17 March 2022 Appointment ccNSO Council Chair and Vice-Chairs Dear John, At its meeting on 10 March 2022 and ion accordance with the temporary election procedure adopted on 24 February 2022, the ccNSO Council appointed Alejandra Reynoso (.gt) as Jordan Carter (.nz) and Adebiyi Oladipo (.ng) as Vice-Chairs. Greetings, First, I want to commend Jordan for his brilliant effort leading the call… Second, I apologise to everyone for being late to the call; I am in a bit of dental “hell” at the moment… I believe that Jordan has summed it up; Becky and Patricio seemed OK with the explanations/clarifications offered, and my “gut” read is that ICANN legal is going to be on board with the Review Mechanism Policy at the end of the day. Hi all We had the call with Becky and Patricio and icann legal this morning. Very short summary: helped clarify the remaining issues and I don't think we will need another call let alone an exchange of letters. Becky clearly 'gets it' in respect of the intent, and the lawyers seemed to too. Others may have more to add? Dear Eberhard I note your concern, however I also want to draw your attention to the extensive discussions the Council had on this matter at its December and January meetings. The outcome, which was agreed upon by all councillors present at these meetings, was: - The Councillors on the drafting team (which includes the chair of the ccPDP3 RM WG and other members of the WG) will meet with the caucus - The full response drafting team should be invited to prepare for the call with the Board Caucus. - The spokesperson i.e. the person co-chairing the meeting from the ccNSO side will be the ccNSO Council vice chair. The detailed feedback has been very useful in refining our understanding of the intended scope and objectives of the policy recommendations. As mentioned in my previous email, we have identified a small number of remaining questions about the policy recommendations, and we would like to discuss these points in order to ensure a shared understanding of the ccNSO’s intent and objectives for the CCRM policy recommendations. We look forward to our upcoming conversation, to discuss these points and move forward with a clear, shared understanding. Below is a brief overview of the points for further discussion: 1. Objective: Procedural and Substantive Review. - We understand that the ccNSO is seeking a simple and low cost process to review disputed decisions regarding the delegation, transfer, revocation, and retirement of ccTLDs. - Based on your responses, we also understand that the envisioned Independent Review Mechanism is intended to determine (i) whether the IANA Function Operator (IFO) followed its processes in making certain decisions and (ii) whether the IFO applied the applicable policies and procedures fairly. - In our experience, the desire for a simple and low cost process is in some tension with the requirement for a substantive/fairness review. We would like to discuss this further with the ccNSO to make sure we have a shared understanding of the role of the CCRM Review and in order to reconcile these objectives. 2. Scope of the Review - It is important to ensure that we are all on the same page regarding the relevant policies to be applied by the CCRM Reviewers. In particular, we would like to discuss the reference to “any other policies developed through a ccNSO policy development process and adopted by the ICANN Board” in Section 4.1. Is this a reference to existing policies, to policies that may be adopted in the future, or to both? If both, is it possible to develop a comprehensive list of applicable policies? Also, should this include previous decisions of the IFO, which would seem to be relevant to the fairness analysis? 3. Role of ICANN President and CEO - We seek clarification from the ccNSO on the intended role of the CEO, specifically regarding the role envisioned for the CEO’s involvement in reviewing the IFO’s failure to comply with the CCRM’s finding. Could this create issues given the existing role of the CEO in the IANA Customer Service Complaint Resolution Process? We look forward to reviewing these points with the drafting team. Best, Becky

Dear all, In preparation of tomorrow’s working session you can find results from the previous working session. As you will recall the purpose of this cycle of working session is to produce a roadmap to improve the ccNSO working methods and resourcing to be discussed and presented by ICANN82. As you may recall the attendees of the Istanbul working sessions focused on the following two aspects of improving the capacity: * What are we trying to accomplish by improving the capacity of the ccNSO to deliver on its Purpose and Goals? The results of this part of the working session are included in the consolidated notes and clustered in the What are we trying to accomplish overview. * What changes can we make that will result in improving the capacity of the ccNSO to deliver on its work? The results are included in the consolidated notes and how to build capacity overview In tomorrow’s session the focus will be on two following questions, building on the outcomes of the previous session, specifically on the results of the 2nd part of that session: * What do you want to do to increase capacity (improve working methods and/or resources)? * How would you that? What would it take to do that?
