Revised ALAC-GAC-GNSO Chair's Joint Letter

Dear Councilors, Sebastien, Nico Caballero and Jonathan Zuck had a call last week to discuss the joint ALAC-GAC-GNSO Chairs' letter to the Board regarding the Facilitated Dialogue. Both the ALAC and GAC wanted to state that the status quo should be requested in the second bullet point. That said, the ALAC and GAC understood that the GNSO chair needs to remain neutral on this topic. We have attached a version of the letter reflecting this in the footnote. Keep in mind that this is a joint letter and primarily meant to communicate that work on the Facilitate Dialogue has reached an end but should not in any way delay the next round of new gTLDs. As this letter has been with Council for some time, we would ask that we have your comments, if any, by Thursday (9/28) at 20:00 UTC. CCWG-AP Letter to Org

Dear Councilors, As you will recall from my agenda item at September's Council Meeting, on 17 July 2023, Xavier Calvez sent a written update<https://mm.icann.org/pipermail/council/2023-August/027220.html> on the progress of ICANN org's implementation of the Cross Community Working Group's - Auction Proceeds (CCWG-AP) Final Report. Specifically, the letter let us know of the Board's intention to direct ICANN org to change the implementation path of the CCWG-AP's Recommendation 7, which was focused on limiting the use of ICANN's accountability mechanisms to challenge individual application decisions made by the independent assessment panel. The CCWG-AP recommended that this limitation should be achieved through changing the ICANN Bylaws on the Reconsideration Request and Independent Review Processes to specify a carve out. Instead of touching ICANN's core accountability mechanisms in the Bylaws, the ICANN Board intends to now direct ICANN org to achieve this recommendation through the applicant terms and conditions that grant applicants will agree to when submitting their grant application. Because the Board is looking to direct ICANN org to implement the CCWG-AP's recommendation to limit access to ICANN's accountability mechanisms in a different manner than the CCWG-AP contemplated, the Board agreed it was important to give advance notice to those CCWG representatives who formed Recommendation 7 and at the same time wanted to provide transparency to the chartering organizations approved the CCWG-AP Final Report and its recommendations. The specific ask was to let ICANN Org know if the GNSO Council was comfortable in having ICANN Org engage with the former CCWG-AP members in this conversation or whether it should be held differently. There was a good discussion on this topic and on the Board's decision to change implementation of Recommendation 7, which we have summarized in the attached letter. All, Full credit here to Paul McGrady who asked me a question on what I personally thought the issues for the GAC would be at the upcoming ICANN meeting and what if anything I believed may be subject to GAC advice. I thought I would share this with the full Council list so that you all could have discussions on these issues and be prepared. Please note that my thoughts are based on discussions with the GAC Point of Contact and working on the agenda for ICANN 78. I am not speaking on behalf of the GAC PoC or the GAC as I cannot do that, nor do I have the ability to do so. I am going to send out a more comprehensive version of this to the Council shortly before ICANN 78 which has the final agenda for the GAC/GNSO bilateral as well as some potential talking points. Some of these items below will likely be on the GAC/GNSO agenda, but likely not all of them due to time constraints. 1. SubPro Topics: a. Closed Generics - Status on the Facilitated Dialog and the future of Closed Generic discussions / implementation. Jeff's note: If you recall the original draft letter proposed by the GNSO/GAC/ALAC chairs recommended that the Board be instructed to maintain the moratorium on Closed Generics from the last round, but the GNSO discussed removing that from the letter. The GAC has a very strong interest in the issue of Closed Generics and does not believe they should be allowed absent consensus policy on the topic (which of course is developed with GAC input). b. IRT Progress on Next Round - Jeff's take: No known concerns here from GAC, just an update. c. Pending items still not addressed by the Board / Open Issues - PICs / RVCs: Jeff's Take: As most GAC Advice on new gTLDs is implemented as a PIC, or may be implemented as an RVC if Registries respond to Early Warnings or comments, it is important to the GAC that these be incorporated as contractual commitments into the agreements (See ICANN 77 Communique Advice 2(a). GAC agrees that such commitments must be enforceable by ICANN through clear contractual obligations, and