SSAD Next Steps and draft Assignment Form

Dear Councilors, As noted in the recent message<https://lists.icann.org/hyperkitty/list/council@icann.org/thread/EVFJHTBDT4…> from GNSO Support Staff in reference to the SSAD Supplemental Recommendations Team, we are circulating a proposed draft Assignment Form <https://docs.google.com/document/d/1ulSvcKgCVt-C6qTsD24BpMK959n8n8LQNol5031…> for the SSAD Supplemental Recommendations Team for the Council's review and feedback. Once finalised, this proposed Assignment Form<https://docs.google.com/document/d/1ulSvcKgCVt-C6qTsD24BpMK959n8n8LQNol5031…>, similar to previous Small Team Assignment Forms, would govern the work of the SSAD Supplemental Recommendations Team. It includes details and limitations on the scope of the work, the membership of the group, the timeline of the work, the transparency considerations of the group, et al. Based on some of the questions and concerns Leadership has received, we have tried to answer some of the questions and address some of the concerns below. Reminder of how we got here The Council began discussing possible next steps for the SSAD recommendations beginning in November<https://icann-community.atlassian.net/wiki/spaces/gnsocouncilmeetings/pages…>, following the delivery of the RDRS Standing Committee Final Finding Report. The Council continued to discuss the RDRS Standing Committee Report and next steps during the December meeting<https://icann-community.atlassian.net/wiki/spaces/gnsocouncilmeetings/pages…>, the January meeting<https://icann-community.atlassian.net/wiki/spaces/gnsocouncilmeetings/pages…>, the SPS (where we reached agreement on the path of Supplemental Recommendations), and the February meeting<https://icann-community.atlassian.net/wiki/spaces/gnsocouncilmeetings/pages…>. In discussions with the Board, the Council agreed on this path, in part because this was also the recommendation of the RDRS Standing Committee. Specifically, the Council discussed the ramifications of following the RDRS Standing Committee's recommendations during the dialogue with the Board Data Privacy/Protection Caucus members and noted<https://gnso.icann.org/sites/default/files/policy/2026/correspondence/payne…> the following: * The RDRS Standing Committee was composed of members from across the ICANN Community and discussed the potential benefits and drawbacks of all available procedural paths before making the recommendation to not adopt the SSAD recommendations as a package; * Non-adoption and the subsequent steps in Annex A, Section 9 of the Bylaws would initiate a dialogue between the GNSO Council and the ICANN Board; * The GNSO Council would have an opportunity to provide Supplemental Recommendations, which would allow for important and necessary improvements to the existing SSAD recommendations; and, * This would provide a procedurally efficient path that recognizes the ICANN Community's desire for this work to be completed in a timely manner. Because we previously agreed on this Supplemental Recommendation path, and this has now been formally assigned to us by the recent Board resolution, my hope is that we can continue to refine the draft Assignment Form<https://docs.google.com/document/d/1ulSvcKgCVt-C6qTsD24BpMK959n8n8LQNol5031…>, in order to incorporate additional guardrails, if these are felt to be needed, and settle on a mutually-agreeable team composition in order to progress the task efficiently. Remit of the Council under the Bylaws Annex A, Section 9 of the ICANN Bylaws<https://www.icann.org/ru/governance/bylaws> governs the process for Supplemental Recommendations. Specifically, if the Board determines GNSO policy recommendations are "not in the best interests of the ICANN community or ICANN (the Corporation), the Board shall (i) articulate the reasons for its determination in a report to the Council (the "Board Statement"); and (ii) submit the Board Statement to the Council." Subsequently, "at the conclusion of the Council and Board discussions, the Council shall meet to affirm or modify its recommendation, and communicate that conclusion (the "Supplemental Recommendation") to the Board." The Bylaws do not dictate the method in which the Council produces Supplemental Recommendations. In the past, specifically for the Subsequent Procedures Supplemental Recommendations, the Council chose to use a Small Team Plus, which allowed the Council to advance its work with the inclusion of additional subject matter expertise from outside the GNSO Council. Here, the Council has previously noted the advantage of allowing for