Next Council Meeting 17 December 2020 - Sub Pro WG Status & Proposed New Timeline

All, Below is new timeline proposed by the Sub Pro Leadership. In my opinion, these new proposed extensions are quite reasonable and realistic. They allow the discussion of the Final Report during the GNSO Council Meeting in January. Leadership expects the Council will have 1) the consensus designation prior to the Document Deadline for the January meeting (which is 11 January), and 2) the minority reports (If any) before the January meeting itself. The plan is to present this for a vote during the February Council Meeting. If asked for, we may consider to organize a more in-depth discussion of the report after our January Council Meeting, before the vote in February. Let me remind that the Draft Final Report was published last Summer out for comment. It was the result of 5 years of discussions. I have witnessed that Sub Pro Leadership has been providing the Working Group with several drafts. The Working Group members have been given an opportunity to comment and their comments have been shared among the participating members. The latest drafts contain minor clean ups. I add my personal gratitude to Staff. Without their relentless support, this was impossible to achieve. The new timeline is a positive response to people asking for more time. The timeline will give them extra days to express support/non-support for the report. It will also add an extra 10 days for the minority report(s). For the purpose of contributing to the security, stability and resilience of the DNS, Member States shall ensure that TLD registries and the entities providing domain name registration services for the TLD shall collect and maintain accurate and complete domain name registration data in a dedicated database facility with due diligence subject to Union data protection law as regards data which are personal data. 2. Member States shall ensure that the databases of domain name registration data referred to in paragraph 1 contain relevant information to identify and contact the holders of the domain names and the points of contact administering the domain names under the TLDs. 3. Member States shall ensure that the TLD registries and the entities providing domain name registration services for the TLD have policies and procedures in place to ensure that the databases include accurate and complete information. Member States shall ensure that such policies and procedures are made publicly available. 4. Member States shall ensure that the TLD registries and the entities providing domain name registration services for the TLD publish, without undue delay after the registration of a domain name, domain registration data which are not personal data. 5. Member States shall ensure that the TLD registries and the entities providing domain name registration services for the TLD provide access to specific domain name registration data upon lawful and duly justified requests of legitimate access seekers, in compliance with Union data protection law. Member States shall ensure that the TLD registries and the entities providing domain name registration services for the TLD reply without undue delay to all requests for access. Member States shall ensure that policies and procedures to disclose such data are made publicly available. Once the NIS2 Directive proposal is agreed upon and consequently adopted, Member States will have to transpose it within 18 months. Dear Councilors, As an action item of our Council call, we agreed to discuss with leaders of the GNSO SGs and Cs regarding potentially delaying the upcoming GNSO3 Review until the ATRT3 recommendations are implemented and tentatively agreed to develop a response to Marteen's letter<https://www.icann.org/en/system/files/correspondence/botterman-to-gnso-coun…> on this topic. Council leadership met with SG/C leaders on 25 Nov and agreed that the SG/Cs should of course provide their own input, but the Council as a part of the GNSO community, will also provide comment. The attached is a draft response letter in that spirit. It's hopefully quite straightforward and given that it's consistent with the approach taken by the SGs/Cs, I hope you won't mind a deadline by the end of the week for any comment you might have. Hello Berry, I think that the planning PDFs for the 17DEC2020 might contain some dates not fitting the real planning for SubPro PDP (Also it might affect the colour codes of the project). Of course we could always be wrong, but we will do our best. > i. We know that is not a lot of time. However, given that we have had a draft final report, comments to the draft final report, extensive discussions of those comments of the draft final report, and you have seen several redlines already, we believe that if you disagree with the way the group is heading, you should pretty much know that now. There is no reason to wait until the designations of levels of support to start drafting. In fact, I am told that the ALAC has already been working on a minority report to certain topics for some time now. Bottom Line – you can start working on any minority report now.
