I appreciate the GNSO Council considering the opportunity for me to participate in the CCWG-Accountability F2F in person. As you know, it's much more effective and useful to participate in meetings like this in person, rather than remotely. I understand the question was raised whether the recipient of this slot should seek to represent the GNSO as a whole, rather than their SG or C. On the one hand, it would be a little odd to change my perspective for this meeting alone, since this is part of an ongoing process that I've been involved in for 10 months. On the other hand, I've always tried to take a broad, pragmatic, multistakeholder-oriented view of the CCWG's work and my participation in it. I think I've generally pulled in the same direction as other GNSO participants, and we've all worked hard together to keep the CCWG moving forward. Working toward consensus is the hallmark of effective WG participation, and it's a goal I strive for in my participation. That said, I am going redouble my efforts to work with my fellow GNSO CCWG participants, and to heed their concerns, both at the F2F and otherwise -- not merely because I am in a "GNSO-funded" seat, but because we are at a critical time in the CCWG. We need to pull together to achieve consensus, resolve issues and bring a final report to the chartering organizations and the community. In that spirit, I am wide open to input and feedback from both GNSO Council members and GNSO CCWG participants (and the GNSO community generally) about the important issues before us in the CCWG and how best to resolve them for our common good. All, ICANN has offered to support one traveller per chartering organisation in addition to the currently sponsored travel slots (primarily for members of the CCWG). We do not have a simple process or mechanism to deal with this, especially in such a tight time frame. Currently, Carlos (a GNSO Council member and participant in the CCWG) has volunteered to attend and take up this option. Accordingly, please be aware of this offer and communicate any objections or concerns you may have. Also, if you are aware of an active CCWG participant from within your SG who could make effective (for the benefit of the GNSO) use of such funding, please check their availability and make the name known. If more than one candidate emerges, we may need to undertake some form of vote. Thanks Jonathan

Several Councilors have raised questions about the scope and timing of the Paper on the Council mailing list. Here the Council will receive an overview of the contents of the Paper as well as expected next steps, and discuss any possible Council or GNSO action in response, including the possibility of requesting an extension to the public comment period (currently scheduled to close on 18 October 2015). 6.1 - Presentation (Marika Konings) 6.2 - Council discussion 6.3 - Next steps Item 7: COUNCIL DISCUSSION - Final Report of the Independent Examiner on GNSO Review (20 minutes) As part of ICANN's Bylaws-mandated periodic review of its structures, the ICANN Board's Structural Improvements Committee appointed Westlake Governance as the independent examiner to conduct the current review of the performance and operations of the GNSO. A GNSO Working Party, chaired by former Councillor Jennifer Wolfe and comprising representatives of all the GNSO's Stakeholder Groups and Constituencies, was formed to consult with Westlake over the design and conduct of the review. Westlake's Draft Report was published<https://www.icann.org/public-comments/gnso-review-draft-2015-06-01-en> for public comment on 1 June 2015 (closing on 31 July). Following feedback received, including from the GNSO Working Party, Westlake is expected to publish its Final Report<https://www.icann.org/en/system/files/files/gnso-review-final-15sep15-en.pdf> in mid-September. Here the Council will receive an overview of the main recommendations made by Westlake in its Final Report, and discuss the possible implementation of some or all of these recommendations. 