However, we thought you would prefer to receive this update sooner rather than later, so that you can inform your respective groups and factor in the need to initiate your internal processes to select members for the Community Representatives Group into your overall planning and current activities. Please therefore find attached the updated, proposed Terms of Reference (ToR) that will guide the work of the Community Representatives Group to select a slate of nominees for the Independent Review Process (IRP) Standing Panel. We have included the additional criteria suggested by Donna as well as cleaned up the document to reflect previous feedback from various groups. As the first action will involve constituting the Community Representatives Group, I will also highlight the fact that we have noted your collective preference that the Group be kept small, comprise an odd number (at least 7, but not more than 15, members), be as diverse as is feasible, and possess certain skillsets in the aggregate. The updated ToR also notes that the Group will seek to act by consensus, select its own Chair, and maintain confidentiality of its deliberations while maintaining as much transparency as is practicable (e.g. publication of the final ToR, the Group members’ Statements of Interest and other relevant documents). Assuming that the updated ToR reflects your understanding of the agreements reached and general expectations of the role and tasks for the Group, we suggest issuing a call for Expressions of Interest for potential Group members soon. WG chair and Vice-chair nomination prooces

Dear all, One action item from last week’s Council call was to recap the issue underlying the chair/vice-chair nominations of the ccPDP4 WG, and alternative approaches to resolve it. Basic issue to date it was not necessary to have a detailed procedure in place for the WG chair and Vice-Chair Nomination by the WG. However with new members this issue became apparent and resulted in a situation where the (informal) nomination is questioned and may impact the effectiveness of the working group. Proposed way forward: The Council supports to suggest to the WG a more detailed nomination procedure based on a combination of the current mechanism for Council and vice-chair(s) and general selection procedure. The Chair of the Council will inform the WG of the decision and present the nomination procedure. The chair and vice-chair nomination and future sub-WG nomination will be run accordingly. The proposed procedure, after going through normal process, will be added to the ccNSO WG Guideline as an Annex. Please note that the basic principle that Council is expected to appoint the Chair and Vice-chair() of Working groups at the nomination of the working group members is NOT at stake. Please advise by Tuesday 3 November 2020, whether you agree, or have any questions, suggestions. Recap ccPDP4 WG chair and vice-chair nomination. After a call for nominations, 4 persons were nominated, and on the call following the call based on information at that point a chair and vice-chair were selected. After the call a member raised concerns that the process was not detailed enough: no deadline for closure of the call for nominations, no deadline for acceptance of the nomination and no selection process. The Guideline: ccNSO Working Groups does not detail the nomination process ( see: https://ccnso.icann.org/sites/default/files/filefield_47785/guidelines-work…) Following the WG Call on 6 October, two alternatives were proposed to the WG: Alternative 1. Keep nomination as is ( Kenny as chair and Anil as Vice-chair) and the ccNSO Council will be asked to appoint them. For the up-coming sub-working groups chair nominations the WG will agree first upon light-weight procedure ( deadline for nominations and acceptance of nominations, procedure to express preference if more than one candidate. Alternative 2. Circulate light weigh procedure for chair / vice chair nomination by the WG members. WG to adopt procedure. After adoption start with step that all nominees will be again and explicitly be asked to express their willingness to stand as Chair/vice-chair. If more than one candidate for either chair or vice-chair role only the members of the WG will be asked to express their preference (confidentially). For sub-working groups we will use the same nomination procedure as shared There was no clear preference for either two options. Some suggested to appoint one chair and two-vice chairs, however the charter suggests one vice-chair, and, more importantly, the sub-working groups will need their own chairs as well. With adding an additional vice-chair the pool of potential chairs will become smaller. According to the Charter the WG leadership should avoid to become sub-working chair. Other suggested that the WG would develop its procedure first and then, accordingly, would nominate its chair and vice-chair. Moving forward. On the Council call 3 alternative approaches were proposed to resolve the issue: 1. Suggest to the WG a more detailed nomination procedure based on a combination of the current mechanism for Council and vice-chair(s) and general selection procedure 2. Appoint current nominees, and additional vice-chair. 3. Ask the WG to develop its own procedure and organize call for nomination. Proposed way forward is that the Council supports option 1, and the Chair of the Council will inform the WG of the decision and the nomination procedure. The chair and vice-chair nomination and future sub-WG nomination will be run accordingly. Election Notice: ICANN Board Seat 12

