Draft Resolution and draft charter WG EPSRP

Dear all, Please find included draft resolution and draft charter for the creation of the WG EPSRP. Background for the WG is the Board request of 25 June 2015 to provide further guidance to provide further guidance on and refinement of the methodology of second string similarity review process. As indicated on the last Council call (20 August), staff would prepare a draft and send it to Council for adoption by email. Please let me know if you have any comments, reservations please respond by 11 September, noon UTC. If no objections or abstentions by that time, staff will send out a call for volunteers on Friday 11 September 2015. Kind regards, Bart Resolution on establishing WG EPSRP Background and introduction At its meeting on 25 June 2015 the ICANN board of Directors requested "the ccNSO, in consultation with other stakeholders, including GAC and SSAC, to provide further guidance on and refinement of the methodology of second string similarity review process, including the interpretation of its split recommendations, to be applied to the relevant current and subsequent cases in the IDN ccTLD Fast Track process as well as to inform the proposed policy for the selection of the IDN ccTLD strings"[1] . As discussed at its meeting on 20 August staff and affected parties have drafted charter as requested. As part of that process Giovanni Seppia (.eu) has indicated his willingness to become chair of the WG. As the scope of the WG is very limited, membership will be limited. In order to meet request that in particular the GAC and SSAC will be consulted, it is suggested that the GAC and SSAC will become participating organisations and as such will, at a minimum, not-object to submitting the recommendations of the WG to the Board of directors. Draft Resolution The ccNSO Council adopts the proposed charter for the Working group to provide guidance on aspects string similarity review - (WG EPSRP) and request the secretariat to send out a call for volunteers, which should takes into account the requirements listed in the charter. The ccNSO Council appoints Giovanni Seppia (.eu) as chair of the WG. In order to meet the concerns raised and according to the power vested in the ccNSO Council by the Guideline, the ccNSO Council has established a procedure for the 2016 NomCom Appointment (the Council resolution of 4 September 2015 will be posted shortly at: http://ccnso.icann.org/about/council/decisions-resolutions.htm) In accordance with the Council resolution we are now looking for a volunteer to serve on ICANN's Nominating Committee (NomCom) on behalf of the ccNSO. Candidates may self-nominate. Those of you who have already self-nominated during the previous round will remain candidates. ccNSO Council submission on ICG Proposal Stewardship Transition

Dear all, The ccNSO Council has commented on the Proposal to Transition the Stewardship of the Internet Assigned Numbers Authority (IANA) Functions, in particular on section 1027, the current status of the Framework of Interpretation (FOI), and section 1036, References to documentation of policy development and dispute resolution processes. With regard to the FOI, the ICG is recommended to update the text to reflect the current state of affairs ( the FOI was adopted buy the ICANN Board of directors in June 2015). With respect to the references to documentation etc.section, the ICG is recommended to remove the reference to ICP-1 from section 1036. Draft Submission on ICG Proposal