7.1 - Presentation (Jennifer Wolfe) 7.2 - Council discussion 7.3 - Next steps Item 8: UPDATE & DISCUSSION - Cross Community Working Group on Enhancing ICANN Accountability (20 minutes) In the course of discussions over the IANA stewardship transition, the community had raised concerns about ICANN's accountability, given ICANN's historical contractual relationship with the United States government. The community discussions indicated that existing ICANN accountability mechanisms do not yet meet some stakeholders' expectations. Considering that the US Government (through the NTIA) has stressed that it expects community consensus on the transition, this gap between the current situation and stakeholder expectations needed to be addressed. This resulted in the creation<http://gnso.icann.org/en/drafts/enhancing-accountability-charter-03nov14-en…> of a Cross Community Working Group on Enhancing ICANN Accountability (CCWG-Accountability<https://community.icann.org/x/ogDxAg>) of which the GNSO is a chartering organization. On 3 August, the CCWG-Accountability published<https://www.icann.org/public-comments/ccwg-accountability-2015-08-03-en> its Second Draft Proposal for public comment. This second proposal included significant changes made by the CCWG to its initial proposal, focusing on outstanding issues, further details on Work Stream 1 and revisions arising from feedback received in the first public comment consultation period. The public comment period closed on 12 September. Here the Council will receive an update on the work of the CCWG, in view of the public comments received, and discuss any specific issues that need to be addressed in view of the timeline of the CCWG and the connection between its work and the IANA stewardship transition. 8.1 - Update (Thomas Rickert) 8.2 - Council discussion 8.3 - Next steps Item 9: COUNCIL DISCUSSION - New ICANN Meeting Strategy (10 minutes) On 14 July 2015 the GNSO Chair had sent a letter<http://gnso.icann.org/en/correspondence/robinson-to-crocker-14jul15-en.pdf> to the ICANN Board, informing them of the GNSO's progress in developing and adapting community plans to conform to the new ICANN meeting strategy, particularly in relation to the new format for Meeting B. The GNSO's current draft plan<http://gnso.icann.org/en/drafts/gnso-council-proposal-new-meeting-strategy-…> has also been shared with other ICANN Supporting Organizations and Advisory Committees, each of which have also begun planning for the new meeting strategy within their communities. Here the Council will discuss any additional actions it may wish to take to ensure that its planning is coordinated with that of the Board's as well as the other SOs and ACs. 9.1 - Update (Volker Greimann / Marika Konings) 9.2 - Council discussion 9.3 - Next steps Item 10: Any Other Business (5 minutes) ___________________________________________ Appendix 1: GNSO Council Voting Thresholds (ICANN Bylaws, Article X, Section 3) 9. Except as otherwise specified in these Bylaws, Annex A hereto, or the GNSO Operating Procedures, the default threshold to pass a GNSO Council motion or other voting action requires a simple majority vote of each House. The voting thresholds described below shall apply to the following GNSO actions: a. Create an Issues Report: requires an affirmative vote of more than one-fourth (1/4) vote of each House or majority of one House. b. Initiate a Policy Development Process ("PDP") Within Scope (as described in Annex A<http://www.icann.org/en/about/governance/bylaws#AnnexA>): requires an affirmative vote of more than one-third (1/3) of each House or more than two-thirds (2/3) of one House. c. Initiate a PDP Not Within Scope: requires an affirmative vote of GNSO Supermajority. d. Approve a PDP Team Charter for a PDP Within Scope: requires an affirmative vote of more than one-third (1/3) of each House or more than two-thirds (2/3) of one House. e. Approve a PDP Team Charter for a PDP Not Within Scope: requires an affirmative vote of a GNSO Supermajority. f. Changes to an Approved PDP Team Charter: For any PDP Team Charter approved under d. or e. above, the GNSO Council may approve an amendment to the Charter through a simple majority vote of each House. g. Terminate a PDP: Once initiated, and prior to the publication of a Final Report, the GNSO Council may terminate a PDP only for significant cause, upon a motion that passes with a GNSO Supermajority Vote in favor of termination. h. Approve a PDP Recommendation Without a GNSO Supermajority: requires an affirmative vote of a majority of each House and further requires that one GNSO Council member representative of at least 3 of the 4 Stakeholder Groups supports the Recommendation. i. Approve a PDP Recommendation With a GNSO Supermajority: requires an affirmative vote of a GNSO Supermajority, j. Approve a PDP Recommendation Imposing New Obligations on Certain Contracting Parties: where an ICANN contract provision specifies that "a two-thirds vote of the council" demonstrates the presence of a consensus, the GNSO Supermajority vote threshold will have to be met or exceeded. k. Modification of Approved PDP Recommendation: Prior to Final Approval by the ICANN Board, an