Dear Councilors, Under agenda item 7 of the 14 April 2022 GNSO Council meeting, it was agreed that we would seek additional volunteers to participate in the Council small team focused on closed generics. You will recall that this group currently has a relatively small number of team members (three Councilors, the GNSO liaison to the GAC, and the ALAC liaison to the GNSO). Now that Council has provided an initial response<https://gnso.icann.org/sites/default/files/policy/2022/correspondence/fouqu…> to the Board that it is willing to pursue next steps on a facilitated dialogue, the expanded small group will work to provide suggestions to Council about how the proposed facilitated dialogue could be carried out, namely the conditions, parameters, and methodology for the dialogue, including potential desired attributes for a facilitator. These small team suggestions are intended to form the basis for initial discussions with the GAC to identify a mutually agreeable foundation for the facilitated dialogue. Phillipe, I see no harm in including the following sentence that Manju suggests: “While the Council is willing to pursue these next steps, it is important to note that Non-Commercial Stakeholders Group expressed its opposition to the approach.” I also believe there is no harm in linking to the NCSG’s letter such that they do not believe they have to deal directly with the Board on this. The content at the link is clearly branded NCSG and I don’t think any Board member will believe that what the NCSG has to say in its letter is coming from the Council given the context of the Council’s letter and the branding of the NCSG’s letter. We can’t be in the business of editing C’s & SG’s communications, but we should be in the business of noting them and passing them along in a way that is distinct from the Council’s own voice. With all respect and personal affection, the only significant objection to this link has come from the Council’s liaison to the GAC. We have sitting Councilors asking for it and, I hope my memory is correct, no sitting Councilors objecting to it (sorry if I got that wrong, but I can say with certainty that there is no overwhelming surge against including the link). Can we please deescalate all of this by including the link as originally requested? It can be hyperlinked to “expressed its opposition” in the proposed sentence above. I understand the word is commonly used in governmental settings but we needn't adopt the custom if it is not clarifying or helpful. Slightly more seriously, when we meet among ourselves and with the GAC, we should all understand the target and "modalities" seems too broad. It would be helpful for me (maybe it is just me) to replace the word with commonly spoken terms or to parenthetically define it. GNSO PDP Improvements - Tracking and Coordination - Discussion Paper

Dear All, As discussed during the ICANN73 wrap up, a number of parallel conversations have emerged that have highlighted that following PDP3.0, there may be other aspects of the PDP for which improvements could be considered. In addition, there are a number of projects on the Council’s Action Decision Radar (ADR) related to PDP improvements which will need to be addressed at some point in the future. To provide the Council with a clear picture of these different parallel initiatives and projects, and to avoid overlap and ensure complementarity, the staff support team developed the attached paper. In addition to an overview of the different initiatives and projects, the paper also suggests a possible approach for managing these different initiatives by focusing on 1) which aspects could be implemented without much further work, 2) which aspects could be implemented with some work, 3) which aspects need careful planning and consideration before these can be implemented. Going forward, progress on these different initiatives could be tracked through a PDP improvements tracker to ensure oversight and forward planning can factor in these developments. A discussion item will be added to the May Council meeting to obtain your input but of course, feel free to share any comments or suggestions you may have with the list in advance of that meeting. I for one have a great deal of sympathy with the idea that GAC advice should not restart policy work in the GNSO, but rather the Board needs to figure out how to implement (via IRT) both the completed policy Recommendations and the GAC advice in the next version of the Applicant Guidebook (like they did with much of the GAC advice that rolled in after the policy work was done for the first round). Hopefully something will come out of this dialogue that helps in that process. As for the letter itself, I think we could just as easily say “Dear Board, of course we are happy to talk with the GAC about their concerns. We will reach out to them and get it set up.” But, we do like our letters here in ICANNland, so my marked up version (based off the last version sent by Philippe) is attached. If we are going to frame the issues, instead of just a quick “we are on it” response, I think a tiny bit of more detail of how we got here makes sense. Hopefully my