Dear ccNSO Members, This is to inform you about the forthcoming ICANN Board seat 12 elections. The elections will start on Wednesday, 4 November 2020 (00:01 UTC) – and close on Wednesday, 18 November 2020 (23:59 UTC), according to the timeline<https://ccnso.icann.org/sites/default/files/field-attached/timeline-nominat…> previously adopted by the ccNSO Council. Following the Call for Nominations, two candidates were nominated, seconded and accepted their nomination and the due diligence or background check was concluded without identifying any issues or concerns. On 15 October 2020, one of the candidates informed the ccNSO Council, ccNSO Membership and the Nomination Process Manager that he withdrew his name for consideration for the Board Seat 12 term which starts in October 2021. Consequently, there is only one remaining candidate: Katrina Sataki. As per the relevant guideline, an election will still be held. The ballot will include two options: the name of candidate and ”None of the Above”. The latter option was added after ccNSO members expressed the need for such an option. Katrina submitted her candidate statement<https://ccnso.icann.org/en/workinggroups/sataki-statement-16jul20-en.pdf> to the ccNSO. She was interviewed and answered questions from the ccNSO members and broader ccTLD community at a Question and Answer session, held during the ccNSO Members Meeting at ICANN69. Dear ccNSO members from the Asia-Pacific region, This is to inform you about the elections for the position of one ccNSO council member for the Asia-Pacific region. Voting in the first round starts on Tuesday, 03 November 2020 (00:01 UTC) and closes on Tuesday, 17 November 2020 (23:59 UTC), as per the timeline<https://community.icann.org/download/attachments/138970351/Item%209%20-%20t…> approved by the ccNSO Council. In accordance with the applicable rules, three (3) candidates from the Asia-Pacific region were nominated, seconded and have accepted their nomination. Consequently, an election will be held among the ccNSO members of the Asia-Pacific Region according to the timeline previously agreed upon by the ccNSO Council. Only ccNSO members from a Geographic Region are allowed to vote for candidates to the ccNSO Council from that Geographic Region. You can vote an unlimited number of times, but only the last vote submitted will be counted. As per the relevant guideline, a majority of all ccNSO members in the Geographic Region entitled to vote shall constitute a quorum, and the selected candidate must receive the votes of a majority of those cast by ccNSO members within the Geographic Region. Next Steps The election closes on Tuesday, 17 November 2020 (23:59 UTC). The Election Manager will announce the voting results on Wednesday, 18 November 2020 (latest by 23:59 UTC). The ICANN Board recognizes Biaou's commitment to local and regional capacity-building programs in his home country of Benin as well as across Africa. He has worked to improve the technical skills of women in Africa and encouraged their participation in endeavors related to the Internet and Domain Name System (DNS). Through his efforts, the diversity and number of new ICANN community members increased. NEW: ICANN69 GAC Communiqué Now Available The GAC announced that their ICANN69 Communiqué is now available. The GAC provides advice to the ICANN Board on policy matters where there may be an interaction between ICANN’s policies and various laws, international agreements, and public policy objectives. NEW: ICANN org Responds to the European Data Protection Board’s Public Consultation on the Board’s Guidelines on the Concepts of Controller and Processor ICANN recently announced that it has responded to the European Data Protection Board's (EDPB) public consultation on its Guidelines 07/2020 on the concepts of controller and processor in the GDPR. The EDPB is an independent European body whose purpose is to ensure consistent application of the General Data Protection Regulation (GDPR) and to promote cooperation among the European Union data protection authorities. The issue of controllership has been critical throughout the work of the Expedited Policy Development Process on the Temporary Specification for gTLD Registration Data (EPDP) and remains important for the implementation of a System for Standardized Access/Disclosure as recommended by the EPDP Phase 2 Team. In ICANN org's response to the public consultation, which closed today, it was noted that while the guidelines are a helpful step, ICANN org believes that further clarity would be beneficial in three areas: Precise attribution of "control" to particular stages in the processing under a micro-level analytic framework. When and how is "control" inferred from a contract, absent a party's actual involvement in processing contemplated under any such agreement. The newly introduced concept of "converging decisions."