Approved PDP Recommendation may be modified or amended by the GNSO Council with a GNSO Supermajority vote. l. A "GNSO Supermajority" shall mean: (a) two-thirds (2/3) of the Council members of each House, or (b) three-fourths (3/4) of one House and a majority of the other House." Appendix 2: Absentee Voting Procedures (GNSO Operating Procedures 4.4<http://gnso.icann.org/council/gnso-operating-procedures-22sep11-en.pdf>) 4.4.1 Applicability Absentee voting is permitted for the following limited number of Council motions or measures. a. Initiate a Policy Development Process (PDP); b. Approve a PDP recommendation; c. Recommend amendments to the GNSO Operating Procedures (GOP) or ICANN Bylaws; d. Fill a Council position open for election. 4.4.2 Absentee ballots, when permitted, must be submitted within the announced time limit, which shall be 72 hours from the meeting's adjournment. In exceptional circumstances, announced at the time of the vote, the Chair may reduce this time to 24 hours or extend the time to 7 calendar days, provided such amendment is verbally confirmed by all Vice-Chairs present. 4.4.3 The GNSO Secretariat will administer, record, and tabulate absentee votes according to these procedures and will provide reasonable means for transmitting and authenticating absentee ballots, which could include voting by telephone, e- mail, web-based interface, or other technologies as may become available. 4.4.4 Absentee balloting does not affect quorum requirements. There are probably a few other criteria to consider aa well - posts, leadership positions and the like - and based on all of them I reached out to Greg Shatan and was happy to learn he would be willing to go. His 83% attendance record is close to the top and only begins to measure how active and valuable Greg has been in and to the CCWG. On the legal sub team, for example, where we both served Greg put in many hours, as all of us did, early in the process, sometimes attending 3-4 calls per day. Given the issues expected to be on the table in L.A. I think Greg's legal expertise would also be valuable. We have lots of excellent names on the table - I like and admire James, Carlos and Phil - but in terms of who most deserves to be there based upon past participation and who has the best skill set for this particular Meeting I think it would be hard to beat Greg. Of course, I'd welcome additional names to consider - it's been a long process and I might have forgotten someone. It strikes me that we cannot evaluate these on subjective criteria e.g. a motivation statement from the candidate. One (and perhaps the only) objective criterion that we could apply is participation in the CCWG to date. Logs of participation are recorded and so we have the data. This session is particularly timely given the Council's discussion at its last meeting of the relevance of public interest considerations in its work for subsequent rounds of the New gTLD Program on the issue of exclusive registry access for generic strings. 5.1 - Update (Nora Abusitta) 5.2 - Discussion/Q&A 5.3 - Next steps Item 6: UPDATE & DISCUSSION - Discussion Paper on New gTLD Auction Proceeds (20 minutes) On 8 September 2015 ICANN published<https://www.icann.org/public-comments/new-gtld-auction-proceeds-2015-09-08-…> for public comment, a Discussion Paper on the proceeds from ICANN-conducted auctions for contested new generic Top-Level Domain (gTLD) strings. The Paper calls for broad, open and inclusive public comment and encourages participation from all sectors, regions and levels (or no level) of engagement with the ICANN community. Several Councilors have raised questions about the scope and timing of the Paper on the Council mailing list. Here the Council will receive an overview of the contents of the Paper as well as expected next steps, and discuss any possible Council or GNSO action in response, including the possibility of requesting an extension to the public comment period (currently scheduled to close on 18 October 2015). 