proposed changes (which are in red on my screen) will be viewed as friendly amendments, which is the spirit in which they are offered. Thank all! As Justine states, there are some mischaracterizations in that letter and as far as I am aware the rest of the Council does not agree with the opinions expressed by the NCSG. If you include the NCSG letter, would you consider adding letters from the other SGs and Cs that are in support of the meeting? I believe the best way is to note the NCSG’s disagreement, but not attach anything. And with respect to the word “modalities”, it is an unnecessary word. A “modality” is a condition is it not? Council leadership has proposed that we use this opportunity to incorporate some of the improvements into the EPDP SCRP IGO WGSA as a “soft launch” of the updates. This pilot would provide an opportunity for the CCOICI to incorporate any further changes based on the feedback received before the updates are finalized. As mentioned during our meeting, Council has not yet officially approved the CCOICI recommendations. A public comment period will be first held on the proposed updates to the Operating Procedures associated with the CCOICI report along with outputs of the SOI Task Force. CCOICI has completed one of its assignments <https://gnso.icann.org/en/council/resolutions/2020-current#202203> from the Council regarding the WS2 Implementation, which is to rank WS2 Recommendation 1 (Diversity), Recommendation 2.3 (Standalone Framework for Exercising Empowered Community Powers), and Recommendation 3 (Human Rights Framework) based on priority levels from GNSO Council’s perspective. The result may help inform the Community Coordination Group (CCG)’s consideration for the sequence of work. CCOICI members conducted a poll for ranking the three WS2 recommendations and below is the result: - Recommendation 1 (Diversity) is deemed to have the highest priority, - Recommendation 3 (Human Rights Framework) medium priority, and - Recommendation 2.3 (Standalone Framework for Exercising Empowered Community Powers) lowest priority As the GNSO Council Representative at the CCG, I have shared this priority ranking result that the CCG should tackle Recommendation 1 first, Recommendation 3 next, and Recommendation 2.3 last. It does not conflict with the preliminary agreement by the CCG to begin discussions with Recommendation 1.1 (Diversity Elements). Dear all, Even though ICANN74 is the very first iteration of a hybrid meeting, the aim is for councilors on-site in the Hague to be able to convene for a traditional GNSO Council dinner on Monday 13 June 2022, at the end of Day 1. As a reminder, this is an informal gathering for councilors to be able to get to know each other. Each councilor pays for their own meal, menu prices will be communicated ahead of time. Sebastien Ducos has very kindly accepted to take on the role of Council dinner sponsor and will therefore find a venue, and take care of organizing the event. The dinner will be held close to the World Forum, a very short cab ride away at the most. Dear Councilors, Please find the action items, as stated during the meeting, below arising from the GNSO Council meeting held on Thursday 14 April 2022. Please take note of the action items coming out of the Council meeting and the proposed timing for delivering on these actions. GNSO COUNCIL MEETING April 14 2022 Item 4: COUNCIL DISCUSSION - Small Team Reviewing the System for Standardized Access/Disclosure (SSAD) Operational Design Assessment Preliminary Draft Report Action Items: GNSO Council leadership to draft a letter to the ICANN Board of Directors for review by the GNSO Council on the review of the SSAD ODA in which it would: 1. Share the EPDP Phase 2 small team preliminary report (with the necessary caveats); 2. Recommend pausing consideration of the SSAD recommendations for now; 3. Request ICANN org to proceed with the design of “SSAD Light,” but make clear that a final decision on whether to proceed or not would need to be taken once further information is available with respect to costs, details and timing of implementing “SSAD Light.” Item 7: COUNCIL DISCUSSION - Closed Generics Small Team Update Action Items: 1. The GNSO Council to expand the Closed Generics Small Team with additional GNSO councilors for greater representativeness, and task the Small Team with determining whether it should be extended to the ALAC, and with developing the formal proposed conditions for that dialogue. 2. The GNSO Council leadership to indicate to the ICANN Board of Directors the GNSO Council’s willingness to have a facilitated dialogue, subject to agreement on the conditions and modalities for the dialogue. Item 8: ANY OTHER BUSINESS 8.2 - Council expertise survey reminder Action Items: Councilors are reminded to complete the expertise survey. 8.3 - Working Group Self-Assessment - EPDP on Specific Curative Rights Protections for IGOs - Proposed pilot of updated questions recommended by the CCOICI Action Items: Council leadership to follow up on the GNSO Council list by 15 April and give until 22 April for any objections to the suggested approach to be raised by Councilors on the list.