external expertise to be included in the SSAD Supplemental Recommendations Team; specifically, some Councilors have noted the importance of including expertise from the RDRS Standing Committee, for example. In addition, some Councilors have noted the importance of including members from outside the GNSO that actively participated in the original EPDP Team and the RDRS Standing Committee, e.g., ALAC, GAC, and SSAC. Can the SSAD Supplemental Recommendations Team create new policy? The remit of the SSAD Supplemental Recommendations Team is to modify existing policy recommendations, not create new policy. The modification of existing recommendations (i.e., the eventual Supplemental Recommendations) will be expressly limited by the SSAD Supplemental Recommendations Team's draft Assignment Form<https://docs.google.com/document/d/1ulSvcKgCVt-C6qTsD24BpMK959n8n8LQNol5031…> and its corresponding scope. In other words, the creation of Supplemental Recommendations is only an open opportunity for the Council to modify policy recommendations, grounded in previous work. The RDRS Standing Committee, which was chartered by the GNSO Council, was tasked with, et al., providing the Council with "specific lessons learned that should be factored into the consideration of how to proceed with the SSAD (System for Standardized Access/Disclosure) Recommendations and suggestions to the Council for a proposed recommendation(s) to the ICANN Board in relation to the consideration of the SSAD recommendations." In providing its rationale for Recommendation 5, which advised the Council to consider asking the Board to non-adopt the 18 SSAD recommendations, the RDRS Standing Committee noted it "encourage[s] a willingness to consider modifying parts of the EPDP Phase 2 policy recommendations, if needed, as indicated in the below table. The SC considers it important to achieve a functional policy that adapts to the changed circumstances and benefits from the lessons learned of the RDRS pilot. [Accordingly,] the SC has developed the table below evaluating each of the 18 SSAD policy recommendations considering the RDRS pilot outcomes. It indicates whether each recommendation should be kept or modified along with rationale rooted in the pilot's evidence and the Standing Committee's considerations in [conducting its assignment from the Council.]" In light of the above, the Standing Committee's, ICANN Board's, and the Council's expectation would be that the EPDP recommendations would be modified, using the provided guidance, to allow for important and necessary improvements to the existing SSAD recommendations. For the avoidance of doubt, the SC's guidance on the potential modifications is simply that. It serves as a valuable starting point for the SSAD Supplemental Recommendations Team, given the substantial consideration that the SC has already given to this issue, but does not determine the outcome. Can all GNSO Councilors participate? Yes, any interested and committed GNSO Councilor is invited to participate in the SSAD Supplemental Recommendations Team. What is the expected time commitment? At minimum, it is likely that the SSAD Supplemental Recommendations Team will meet once per week for up to 90 minutes, with a possibility of increasing the cadence if the need arises. Additionally, we understand that ICANN Support Staff has been working on providing the group with dedicated face-to-face time at ICANN86. In light of this, ICANN org is currently working on organizing a one-day in-person workshop on Sunday, 7 June before ICANN86 officially begins on Monday. If you think you are interested in participating in the SSAD Supplemental Recommendations Team, please make note of this date. Hello, I was reading the notes and there is this action item: Action Item: Council to formally notify the Board of the decision to incorporate authentication as part of the work on Supplemental Recommendations on SSAD and to confirm the urgent request timeline and associated policy language can be published as an update to the Registration Data Policy. In the document on ICANN org Proposed Timeline for Urgent Requests which we (NCSG) provided public comment on, under section 3.9 it says that: “Authenticated Requestor” means a law enforcement requestor or trusted/competent authority that is authenticated through an authentication mechanism implemented pursuant to *ICANN Consensus Policy."