6.1 - Presentation (Marika Konings) 6.2 - Council discussion 6.3 - Next steps Item 7: COUNCIL DISCUSSION - Final Report of the Independent Examiner on GNSO Review (20 minutes) As part of ICANN's Bylaws-mandated periodic review of its structures, the ICANN Board's Structural Improvements Committee appointed Westlake Governance as the independent examiner to conduct the current review of the performance and operations of the GNSO. A GNSO Working Party, chaired by former Councillor Jennifer Wolfe and comprising representatives of all the GNSO's Stakeholder Groups and Constituencies, was formed to consult with Westlake over the design and conduct of the review. Westlake's Draft Report was published<https://www.icann.org/public-comments/gnso-review-draft-2015-06-01-en> for public comment on 1 June 2015 (closing on 31 July). Following feedback received, including from the GNSO Working Party, Westlake is expected to publish its Final Report<https://www.icann.org/en/system/files/files/gnso-review-final-15sep15-en.pdf> in mid-September. Here the Council will receive an overview of the main recommendations made by Westlake in its Final Report, and discuss the possible implementation of some or all of these recommendations. 7.1 - Presentation (Jennifer Wolfe) 7.2 - Council discussion 7.3 - Next steps Item 8: UPDATE & DISCUSSION - Cross Community Working Group on Enhancing ICANN Accountability (20 minutes) In the course of discussions over the IANA stewardship transition, the community had raised concerns about ICANN's accountability, given ICANN's historical contractual relationship with the United States government. The community discussions indicated that existing ICANN accountability mechanisms do not yet meet some stakeholders' expectations. Considering that the US Government (through the NTIA) has stressed that it expects community consensus on the transition, this gap between the current situation and stakeholder expectations needed to be addressed. This resulted in the creation<http://gnso.icann.org/en/drafts/enhancing-accountability-charter-03nov14-en…> of a Cross Community Working Group on Enhancing ICANN Accountability (CCWG-Accountability<https://community.icann.org/x/ogDxAg>) of which the GNSO is a chartering organization. On 3 August, the CCWG-Accountability published<https://www.icann.org/public-comments/ccwg-accountability-2015-08-03-en> its Second Draft Proposal for public comment. This second proposal included significant changes made by the CCWG to its initial proposal, focusing on outstanding issues, further details on Work Stream 1 and revisions arising from feedback received in the first public comment consultation period. The public comment period closed on 12 September. Here the Council will receive an update on the work of the CCWG, in view of the public comments received, and discuss any specific issues that need to be addressed in view of the timeline of the CCWG and the connection between its work and the IANA stewardship transition. 8.1 - Update (Thomas Rickert) 8.2 - Council discussion 8.3 - Next steps Item 9: COUNCIL DISCUSSION - New ICANN Meeting Strategy (10 minutes) On 14 July 2015 the GNSO Chair had sent a letter<http://gnso.icann.org/en/correspondence/robinson-to-crocker-14jul15-en.pdf> to the ICANN Board, informing them of the GNSO's progress in developing and adapting community plans to conform to the new ICANN meeting strategy, particularly in relation to the new format for Meeting B. Changes to an Approved PDP Team Charter: For any PDP Team Charter approved under d. or e. above, the GNSO Council may approve an amendment to the Charter through a simple majority vote of each House. g. Terminate a PDP: Once initiated, and prior to the publication of a Final Report, the GNSO Council may terminate a PDP only for significant cause, upon a motion that passes with a GNSO Supermajority Vote in favor of termination. h. Approve a PDP Recommendation Without a GNSO Supermajority: requires an affirmative vote of a majority of each House and further requires that one GNSO Council member representative of at least 3 of the 4 Stakeholder Groups supports the Recommendation. i. Approve a PDP Recommendation With a GNSO Supermajority: requires an affirmative vote of a GNSO Supermajority, j. Approve a PDP Recommendation Imposing New Obligations on Certain Contracting Parties: where an ICANN contract provision specifies that "a two-thirds vote of the council" demonstrates the presence of a consensus, the GNSO Supermajority vote threshold will have to be met or exceeded. k. Modification of Approved PDP Recommendation: Prior to Final Approval by the ICANN Board, an Approved PDP Recommendation may be modified or amended by the GNSO Council with a GNSO Supermajority vote. l. A "GNSO Supermajority" shall mean: (a) two-thirds (2/3) of the Council members of each House, or (b) three-fourths (3/4) of one House and a majority of the other House." Appendix 2: Absentee Voting Procedures (GNSO Operating Procedures 4.4<http://gnso.icann.org/council/gnso-operating-procedures-22sep11-en.pdf>) 4.4.1 Applicability Absentee voting is permitted for the following limited number of Council motions or measures. a. Fill a Council position open for election. 4.4.2 Absentee ballots, when permitted, must be submitted within the announced time limit, which shall be 72 hours from the meeting's adjournment. Update on CWG-UCTN