The team would also appreciate expressions of support:-) Thank you and kind regards, Bart ------------------------------------------------------------ ccNSO Council Submission on the Proposal to Transition the Stewardship of the Internet Assigned Numbers Authority (IANA) Functions 7 September 2015 The ccNSO Council welcomes the opportunity to review the Proposal to Transition the Stewardship of the Internet Assigned Numbers Authority (IANA) Functions from the U.S. Commerce Department’s National Telecommunications and Information Administration (NTIA) to the Global Multistakeholder Community. The comments of the ccNSO council focus on sections 1027 and 1036 of the ICG’s Proposal. This submission was adopted by the ccNSO Council (unanimously/majority) through email vote on 7 September 2015. On behalf of the ccNSO Council Byron Holland, Chair Framework of Interpretation (Section 1027) The Council wishes to bring to your attention that certain statements set out in section 1027 of the consolidated IANA stewardship Transition proposal are rendered obsolete.. >From the Proposal (s.1027) “The ccNSO formally endorsed the FOIWG’s Final Report in February 2015 and transmitted it to the ICANN Board of Directors. It is currently pending review and adoption by the ICANN Board.” The Framework of Interpretation (FOI) is no longer pending. At its meeting on 25 June 2015 ICANN’s Board of Directors adopted and endorsed the Framework of Interpretation without reservation. The Board of ICANN directed that “the CEO & President or his designee to develop an implementation plan for the recommendations for community consideration through a public comment, and to implement the plan when finalized.”[1] We understand the difficulty to reflect the current state-of affairs of the matters documented in the proposal. However, in order given the paramount importance of the Framework of Interpretation in the context of delegation and re-delegations of ccTLDs, it is also important that there be a defined and current baseline documentation available post-transition. Accordingly, we recommend the ICG, to consider the Proposal a 'living instrument' and update it from time-to-time to accurately reflect the actual and current state of affairs regarding the Framework of Interpretation. We suggest it is updated by the ICG up and until the submission of the Transition Proposal to the ICANN Board of Directors. The ccNSO Council undertakes to inform the ICG on future relevant matters relating to the Framework of Interpretation, if any, to assist the ICG in keeping the Proposal up to date with respect to all matters pertaining to ccTLDs. References to documentation of policy development and dispute resolution processes (ccTLDs) (Section 1036) The ccNSO Council notes that the list of reference documentation of policy development and dispute resolution process (ccTLDs), section 1036, includes a reference to ICP-1, carrying the implication that ICP-1 is policy. The ccNSO Council regrets this, and believes that this reference creates unnecessary ambiguity and uncertainty now and, more importantly, for the post-transition landscape. The ccNSO Council further regrets that the inclusion of such a reference has unnecessarily re-opened a debate on the proposal as a whole, and as a result has had a adverse effect on the support for the Stewardship Proposal by the ccTLD community. Inclusion of a reference to ICP-1 in this way is incorrect. It is not a document of policy development and dispute resolution processes as implied by the heading of this section. As noted in section 1027 of the Proposal, the ccTLD community and the ccNSO have very longstanding and formal objections to ICP-1 on the grounds of both content and procedure. Further, as noted above, section 1025 of the Proposal, following formal submision of the Framework of Interpretation, the ICANN board has agreed to our recommendation that ICANN is to archive ICP-1, News Memo – 1 and also the GAC Principles 2000 (superseded by the GAC Principles 2005[2]). Also, the Framework of Interpretation, accepted unanimously by ccTLD members of the ccNSO, articulates that RFC1591 and the 2005 GAC Principles are they only applicable policies and guidelines for delegations and redelegations of ccTLDs. Finally, we observe that referencing ICP-1 alone in this section is inconsistent. Either, all obsolete and non-policy documentation should be included, or only actual and current documentation. In the first case News Memo – 1 and the GAC Principles 2000 along with several early RFCs should be included as well (marking them as obsolete and their status of archived), or none of them should be referenced at all. In the announcement, NTIA explains that: "Beyond 2016, we have options to extend the contract for up to three additional years if needed. This one-year extension will provide the community with the time it needs to finish its work." IANA-related intellectual property rights An area of ongoing discussion related to the ICG's Consolidated IANA Stewardship Proposal has to do with the future of where the IANA-related trademarks and domain names will be held – referred to in the discussions as the IANA IPR. Of the three operational community proposals, only the numbering resources community, in its proposal<http://www.nro.net/crisp-final-proposal> developed by the Consolidated RIR IANA Stewardship Proposal Team (CRISP Team), documented a concrete suggestion for keeping the holder of IANA's IPR separate from the operator of IANA functions. The CRISP Team proposal states: "It is the preference of the Internet Number Community that the IANA trademark and theIANA.ORG domain name be transferred to an entity independent of the IANA Numbering Services Operator, in order to ensure that these assets are used in a non-discriminatory manner for the benefit of the entire community. From the Internet Number Community's perspective, the IETFTrust would be an acceptable candidate for this role." The protocol parameters community, via the IANAPLAN working group, found this an acceptable way forward and the IETF Trust confirmed it was willing to take on the task, if requested. The names community proposal, developed by the Cross Community Working Group Develop an IANA Stewardship Transition Proposal on Naming Related Functions (CWG-Stewardship<https://community.icann.org/display/gnsocwgdtstwrdshp/CWG+to+Develop+an+IAN…>), did not contain any specific proposal about how to handle the IPR. On 15 August, the ICANN Board announced<https://www.icann.org/news/announcement-2015-08-15-en> that ICANN is: "…Prepared to transfer full ownership of the IANA-related trademarks to a neutral third party mutually agreed among the operational communities with the understanding that ICANN, as the current IANA Functions Operator, will be granted license to those trademarks and ICANN will maintain operational control of the IANA.ORG domain for as long as ICANN remains the IANAFunctions Operator." On their 20 August call, the CWG-Stewardship agreed that the IANA IPR can be held a by neutral third party. The CWG-Stewardship sees its position on the IANA IPR as consistent with the other two proposals. Requirements for the neutral third party can be coordinated with the other communities in implementation. The CWG-Stewardship committed to issuing a statement before the close of the ICGpublic comment. Drafting of updated ICANN Bylaws Both the proposals of the CWG-Stewardship and the CCWG-Accountability include changes to ICANN's Bylaws<https://www.icann.org/resources/pages/governance/bylaws-en>. Below is a summary of the most recent developments: * On 11 August, Sidley Austin sent the CWG-Stewardship a draft matrix<http://mm.icann.org/pipermail/accountability-cross-community/attachments/20…> of ICANN Bylaws, designated and set out in the CWG-Stewardship Final Proposal. * On 19 August, the co-Chairs of the CCWG-Accountability formally requested<http://mm.icann.org/pipermail/accountability-cross-community/2015-August/00…> ICANN's general counsel, John Jeffrey, to begin working with the CCWG-Accountability's external counsel to draft language to include the Affirmation of Commitments<http://www.ntia.doc.gov/ntiahome/domainname/Affirmation_of_Commitments_2009…> (AoC) reviews into ICANN Bylaws, as defined by the CCWG-Accountability and in line with the agreed-upon process (see attached for full reference).
