Time for Council meetings on 17 January and 31 January 2008

Dear Councillors, The Council representative's time zone spread is such that there is always an unfriendly hour for some. If one considered that meetings should not start later than midnight and earlier than 5:00 am and 22:00 UTC were a time that would accommodate the extremes, could we be sure that the affected council members would participate? Hotel locations in Delhi

There is a Google map with hotel locations at http://delhi.icann.org/hotels, but you should note that several hotels are in the wrong place. Specifically, the meeting venue is not several miles away from the ITC Maurya (where Glen said she had a GNSO block of rooms), but it is just down the street from the Maurya. 'New Delhi, similar to other international cities in high season, is expensive' said Paul Levins, Executive Officer and Vice President Corporate Affairs. ICANN and the meeting local hosts have worked to achieve lower rates for participants. 'This negotiation has taken some time, but we are now holding rooms at negotiated rates. These rates are still high, ranging from US$354 to over US$400, but they are cheaper than the published rates' he said. Unfortunately many of these cheaper rates can be held for a short period of time only given the demand for rooms in New Delhi. If rooms are not booked by ICANN participants, they will then be released to the general public. There are presently many rooms available in the ICANN block at The Metropolitan (US$354), Le Meridien (US$379) and The Grand Hotel (US$418) see http://del.icann.org 'If you plan on attending then you should book now to take advantage of these lower rates' Mr Levins said. The schedule of events for the New Delhi meeting is currently being developed and will be posted on the meeting website on 15 January 2008. Each year ICANN holds three meetings in different regions around the world. In carrying out their responsibilities to fill Seats 9 through 14, the Supporting Organizations shall seek to ensure that the ICANN Board is composed of members that in the aggregate display diversity in geography, culture, skills, experience, and perspective, by applying the criteria set forth in Section 3 of this Article. At any given time, no two Directors selected by a Supporting Organization shall be citizens of the same country or of countries located in the same Geographic Region. Bylaws Article VI, section 2.3, requires that "no two Directors selected by a Supporting Organization shall be citizens of the same country or of countries located in the same Geographic Region." Since Bruce Tonkin is a citizen of the Asia/Australia/Pacific region, and holds Board seat 13, the GNSO may not select another Director from that region. The GNSO is free to select a citizen of any of the four other regions, since each region will continue to have at least one Director per region and no region could have more than five as a result of the GNSO's pending selection. Section 4. ADDITIONAL QUALIFICATIONS 1. Notwithstanding anything herein to the contrary, no official of a national government or a multinational entity established by treaty or other agreement between national governments may serve as a Director. As used herein, the term "official" means a person (i) who holds an elective governmental office or (ii) who is employed by such government or multinational entity and whose primary function with such government or entity is to develop or influence governmental or public policies. 2. No person who serves in any capacity (including as a liaison) on any Supporting Organization Council shall simultaneously serve as a Director or liaison to the Board. If such a person accepts a nomination to be considered for selection by the Supporting Organization Council to be a Director, the person shall not, following such nomination, participate in any discussion of, or vote by, the Supporting Organization Council relating to the selection of Directors by the Council, until the Council has selected the full complement of Directors it is responsible for selecting. In the event that a person serving in any capacity on a Supporting Organization Council accepts a nomination to be considered for selection as a Director, the constituency group or other group or entity that selected the person may select a replacement for purposes of the Council's selection process. 3. Persons serving in any capacity on the Nominating Committee shall be ineligible for selection to positions on the Board as provided by Article VII, Section 8. Section 5. INTERNATIONAL REPRESENTATION In order to ensure broad international representation on the Board, the selection of Directors by the Nominating Committee and each Supporting Organization shall comply with all applicable diversity provisions of these Bylaws or of any Memorandum of Understanding referred to in these Bylaws concerning the Supporting Organization. One intent of these diversity provisions is to ensure that at all times each Geographic Region shall have at least one Director, and at all times no region shall have more than five Directors on the Board (not including the President). As used in these Bylaws, each of the following is considered to be a "Geographic Region": Europe; Asia/Australia/Pacific; Latin America/Caribbean islands; Africa; and North America. The specific countries included in each Geographic Region shall be determined by the Board, and this Section shall be reviewed by the Board from time to time (but at least every three years) to determine whether any change is appropriate, taking account of the evolution of the Internet. Only GNSO Council members may nominate, second and vote for candidates, although GNSO Council members should consult with their constituencies with regard to suitable candidates. ICANN Releases Its Submission to the Midterm Review of the Joint Project Agreement

The submission’s main point is that the conclusion of the JPA would be a further step in the transition envisioned since ICANN was established — one of moving the Domain Name System to private-sector co-ordination. "Ending the JPA will provide long-term stability and security for a model that works," stated Chairman Peter Dengate Thrush in the ICANN Board submission. "It will provide confidence to all participants that the investment of time, thought and energy for over nine years has secured an Internet coordination body that will always be owned by all stakeholders, not managed or overseen by any one entity." The U.S. Government has been committed to the transition of the DNS to the private sector since 1998. Over this time there have been seven Memorandums of Understanding between ICANN and the USG, and 13 status reports measuring ICANN’s progress. The submission also states that the completion of the JPA will clearly signal that JPA and the MOUs before it have been successful. "This success should be commemorated," Dengate Thrush stated in the Board’s submission. ICANN’s Board is encouraging the Internet Community to take part in the Midterm Review before the 15 February 2008 deadline for submissions. If you continue to believe, in full transition of the domain name system to the private sector, and in an Internet that is co-ordinated not controlled, now is the time to say so and be a part of the next step in that transition.
