Formal request of GAC Opinion or Advice per Annex B Section 8 of the ICANN Bylaws

Dear Thomas, As we have indicated during our joint meeting in Copenhagen, the ccNSO Council has initiated one (1) ccNSO Policy Development Process (ccPDP) to develop and recommend both a policy on the retirement of ccTLDs and on a review mechanism for decisions pertaining to the delegation, transfer, revocation and retirement of ccTLDs. The decision of the ccNSO Council is published and can be found at: <https://ccnso.icann.org/workinggroups/minutes-ccnso-council-meeting-15mar17 -en.pdf> https://ccnso.icann.org/workinggroups/minutes-ccnso-council-meeting-15mar17- en.pdf (Resolution 127-03 under agenda item 11). Please also find attached the Issue Report. After careful consideration of the Issue Report, the ccNSO Council decided to focus the attention first on the retirement of ccTLDs and then on the review mechanism. The work under the ccPDP will be organized through working groups. Their charters are included in the Issue Report. In a separate letter the members of the GAC will be invited to get involved in the effort in a way most convenient to them, with the understanding that participants from the GAC will not represent views of the GAC. As this Policy Development Process is organized through working groups and hence no Task Force, as foreseen in Annex B of the ICANN bylaws, is formed, I formally request you on behalf of the ccNSO Council, to offer opinion or advice on the Issue Report. Dear Councillors, We have received a letter from the Board with questions regarding the report of the EPSRP WG that we submitted. As you know, SSAC advised the Board not to adopt the proposals in the report. After discussions with SSAC it is clear to me that differences in our opinions are coming from different understanding of the essence of the proposals. The way I see it, it's more about the way we word them. For example, EPSRP WG said that the Registry must be given the right to mitigate the risks (of confusing similarity). The SSAC believes evaluation of mitigation strategy should be part of the overall evaluation process. Does one contradict the other? No. We have never objected to this approach (as long as IDN ccTLDs and IDN gTLDs are treated equally) and can fully subscribe to it. I have agreed with Patrik, the Chair of the SSAC on the following steps: 1. ccNSO and SSAC create a very small (very informal) working party which addresses the questions in the Board's letter. 1-3 representatives from each side. I have spoken to Hiro and Wafa and they agreed to be our reps on this working party – thank you very much for this! They know the work of the EPSRP WG and are willing to resolve this issue as efficiently and pragmatically as possible. Anyone else would like to volunteer to do the job? 2. The working party with reps from ccNSO and SSAC develops a document (a common position). 3. Both SSAC and ccNSO Council approve the document and send it to the Board. The optimistic plan is to have it by Johannesburg. Will it be possible? Hopefully so. 4. ccNSO/SSAC present the position (solutions) to the Board. How does the plan look to you? PLEASE VOTE: A Resolution related to the CCWG Accountability

Dear Councillors, Today I received a letter of resignation from Mathieu Weill, ccNSO appointed co-chair of the CCWG-Accountability (see below). Mathieu will leave Afnic on 1 May 2017 and take up a new position, which he cannot combine with the membership and co-chairmanship of the CCWG. Moving forward, we will have to take two decisions: - Appoint a co-chair to replace Mathieu. Jordan Carter, .nz is another very active ccNSO member on the CCWG. He has participated on the calls of co-chairs before and knows everything that needs to be done. Luckily, Jordan agreed to step. I don’t think we can find a better replacement for Mathieu; - Call for a new member to fill our slate of members on CCWG. Included is the resolution. I would appreciate if you could express your views as soon as possible, but definitely by next Tuesday, 2 May 2016, to ensure continuity of the CCWG and our role in the process. Kind regards, ]{atrina Resolution Background The ccNSO Council has received a letter from Mathieu Weill, .fr, informing that he steps down as a ccNSO appointed co-chair of the cross-community working group Accountability (CCWG) and resigns as a ccNSO appointed member. As one of the chartering organsations of the CCWG, the ccNSO may appoint a co-chair and up to five (5) members on the CCWG. To ensure continuity of the CCWG and the role and input of ccTLDs in the work stream 2 process, the ccNSO Council decides: Decision 1. The ccNSO Council appoints Jordan Carter, .nz, as the ccNSO appointed co-chair of the CCWG effective immediately, to replace Mathieu Weill in that position. The Chair of the ccNSO is requested to inform the other co-chairs, chartering organisations and relevant ICANN staff accordingly. Decision 2. The Secretariat is requested to launch a call for membership on the CCWG. The ccNSO Council will use the same selection process as for the original appointments and replacements for WS 2. The Council decided to first focus the efforts on the retirement of ccTLDs and directed the ccNSO secretariat to send out a call for volunteers for the working group dealing with this topic. Background The goal of the working group (WG) is to report on and recommend a policy for the retirement of the delegated Top Level Domains associated with the country codes assigned to countries and territories listed in the ISO 3166-1 within the framework of the ccNSO Policy Development Process. To achieve its goal, the WG shall initially focus on and be guided by the topics and issues listed below in section 1.3 If other topics and issues become apparent that are not listed and that in the view of the WG need to be addressed to achieve its goal, the WG should take these into consideration and inform the ccNSO Council and Issue Manager accordingly. As this WG will undertake its activities within the framework of the ccNSO Policy Development Process, the limitations with respect to the scope of a ccPDP, specifically by Article 10 and Annexes B and C to the ICANN Bylaws shall also limit the scope of the WG’s work. The high-level topics and issues the working group is expected to deal with are: * Consistency of terminology * What triggers a retirement? * Who triggers retirement process? * Additional conditions for retirement of a ccTLD?