Dear Council colleagues, Following up on the missed agenda item from our previous Council meeting, Carlos and I are pleased to provide a concise update on the activity of the CWG-UCTN (Cross-Community Working Group on the Use of Country and Territory Names as top-level domains. The objective of the CWG-UCTN is to review the current status of representations of country and territory names, as they exist under current ICANN policies, guidelines and procedures. In addition, the Group has been asked to provide advice regarding the feasibility of developing a consistent and uniform set of definitions that could be applicable across the respective SO's and AC's for country and territory names as top-level domains. Since ICANN53, the CWG has reached preliminary conclusions in relation to the use of two-letter codes. We are working to publish an interim report setting out those preliminary conclusions prior to ICANN54. Applying a similar methodology to that used in analysing 2-letter codes whereby we start with information gathering to ascertain current usage, the CWG has recently circulated to SG and C leaders a short list of questions about current practice in the use of 3-letter codes as TLDs. I'm aware that as Dublin approaches we are all increasingly busy, but if there is any opportunity to do I would be grateful if you could encourage your SG and C members to respond and send their responses to Lars Hoffmann (lars.hoffmann(a)icann.org) who is part of the CWG's staff support team, prior to the start of ICANN54. Input received now will help to shape our face-to-face discussions in Dublin and develop a work plan going forward. I note in closing that the ccNSO members of the WG have been very active both in terms of participating in the CWG and in contributing to the calls for information on current practice. I fear that if we do not have sufficient input from the GNSO side, the CWG will embark on a ccNSO-centric discussion, leading to ccNSO-centric findings and conclusions. Phil, thank you for your questions. As the main author of the paper, I am happy to respond. The idea for a discussion paper was raised during the SO/AC High Interest Topic Discussion as well as the workshop as a next step to allow for additional input from those that were not able to participate or provide input during the sessions in Buenos Aires. This proposed approach was also shared by Jonathan during his recent updates to the GNSO Council. A CCWG is typically open to anyone interested to participate – there is no requirement to be an ICANN regular or member of an SO/AC, although recent CCWGs have, in addition to participations, SO/AC appointed members which have a particular communication and co-ordination role with respect to their SO/AC. As you point out there may not be any meaningful distinction between the ICANN community and others, but the paper wanted to make clear that anyone should be encouraged to provide input and feedback. The issues in section 4 are intended to be a starting point for discussions and are largely based on issues raised during the BA sessions as well as my personal experiences with the development of charters for (C)WGs. It is the hope that these, in addition to other points that may be raised in response to the public comment forum, will help to inform the drafting team deliberations. With regards to the ‘other approach’ as you may recall, one of the questions that was asked during the High Interest Topic Discussion in Buenos Aires was whether those participating were supportive of a CCWG or whether alternative approaches should be considered. Those that participated seemed generally supportive of a CCWG to address this topic, but staff did not want to exclude the possibility that there could be new suggestions or ideas in response to the public comment forum from those that may not have been able to participate in the BA meeting that the community may want to consider. This is in no way intended to undermine the CCWG approach but merely to allow those that may not have been able to have their voice heard before to share ideas and suggestions that may warrant further consideration. I understand that the timing of the public comment forum is not ideal and consideration may need to be given to extending it beyond the Dublin meeting, but the hope was that the feedback provided would enable the community to review the feedback provided and embark on the next steps in this