RySG Comment to Council Draft letter to Board

Dear Council Leadership: The RySG has reviewed the proposed letter to the ICANN Board regarding the Board rejection of the IPC Auction Proceeds Request for Reconsideration and appreciates the work of the collaborative small team that put it together. After consideration and discussion, the RySG respectfully suggests that the letter might have a better chance of achieving its desired effect if it is somewhat refocussed and simplified. For example, the Council case is not about the merits of the reconsideration request, as the Board has already agreed to pursue a Bylaws change. Therefore, we could remove substantive references to the auction proceeds model as those references serve to distract from our key point about the Board’s response to the reconsideration request. We also think that the Board is unlikely to issue a statement as requested by the letter. The Board will likely receive advice that it should not make a statement. In any case, such a statement would put an end to the discussion without dealing with the matter at hand. Instead, we believe the letter should explain why the Board response was possibly problematic, state that the Council is concerned about what this means for future reconsideration requests, and seek to place this topic on the agenda for its meeting with the Board in Istanbul. As this is a matter that could affect other SOs and ACs, it may also be appropriate for the Council to suggest that it be added to the agenda of the SO, AC and SG teams that are meeting with the Board prior to the ICANN meeting in Istanbul. We hope you accept this input in the constructive nature intended as we share the goal of the drafters to have a constructive and iterative discussion on this topic with the Board to ensure a mutual understanding of concerns. Deadlines Not Later Than: Activity Commences: 9 May 2024 Summer ICANN Meeting and/or dependency on new travel deadlines Announce Proposed Procedure and Timeline 12 JULY 2024 (ICANN81 funded traveler name submission deadline) T – 60 Days and/or dependency on new travel deadlines NomCom Selectees Announced SG/C New Council Members Announced House Nominee Selection 14 October 2024 T – 30 Days Houses Submit Nominees 26 October 2024 T – 18 Days Candidates Submit Statements 10 November 2024 T – 3 Days Candidate Meetings 13 November 2024 T Election Held at Annual General Meeting 15 November 2024 T + 2 Days Council informs the Board & Community and posts election results on the GNSO website Traditionally the timeline is built in keeping with GNSO Operating Procedures guidelines, but with the funded traveler submission deadline now being 120 days prior to the meeting (instead of 90 days), we have had to adapt the first two steps of the timeline. This now fits in with the 12 July 2024 as submission deadline for funded traveler names for ICANN81. Kindly find my draft below: From: The ICANN GNSO Council To: The ICANN Board Dear Tripti, We write in response to your letter asking for input on new gTLD Applicant Support Program<https://newgtldprogram.icann.org/en/application-rounds/round2/asp> (ASP) use of $5M in Auction proceeds. It is our understanding that the ICANN Board and Org. seek a workaround to provide adequate funding to kick off the Applicant Support Program prior to the commencement of the next round of New gTLD application round. The GNSO Council support this intervention as we believe it is not in variance with advise previously provided the board through the Applicant Support Program GGP process, and we also believe this would enhance the success of the ASP such that a repeat of the challenges identified with the previous round would be avoided. It is our understanding also that by this action, meaningful support would be provided for up to 45 new gTLD applicants or an anticipated full support for at least half that number of applicants.
