Call for volunteers to Joint DNS Security and Stability Analysis Working Group (DSSA)

Dear all, As you may recall, the ccNSO council has adopted the charter of the Joint DNS Security and Stability Analysis Working Group (DSSA Working Group). The objective of this working group is to: - examine the level, frequency and severity of threats to the DNS; - the current efforts and activities to mitigate these threats; and - identify possible gaps in the current security response to DNS issues. The Charter is available at http://www.ccnso.icann.org/announcements/announcement-15nov10-en.htm As this charter was also adopted by the ALAC and GNSO and is in the process of being adopted by the NRO, we are now calling for volunteers from the ccTLD community to join the DSSA Working Group. If you would like to become a member of the DSSA WG, please note that following membership criteria apply: 1) You should have knowledge or expertise of the objectives of the DSSA Working Group 2) You should be prepared to actively participate in the activities of the working group on an ongoing and long-term basis. 3) You should be prepared, if required, to sign a a Formal Affirmation of Confidentiality and Non-Disclosure paper (see Annex B of Charter) and/or a Non-Disclosure Agreement. The WG might want to set up a sub-working group to access confidential or proprietary information. If you want to participate in such a sub-working group you will most likely be be required to sign one or both of the aforementioned agreements in order to ensure access to and protection of confidential information. If you are interested in joining this Working Group, we also need a Statement of Interest, containing following information: - Current vocation, employer and position - Type of work performed - Identify any financial ownership or senior management/leadership interest in that are interested parties in DSSA related topics. - Identify any type of commercial or non-commercial interest in DSSA related topics. Are you representing other parties? Describe any arrangements/agreements between you and any other group, constituency or person(s) regarding your nomination/selection as a work team member. - DSSA Working Group members are expected to demonstrate knowledge or expertise aspects of the objectives of the DSSA Working Group. Please, identify any knowledge, expertise or experience you have that would be relevant to the work of the DSSA Working Group. - Describe any tangible or intangible benefit that you receive from participation in such processes, for example, if you are an academic or NGO and use your position to advance your ability to participate, this should be a part of the statement of interest, just as should employment by an organisation that has an interest in DNSSA Working Group outcomes. The Statement of Interest will be posted on the DSSA Working Group website. You do not need to be a ccNSO member to join the group! If you are interested in joining the DSSA Working Group, please let me have your statement by the 17 January 2011, at the latest. Thank you, Ron Sherwood ALAC Liaison ------------------------------------------------------------------------------------------- Compliance Staff response to questions posed during ALAC Policy Discussion Part 1 Meeting As requested during the Compliance staff briefing that took place in the ALAC Policy Discussion Part I meeting held 7 December 2010, please find below the written answers to questions that were posed in the Adobe Connect room. ** Q: How many new compliance officers are planned to be added during the next calendar year? A: 3 but we have plans to adequately staff the department to support the new gLTD program. Q: The latest draft terms and conditions governing registrar accreditation applications still seem to allow for the accreditation of shell corporations. Why is ICANN continuing to allow this practice? A: It is our understanding that there is no policy that prohibits this practice. If the community wishes to adopt such a policy, staff will follow it. Q: Section 3.16 of the RAA requires registrars to provide on their web sites accurate contact details, including a valid email and mailing address. Is this being audited? A: It is ICANN's current practice that prior to renewal, ICANN informs registrars of this new requirement and checks registrars' websites for compliance as part of the renewal process. In addition, ICANN is planning to incorporate website checks into its 2011 registrar audit schedule. Q: Onlinenic was ordered to pay $33 million for cybersquatting. Why is this cybersquatter still an accredited registrar? A: ICANN was aware of the judgment, but the matter was subsequently settled between the parties. ICANN staff engaged in numerous correspondence and discussions with OnlineNIC's attorneys and staff when considering its renewal application. Based on the facts and materials available to ICANN at the time, we did not believe that there were grounds for denying its renewal application pursuant to Section 5.4 of the RAA: 5.4 Term of Agreement; Renewal; Right to Substitute Updated Agreement. This Agreement shall be effective on the Effective Date and shall have an initial term running until the Expiration Date, unless sooner terminated. Thereafter, if Registrar seeks to continue its accreditation, it may apply for renewed accreditation, and shall be entitled to renewal provided it meets the ICANN-adopted specification or policy on accreditation criteria then in effect, is in compliance with its obligations under this Agreement, as it may be amended, and agrees to be bound by terms and conditions of the then-current Registrar accreditation agreement (which may differ from those of this Agreement) that ICANN adopts in accordance with Subsection 2.3 and Subsection 4.3. ICANN continues to closely monitor OnlineNIC's registration practices as well as its compliance with all RAA requirements. The fact that OnlineNIC is now under the 2009 RAA means more enforcement tools would be available to ICANN if