At its meeting on 2 October 2007, the ccNSO Council resolved to call for an Issue Report to examine the need for a Policy Development Process (ccPDP) to consider: 1. Whether Article IX of the ICANN bylaws applies to IDN ccTLDs associated with the ISO 3166-1 two letter codes, and if it does not then to establish if Article IX should apply. 2. Whether the ccNSO should launch a PDP to develop the policy for the selection and delegation of IDN ccTLDs associated with the ISO 3166-1 two-letter codes. The Council requested that, in preparing the Issue Report, the Issue Manager identify policies, procedures, and/or by-laws that should be reviewed and, as necessary revised, in connection with the development and implementation of any IDN ccTLD policy. The Council, also at the 2 October meeting, appointed Bart Boswinkel as Issue Manager by the ccNSO Council, responsible for producing the Issue Report. The ccNSO Council has asked Bart Boswinkel to consider, in preparing the Issue Report and in proposing a time line for conducting each stage of the ccPDP, the joint ccNSO GAC Issues Paper, the technical limitations and requirements including the IDNA Guidelines, and any other matters that the Issue Manager considers to be of relevance, which includes the intermediate results and final outcome of the work of the IDNC Working Group (“fast track approach”). To identify matters that are potentially relevant to the Issues Report, a comment period will open on 19 December 2007 and close on 25 January 2008. Comments can be submitted via email and will be archived for public review. The email address for comments and link to the archive will be published at the opening of the comment period. Hi, The attached document is the draft produced by the small drafting team set up for that purpose. This is not on the agenda for 20 Dec, but rather for 3 Jan. In the meantime we can discuss it on the list and can revise it as necessary before the meeting. At this point I see a few alternative actions: - After revisions and discussions by the council it is sent to the Board - After discssions and a decsion on the 6th, it is sent back to the drafting team for further work. - After discussion by the council we decide to do somethig ther en send this to the Board. Note: One line in the draft says that this has the agreement of the council. that phrase is [bracketed with a note] as it is obviously not (yet) the case. WHOIS study template for GNSO consideration

GNSO Councilors, Attached please find a draft template for your consideration, developed by our subgroup, that can be used to suggest studies on WHOIS. Once reviewed and approved by the Council, this template will be used to solicit ideas for studies of WHOIS from GNSO councilors, constituencies and from the SOs and ACs. It can also be posted to solicit public comments following Council approval. Pending Council approval of the template, the design team may also continue on with the next step of defining a few studies using that template, and passing those on to other ICANN groups that might be interested in contributing ideas for studies. I suggest it be changed to the following: "Any proposal approved by the council will then be sent to ICANN staff for preparing cost estimates." It may be that staff would need to request bids but I don't think we should tie there hands if they can do cost estimates without asking for bids. Also, organizations are not always highly motivated to provide bids if there is a high degree of uncertainty that a study would actually be approved. Revised WHOIS National Laws Procedure posted

GNSO Councilors: ICANN has posted a notice of implementation of the revised ICANN Procedure for Handling WHOIS Conflicts with Privacy Law (http://www.icann.org/announcements/announcement-18dec07.htm) The procedure will be posted for 30 days and is planned for implementation in January 2008. The revised procedure incorporates the advice from the GAC received during the ICANN meeting in Los Angeles, http://gac.icann.org/web/communiques/gac29com.pdf) A copy of the revised procedure is attached, courtesy of Patrick Jones, showing the modifications from the previous draft procedure highlighted in yellow.
