Paul, We do not have to wait until Dublin to finalize the AGB based on Council's direction. Council can choose to vote October 9 or a vote outside the meeting can be noticed pursuant to 4.10. The AGB will move forward in a timely way and that is why we are having an Extraordinary meeting. No one wants to delay. Unfortunately an alternative that states only that both options are implementable does not yield adequate direction from Council to respond to the staff's question regarding the intent of the policy recommendations. This is the central question before the Council and we should answer. We should answer because there is a disagreement at the IRT level and Council is being asked to settle it. Your proposed friendly amendment would not settle that question and would not provide adequate direction to ICANN staff for finalizing the draft AGB for Board consideration. If you mean for Council to direct the IRT to let the Board decide between Option 1 and Option 2 because both are equally implementable, then the Board's correspondence becomes more relevant. The Board has stated it prefers Option 2 and considers it to be more in line with the recommendations noted as an Annex to the staff briefing paper linked in the Motion and attached again here for convenience, but acknowledges that the Council may have a different point of view. The Board has also noted that the global public interest may be implicated and that GAC Advice is possible. IRT Staff awaits instruction from the Council on which of the two options should be selected in order to finalize the AGB. This can be readily supplied before Dublin. Again, Susan and I both agree that the question before the Council is which Option properly reflects the natural meaning and intent of the policy Recommendations. The two Options differ significantly in their consequences and so this question is not a "toss-up". The Motion submitted seeks to clarify these points. Re: Draft Proposal: Board Reversal of its Adoption of a GNSO PDP Recommendation

Dear Councilors, I have an update on the development of the draft redlines for the ICANN Board’s non-adoption of previously adopted GNSO policy recommendations. Having neither seen nor heard any objections, staff has developed proposed redlines to the relevant procedural manuals. * PDP Manual: A new section 16 has been added (and FYI, there was a numbering issue where 13 was repeated) - https://docs.google.com/document/d/1WxnQEsswTbeLuT-D_iZzD8N9BXGIgiGkYiaADsx… * EPDP Manual: No edits appear necessary as the relevant sections for the EPDP rely upon the PDP Manual. * GGP Manual: Here, a new section 10 has been added, which is very, very similar to the proposed edits to the PDP Manual - https://docs.google.com/document/d/159UvOrKfigdEvWCB9f4cmHNo8cVVlOMCE2LTTRE… Staff would like to propose that Councilors review these redlines with their respective groups and provide comments or concerns on Council list. In the likely event that a special meeting will need to be scheduled for the SubPro Reserved Names issue, perhaps this topic can be added for a brief discussion as well; the scheduling of that meeting can help dictate the deadline for feedback on the updated manuals. These next steps are proposed with an eye towards putting the Council in a position where it’s able to discuss the proposed redlines with the Board at ICANN84. The action item from the SPS was to identify the proper place to document that generally agreed upon process. Your GNSO support staff has coordinated with ICANN legal to determine the most appropriate location to capture the process and in short, the recommendation is to update the EPDP, PDP, and GGP Manuals. In the attached document, you will see a briefing document that contains about 2.5 pages of text that explains the thought process and rationale for the approach; if you’re able to recall the conversation at the SPS, this text should feel very familiar. What has been included on page 3 is a very brief analysis on which documentation is most appropriate for capturing the process, which specific section could be updated, and the nature of the changes. Proposed next steps: * Council to review the attached document and in particular, consider the suggestion of where to document the process, and provide any questions or concerns by 27 August. * If there are no substantive concerns on how to capture the process, staff to develop proposed redlines to the EPDP, PDP, and GGP Manuals, in time for discussion by the Council during the September meeting. * Again, if no substantive concerns, the ICANN Board and GNSO Council can discuss the proposed redlines during their bilateral at ICANN84. * Once there is a set of mutually agreed upon (i.e., Board and Council) redlines, the amended GNSO Operating Procedures would be put out for public comment, as is required for such changes. The proposed next steps assume that there are no major concerns that need to be addressed along the way; if that turns out to not be the case, then intervening discussion can and would of course take place, pushing out timelines as needed. Minutes of the GNSO