process during the ICANN meeting in Dublin. It also seems to echo elements of the email that Steve Crocker sent when he first learned of potential support for a CCWG. I also remain unclear about whether there is any meaningful distinction between the ICANN community and other Internet-related interests or entities who do not participate in it -- given that ICANN participation is open to everyone without barriers as well as the very high physical and remote attendance at contemporary ICANN meetings. I am also curious regarding the origin of the Issues to be Considered and Addressed catalogued in section 4 of the paper. I don’t have any specific objection to any of them but wonder where they came from – and whether the list of potential issues shouldn’t properly come from those who engage in this comment process and a future CCWG. I further note this part of the Notice: Next Steps: This discussion paper is published for public comment in order to allow for additional input before this paper is submitted to the drafting team, which is expected to be tasked with developing a proposed charter for a Cross-Community Working Group for consideration, unless another approach is suggested as part of the public comment period and which is then deemed preferable. (emphasis added) It is not clear whether “another approach” refers to the Charter drafting team, or to the CCWG itself. If it is the latter (which seems more logical, as every CCWG needs a Charter drafted) then it would seem that there may be some intent to undermine a CCWG proceeding. In any event, I think this assertion needs clarification. Finally, I am curious about what prompted the publication of this notice at this time, as it sets a comment deadline of October 18 – which is the starting Sunday of the Dublin ICANN meeting – which means that the comments cannot possibly be evaluated in time to inform any discussion of this topic in Dublin. The disposition of $60-million+ is a very important topic and asking the community to submit well-considered input at a time when so many remain heavily engaged on stewardship and accountability seems questionable. Further, I was under the impression that there was a general policy against setting deadlines that coincided with ICANN public meetings. In regard to the discussion on Public Interest during the Council call

Hi, In respect to the point made by Amr and Volker that Public Interest is hard because there are different viewpoints on it. I would like to point out that this is the case on many issues and that is pretty much the point behind multistakeholder processes - to figure out a consensus point, if any exists, on hard issues with multiple viewpoints. As for the current issue with generic strings, it is perhaps appropriate to take up the issue now to answer the issues so that the applications that are blocked can become unblocked. Dear Councillors, Please find attached the GNSO Council Recommendations Report to the Board for the Adoption of the Translation and Transliteration PDP recommendations. The Report will form part of the consent agenda for the next Council meeting on 24 September 2015. Please note that the Report is prepared by staff, summarises the PDP works, details the recommendations, contains links to the various public comment fora, and generally brings together different aspects of the work that have gone into the PDP, as prescribed by the PDP Manual. The Recommendations Report is part of the documents that the Board requires before considering the recommendations. Because of the timeline, staff will submit the Report to the Board in the next days, with the explicit caveat that the Report still awaits GNSO Council approval. This will mean that if there are no (or only minor) changes, the Board will be able to consider the recommendations at its meeting on 28 September. If major changes are required following the next GNSO Council meeting, the Board will consider the issue in Dublin. The extension was viewed as necessary given the number of potential topics that had been identified by the New gTLDs Subsequent Procedures Discussion Group and the need to develop a proposed framework for handling those topics in a possible PDP. The Council had also discussed briefly the possible benefits of having an extended public comment period in view of the community interest in this matter. Here the Council will discuss the ramifications of extending the public comment period and decide whether or not to recommend moving forward with the idea. 4.1 - Update and presentation of possible timelines (Steve Chan) 4.2 - Council discussion 4.3 - Council