Mary Wong:This is just an except from the most relevant and recent GAC advice. There has been a consistent theme of GAC advice on this topic dating back to 2012 or 2013. Mary Wong:*excerpt Mary Wong:The GAC also provided comments to the Initial Report, as did quite a few IGOs. There was also the IGO Small Group Proposal that the Board referred to the WG in late 2016. I quickly read the report when it came out, but do not remember. Mary Wong:@Avri, not specifically. Typically these are documented during the WG meetings where the advice and comments were addressed. Mary Wong:But there is a section in the Final Report that summarizes how the WG considered the GAC advice and Small Group Proposal. Avri Doria:ok, thanks Marie Pattullo:We of course need to give due weight to GAC advice, but it is unfortunate that the small group chose to work in parallel and not favour integration with the WG. Keith Drazek (RySG):Was the "small group" dynamic a potential process concern? Rubens Kuhl - RySG:I will float a suggestion that even I am not fully convinced, but as an starting point. Rafik Dammak:we cannot prevent the GAC having small groups but that doesnt seem enabling them to participate in PDP directly Heather Forrest:Indeed, thanks Mary -the history is that this PDP is the result of a previous PDP recommending its formation Rubens Kuhl - RySG:For the council to consider that Rec.5 decision process, considering the 3.7 requests and minority statements, might be tainted; so, to replace the Rec.5 decision from its original options, using a vote. Regardless of GAC advice or not, only looking at substance. Keith Drazek (RySG):Thanks Mary, that's helpful context. Marie Pattullo:Agree Rafik and we'd never want to try to shut down any discussion - but it would help us all to have more integration before we get to the final recommendations stage. Rubens Kuhl - RySG:While it's unfortunate that those recs might go against GAC advice, this shouldn't be a factor for council's decision. Heather Forrest:Facilitated dialogue I believe was Copenhagen and it resulted in the reopening of RC Mary Wong:@Heather, yes Mary Wong:The Small Group Proposal was sent to the GNSO in Oct or Nov 2016, so it was able to be considered before the Initial REport was finalized for public comment. Keith Drazek (RySG):Thanks Donna, much appreciated. Mary Wong:I've pasted the GAC advice relating to the Small Group Proposal and the WG in the Notes pod on the right. Donna Austin, RySG:I agree with Heather: Continued participation in any PDP WG is challenging becuase of the length of time these efforts take. Julf Helsingius:And most GAC members don't engage between ICANN meetings Avri Doria:Mary, was recommendation III done. IS the results of this also considered in the report? GNSO Council meeting with the Board at ICANN63 -urgent call for objections

Dear Council colleagues, I put out a call for questions for the Board some time ago and got no response. Leadership has given this quite a bit of thought, and particularly referred back to the ideas Rafik raised in our Strategic Planning Session back in January about moving away from a they ask-we ask type setup. In the meantime, I received the agenda for the SO/AC Chairs' workshop which falls on the Friday before ICANN63 begins, and it contains the following discussion item: How should ICANN's multi stakeholder model of governance and Policy Development Process evolve to balance the increasing need for inclusivity, accountability and transparency, with the imperative of getting our work done and our policies developed in a more effective and timely manner, and with the efficient utilization of ICANN’s resources? Donna, Rafik and I propose to you all that we spend our time with the Board workshopping this question - it would be interesting to hear their perspective, and we have much to bring to the table in this discussion from Council's perspective. We're very late behind the deadline because this one got buried in my inbox (which looks like a natural disaster as ICANN63 bears down, so apologies if you've emailed me and haven't yet received a response) so I'll ask for a quick call for objections. Please refer to this page for the recent status updates on the Action items. ACTION ITEMS FROM THE GNSO COUNCIL MEETING 27 SEPTEMBER 2018 Item 2. Opening Remarks / Review of Projects & Action Items List Action Items: * IFR Team - ICANN staff to check on timeline for seating review team, after which GNSO would be responsible for selecting a GNSO co-chair from amongst the GNSO members. Give the SSC a heads up that they may be asked to conduct a selection process. * SubPro/RPMs Consolidated Timeline - ICANN staff to schedule informal liaisons and Chairs discussion at ICANN63. * SubPro/RPMs Consolidated Timeline - ICANN staff to arrange for a prep call between respective leadership teams and Council liaisons. * Strategic Planning Session (SPS) Action Items - Council leadership to take stock of action items and determine what is completed, unrealistic to achieve, etc. Item 3: Consent Agenda Voting Results: * Motion passed unanimously by voice vote. Action items: * Customer Standing Committee (CSC) Effectiveness Review - GNSO Secretariat to notify ICANN Org no later than 30 September that the GNSO has approved of the method of review the and GNSO representatives for CSC Effectiveness Review, specifically Donna Austin and Philippe Fouquart. * Approval of the Members and Liaisons of the Customer Standing Committee (CSC) - GNSO Secretariat to notify ICANN Org no later than 30 September that the GNSO has approved the full list of CSC liaisons and members (which can be found here: https://community.icann.org/x/IxlpBQ) Item 4: COUNCIL VOTE – Approval of the CCWG-Accountability WS2 Final Report Voting Results: * Motion passed unanimously by voice vote. Action items: * GNSO Secretariat to share the results of this motion with the Chairs of the CCWG-Accountability as soon as possible. * Council leadership to draft communication which emphasizes that the GNSO Council expresses its sincere appreciation to the CCWG-Accountability, the GNSO members and participants in that effort, and especially the GNSO-appointed Chair, Thomas Rickert, for all their hard work in achieving the delivery of the WS2 Final Report and Recommendations. Item 5: COUNCIL VOTE – Adoption of the Final Report on the Protections for Certain Red Cross Names in All gTLDs Policy Amendment Process Voting Results: * Motion passed unanimously by voice vote (with one vote received via absentee ballot). Action Items: * ICANN staff to prepare a Recommendations Report for delivery to the ICANN Board in accordance with the process outlined in the ICANN Bylaws. * Council leadership to draft communication which emphasizes that the GNSO Council expresses its sincere appreciation to the Reconvened PDP Working Group and its members, the International Red Cross and Red Crescent Movement the PDP WG Chair, Thomas Rickert, for all their hard work in achieving the delivery of the Final Report and Recommendations. Item 6: COUNCIL UPDATE – new gTLD Auction Proceeds CCWG Action Items: * None Item 7: COUNCIL UPDATE – Temporary Specification for Registration Data Expedited Policy Development Process - Recurring Update Action Items: * None Item 8: Any Other Business Action Items: * ICANN63 Planning - ICANN staff and Keith Drazek to select a restaurant for the Council’s informal get together. * 8.2.2 - ATRT3 - SSC instructed to consider next steps for selections for the ATRT3, which could include re-confirming members, seeking additional volunteers, or other options as needed. Next steps could be dependent upon the SSC’s assessment of the overall makeup of GNSO volunteers. * 8.2.3 - Fellowship Program - ICANN staff to initiate call for volunteers, based on requirements from PRS (target post-ICANN63) and SSC to subsequently conduct selection process. Next steps for the IGO-INGO Curative Rights Protection Mechanisms PDP WG Final Report - ICANN staff to schedule webinar for questions and answers.