* But we are asking the supplemental team to come up with a consensus policy? How are you reconciling the two while supplemental team is not supposed to make new policy? Also sorry I missed this but did we ever discuss the public comments that were received on urgent request timeline? In our NCSG public comment we are clear about two things: we need more clarification on the criteria of urgent request (imminent threat etc) and we do think that for authentication we need a PDP. I have attached our public comment. Now to have a path forward, I suggest the following (have not discussed with NCSG especially number 1): 1. Ask the supplemental review team to address the urgent request timeline and criteria and a few things that need more clarification such as what it means to "respond" to law enforcement. That is not new policymaking in my opinion. We are only interpreting and clarifying the criteria and we will discuss human rights impact as well. 2. Discuss how to go about authentication in a way that the supplemental team does not come up with new policy. I know doing an EPDP is a lot of work but I just can't see any other way. Maybe we can have more suggestions by the staff on how to do the authentication piece quickly. We have mentioned in our public comment why we think a PDP on authentication is necessary. But if there are other ways to address our concerns then would love to hear them. Best regards, Farzaneh

Call for Volunteers | SSAD Supplemental Recommendations Team

Dear GNSO Councilors, As discussed during the 16 April GNSO Council meeting, the GNSO Council has tasked the SSAD Supplemental Recommendations Team to develop proposed modifications to non-adopted recommendations in the EPDP Phase 2 Final Report regarding the System for Standardized Access/Disclosure (SSAD). The SSAD Supplemental Recommendations Team Assignment Form is under review and will be distributed to the volunteers as soon as it is finalized. GNSO Council Members are invited to participate in the SSAD Supplemental Recommendations Team to help inform this assignment. GNSO Council Member participation in the Supplemental Recommendations Team will not count toward the team composition allotments for the RrSG, RySG, NCSG, and CSG. Please note the Assignment Form notes that members are “expected to be familiar, or familiarize themselves, with the SSAD recommendations (Recs. 1-18) in the EPDP (RegData) Phase 2 Final Report and the RDRS Standing Committee Final Findings Report.” Call for Volunteers Deadline Please email gnso-secs(a)icann.org<mailto:gnso-secs@icann.org> by 24 April 2026 if you would like to volunteer to be a member of the SSAD Supplemental Recommendations Team. Scope of Team’s Assignment As a reminder, the SSAD Supplemental Recommendations Team has been tasked to develop proposed modifications that are focused on addressing the Board’s concerns and RDRS Stand Committee’s recommendations. This is not an opportunity to bring new issues to the table or reopen previous conversations. As a result, the deliberations are expected to be focused, narrow, and swift. Estimated Time Commitment It is projected that the SSAD Supplemental Recommendations Team will begin by meeting once per week for ninety (90) minutes with the potential to increase the meeting cadence if needed. Upcoming Face-to-Face Meeting In addition, a full-day face to face meeting on Day 0 of ICANN86 (Sunday, 7 June) in Seville has been planned to collaborate on draft supplemental recommendations. Further details will be provided for members, and remote participation will be provided for team members who are unable to travel. For the avoidance of doubt, members of the SSAD Supplemental Recommendations Team (including participating Councilors) will be provided with one additional hotel day and one additional day of per diem in Seville. There will not be additional flights or hotel days provided for members who will not be in Seville. The GNSO Council has expressed a desire to provide feedback to the ICANN Board on issues in the GAC Communiqué as these relate to generic top-level domains to inform the ICANN Board as well as the broader community of past, present, or future gTLD policy activities that may directly or indirectly relate to Advice provided by the GAC; 4. Following discussions with the GNSO Council, on 12 March 2026, the Board passed a resolution<https://www.icann.org/en/board-activities-and-meetings/materials/approved-r…> to not adopt the 18 SSAD recommendations. [Additionally, ICANN Board caucus members have been invited to participate in the discussion.] 