decision and next steps Item 5: COUNCIL DISCUSSION - Letter from ICANN Board Chair on Exclusive Registry Access for gTLD Terms representing Generic Strings (10 minutes) On 27 July 2015 the ICANN Board Chair sent a letter<https://www.icann.org/en/system/files/correspondence/crocker-to-robinson-27…> to the GNSO Chair requesting that the GNSO specifically include the issue of exclusive registry access for generic strings serving a public interest goal as part of the policy work it is planning to initiate on subsequent rounds of the New gTLD Program. The GNSO was also asked to inform the Board on a regular basis with regards to progress on the issue. Here the Council will discuss the letter and decide on its response. 5.1 - Council discussion 5.2 - Next steps Item 6: UPDATE & DISCUSSION - Protection for IGO Acronyms at the Second Level in All gTLDs (15 minutes) At the July 2015 Council meeting, PDP Working Group co-chair Philip Corwin outlined for the Council certain concerns that the WG co-chairs shared regarding the timing and mechanisms for interactions between the WG and the IGO "small group" (comprising IGO and GAC representatives) that had been formed to formulate a substantive proposal for discussion with the GNSO. The final proposal is expected to be based on the Board's New gTLD Program Committee (NGPC) initial March 2014 proposal<http://gnso.icann.org/en/correspondence/chalaby-to-robinson-20mar14-en.pdf> to the GAC, and as such is expected to address both so-called "preventative" (i.e. pre-registration) as well as "curative" (i.e. post-registration) protections for IGO acronyms. In respect of preventative protections, the NGPC had previously requested<http://gnso.icann.org/en/correspondence/chalaby-to-robinson-16jun14-en.pdf> that the GNSO Council consider amending those of its adopted policy recommendations that are inconsistent with GAC advice. Following discussions with the NGPC, the Council had put the matter on hold<http://gnso.icann.org/en/correspondence/robinson-to-chalaby-disspain-07oct1…> pending further details regarding possible amendments from the NGPC. Here the Council will receive an update on the status of the WG, GAC and IGO interactions on the topic if IGO protections, and discuss what, if anything, it might wish to do at this stage to facilitate progress in resolving any issues arising therefrom. 6.1 - Update (Philip Corwin / Mason Cole / Mary Wong) 6.2 - Council discussion 6.3 - Next steps Item 7: UPDATE ON EXPECTED COUNCIL ACTION - Final Report from the Data & Metrics for Policy Making Working Group (5 minutes) The Data & Metrics for Policy Making Working Group was chartered to explore opportunities to review standard methodologies of reporting and metrics that can better inform fact-based policy development and decision-making, including how the community can collaborate with Contracted Parties and other service providers in the sharing of metrics and data. The WG published its Initial Report for public comment on 29 July 2015, and the public comment period will close on 7 September 2015. Here the Council will receive an update on the expected timeline for delivery of the WG's Final Report and note potential issues for Council consideration in the Final Report. 7.1 - Update (Jonathan Zuck) 7.2 - Council discussion 7.3 - Next steps Item 8: UPDATE & DISCUSSION - Cross Community Working Group on Enhancing ICANN Accountability - CCWG Accountability (15 minutes) In the course of discussions over the IANA stewardship transition, the community had raised concerns about ICANN's accountability, given ICANN's historical contractual relationship with the United States government. The community discussions indicated that existing ICANN accountability mechanisms do not yet meet some stakeholders' expectations. Considering that the US Government (through the NTIA) has stressed that it expects community consensus on the transition, this gap between the current situation and stakeholder expectations needed to be addressed. This resulted in the creation<http://gnso.icann.org/en/drafts/enhancing-accountability-charter-03nov14-en…> of a Cross Community Working Group on Enhancing ICANN Accountability (CCWG-Accountability<https://community.icann.org/x/ogDxAg>) of which the GNSO is a chartering organization. On 3 August, the CCWG-Accountability published<https://www.icann.org/public-comments/ccwg-accountability-2015-08-03-en> its Second Draft Proposal for public comment. This second round of public consultation concerns significant changes made by the CCWG to its first proposal. The changes focus on outstanding issues, add details to the Work Stream 1 proposal(s), and include revisions to the original proposal(s) arising from the feedback received in the first public comment consultation period. Public comments may be sent in through 12 September. Here the Council will review the CCWG's status and progress, and discuss any specific issues that need to be addressed in view of the timeline of the CCWG and the connection between its work and the IANA stewardship transition. 