Council Meeting on 18 September 2025 will be posted on 02 October Item 2: COUNCIL VOTE - New gTLD Subsequent Procedures PDP - Interpretation of Intent for Select IGO/INGO PDP Recommendations (30 minutes) During its September meeting<https://icann.zoom.us/rec/play/XYy4NN_IZZv08C-bg6V2CiZv-C_HxrwTqlFeWgVvkHfm…>, the Council discussed an issue that recently arose in the proposed implementation of the Subsequent Procedures PDP recommendations. Specifically, ICANN org staff prepared a discussion paper<https://icann-community.atlassian.net/wiki/spaces/SPIR/pages/460783617/2025…> to explain the issue and to provide a path forward. The IRT was not aligned with ICANN org’s proposal. The Council was requested to provide guidance on the intent of relevant recommendations; without this guidance, the timeline for the Board’s adoption of the Applicant Guidebook and launch of the Next Round are likely to be negatively impacted. GNSO support staff sought to identify the underlying question for the Council to consider: What does it mean for the full name identifiers to be “protected,” but available for the relevant organization via an exception procedure? Based upon discussions within the SubPro IRT, there are two interpretations: 1. Protected only means that no organization other than the relevant organization can apply for the exact match of the full name identifier. This implies that an unrelated third party could apply for a confusingly similar string, thereby preventing the relevant organization from securing their protected string in the future. 2. Or, protected means that no organization other than the relevant organization can apply for the exact match of the full name identifier AND the ability for the relevant organization to secure their protected string should persist. This implies that unrelated third parties would need to be prevented from securing confusingly similar strings (i.e., include the protected strings in string similarity). The Council has been asked to help determine whether the intent of the relevant IGO/INGO PDP recommendations are aligned with interpretation 1 or 2 above. Councilors have been asked to consult with their respective groups to help reach alignment on the original intent of the recommendations. Here, the Council will vote on its interpretation of the original intent of the relevant recommendations and to provide that guidance to the SubPro IRT. 2.1 - Introduction of Motion (Anne Aikman-Scalese & Susan Payne, GNSO co-liaisons to the PDP) 2.2 - Council Vote (threshold: simple majority of each House) 2.3 - Next Steps Item 3: COUNCIL DISCUSSION - Board Reversal of its Adoption of a GNSO PDP Recommendation (20 minutes) During the Council’s last Strategic Planning Session (SPS), the Council came to general agreement on an approach for the ICANN Board to reverse its adoption of a GNSO recommendation. The resulting action item was to identify the proper place to document that generally agreed upon process. On 19 August 2025<https://lists.icann.org/hyperkitty/list/council@icann.org/thread/LOD5WHIQ6I…>, GNSO support staff sent a message to the Council, noting that support staff coordinated with ICANN legal colleagues to determine the most appropriate location to capture the process, and, following that discussion, recommended updating the EPDP, PDP, and GGP manuals. Having received no objections to this approach, GNSO Support Staff provided draft redlines for the EPDP, PDP, and GGP manuals for the Council’s consideration on 19 September 2025<https://lists.icann.org/hyperkitty/list/council@icann.org/thread/RMMJYAX6NC…> with an accompanying request to provide comments and concerns prior to this Special Meeting. Steve, I read the Call for Volunteers for the SPIRT. The summary information did not appear to disclose the special requirements of the SPIRT SOI which, to the best of my recollection, mandate agreement to disclosure of client interests by name. I believe that potential applicants need to be advised of this requirement as some may not be comfortable with the SOI requirements that were approved at the Council level. In other words, we could end up with withdrawn applications if this specific SOI requirement is not disclosed. Have I somehow missed this in the announcement of the Call for Volunteers? You can see the 2026 job description attached, which relies on a version that was subject to Council’s review and revisions a few years ago. Council leadership has reviewed the 2026 job description and believe it remains fit for purpose and can again be used. Our suggestion is to move forward with the current job description for 2026. However, if you believe changes are needed, please reply to this message by 12 September. If changes are needed and are of a substantive nature, we may need to consider establishing a short-lived drafting team. Hi Paul, Anne, all, Lars is hopefully in the midst of his Friday evening and weekend mindset, so I will try and respond, though I am not the staff SME on this topic. I am going to try and isolate the question being presented to the Council because I believe talking about the options