that consequences for the failure to meet those obligations should be specified in the relevant agreements with the contracted parties. However, they are looking to understand (as we are) the changes being proposed by the ICANN Board to the language. - Private Auctions: Jeff's take: The GAC has previously expressed on several occasions, including as Advice in its ICANN 77 Communique that, ICANN "ban or strongly disincentivize private monetary means of resolution of contention sets, including private auctions." (ICANN 77 Communique 4(a)(ii). They also do not want to see ICANN auctions of last resort in contention sets involving non-commercial applicants. - Opening up small team to GAC participation (especially for items not accepted by the Board) Jeff's Take: GAC members want to make sure that they are participating in the process to determine both the processes used, as well as the substance, of revisions to recommendations, new recommendations, not pursuing existing recommendations, etc. This is especially true for all of the issues that the GAC has already issued advice on as well as items that they previously deemed were of importance to the GAC. - Applicant Support (more than financial) - Jeff's Take: Not surprisingly and also quite aligned with the GNSO, the GAC issued advice on Applicant Support (ICANN Communique 77, Advice #3). The Applicant Support program to be incredibly important to them and they want to make sure that applicants not only have access to financial assistance with the application, but also assistance in application preparation and ongoing registry management (including potentially a reduction in ICANN ongoing registry fees). They also want to make sure that the program is highly publicized to those that are the intended beneficiaries of the program. - GGP Initial Report - Jeff's Take: I would propose this gets combined with the topic above and may just be an update. - .quebec: Is this an issue for the GAC? Jeff's Take: This issue of course is of interest to the GAC Canadian Reps, but as of today this issue has not gotten on the GAC agenda as a whole. That is not an indication of whether this issue is important or not, there just have not been any GAC-wide discussions on the topic. Because it was discussed within the GNSO Council this week, I raised it at the meeting today and the GAC Point of Contact is going to see if this is an issue for the GAC at this ICANN meeting. 2. IGOs a. Implementation of Curative Rights (what is the status of the IRT) - Jeff's Take: I believe The GAC is supposed to get a briefing at ICANN78 from ICANN on the status of implementation of Curative Rights as well as the Watch Service (see below). They believe that these are must haves before ICANN should consider lifting the reservation of IGO Acronyms. This was in their GAC Communique as advice a couple of meetings ago. They want to discuss this with the GNSO. I do not expect further advice on this unless they affirm their previous advice or if it appears that ICANN is moving in a direction that is inconsistent with the previous GAC Advice. b. Question of Moratorium on IGO acronyms / watch service (which ICANN is supposed to develop) - See Above. 3. Future Policy Work on DNS Abuse? Jeff's Take: The GAC positions on this are well-known. They are supportive of the proposed contract amendments for the Contracted Parties but of course want to see more done on the policy front before the opening up of the next round. But I do not expect any advice here, just more of wanting an update on what is going on and making sure it is progressing. 4. WHOIS / Data Protection a. Access to non-public information / "urgent requests" - Jeff's Take LONG): This relates to the pilot being lunched soon by ICANN with the Registrars. On August 23, 2023, the GAC Chair sent a letter to the ICANN Board (https://www.icann.org/en/system/files/correspondence/caballero-to-sinha-23a…) to express its concerns over the time line to respond to requests in select emergency situations ("Urgent Requests"). They do not like the proposed three (3) business days currently in the EPDP Phase 1 implementation report and want the ICANN Board to reconsider this. On September 8, 2023, the Registrars sent a letter to the ICANN Board (https://www.icann.org/en/system/files/correspondence/heineman-to-sinha-08se…) providing some context to the 3 business days stating that this language has been in the text since September 2021, but in August 2022 the language changed to requiring a response, "no longer than two (2) business days from receipt" which was put out for comment. This was a change from the Implementation Pilot Team without consultation of the full IRT. Once that was published, there were several meetings of the full IRT to come up with a compromise solution. The Compromise language published following the July 24, 2023 meeting, which the Registrars agree with, was: "10.6. For Urgent Requests for Lawful Disclosure, Registrar and Registry Operator MUST respond, as defined in Section 10.7, without undue delay, generally within 24 hours of receipt. 