8.1 - Summary and status update (Thomas Rickert) 8.2 - Council discussion 8.3 - Next steps Item 9: DISCUSSION - Preparation for ICANN54 (15 minutes) During the regular GNSO weekend working sessions at each ICANN Public Meeting, the GNSO Council and community meet with the ICANN Board, the GAC, staff from ICANN's Global Domains Division, and senior ICANN management. Except as otherwise specified in these Bylaws, Annex A hereto, or the GNSO Operating Procedures, the default threshold to pass a GNSO Council motion or other voting action requires a simple majority vote of each House. The voting thresholds described below shall apply to the following GNSO actions: a. Create an Issues Report: requires an affirmative vote of more than one-fourth (1/4) vote of each House or majority of one House. b. Initiate a Policy Development Process ("PDP") Within Scope (as described in Annex A<http://www.icann.org/en/about/governance/bylaws#AnnexA>): requires an affirmative vote of more than one-third (1/3) of each House or more than two-thirds (2/3) of one House. c. Initiate a PDP Not Within Scope: requires an affirmative vote of GNSO Supermajority. d. Approve a PDP Team Charter for a PDP Within Scope: requires an affirmative vote of more than one-third (1/3) of each House or more than two-thirds (2/3) of one House. e. Approve a PDP Team Charter for a PDP Not Within Scope: requires an affirmative vote of a GNSO Supermajority. f. Changes to an Approved PDP Team Charter: For any PDP Team Charter approved under d. or e. above, the GNSO Council may approve an amendment to the Charter through a simple majority vote of each House. g. Terminate a PDP: Once initiated, and prior to the publication of a Final Report, the GNSO Council may terminate a PDP only for significant cause, upon a motion that passes with a GNSO Supermajority Vote in favor of termination. h. Approve a PDP Recommendation Without a GNSO Supermajority: requires an affirmative vote of a majority of each House and further requires that one GNSO Council member representative of at least 3 of the 4 Stakeholder Groups supports the Recommendation. i. Approve a PDP Recommendation With a GNSO Supermajority: requires an affirmative vote of a GNSO Supermajority, j. Approve a PDP Recommendation Imposing New Obligations on Certain Contracting Parties: where an ICANN contract provision specifies that "a two-thirds vote of the council" demonstrates the presence of a consensus, the GNSO Supermajority vote threshold will have to be met or exceeded. k. Modification of Approved PDP Recommendation: Prior to Final Approval by the ICANN Board, an Approved PDP Recommendation may be modified or amended by the GNSO Council with a GNSO Supermajority vote. l. A "GNSO Supermajority" shall mean: (a) two-thirds (2/3) of the Council members of each House, or (b) three-fourths (3/4) of one House and a majority of the other House." Appendix 2: Absentee Voting Procedures (GNSO Operating Procedures 4.4<http://gnso.icann.org/council/gnso-operating-procedures-22sep11-en.pdf>) 4.4.1 Applicability Absentee voting is permitted for the following limited number of Council motions or measures. a. Initiate a Policy Development Process (PDP); b. Approve a PDP recommendation; c. Recommend amendments to the GNSO Operating Procedures (GOP) or ICANN Bylaws; d. Fill a Council position open for election. 4.4.2 Absentee ballots, when permitted, must be submitted within the announced time limit, which shall be 72 hours from the meeting's adjournment. In exceptional circumstances, announced at the time of the vote, the Chair may reduce this time to 24 hours or extend the time to 7 calendar days, provided such amendment is verbally confirmed by all Vice-Chairs present. 4.4.3 The GNSO Secretariat will administer, record, and tabulate absentee votes according to these procedures and will provide reasonable means for transmitting and authenticating absentee ballots, which could include voting by telephone, e- mail, web-based interface, or other technologies as may become available. 4.4.4 Absentee balloting does not affect quorum requirements. (There must be a quorum for the meeting in which the vote is initiated.)
