and, Whereas, in June 2008, the ICANN Board adopted the GNSO's policy recommendations for the introduction of new gTLDs and directed staff to develop an implementation plan for a new gTLD introduction process; and Whereas, in September 2009, ICANN and the U.S. National Telecommunications Information Administration entered into an Affirmation of Commitments (“AOC”) in which ICANN committed to organize a review of certain aspects of the introduction and expansion of gTLDs (AOC, at Section 9.3); and, Whereas, in its April, 2011 Communique, ICANN’s Governmental Advisory Committee (“GAC”) asked (at p.6) for a "comprehensive post-launch independent review of the [Trademark] Clearinghouse [to] be conducted one year after the launch of the 75th new gTLD in the round;” and, Whereas, in June 2011, the ICANN Board approved an Application Guidebook ("AGB") for new gTLDs and authorized the launch of the New gTLD Program; and, Whereas, the AGB provided that it was intended to govern "the first round of what is to be an ongoing process for the introduction of new TLDs" (Application, Module 2); and, Whereas, Section 1.1.6 of the AGB ("Subsequent Application Rounds") provided that "ICANN’s goal [was] to launch subsequent gTLD application rounds as quickly as possible" and promised to base the timing of subsequent rounds on "experiences gained and changes required after this round is completed" with a "goal...for the next application round to begin within one year of the close of the application submission period for the initial round.;" and Whereas, the first round application submission period closed in June, 2012; and, Whereas, the Council believes that it has a continuing interest and role to play in evaluating the experiences of the first found and proposing policy recommendations, if necessary, for changes to subsequent rounds; Now therefore, it is resolved: 1. The GNSO Council creates a new committee of the Council to discuss the experiences gained by the first round of new gTLD applications and identify subjects for future issue reports, if any, that might lead to changes or adjustments for subsequent application rounds; and, 2. ICANN invites the New gTLD Program Committee of the ICANN Board to provide input into the GNSO Council discussion to identify areas that it believes may be appropriate for discussion for an evaluation of the current gTLD application round and/or for possible adjustments for subsequent application rounds; and, 3. The GNSO Council requests a status report from ICANN Staff on the current progress of (a) the New gTLD program generally; (b) ICANN's anticipated timeline and work plan for the review specified in Section 9.3 of the Affirmation of Commitments; (c) ICANN's work to date on any evaluation of the first round; (d) the work to date on the post-launch independent review of the Trademark Clearinghouse; and (e) ICANN's current projection for a timetable for subsequent rounds. — END MOTION —

He has indicated that it may be particularly helpful to try to have at least a short face-to-face meeting while many people are here in London to that end, he is hoping that a number of interested GNSO participants will be available on Monday 23 June from 3.15-4 p.m. London time. Based on conversations to date, we anticipate that the ALAC and SSAC will join this effort and we sincerely hope that the ICANN's other supporting organizations and advisory committees will also respond positively to this initiative. The final draft charter will be presented to at least each of the organizations participating in this effort for their adoption, according to each organization's own rules and procedures. Taking into account the principles outlined by the NTIA in its announcement, we believe such a cross community working group, with participation from and supported by the ICANN community as well as other organizations, is the most appropriate way to develop a proposal for a transition plan. Initial work by some members of the community resulted in a first draft straw-man document, which is included here as an annex. We believe this may help the drafting team in its efforts, but it is by no means intended to prescribe, limit or restrict conversations, though it is worth noting that some elements contained in the document align with the current thinking of some ccNSO and GNSO members. We anticipate that any final draft should address at a minimum: - Purpose and Scope (what is in and what is out of scope) - Goals and objectives - Deliverables - Timeline - Proposed approach (how is the WG expected to conduct its work, reporting to chartering organizations) - Relationship with Coordination Group as proposed by ICANN (see <https://www.icann.org/resources/pages/process-next-steps-2014-06-06-en> https://www.icann.org/resources/pages/process-next-steps-2014-06-06-en) - Membership / sponsorship (should membership be limited, open to anyone interested?) - Sponsorship / chartering organizations (should sponsorship be restricted to ICANN structures or also extend to external organizations?) - Staffing / support needed - Rules of engagement - Decision-making methodology (how are decisions made in the WG and how are these reflected in the recommendations) - Process for review / adoption of proposal by chartering organizations (also addressing what would happen if one of the chartering organizations would not adopt the proposal) - Closure of the WG In order to be able to complete the drafting of the charter and share it with the different organizations for consideration in a timely manner, we would ask that each participating organization assign a maximum of 4 representatives to the drafting team. To facilitate the work of the drafting team at its initial stages, we are both available to serve as interim chairs of the charter drafting team, if that is deemed to be helpful, and for as long as the drafting team would like us to. Although the ICANN London meeting is very close, we recognize the value of meeting face-to-face. Therefore we would like to organize an informal meeting of the drafting team during the London ICANN meeting and as such have identified Monday 23 June 2014, 17h00 UTC (18h00 London) as a possible option to do so. Regarding time of the Board with the community

Hello All, On the topic of time the board spends on its own versus with the community. Generally on the weekend we do work within Board committees, and some work as a Board workshop. The workload in these committees/workshops has increased quite a bit in recent years - e.g work reviewing the ATRT 2 recommendations, work on reviewing the budget, work on reconsideration requests, work on responding to GAC advice etc. We try to get much of this done at Board retreats etc - but to be timely we also spend the weekend on it at the ICANN public meetings. During the week we mostly attend meetings with the various stakeholders at ICANN - GAC, ALAC, GNSO, RSSAC, SSAC, etc., and we attend the public sessions on Monday. We do take some time on Wednesday afternoon to prepare for the Board meeting and public forum on Thursday. We used to work into the night during the week - often 2 or 3am in the morning - which tends to lead to bad decisions. Now we don't tend to work in the evenings - and make an effort to attend the various social functions to interact with the community. So we have probably moved to get a bit more work done during the day and interact a bit more with the community in the evenings. It would perhaps be helpful to think whether we can better use the time we do allocate to the GNSO. Currently it is most of Tuesday and an hour on Sunday - as a whole Board, and Bill Graham and I also attend additional meetings with Stakeholder groups. I have been feeling for some time that there is a lot of repetition between these forums - particularly on Tuesday - so maybe we could think of better ways of structuring that day - especially to get substantive input on the content of proposed policies and procedures. Apart from some discussion of IDNs - I don't think we discussed any actual content today for example. Regards, Bruce Tonkin
