Item 4: COUNCIL DISCUSSION - EPDP Phase 2A Final Report (35 minutes) On 21 October 2020, the GNSO Council approved the initiation <https://gnso.icann.org/en/council/resolutions/2020-current#20201021> of EPDP Phase 2A, to examine the topics of legal/natural and feasibility of unique contacts. In doing so, the Council required that the GNSO Council Liaison to the EPDP report back to the GNSO Council on the status of deliberations. Accordingly, status updates were regularly provided to the GNSO Council over the course of the EPDP Phase 2A’s deliberations. The EPDP Team published its Initial Report for public comment<https://www.icann.org/public-comments/epdp-phase-2a-initial-report-2021-06-…> on 3 June 2021, which included preliminary recommendations as well as questions for community input. The EPDP Team delivered its Phase 2A Final Report to the GNSO Council on 3 September 2021, which was updated on 13 September 2021 with the minority statements incorporated into the Final Report The GNSO Council will receive a presentation on the Final Report, to better prepare the Council for a vote during the October meeting. While this agenda item is for discussion only, a draft motion<https://community.icann.org/x/_gBmCg> was circulated to the GNSO Council on 13 September 2021 for discussion purposes. The Council will also consider the proposal contained in the Final Report, which recommends that the Council follow current and future legislative developments which may require further policy work. Here, the GNSO Council will receive a presentation, as well as discuss the Final Report and the draft motion. 4.1 – Introduction of topic (Philippe Fouquart, GNSO Council liaison to EPDP Phase 2A) 4.2 – Presentation on the Final Report 4.3 – Council discussion 4.4 – Next steps Item 5: COUNCIL DISCUSSION - GDS Update on the Framework for the Policy Status Report Framework on the UDRP (30 minutes) On 21 January 2021, the GNSO Council approved the recommendations from the Phase 1 Final Report of the GNSO Policy Development Process (PDP) on the Review of All Rights Protection Mechanisms (RPMs) in All gTLDs, covering RPMs applicable to gTLDs launched under the 2012 New gTLD Program. The Council has discussed the need to review the RPMs charter in advance of launching Phase 2 of the PDP, which is focused on the UDRP. Council leadership had considered the best path forward to initiating this work and shared their thoughts<https://gnso.icann.org/sites/default/files/file/field-file-attach/rpms-pdp-…> for advancing this effort on 13 July 2021, which considers a Policy Status Report (PSR) as a possible next step. The Council discussed the approach during its July meeting and agreed that ICANN org should consider how to conduct the PSR and return to the Council to present their proposed framework for the PSR, in advance of initiating the actual work. ICANN org shared a presentation on 13 September 2021. Here, the Council will receive a presentation and consider whether it agrees with the proposed approach for the PSR. 5.1 – Introduction of topic (Council leadership) 5.2 – Presentation (Antonietta Mangiocotti - ICANN org) 5.3 – Council discussion 5.4 – Next steps Item 6: COUNCIL DISCUSSION - CCWG-Accountability WS2 Implementation - Next Steps for the GNSO Council (15 Minutes) On 7 November 2019, the ICANN Board adopted<https://features.icann.org/ccwg-accountability-ws2-%E2%80%93-final-report> all of the consensus recommendations contained within the WS2 Final Report<https://www.icann.org/en/system/files/files/ccwg-acct-ws2-final-27mar18-en.…>. As part of the resolved clauses, ICANN Org was directed to begin implementation of those recommendations, in accordance with the WS2 Implementation Assessment Report<https://community.icann.org/display/WEIA/Public+Documents?preview=/12081960…>. In 2020, the GNSO Council sought to get ahead of impending work it will eventually be asked to undertake for the implementation of WS2. GNSO liaison to the GAC - Proposed updates

Dear Councilors, As you may recall, Council leadership took as an action item to develop proposed language to further clarify the role and expectations in relation to the GNSO Council Liaison to the GAC from the perspective of the Council. Based on the input received during the different discussions, you will find attached our proposed updates. As a reminder, the original document describing the role and responsibilities of the GNSO Liaison to the GAC was developed by the GAC-GNSO Consultation Group many years ago (2014) and used to launch the first call for applications to fill the role of GNSO Liaison to the GAC. Throughout the years, several updates were made, for example, to reflect that the SSC has been assigned the responsibility to review the applications, the change from F2F to virtual meetings and the requirement to provide an annual report to the Council. These updates and some further proposed updates have also been reflected in the form of redline changes in the attached. However, we would like to request you to focus your attention on the changes highlighted in yellow, which, per the Council's discussion, aim to further clarify the Council's expectations with regard to the Liaison's responsibility and interaction with the Council. Leadership has also suggested some updates to the renewal section to bring it more in line with other appointments. As this does not affect the Liaison's responsibilities towards the GAC, we don't anticipate a formal consultation with the GAC is necessary about these changes, but as part of ongoing conversations with the GAC leadership, we will update our GAC counterpart accordingly. Please share any feedback or suggestions you may have via the mailing list by 5 September 2021. Hopefully we can resolve and address any comments or suggestions you may have online so that we can formally accept this updated version at one of our September Council meeting. Call for Expressions of Interest: Chair of EPDP-Internationalized Domain Names

Dear Councilors, As you may recall, the GNSO Council was responsible for running an Expressions of Interest (EOI) process to identify and select Edmon Chung as chair for the EPDP on Internationalized Domain Names. With Edmon having been appointed to the ICANN Board of Directors and taking up his seat at the upcoming AGM, he will step down as chair of the EPDP on IDNs. As such, a new Expressions of Interest process was just announced today <https://www.icann.org/en/announcements/details/call-for-expressions-of-inte…> to identify the new chair of the EPDP on IDNs. If you’re able to share this information with your respective SG/Cs, it would be appreciated. The EPDP team will also be informed of the opening of this EOI process.