10.6.1. If Registrar or Registry Operator cannot respond to an Urgent Request for Lawful Disclosure within 24 hours, it MUST notify the requestor within 24 hours of receipt of an Urgent Request for Lawful Disclosure of the need for an extension to respond. Registrar or Registry Operator’s extension notification to the requestor MUST include (a) confirmation that it has reviewed and considered the Urgent Request for Lawful Disclosure on its merits and determined additional time to respond is needed, (b) rationale for why additional time is needed, and (c) the time frame it will respond, as required by Section 10.7, which cannot exceed two (2) business days from the time of the initial receipt of the request. 10.6.2. In addition to the extension provided for in Section 10.6.1, if responding to an Urgent Request for Lawful Disclosure is complex, or a large number of requests are received by Registrar or Registry Operator, it MAY extend the time for response up to an additional one (1) business day provided it notifies the requestor within (2) business days from the time of the initial receipt of the request of the updated time frame to respond explaining the need for an additional extension of time. " So according to the registrars, they are only requesting 3 business days if they have notified the requestor within 24 hours that it needs more time and if it needs 3 business days it needs to notify the requestor again within 2 business days from receipt of the original request. Registrars do not agree with the GAC's interpretation that this will always be 3 business days and believes that the GAC should have given the Board the full context. It is my impression that the GAC may believe that because it allows 3 business days that this will become the default. This will be discussed by the GAC at ICANN 78. b. Accuracy Issue and status of DPAs between the Contracted Parties and ICANN (Since this has been the reason for delaying policy work on accuracy). Jeff's Take: Accuracy of Registration data is of utmost importance to the GAC and "remains committed to working within the Accuracy Scoping Team to assess the current state of accuracy under ICANN's contracts." The GAC welcomes the completion of a Data Protection Impact Assessment on a contractual compliance audit that could shed light on the current state of accuracy. Although I believe they were ok with the initial 6-month delay of the Scoping Team work waiting for the DPAs, they are looking for more meaningful updates on where ICANN is with the DPAs . They would like to see policy work ASAP. I am not sure if there will be Advice on this, but it certainly is an issue of importance. 5. SOI: Status of discussions on the representation of undisclosed clients. Jeff's Take: The GAC Is following this one closely and I believe they are aligned more with requiring disclosure of clients that are directly being represented in policy processes. Governments individually generally require full disclosure of clients when they engage in discussions with representatives of industry, the community, etc. Whether there will be advice on this at ICANN 78 or not, I don't think so. But it is an item of importance to them. Other GAC Activities / Issues (Jeff's Take) 1. I discussed the proposed Charter for the Standing Committee on RDRS to help inform the next steps on the SSAD policy recommendations with the GAC PoC today. Specifically I discussed the composition which currently is made up of Councilors and members of the ePDP Phase 2 small team members. from the GAC, I believe Chris Lewis-Evans and Laureen Kapin had a "shared membership." Chris is no longer working with the Public safety working group and is in the private sector. So I am sure being able to appoint a replacement (not an alternate) will be important to them. 2. GAC is having two days of outreach sessions at ICANN 78 during the first weekend. The second day will focus on "emerging technologies" and getting briefings from ICANN Org on Blockchain in general and "alternative naming spaces" with an eye on trying to figure out what, if anything, is the GAC role. 3. GAC is also focused on the IANA Review, especially with respect to Articles 18 and 19 of the Bylaws. (https://www.icann.org/en/announcements/details/icann-board-convenes-second-…) This review is taking a broader look athat includes identifying whether the requirements identified in the IANA contract SOW are still relevant or whether they need changing. This is defined in Section 18.3 of the Bylaws. 