According to Annex 6, the winning candidate must achieve more than 50% of the vote in one SG and at least 50% in the other (Minimum Vote). Based on that we have met the Minimum Vote requirement. Follow up on billing contact discussion

Dear Council, Based on our discussion of the Billing Contact in our last call, Council Leadership resolved to: 1. Provide additional clarification. 2. Outline possible paths forward. We also think this topic is well suited for one of our working sessions at ICANN82 because we may need additional time to sort out the issues. Below is a summary of the issue and possible paths forward. Summary The EPDP Phase 1 WG<https://community.icann.org/display/EOTSFGRD/Phase+1+-+archived+-01+April+2…> (WG) was tasked with determining which contact data must be collected and processed. The Billing Contact was specifically identified in the Charter for the EPDP WG<https://gnso.icann.org/sites/default/files/file/field-file-attach/temp-spec…> along with Registrant, Tech, and Admin contacts. The WG was asked "What data should registrars be required to collect for each of the following contacts: Registrant, Tech, Admin, Billing?" In response the EPDP WG produced a table of required and optional data items where the Billing Contact is not included. It is also worth noting that in practice, payment (billing) data is unrelated to the registration data Billing Contact at issue. Payment (billing) data is collected by registrars at an account level, and accounts have the ability to register domains with different registrant data. Based on this, the Implementation Review Team (IRT) for this WG determined that the Billing Contact data was within scope for the WG, and that the intent of the WG was to remove the requirement for registrars to collect the Billing Contact. The IRT determined the absence of a specific provision on this point is a drafting error. Having received this feedback from the IRT, ICANN org reached out to the Council for further guidance. Specifically, if ICANN org were to follow the IRT's guidance that the absence of a policy recommendation on billing contact is a drafting error, this would ultimately amount to a change to the RAA without a clear policy recommendation confirming this intent. When this determination was brought to Council, several councilors noted procedural discomfort with the idea that the Council could provide guidance that would result in a change to an existing provision in the RAA without a clear corresponding policy recommendation. Possible Paths Forward: 1. A motion agreeing with the IRT determination but making it very clear that this will not serve as a precedent of superseding other contractual or policy obligations. 2. A new PDP on this subject 3. Acknowledgement that this work should be brought up in a subsequent PDP, but suggesting a compliance deferral until this work is started. Thanks, Greg

Dear Councilors, We ran out of time to discuss the 2025 Strategic Planning Session (SPS) Outcomes (Agenda Item 8) during the last Council meeting, so we have moved this item to the list. What is this about? Approximately one month ago, many of us were together in chilly Washington, DC, and during our final session, we reviewed a short, bulleted list of outcomes from the SPS. Support Staff took the short list and added some detail to these outcomes and action items. Following Council review, Support Staff will produce a more detailed SPS Outcomes Report and develop a more detailed plan, including identifying volunteers, to begin work on these outcomes and actions. What am I being asked to do now? Councilors are asked to perform a quick review the SPS Outcomes List and confirm if the outcomes and actions were captured correctly. We realize this is a busy time as we head into ICANN82, so there will be more time for thorough review once the draft Outcomes Report is distributed. We are sharing ahead of the announcement deadline in order to allow for more flexible election scheduling. Deadlines Not Later Than: Activity Commences: 25 February 2025 Summer ICANN Meeting and/or dependency on new travel deadlines Announce Proposed Procedure and Timeline 27 June 2025 (ICANN84 funded traveler name submission deadline) T – 60 Days and/or dependency on new travel deadlines NomCom Selectees Announced SG/C New Council Members Announced House Nominee Selection 29 September 2025 T – 30 Days Houses Submit Nominees 11 October 2025 T – 18 Days Candidates Submit Statements 26 October 2025 T – 3 Days Candidate Meetings 29 October 2025 T Election Held at Annual General Meeting 31 October 2025 T + 2 Days Council informs the Board & Community and posts election results on the GNSO website Traditionally the timeline is built in keeping with GNSO Operating Procedures guidelines, but with the funded traveler submission deadline now being 120 days prior to the meeting (instead of 90 days), we have had to adapt the first two steps of the timeline. This now fits in with the 27 June 2025 as submission deadline for funded traveler names for ICANN84. The remaining steps however are in keeping with the GNSO Operating Procedures, counting back from the election date. Please let me know if you have any questions. As a reminder, the objective of this PDP WG is to determine the limited circumstances in which a base ASCII gTLD and the Latin script diacritic version of the gTLD can be simultaneously delegated.
