Preparation meeting with the Board Ad-Hoc group to report on format of discussion, intended outcomes from a Council perspective and agree on roles of Councillors (see Annex A) 1. Identify non-ccNSO sessions on main schedule in which to participate and highlight Identify main sessions of relevance on the main schedule where attendance of Councillor is advisable to report on highlights (if any) discussed. 1. ccNSO & UA Ad-hoc group expected actions Additional volunteers. Preparation and agree on expected role of ad-hoc group. 1. Information “Holistic” Review: preparation Council decision (11.30 local time) ICANN staff supporting the “Holistic review” effort will provide the overview. Preparation for Council decision on if and how to participate in the process. If time permits: 1. Preparation Workshop: How to improve effectiveness and efficiency of the ccNSO processes, including PDPs? Scheduled meeting 189 (17 November 2022, 18.00 – 20.00 UTC) Establish prep team and create a preliminary list topics to be discussed 1. Run through Council agenda Annex A The question from the Board: What collaborative actions should the Community, Board and Org be undertaking to further progress achieving our strategic priorities?” Clarification on question from the board: * "Strategic priorities" refer to the strategic objectives. * "Our" is used in the context of the Strategic Plan. The main idea is to have a long term perspective, what is next for us (ICANN Community) to do. How to get things done together. In preparation the small group agreed: 1. To have an open dialogue around the different elements of the question and 2. The small group would like to know what other SO/ACs responded and how the input they gather from all the groups will be used. Therefore, and taking into consideration what this small group discussed at the call, the topics to touch upon are: 1. Prioritization: Visualization of complexity and how to enhance processes. * What are we doing specifically in the ccNSO. * SOPC comments, the takeaways from the last plenary session on "Who sets ICANN's priorities" and Prioritization Framework. * Efficiency: Things can be prepared in advance by ICANN and suggested to the community. * Metrics: SOPC comments. To make progress one needs to measure, how is this envisioned can this be improved? 2. What working together means: Collaborative action. * ccNSO position in the community. * How are ccTLDs different from gTLDs? * Voluntary work motivation. * How we expect a collaborative relationship with ICANN: * Open and fluid communication. * Coordination when having conversations with Governments that might affect the ccTLDs. (EU case, African Coalition, etc.)

Dear All, The 3-year term for five members of the ccNSO Council will end in March 2023, at the end of the ICANN76 Community Forum: Africa: Souleymane Oumtanaga Asia Pacific: Ai-Chin Lu Europe: Chris Disspain Latin America/Caribbean: Alejandra Reynoso North America: Stephen Deerhake The ccNSO is opening a call for nominations to fill those seats: the nomination and secondment procedure starts 14 September 2022 (00:01 UTC) and closes 3 weeks later Wednesday, 5 October 2022 (23:59 UTC). This announcement about the call for nominations and other relevant news will be posted here: https://ccnso.icann.org/en/about/elections/council.htm The ICANN Bylaws, Article 10 – Section 10.4 (g)<https://www.icann.org/resources/pages/governance/bylaws-en/#article10> state: "(g) The ccNSO Council members selected by the ccNSO members from each Geographic Region (see Section 10.3(a)(i)) shall be selected through nomination, and if necessary, election, by the ccNSO members within that Geographic Region. At least 90 days before the end of the regular term of any ccNSO-member-selected member of the ccNSO Council, or upon the occurrence of a vacancy in the seat of such a ccNSO Council member, the ccNSO Council shall establish a nomination and election schedule, which shall be sent to all ccNSO members within the Geographic Region and posted on the Website." How to nominate and second a candidate Timeline The nomination and secondment procedure starts Wednesday, 14 September 2022 (00:01 UTC) and closes 3 weeks later Wednesday, 5 October 2022 (23:59 UTC). Who can nominate or second? The ICANN Bylaws, Article 10 – Section 10.4 (h)<https://www.icann.org/resources/pages/governance/bylaws-en/#article10> state: "(h) Any ccNSO member may nominate an individual to serve as a ccNSO Council member representing the ccNSO member's Geographic Region. Nominations must be seconded by another ccNSO member from the same Geographic Region. By accepting their nomination, individuals nominated to the ccNSO Council agree to support the policies committed to by ccNSO members." As per the relevant ccNSO guideline<https://ccnso.icann.org/sites/default/files/field-attached/guideline-ccnso-…>, new ccNSO members are able to participate in the nomination process if the ccNSO membership application has been approved by the ccNSO Council one day prior the nomination process starts, i.e. latest on 13 September 2022. Individuals are elected in their personal capacity and serve the ccTLD community. Councillors do not represent the views and interests of their employers. Candidates need to be neither resident in the region, nor a citizen of a country, within the region in which they stand for election. A valid candidate is one that has been nominated and seconded according to the ccNSO council Election Guideline, and that has accepted the nomination. If there is more than one valid candidate in a Geographical Region, an election shall be conducted in that region. Voting will be by secret ballot: the ballot is identified only by a code and not by a name. During a Council Election Webinar (held on 6 and 8 September), the ccNSO