4. GAC will be looking at the Proposed Updates to Existing Rights Protection Mechanisms documentation (https://www.icann.org/en/announcements/details/icanns-proposed-updates-to-e…) posted on August 24, 2023. 5. Please take note of the action items coming out of the Council meeting and the proposed timing for delivering on these actions. Please refer to this page for the recent status updates on the Action items. Please note that actions for all councilors are highlighted below. Item 5: COUNCIL VOTE - Charter for Registration Data Request Service (RDRS) Standing Committee to help inform the next steps on the SSAD policy recommendations (10 minutes) Action Items: 1. The GNSO Secretariat will confirm with the existing EPDP Phase 2 small team members if they are willing to continue as members of the RDRS Standing Committee and/or identify any alternates that may take their place in case of absence. For greater clarity, alternates mean in some cases replacements as required. 2. Prior to the launch of the RDRS Standing Committee, the GNSO Council will identify a Chair. 3. The GNSO Secretariat will reach out to the EPDP Phase 2 ICANN Board liaison and ICANN org liaison to confirm their willingness to continue in their role on the Standing Committee. If not, a new liaison(s) will be requested to be identified. 4. On behalf of the GNSO Council the GNSO Secretariat thanks the EPDP Phase 2 small team for its work to date and appreciates the willingness of its members to continue contributing to this important topic. Item 7: COUNCIL DISCUSSION - SubPro Small Team Updated Assignment Form (20 minutes) Action Items: As there were no questions, comments, or objections the GNSO Council is deemed to have accepted the updated Assignment Form. Item 8: ICANN78 Planning (15 minutes) Action Items: Staff to develop and distribute a list of agreed upon topics for the bilateral GNSO meetings at ICANN78 with At-Large, ccNSO, GAC, and ICANN Board. GNSO Councilors are encouraged to review and suggest additions or revisions. Item 9: Cross Community Working Group - Auction Proceeds Response (20 minutes) Action Items: GNSO Council Leadership to draft a response for Council review to the written update from Xavier Calvez on the progress of ICANN org’s implementation of the Cross Community Working Group’s - Auction Proceeds (CCWG-AP) Final Report, including the concerns expressed during the Council meeting. The CCOICI tasked<https://community.icann.org/display/CCFOICI/b.+Assignment> the GNSO Statement of Interest (SOI) Task Force (TF) to address the following questions: * Is the original objective of the SOI, as stated in the BGC WG Report, still valid? If not, why not and what should the current objective be? * Based on the response to question 1), is the requested information to be provided as part of the SOI still fit for purpose? If not, why not, and what would need to be changed to make it fit for purpose? * Are there any further measures that should be considered from an enforcement / escalation perspective, in addition or instead of those already included in the requirements? 2. The TF commenced its deliberations in February 2022, submitting the TF Recommendations Report<https://mm.icann.org/pipermail/gnso-ccoici/attachments/20230427/565584b7/GN…> to the CCOICI on 27 April 2023. As the TF was not able to achieve full consensus on one essential element of its recommendations, namely whether there should be an exemption for those prevented by professional ethical obligations to disclose who they are representing in a specific effort, it recommended the CCOICI take on responsibility for resolving this specific issue as all other recommendations had achieved full consensus. 3. The CCOICI took up this issue in May of 2023 and considered it in detail as outlined in Annex A of the CCOICI Recommendations Report<https://gnso.icann.org/sites/default/files/policy/2023/correspondence/chen-…>. As the CCOICI was not able to resolve the different positions on the exemption language, the CCOICI agreed to revert to the current, existing exemption language in the SOI to allow the Council to consider all the other recommendations as outlined in section 2 and 3 of the CCOICI Recommendations Report. These recommendations achieved full consensus of the TF as well as the CCOICI. 4. The CCOICI submitted its Recommendations Report<https://gnso.icann.org/sites/default/files/policy/2023/correspondence/chen-…> to the GNSO Council on 14 August 2023. 5. The GNSO Council considered<https://gnso.icann.org/sites/default/files/policy/2023/presentation/present…> the CCOICI Recommendations Report during its August 2023 meeting. Resolved, 1. The GNSO Council adopts the recommendations as outlined in section #2 (SOI Recommendations) and #3 (Proposed Updates to the GNSO Operating Procedures), with the caveat that the proposed updates to the GNSO Operating Procedures will not be implemented until resolved #2 and #3 have been completed. 