5.1 - Introduction of Topic (Susan Payne, GNSO Chair) 5.2 - Council Discussion 5.3 - Next Steps Item 6: Next Steps on Urgent Requests (20 minutes) During the first GNSO Working Session<https://icann85.sched.com/event/2Gwac/gnso-work-session-1-of-3> at ICANN85, the ICANN Board provided an informal update to the GNSO Council regarding the timeline within which registry operators and registrars will be required to respond to urgent requests for lawful disclosure. The Board caucus members noted the public comment period<https://www.icann.org/en/public-comment/proceeding/timeline-for-urgent-requ…> on the timeline for urgent requests had recently concluded. Based on the comments received, the Board and ICANN org noted the comments largely aligned on the proposed timeline<https://itp.cdn.icann.org/en/files/new-generic-top-level-domain-g-tld-progr…> of “without undue delay, not to exceed 24 hours absent exceptional circumstances as described in 10.7.2.3” and associated policy language. Accordingly, the ICANN Board noted the discussion of the timeline appears closed and the policy language can be included as an update to the Registration Data Policy<https://www.icann.org/en/contracted-parties/consensus-policies/registration…>. The Board additionally noted an outstanding question regarding ongoing work on an authentication mechanism for authenticating law enforcement requestors. The Board noted there was generalized alignment in the Community that in order to respond to urgent requests in an appropriate timeframe, authentication of the individual submitting the request was critical. Additionally, the Board noted that while there has been progress on authentication work within the dedicated PSWG Group, there is not currently an agreed upon authentication mechanism. Because the soon-to-be published policy language includes the concept of authenticated entities, there remains a gap in enforcement of the policy. In light of this, the Board noted three potential paths to close the gap and sought feedback from the Council on which path the Council considers appropriate: 1. Council to acknowledge that further development and establishment of an authentication mechanism is part of fully implementing Phase 1, Recommendation 18<https://gnso.icann.org/sites/default/files/file/field-file-attach/epdp-gtld…>. Accordingly, no further policy development work is required for the urgent request timeline specified in Phase 1. 2. Council to further consider authentication as part of its work on Supplemental Recommendations on EPDP Phase 2 (the SSAD recommendations) and any additional language or clarification needed could be added to the Supplemental Recommendations, noting authentication for urgent requests applies for requests sent directly to a Contracted Party OR a request sent via an eventual SSAD. 3. Board to un-adopt a subsection of Phase 1, Recommendation 18<https://gnso.icann.org/sites/default/files/file/field-file-attach/epdp-gtld…> regarding the urgent request timeline, allowing the Council to issue a Supplemental Recommendation that would include the concept of an authentication. (Note: the process for Board un-adoption is still under Council discussion.) Here, the Council will discuss the above options and agree on next steps. 6.1 - Introduction of Topic (Susan Payne, GNSO Chair) 6.2 - Council Discussion 6.3 - Next Steps Item 7: Review of Reviews Update (15 minutes) During its meeting on 14 August 2025<https://icann-community.atlassian.net/wiki/spaces/gnsocouncilmeetings/pages…>, the Council voted to approve the charter<https://www.icann.org/en/system/files/correspondence/reynoso-to-sinha-30jul…> for a Cross Community Group (CCG) on the Review of Reviews. The charter provides that the purpose of the CCG is to manage a fundamental evaluation of the following reviews set out in the ICANN Bylaws, as a whole system, including their implementation, and propose a refreshed system of reviews. The reviews and their past outcomes to be evaluated include: * Periodic review of ICANN structure and operations (section 4.4), * Annual Review (section 4.5) and * Specific Reviews (section 4.6); and * Previously conducted Reviews; and * Reviews that have previously been formally recommended. The CCG will not evaluate the Continuous Improvement Program itself, but will take account of its work and will consider how it can best contribute to the broader system of reviews. This evaluation will exclude the following: * Review of the Independent Review Process (IRP) (section 4.3) * Review of the Reconsideration Request (section 4.2) * Review of the Community Mediation (section 4.7) * Review of the Empowered Community processes related to the Empowered Community powers as listed in