without answering the question is potentially distracting; the proper option should flow out of the Council’s assessment of the underlying question. I believe that the underlying question is: * What does it mean for the full name identifiers to be “protected,” but available for the relevant organization via an exception procedure? There are two interpretations: * Protected only means that no organization other than the relevant organization can apply for the exact match of the full name identifier, full stop. This implies that an unrelated third party could apply for a confusingly similar string, thereby preventing the relevant organization from securing their protected string in the future - (option 1). * Or, protected means that no organization other than the relevant organization can apply for the exact match of the full name identifier AND the ability for the relevant organization to secure their protected string should persist. This implies that unrelated third parties would need to be prevented from securing confusingly similar strings (i.e., include the protected strings in string similarity) - (option 2). These are the competing interpretations of Board-adopted recommendations, which are reproduced below (note, I’ve only included the recs for the Red Cross Red Crescent Movement, but there are similar recs for the International Olympic Committee and IGOs). To try and answer Paul’s specific question, option 2 is what implementing staff believes aligns with the intent of the PDP’s recommendations and is therefore not a policy change or new policy (setting aside the fact that a majority of the IRT disagrees with the staff’s interpretation). Recommendation 3.1.1: Top-Level protections of Exact Match, Full Name Scope 1 identifiers of the Red Cross Red Crescent Movement are placed in the Applicant Guidebook section 2.2.1.2.3, Strings “Ineligible for Delegation”. Recommendation 3.1.2: For Red Cross Red Crescent Movement identifiers, if placed in the Applicant Guidebook as ineligible for delegation at the Top-Level, an exception procedure should be created for cases where a protected organization wishes to apply for their protected string at the Top-Level. Again, I am not the SME, but hopefully this helps to narrow in on the issue and better allows you all to navigate it with your respective groups. Standing Predictability Implementation Review Team (SPIRT) - UPDATE

Dear Councilors, As the September Council meeting was action packed and we didn’t manage to get to all of the AOB items, you will see a handful of email updates to cover the items we missed. 9.5 - Initiating the Standing Predictability Implementation Review Team (SPIRT) For Councilors that may be unfamiliar with the SPIRT, it is a GNSO Council mechanism to manage unforeseen change to the New gTLD Program that may occur after the Board’s adoption of Applicant Guidebook (AGB). With the Board potentially adopting the AGB at ICANN84, steps need to be taken to ensure the SPIRT is established and prepared to carry out its role. The Council adopted<https://gnso.icann.org/en/council/resolutions/2020-current#202408> the draft SPIRT Charter in August 2024. That tiny bit of background aside, the update is: * The Call for Volunteers for the SPIRT will be published soon; we expect the Call for Volunteers will remain open through mid-October. The SPIRT will likely kick-off shortly after ICANN84, presuming that the AGB is adopted by the Board during ICANN84. * As noted in the background above, the Council adopted the SPIRT Charter in draft form. This was because the Predictability Framework, upon which the SPIRT relies upon, was still subject to potential change. As far as staff is aware, there has not been any significant change to the Predictability Framework and as a result, staff plans to make minor and non-substantive adjustments to migrate the SPIRT Charter from draft to final. The RDRS Standing Committee published its Council Report for public comment<https://www.icann.org/en/public-comment/proceeding/registration-data-reques…>; the report provides some insight into anticipated next steps. The Council suggested that level of effort be integrated into the prioritization document, to help provide important context for the prioritization exercise. An updated prioritization document<https://gnso.icann.org/sites/default/files/policy/2025/draft/gnso-council-p…> was shared with Council on 05 September 2025. Here, the Council will continue this discussion for how to prioritize these topics given limited resources. 