OnlineNIC is found to be non-compliant with its RAA obligations. Regards, Ron Sherwood -------------------------------------------------------- Dear All, Please find below a copy of the final text adopted on Friday by the Commission on Science and Technology for Development (CSTD), and provided by Baher Esmat, Manager, Regional Relations for the Middle East. It is the view of the ALAC ExCom that becoming directly involved with the CSTD process constitutes mission creep. Indeed, some RALO bylaws specifically prohibit such involvement beyond the confines of ICANN. The statement below is therefore provided to our ALSes for informational purposes only, as an aid to understand the overall environment that ICANN is evolving in. As the text does not explain procedures used to choose CSTD invitees, we encourage the ALSes directly involved with that process to continue their work and look forward to continue receiving high-level updates on their valuable work. ** Final Text: The Chair of the CSTD establishes a Working Group of 15 member states plus the five member states which hosted the IGF meetings plus the two member states which hosted WSIS. This Working Group will seek, compile, and review inputs from all member states and all other stakeholders on improvement of the Internet Governance Forum in an open and inclusive manner throughout the process The Chair invites the following stakeholders to interactively participate in the Working Group, bearing in mind the the established rules of procedure of the ECOSOC, who will remain fully engaged throughout the process: 5 Business community 5 Civil society 5 Technical and academic community 5 Intergovernmental organizations Pursuant to the ECOSOC decisions 2010 226, 2010 22, and 2010 228, maximum possible assistance, the diversity of ideas, and the equal representation of stakeholders from developing and developed countries in the Working Group should be ensured in consultation with the stakeholders. Dear Councillors, I was really very much keen to participate to my last council meeting. Unfortunatley, for the last month I have faced health problems, that stopped me of many of the daily regular activities. I'm so sorry to miss meeting with you for the last time. It was really a good chance for me to join the ccnso wonderful group for the last 3 years. It was also a great pleasure sharing the discussions, debates and decisions. I'm glad that I have shared the launcing of the IDNs even as a fast track. Three years ago when I first joined the icann world, many were wondering whether this fast track can come true, but it is now! I do wish to have the chance to work with you again in the future. New ccNSO website!

Dear all, I am very pleased to announce that the ccNSO now has launched its new website: ccnso.icann.org This is only the first step in changing the site – we will constantly work on improving it and in future some technical features will also get implemented. You will notice that he structure of this site differs from the previous site. We hope that it is now more user-friendly and that you will quickly find all material you need. Under “Operations” you will find all work-related documents. Under “Library” a new search tool has been integrated. The “Sharing” page is summarising all kind of resources that might be of use for your registry. Our youtube channel is also featured here, as well as a (new) flickr-stream. It is our hope that you will use this page to share all kind of interesting information with the ccTLD community – from policy or technical resources, to photos. Have a look and get inspired! Finally – a huge thank you to all community members who took their time to share their thoughts and ideas with us, so that we were guided in which direction we should go when developing the site. In DAG 4 it was established at post-delegation process in the "support or non-objection" situations for geographical names. This has been a very important issue for the GAC. The wording in the GAC has been considerably weakened, and I would like to know why. This appears in the AG as follows: In footnote 12, page 2-20 in the redlined version; "It is also possible that a government may withdraw its support for an application at a later time, including after the new gTLD has been delegated, if a registry operator has deviated from the conditions of original support or non-objection". In the Attachment to Module 2, Sample Letter of Government Support, the text has been changed substantially from DAG 4 to AG. DAG 4: "(Government/public authority) further understands that the Registry Agreement provides that ICANN _will comply with_ (my underlining)a legally binding decision in the relevant jurisdiction where there has been a dispute between the (government/public authority) and the applicant". AG: ""(Government/public authority) further understands that the Registry Agreement provides that in the event of a dispute between (government/public authority) and the applicant,l ICANN _may implement_ (my underlining)the order of any court sitting in such jurisdiction in favor of such governmental entity related to the TLD." This text is repeated in the "New gTLD Agreement", Article 7, clause 7.13, which reads: "Government Support. In the event that the TLD was delegated to the Registry Operator pursuant to the consent of a governmental entity to use a geographic name related to the jurisdiction of such governmental entity, the parties agree that, notwithstanding any provision contained in this Agreement, in the event of a dispute between such governmental entity and Registry Operator, ICANN _may implement_ (my underlining again) the order of any court sitting in such jurisdiction in favor of such governmental entity related to the TLD." Of course, English is not my mother tongue, as you know, but in my mind - and what I have always been taught, "will" is much stronger than "may". For me it seems that this change of the text is changing the post-delegation to an issues which ICANN can obey at their discretion.
