You can review these in redline format in the attached document. If you have any suggestions or concerns about these proposed additions, please share these with the Council mailing list by 23 December at the latest. Council Small Team - SubPro ODA

Dear Councilors, During the 15 December 2022 Council meeting, you all agreed to initiate a small team<https://community.icann.org/display/gnsocouncilmeetings/2022-2023+GNSO+Coun…> to review the SubPro ODA<https://www.icann.org/en/system/files/files/subpro-oda-12dec22-en.pdf>. From the Council meeting, we have Jeff Neuman, Anne Aikman-Scalese, Thomas Rickert, and Susan Payne as volunteers for this effort. If any other Councilors (or liaisons) would like to join the small team, please let us know at gnso-secs(a)icann.org<mailto:gnso-secs@icann.org>. We are still in the process of identifying a workable time for this small team to meet. Staff, in consultation with leadership, took the liberty of putting together a draft assignment form<https://community.icann.org/download/attachments/215288194/Small%20Team%20A…> to help guide the work of the small team. While the development of an assignment form is now usual practice for small teams, it is particularly important in this case. Given the short period of time to be able to review the lengthy ODA, have the small team agree on draft input to ICANN Board, allow time for that draft input to be communicated to the Council, and finally deliver it to the Board by ~19 January, the task needs to be as tightly scoped as possible. You will see that the assignment form suggests that Councilors should read the ODA by early January and provides 4 suggested areas for focus when reviewing the ODA (note, these 4 areas of focus are inspired by the SSAD ODA review process). The assignment form also includes a Google doc (and attached as Word for Anne) to help collect any areas of input based on the 4 areas of focus. For your input: Draft Survey for SSAD ODP Liaison + Small Team - due 13 January 2023

Dear Councilors, In Sebastien’s email of 25 October<https://mm.icann.org/pipermail/council/2022-October/026146.html>, he outlined several PDP improvements that Council Leadership recommended moving forward with. Included in improvement #9, GNSO Support Staff had an action item to “develop a straightforward survey that can be used to solicit input from the GNSO Council liaison to the SSAD ODP as well as the small team that was tasked to review the ODP to document its findings so that these can be shared when the review takes place after the second ODP completes.” We have developed a draft survey and wanted to share it with you for your input: https://docs.google.com/document/d/1sRmdYtwCslKMeZb5QKTzGsVfae0xYZQY/edit?u…. There is no need to review this survey right away, of course, but we wanted to share it with you when it was ready. Changes to the GNSO Standing Committee on ICANN Budget and Operations (SCBO)