4.1 - Introduction of Topic (Nacho Amadoz, Interim GNSO Co-Chair) 4.2 - Council Discussion 4.3 - Next Steps Item 5: COUNCIL DISCUSSION - Urgent Request Timeline and Related Topics (15 minutes) On 15 October 2024<https://urldefense.com/v3/__https:/gac.icann.org/contentMigrated/gac-follow…>, the GAC wrote to the Board, recommending, “[f]or the work on authentication, we would support the establishment of a joint PSWG/CPH task force. For the work on the response time for authenticated requests, we invite the Board and the GNSO Council to identify an expedited procedure for addressing this workstream. We strongly suggest resuming the work of the IRT, which was halted last summer.” A trilateral meeting was held on 4 November 2024<https://urldefense.com/v3/__https:/icann-community.atlassian.net/wiki/space…> and the Board, GAC, and GNSO Council discussed next steps, including potentially resuming discussions with the IRT. The Council discussed this issue in detail during its meeting on 19 December 2024<https://urldefense.com/v3/__https:/icann-community.atlassian.net/wiki/space…> and responded to the GAC on 15 January 2025<https://urldefense.com/v3/__https:/gnso.icann.org/sites/default/files/polic…>, noting, “[the Council] assumes work on additional timeline discussions would occur within the existing IRT. To be clear, this would not constitute policy development as defined in Annex A of Bylaws (the GNSO PDP) but rather, would be continued implementation work on Recommendation 18 of the EPDP Phase 1 Final Report.” The IRT has resumed meetings on the issue of response time for urgent requests. On 20 August 2025<https://lists.icann.org/hyperkitty/list/council@icann.org/thread/PPUSES3I2W…>, Thomas Rickert, the GNSO Council liaison to the Registration Data IRT, wrote to the Council, noting some potential challenges with the handling of LEA disclosure requests at the global level. Thomas flagged potential legal challenges that may require a nuanced discussion and proposed, et al., a series of meetings between relevant parties, including the ICANN Board, the GNSO Council, and the PSWG/GAC. Here, Thomas will present the concerns in more detail, and the Council will discuss next steps. 5.1 - Introduction of Topic (Thomas Rickert, GNSO Council Liaison to the Registration Data IRT) 5.2 - Council Discussion 5.3 - Next Steps Item 6: COUNCIL DISCUSSION - Board Readiness Small Team Recommendations (20 minutes) During the 2023 GNSO Council Strategic Planning Session (SPS), the GNSO Council agreed that it should seek to limit the likelihood of the Council approving PDP recommendations that the ICANN Board is ultimately unable to adopt. To that end, the Council discussed the desire to ensure it submits “board-ready policy recommendations” to the Board, to the extent possible. Generally speaking, a policy recommendation is considered board ready when the recommendation is likely to achieve board adoption, i.e., the recommendation has been approved by a GNSO Supermajority Vote and will most likely be considered by the Board to be in the best interests of ICANN Community and ICANN org. In August 2024, a Council Small Team began meeting to further discuss the topic of board readiness. Specifically, the Small Team was tasked by GNSO Council to: * Develop a survey/questionnaire related to the Board’s rejection/non-adoption of policy recommendations, which may be administered to relevant PDP Chairs, PDP WG members, ICANN org Support Staff, and Board members. (Examples: EPDP Temp Spec Phase 1 and 2; Subsequent Procedures) * Administer the survey/questionnaire and conduct interviews with relevant PDP Chairs, PDP WG members, ICANN org Support Staff, and Board members. * Synthesize the findings from the survey/questionnaire and interviews into a set of findings and develop a set of recommendations intended to inform Council work on improving Board readiness. Over the past year, the Small Team has been conducting interviews with community members, Board members, and staff members, and has synthesized its findings into recommendations for the Council’s consideration. Here, the Council will receive a presentation of the recommendations<https://gnso.icann.org/sites/default/files/policy/2025/correspondence/br-sm…> from the Board Readiness Small Team and determine next steps. 6.1 - Introduction of Topic (Kurt Pritz, Small Team Lead) 6.2 - Council Discussion 6.3 - Next Steps Item 7: COUNCIL DISCUSSION - Proposed Agenda for GAC and GNSO Bilateral Meeting at ICANN84 (15 minutes) In advance of ICANN meetings, the GNSO liaison to the GAC and the GAC point of contact discuss and propose an agenda for the bilateral meeting at the ICANN meeting. The proposed agenda was circulated to the Council in advance of the September meeting. The Council has suggested that better coordination in advance of the bilateral meeting will ensure that the messaging, goals, and objectives are more aligned in advance of the meeting, helping to avoid surprises for Councilors, while also improving the likelihood of positive outcomes from the bilateral meeting. Here, the Council will review and prepare for the proposed agenda topics for the GNSO/GAC bilateral meeting for ICANN84. 7.1 - Introduction of Topic (Sebastien Ducos, GNSO Council Liaison to the GAC) 7.2 - Council Discussion 7.3 - Next Steps Item 8: New gTLD Subsequent Procedures PDP - Disagreement Between ICANN Staff and the IRT on Implementation (15 minutes) The New gTLD Subsequent Procedures PDP is in the concluding stages of its implementation. However, an issue has arisen recently where the ICANN org staff in charge of implementing the policy recommendations, are not in alignment with the Implementation Review Team (IRT) on the intent of certain policy recommendations. A discussion paper<https://icann-community.atlassian.net/wiki/spaces/SPIR/pages/460783617/2025…> was prepared by ICANN org staff to explain the issue and to provide a path forward. The IRT was not aligned with the ICANN org’s proposal. The Council may be requested to provide guidance on the intent of relevant recommendations; without this guidance, the timeline for the Board’s adoption of the Applicant Guidebook and launch of the Next Round are likely to be negatively impacted. Updated Prioritization Working Document