2. The GNSO Council requests that the GNSO Policy Development Support Staff develop a proposed implementation plan for these recommendations, recognising that exploring the technical options as well as the transition needs careful consideration. 3. The GNSO Council will consider the proposed implementation plan and as part of that consideration confirm when the proposed updates to the GNSO Operating Procedures are expected to take effect. 4. The GNSO Council thanks the members of the GNSO SOI TF as well as the CCOICI for its work. On 25 January 2022, ICANN organization (ICANN org) published its Operational Design Assessment<https://www.icann.org/en/system/files/files/ssad-oda-25jan22-en.pdf> (ODA) of the SSAD. 4. On 4 April 2022, the Phase 2 Expedited Policy Development Process on the Temporary Specification for gTLD Registration Data Small Team (Small Team), which the GNSO Council tasked to assess the ODA, delivered its Preliminary Report<https://gnso.icann.org/sites/default/files/policy/2022/correspondence/ducos…> to the GNSO Council, recommending a "proof of concept" approach. 5. The GNSO Council and the ICANN Board consulted regarding the next steps for the SSAD and the GNSO Council requested on 27 April 2022<https://www.icann.org/en/system/files/correspondence/fouquart-to-botterman-…> that the ICANN Board pause its consideration of the recommendations concerning the SSAD while work continues on a "proof of concept". 6. On 13 September 2022, ICANN org published a WHOIS Disclosure System (System) Design Paper<https://www.icann.org/en/system/files/files/whois-disclosure-system-design-…> based on the "proof of concept" approach outlined by the Small Team. 7. The GNSO Council informed the ICANN Board on 17 November 2022<https://www.icann.org/en/system/files/correspondence/ducos-to-sinha-17nov22…> that the Council unanimously accepted the Addendum to the Preliminary Report<https://gnso.icann.org/sites/default/files/policy/2022/correspondence/ducos…> (Addendum) prepared by the Small Team and supported the implementation of the System. 8. The ICANN Board also “directed ICANN org to continue to engage with the Phase 2 Small Team throughout the development and operation of the System, and ensure periodic publication of the collected usage data, once operational". 9. On 15 March 2023, GNSO Council instructed<https://gnso.icann.org/sites/default/files/policy/2023/minutes/minutes-gnso…> the small team to continue working with ICANN org on the implementation of the System as well as “provide the Council with a recommendation on the approach and format through which, following implementation of the system, data should be reviewed and analyzed to help inform subsequent decisions on how to proceed with the SSAD recommendations”. 10. On 7 September 2023, the small team shared<https://mm.icann.org/pipermail/council/2023-September/027247.html> with the GNSO Council the proposed charter for a Registration Data Request Service (RDRS) Standing Committee to help inform the next steps on the SSAD policy recommendations. 11. The GNSO Council adopts the Charter for the Registration Data Request Service (RDRS) Standing Committee to help inform the next steps on the SSAD policy recommendations (see https://gnso.icann.org/sites/default/files/policy/2023/draft/draft-rdrs-sta…) 2. Prior to the launch of the RDRS Standing Committee, the GNSO Council will identify a Chair. 3. The GNSO Council requests the GNSO Secretariat to confirm with the existing EPDP Phase 2 small team members if they are willing to continue as members of the RDRS Standing Committee and/or identify any alternates that may take their place in case of absence. For greater clarity, alternates mean in some cases replacements as required. Similarly, the GNSO Secretariat will reach out to the existing ICANN Board liaison and ICANN org liaison to confirm their willingness to continue in their role on the Standing Committee. If not, a new liaison(s) will be requested to be identified. 4. The GNSO Council expects that the RDRS Standing Committee will become operational upon the moment of the public RDRS launch. Until that time, the EPDP Phase 2 small team is expected to continue its engagement with the ICANN org team, as necessary, in fulfillment of its assignment. Upon the public launch of RDRS, the EPDP Phase 2 small team will cease to exist. Any remaining activities at that point will transition to the RDRS Standing Committee. 5. The GNSO Council thanks the EPDP Phase 2 small team for its work to date and appreciates the willingness of its members to continue contributing to this important topic. The GNSO Council established a small team to carefully review the pending SubPro recommendations and identify the best path forward to seek to resolve the issues that were preventing Board adoption of the pending recommendations. 