Sent on behalf of Sebastien Ducos Dear Council and SG/C Chairs, I am writing to announce a change to the GNSO Council’s Standing Standing Committee on ICANN Budget and Operations (SCBO). You will likely recall the email I sent on 16 November, which itself followed a joint GNSO Council & SC/G Chairs call on 26 October where this change was first discussed. After seeking input from all of you, it seems that there is support to pursue the change to the SCBO, which at a high level will convert it from a Council-specific standing committee to a GNSO-wide forum to discuss the ICANN budget. As I’ve previously communicated, Council leadership believes this is a positive change that will support broader and more consistent understanding of the ICANN budget across the GNSO, as well as streamline our communications with ICANN Finance. Accordingly, the Council and SG/Cs should all be better prepared to draft any public comments they are considering submitting. Beyond announcing this change, there are two specific items where I require your assistance. 1. While the previous SCBO was limited to just Council members and GNSO subject matter experts, any GNSO members are invited to join the mailing list and any meetings scheduled. If you or any of your members would like to be added to the mailing list, please contact gnso-secs(a)icann.org<mailto:gnso-secs@icann.org>. 2. For those already subscribed to the mailing list, you will see that a meeting was scheduled for Monday, 09 January 2023 at 21:00 UTC. The rationale for targeting this week is because it is just prior to the deadline to submit clarifying questions to ICANN Finance. Please communicate this timing to any interested members. The meeting invite will be circulated to any new members that are added to the mailing list. Please let me know if you have any questions. We continue to think this is the right path for the SCBO and certainly welcome feedback after this budget cycle. Informs the candidates and the SSC that the GNSO Council has approved the SSC leadership team and 2. Thanks Arinola Akinyemi and Alan Woods for volunteering to serve on the SSC leadership team. * Confirmation of the Council Committee for Overseeing and Implementing Continuous Improvement (CCOICI) Chair and GNSO Council representative to the WS2 Community Coordination Group Action Items: On behalf of the GNSO Council, the ICANN org support staff thanks Olga Cavalli for her service and Manju Chen for volunteering to serve as the Chair of the CCOICI and as the GNSO Council representative to the WS2 Community Coordination Group (CCG) and requests her to report back to the GNSO Council on a regular basis on the status of the CCG’s deliberations. Hi Anne, Thanks for these questions. The intent of paragraph 5 is say that a successful candidate should have enough experience with various sectors of the Internet ecosystem to be able to evaluate the applications in the ICANN context. The list of areas in the Internet ecosystem that may be relevant is brought over from the Fellowship Selection Committee webpage<https://www.icann.org/resources/pages/fellowship-selection-committee>. I’ve clarified with Org colleagues supporting the Fellowship Program that “I* entities” include organizations such as ISOC, the IETF, and the IAB, in addition to ICANN. I don’t believe that there is any restriction on the ability of a Nom Com appointee to Council from applying, as long as they meet the other criteria. I hope this is helpful. The SSC will be meeting early next week to go over the assignment from Council, and we can discuss any further questions there, as well. The Council received a briefing from the former Chair of the CCOICI during its November meeting. Given concerns about capacity, along with the general perception that no known issues have presented themselves, the Council agreed in November 2020 to delay the request for the Policy Status Report (PSR) that had been identified by the Action Decision Radar as requiring consideration; the deferral was for a period of 24 months, necessitating consideration November 2022. In July 2022, the Council agreed that it would be helpful to check with the registrars and ICANN Compliance to help determine if there are any known issues or concerns with either of the two Expiration Policies which could warrant requesting a PSR. A report from Contractual Compliance<https://mm.icann.org/pipermail/council/2022-November/026164.html> was shared with the Council on 1 November 2022 and feedback from the registrars has been shared in the past on previous Council calls. The Council received a briefing on the report from ICANN Compliance and the Council briefly considered potential next steps. One suggestion may be to task a Councilor member to review the report from Contractual Compliance in detail and determine if any of the issues raised warrant further work at present. That analysis will help inform the Council overall and allow the Council to formally record its determination as appropriate. The ODP Team has shared numerous updates to the community and sent several sets of assumptions/questions to the GNSO Council via the Council’s liaison to the ODP. ICANN org is expected to publish the SubPro Operational Design Assessment (ODA) on 12 December. In advance of publication of the ODA, the Council will receive a briefing during a webinar on 7 December. While it is unlikely that there is adequate time for Councilors to have reviewed the ODA in detail, there may be initial impressions from council-specific webinar. The ICANN org staff that supported the SubPro Operational Design Phase (ODP) will be available to answer questions and engage in dialogue. This message is in regards to the latter. During the call, Council leadership described the proposed path forward, which at a very high level, is to evolve the SCBO away from its limited focus on drafting public comments on behalf of the GNSO Council, towards a central forum for all of the GNSO more broadly to be able to interface with ICANN finance and gather information and ask questions as needed. What is important to note is that this new central forum would NOT be responsible for drafting a singular public comment on behalf of the GNSO; the GNSO Council and SG/Cs would retain the ability to submit individual public comments, as they do now. Council leadership believes that evolving the SCBO in this manner will meet the needs of both the GNSO Council and GNSO more broadly. Attached, you will find a brief write-up that explains the current state of the SCBO, issues that we have observed with that current state, and then a more detailed description of how we envision the SCBO evolving. We ask that if you have any concerns, please share them with this list by 30 November 2022. If there are no objections with this approach, we believe it can be put in place as early as the FY24 ICANN Budget & Operating Plan public comment period. Dear Council Members, Please find this motion to be added to the agenda for our 15 December meeting. Motion to confirm CCOICI Chair and GNSO Council representative to the WS2 Community Coordination Group Submitted by: Sebastien Ducos Seconded by: WHEREAS, 1. The GNSO Council initiated the GNSO Framework for Continuous Improvement Pilot Project on 16 June 2021; 2. As part of this Framework, a Council Committee for Overseeing and Implementing Continuous Improvement (CCOICI) was established; 3. The previous chair of the CCOICI, Olga Cavalli had to step down from her role as Chair as well as GNSO Council representative to the WS2 Community Coordination Group (CCG) following her departure from the GNSO Council. RESOLVED, 1. The GNSO Council confirms Manju Chen as the Chair of the CCOICI. 2. The GNSO Council confirms that Manju Chen will serve as the GNSO Council representative to the WS2 Community Coordination Group (CCG) and requests her to report back to the GNSO Council on a regular basis on the status of the CCG’s deliberations. 3. The GNSO Council thanks Olga Cavalli for her service and Manju Chen for volunteering to take on this role.