section 6.2 (for example the Rejection Action and Approval Action Processes, and Board Recall and Director Removal Processes) * Reviews established through the IANA Stewardship Transition: * the Customer Standing Committee Effectiveness Review (section 17.3), and * the IANA Functions Review (section 18) including the Special IANA Function Review (section 18.12). The GNSO-appointed representatives to the CCG have provided periodic updates to the Council. Here, the GNSO-appointed representatives to the CCG will provide an update on the latest progress to date. 7.1 - Introduction of Topic (Osvaldo Novoa and Sophie Hey, GNSO representatives to the Review of Reviews) 7.2 - Council Discussion 7.3 - Next Steps Item 8: Review of DNS Abuse PDP1 Work Plan (15 minutes) During its meeting<https://icann-community.atlassian.net/wiki/spaces/gnsocouncilmeetings/pages…> on 11 December 2025, the GNSO Council passed a motion<https://gnso.icann.org/en/council/resolutions/2020-current#202512> to initiate two (2) PDPs on DNS Abuse Mitigation. The GNSO Council requested that the DNS Abuse Mitigation PDP 1 Working Group be convened as soon as possible after the adoption of the Charter in order to fulfill the requirements of this PDP. On 15 January 2026, the GNSO Council adopted <https://gnso.icann.org/sites/default/files/policy/2026/vote-result/gnso-cou…> the PDP 1 Charter<https://gnso.icann.org/sites/default/files/policy/2026/draft/charter-dns-ab…> and commenced the formation of the PDP 1 WG, which held its first meeting at ICANN85 Mumbai. Since then, the PDP WG has been making progress on its charter questions while it finalizes its project plan. As a required step in the GNSO operating procedures, the PDP WG has submitted its work plan to the GNSO Council. Work plans are generally only acknowledged by the Council as a matter of AOB; afterwards, the work plan functions as a critical element of mutual accountability between the WG and the Council, as the manager of the policy development process. Dear Fellow Councilors, I’m writing in my role as Council Liaison to provide a brief update on a disagreement that has emerged within the IGO-INGO Curative Rights IRT following the January Council meeting and Resolution<https://gnso.icann.org/en/council/resolutions/2020-current>. To recap the context, the EPDP<https://itp.cdn.icann.org/en/files/generic-names-supporting-organization-co…> recommendations on Specific Curative Rights Protections for International Government Organizations (IGOs) were designed to resolve a long-standing barrier to IGO use of the UDRP or URS because of their inability to submit to court jurisdiction without compromising their legal immunities. The agreed solution was to provide registrants with an alternative to court proceedings: a new, binding specialized arbitration mechanism that registrants may use when a UDRP or URS proceeding is filed by an IGO. In January, the Council was asked to clarify the timing of this mechanism, and whether the EPDP Recommendations should be read as limiting its availability until after a UDRP or URS proceeding has been concluded. As you will remember, the Council passed a resolution affirming that the intent of the recommendations was to allow respondents in an IGO-related proceeding to voluntarily leverage arbitration or alternative dispute resolution methods at any time once a proceeding has commenced - even prior to a final UDRP or URS decision. However, since the passing of the Resolution, IGO representatives within the IRT have voiced strong objections. They contend that allowing access to the new specialized arbitration mechanism before a UDRP or URS determination oversteps the original policy scope and should not be permitted. Neither do they regard the Council Resolution as addressing this scenario. Instead, IGO representatives read the resolution as confirming only that arbitration proceedings are possible at any time, which should remain separate and unregulated within the existing UDRP/URS framework as is the case at present. However, other members of the IRT believe this is a misreading of the intent of the EPDP and Resolution that could ultimately disadvantage respondents in these disputes. ICANN staff are actively supporting the IRT to find a way forward and are currently exploring various implementation options to resolve this issue. We aren’t at a point where a formal request for Council intervention is needed, but I wanted to put this on your radar now because of the significance of this implementation for the wider IGO workstream and acronym release.