4. The GNSO Council’s small team benefited greatly from the open and frank dialogue with the co-leads of the Board’s Caucus on SubPro. 5. On 22 May 2023, the GNSO Council and ICANN Board discussed the expectation that for certain pending recommendations, a Clarifying Statement from the Council may be sufficient to mitigate the concerns preventing adoption of some of the pending recommendations. 6. At ICANN77, the GNSO Council and ICANN Board reached agreement on the specific set of pending recommendations that may be resolved via a Clarifying Statement from the Council. 7. The GNSO Council’s small team developed a draft Clarifying Statement<https://gnso.icann.org/sites/default/files/policy/2023/draft/draft-sub-pro-…> that was discussed with the Council during its July meeting and was subsequently shared with the ICANN Board for their consideration of whether the Clarifying Statement does indeed address the Board’s concerns. 8. The GNSO Council took into account the feedback from the ICANN Board and finalized the Council’s first Clarifying Statement<https://gnso.icann.org/sites/default/files/policy/2023/draft/draft-subpro-p…> by removing the text in the Clarifying Statement relating to the enforceability of PICs and RVCs and holding this over to a future Clarifying Statement, pending further feedback from the ICANN Board. 9. The GNSO Council approved the first Clarifying Statement<https://gnso.icann.org/sites/default/files/policy/2023/draft/draft-subpro-p…> durings its August 2023 meeting. 10. The ICANN Board’s SubPro caucus shared feedback on the recommendations relating to the enforceability of PICs and RVCs with the Council’s SubPro Pending Recommendations small team; the small team subsequently finalized the Council’s second Clarifying Statement (add link when available). 11. As with the first Clarifying Statement, this second Clarifying Statement should also be read as complementary to the relevant pending recommendation(s) and should be considered jointly with the recommendations for the purposes of implementation. The GNSO Council approves the second Clarifying Statement (add link when available) regarding select pending SubPro recommendations and stresses that the statement should be read as complementary to the relevant pending recommendation(s) and should be considered jointly with the recommendations for the purposes of implementation. 2. Hello Councilors, As the GNSO Council representative to the WS2 Community Coordination Group (CCG), I'm forwarding this question from the WS2 CCG to seek your feedback. I propose we add this to the AOB for our Council meeting this Friday. As noted in Alperen's email below, the WS2 CCG was tasked to deal with WS2 rec 2.3. The problem is that rec 2.3 is sort of contingent on the completion of rec 2.1 and 2.2 by all SO/AC. (These recommendations are regarding the removal of individual ICANN Board Directors. Check the complete recommendations here starting from page 19: https://www.icann.org/en/system/files/files/ccwg-acct-ws2-final-27mar18-en.… ) GNSO is not one of the SO/ACs that hasn't completed the WS2 recommendation 2.1 and 2.2 implementation. In December last year, the Council resolved <https://community.icann.org/display/gnsocouncilmeetings/Motions+2022-12-15> to adopt the CCOICI WS2 Recommendations Report <https://gnso.icann.org/sites/default/files/policy/2022/draft/draft-ccoici-w…>. In the report, the CCOICI marked all but one relevant recommendation as implementation completed; the only recommendation (2.1.2) marked as 'implementation planned' was implemented right after Council's adoption. Above is my poor attempt to provide context for the discussion later this week. My primary suggestion is to let the CCOICI handle this while we work on reviewing the CCOICI pilot, as CCOICI has dealt with the WS2 recommendations and is therefore familiar with the topics. Thanks! EPDP-IDNs Self-Assessment Survey Result