Dear Councilors, Attached, please find an updated work prioritization document. As was requested the last time this document was discussed by the Council, we have added educated guesses on what the next steps are for each area of work and based on those assumptions, we tried to assess a level of effort. In addition, we’ve also added a timeline graphic that tries to show how current and anticipated work lines up against each other, along with key inputs/dependencies related to the items in the prioritization matrix. I want to include some caveats to the things we’ve added, since this exercise is definitely more art than science. First, staff does not expect that we got the “What Could the Future Work Look Like” column precisely right in every instance, nor are we trying to get ahead of Council decisions. Second, please do not hold us to any of the dates we’ve included in the timeline graphic, other than for the Latin Diacritics PDP! While we recognize how useful it is to have a timeline graphic, there is a ton of guesswork involved; I’m not even sure I want to describe the dates as educated guesses! Despite the caveats, I hope this attached document proves useful to the Council’s work prioritization efforts during the upcoming September Council meeting. Hi Paul, In my years supporting the Council, I do not recall the Council ever providing comment to a Preliminary Issue Report. The public comment period for the Preliminary Issue Report is really for the broader community to share input with the staff that have drafted that report, who then takes it into account and makes revisions as necessary for the Final Report. The Council is then well positioned to consider the Final Issue Report, inclusive of feedback received, and determine the appropriate next steps. As for timeline to prepare the Final Issue Report, the answer is that it depends on the volume and complexity of public comments received. The PDP Manual provides staff with 30 days from the close of the public comment period to prepare the summary and analysis and the Final Issue Report (along with the potential for an extension). The Review of Reviews Cross Community Group (RoR CCG) is being established as a follow-up to the Pilot Holistic Review (PHR) Team’s proposal to fulfill a one off evaluation of the full set of reviews and assess the need for change to ICANN's structures. 2. On 30 July 2025, the final version of the draft Charter<https://www.icann.org/en/system/files/correspondence/reynoso-to-sinha-30jul…> for a CCG to oversee and coordinate efforts relating to this matter was delivered by Alejandra Reynoso, the ccNSO Chair, to Tripti Sinha, the ICANN Board Chair. 3. According to the draft Charter, the CCG is open to members nominated by Nominating Groups, including ICANN’s SOs and ACs, where each Nominating Group may propose nominees for membership in the group in accordance with their own rules and procedures on the explicit understanding that there will be only a maximum of two (2) per Group. 4. On 5 August 2025, the GNSO announced a Call for Expressions of Interest (EOI)<https://gnso.icann.org/en/announcements/announcement-05aug25-en.htm> to solicit two (2) volunteers to fill the roles of members to the RoR CCG, which closed on 11 August 2025. 5. On 14 August 2025, the GNSO Council approved the Charter for the RoR CCG and tasked the GNSO Standing Selection Committee (SSC) with reviewing the applications and recommending two (2) candidates as the members for the RoR CCG, at least one of whom should be a GNSO Council Member. 6. On 20 August 2025, the SSC convened to review and deliberate on the five (5) applications received—three (3) of them Councilors—taking into account the selection criteria outlined in the announcements. 7. On 8 September 2025, the SSC submitted its Full Consensus recommendation to the GNSO Council, by way of submission of the relevant motion. 8. Action Items NextGen@ICANN Mentor Program Nominations The NextGen@ICANN Program is seeking nominations for three (3) positions in the 2026 Mentor Program. These mentors will guide the NextGen participants through the mentorship process during the ICANN85-87 meetings. ICANN will provide travel funding for the appointed mentors to attend these meetings. Each Supporting Organization (SO) and Advisory Committee (AC) is invited to nominate one individual for a total of three spots. Nominations can include program alumni, and we encourage the selection of active community members who are passionate about mentoring students.