Hello everyone, As you may recall, in March 2023, the GNSO Council approved a process and questionnaire for Working Groups to conduct periodic Self-Assessments during their lifecycle. These periodic surveys are intended to supplement Self-Assessments that already occur when a Working Group closes. The goal is to provide the GNSO Council with important information about how its Working Groups are functioning and whether there are any issues that may need to be addressed as the Working Group proceeds. After the EPDP-IDNs Team delivered its Phase 1 Initial Report for public comment, this Self-Assessment survey was conducted as an opportunity for the Team to reflect on how it is functioning and whether there are areas that may benefit from improvement. The survey was closed on 3 July 2023. Please find attached the report summarizing the aggregated responses to all the survey questions. This report was shared with the GNSO Council leadership and the EPDP-IDNs Team on 12 July and posted on the EPDP public wiki. For transparency and accountability purposes, this report is now shared with the full GNSO Council upon the leadership request. Please be so kind to review and share any questions or concerns you may have. We'll have an opportunity to further review this during our upcoming meeting, should there be any questions or concerns. I would like to request at this stage whether there any objection for the small team continuing its work between now and the next Council meeting on the assumption that the Council will be supportive of the updated assignment so it can keep the momentum going. Kurt Pritz, RySG, also commented that the SubPro Final Report was unsure of the status quo regarding Closed Generics, and noted that contradicting the Final Report is inappropraite (sic). Could be, Kurt Pritz, RySG, commented that this niche issue has taken up hundreds of hours of community time rather than on discussions about Web 3.0, UN discussions on internet governance, or internet fragmentation. Kurt Pritz, RySG, also commented that the proposed letter, as written, inappropriately changed the SubPro Final Report recommendations, which left the issue on whether to delegate Closed Generics to the Board. Kurt cited the ICANN staff letter to the Facilitated Discussion team that indicated if the Facilitated discussion did not result in a framework, the issue needed to be decided by the Board. After the CCWG-AP concluded its work in 2020, each Chartering Organization approved the report before it was provided to the ICANN Board for consideration. As you may have seen in blog posts and community sessions, the ICANN Board adopted the CCWG-AP recommendations, and ICANN org is working toward implementation. Attached you will find an update that I sent to the former members of the CCWG-AP (as appointed by your organizations). Last month, the ICANN Board Chair also sent an email to the former members of the CCWG-AP to inform them of the Board’s intention to direct ICANN org to change the implementation path of the CCWG-AP’s Recommendation 7, which was focused on limiting the use of ICANN’s accountability mechanisms to challenge individual application decisions made by the independent assessment panel. As part of its recommendation, the CCWG-AP included that this limitation should be achieved through changing the ICANN Bylaws on the Reconsideration Request and Independent Review Processes to specify this carve out. Instead of touching ICANN’s core accountability mechanisms in the Bylaws, the ICANN Board intends to now direct ICANN org to achieve this recommendation through the applicant terms and conditions that grant applicants will agree to when submitting their grant application. More information can be found in the attached email. Because the Board is looking to direct ICANN org to implement the CCWG-AP’s recommendation to limit access to ICANN’s accountability mechanisms in a different manner than the CCWG-AP contemplated, the Board agreed it was important to give advance notice to those who formed that recommendation. At the same time, acknowledging that the chartering organizations approved the CCWG-AP Final Report and its recommendations, we are also providing this information directly to the Chartering Organizations. In addition, we will make sure that an email exchange with one of the former CCWG-AP members in response to the Chair’s email is moved to a publicly archived mailing list so that there is a transparent record of these communications. A copy of that exchange is also provided for your reference. The Board recognizes the significance of its forthcoming action - both in terms of maintaining the community working group’s recommendation to limit access to ICANN’s accountability mechanisms and in identifying a new, limited path forward to doing so that does not involve changes to these most fundamental of ICANN Bylaws. When taken, the Board’s resolution will be accompanied by a detailed rationale acknowledging the uniqueness of this situation along with the Board’s acknowledgement that contracts should only be considered as tools for limiting the use of ICANN’s accountability mechanism when the community has recommended that access to accountability mechanisms be limited in specific circumstances. The ICANN org team looks forward to providing further public updates on the progress of the ICANN Grant Program across various communication avenues. The creation of the former CCWG-AP members list is one of them, as is this email to you.