Chair and other Councillors gave an overview of the election process and address the need to replace Councillors at reasonable and regular intervals. Moreover, they provided further information about the required skill sets for Councillors, the time commitment and working methods of the ccNSO Council. Accepting nominations After closure of the nomination period, the Election Manager will ask the candidates that are nominated to accept their nomination. Self-nominations are understood to have accepted their nomination. The Election Manager will provide a list with the name(s) of the candidate(s) who have accepted their nomination. A record of who has nominated and seconded the candidate(s) is publicly available: http://forum.icann.org/lists/ccnso-nominations Next steps The Election Manager will ask the candidates to provide a written candidate statement. A Question and Answer session with the candidate(s) will be held in the 17-21 October timeframe (exact time and date to be confirmed). In preparation of the Q&A session, the written candidate statements will be posted on the ccNSO website. The Q&A session gives the ccNSO members and broader ccTLD community an opportunity to interact with the candidates. If at the close of nominations there are no more valid candidates in a particular geographic region than there are seats on the ccNSO Council available for that geographic region, then the nominated candidates shall be selected to serve on the ccNSO Council. Otherwise, an election shall be held for that geographic region, to select the ccNSO Councillors from among the valid candidates. Chris Disspain, ccNSO Councillor since January 2022, was selected by the Council to serve on NomCom 2023 in April 2022. 2. ICANN org was informed accordingly. 3. Chris’s term as Councillor ends in March 2023, at the end of the Council meeting during ICANN76. 4. It is the understanding of Council that according to ICANN Bylaw Article 8.8, a person who serves on the NomCom may not be selected for the ccNSO Council by the members, while serving on the NomCom. 5. To ensure the interpretation is correct and to include a provision in the ccNSO internal procedure, post iCANN 75 ICANN legal will be asked to share their opinion on the interpretation on the scope of ICANN Bylaw Article 8.8 ( see below strawman for your consideration) 6. To avoid any issues, Chris has stepped down as ccNSO appointed delegate to the 2023 NomCom and the chair of the NomCom, has been informed accordingly. 7. The 2023 NomCom has not yet been convened. This is expected to take place after closure of ICANN75. All delegates to the NomCom, including the ccNSO appointed delegate are expected to attend the first NomCom meeting. 8. The Council discussed the possibility to select the second most preferred candidate, from the 2023 NomCom call for Expression of interest. However, the internal procedure states that a vacancy has to be filled using the general selection procedure. This could be mitigated if – as stated in section 9.2 of the Guideline - the procedure does not provide guidance and/or the impact is unreasonable to conduct the business of the ccNSO. However, the impact of using the procedure would effectively only increase fairness and the acceptability of the result. 2. Following section 8.1 of the same ccNSO internal procedure, the Council is expected to “initiate a process i.e. whenever a position needs to be filled, the ccNSO Council shall appoint a member of the secretariat to manage the process (the Process Manager) and adopt a timeline, which includes the major milestones. After the process is initiated, the ccNSO Council instructs the ccNSO Secretariat to issue the call for Expression of Interest for membership.” 1. To fill the vacancy after Chris’s resignation. on the 2023 NomCOm, the ccNSO Council will need to appoint the selection process manager and adopt a timeline and instruct the selection process manager to launch the call for expression of interest. 2. It is proposed to appoint Joke Braeken as selection process manager. 3. The following timeline is suggested: Pre-alert call for expression of Interest: 24 August 2022 (Secretariat, announcement to include note that Chris stepped down as ccNSO appointed delegate, note on requirements, including expectation that delegate is available during constitutive meeting of 2023 NomCom meeting. 1. * Call for expression of Interest: from Friday 26 August until 2 September 2022 * Selection process Councillors: Monday 5- Thursday 8 September 2022 * Inform Council of results: Friday 9 September 2022 * Formal appointment: email decision 12- 14 September * Inform ICANN Org and Chair of NomCom: 15 September 2022. The ccNSO Council adopts the proposed timeline, starting with the call for expression of interest as the ccNSO appointed delegate on the 2023 NomCom, starting with the call for expression of interest on Friday 26 August 2023. ------------ Strawman draft letter to ICANN legal Dear John, Recently the ccNSO Council has run into the issue that one of its members was selected to serve on the NomCom and this person’s term on Council would end in March 2023 halfway through the expected term of service on the NomCom. As a result, and to avoid any potential issues when made aware of Article 8.8, this person stepped down from serving on the NomCom in the hope to be elected as Councillor again by the ccNSO membership. Further, in the past the ccNSO Council has selected a Councillor to serve, however that person’s term did not conclude while serving on the NomCom. Going forward, the ccNSO Council would appreciate your opinion on the scope of Article 8.8 to ensure the ccNSO internal selection procedure will be aligned with the Bylaws again, specifically, Would Article 8.8 preclude the selection of a Councillor to serve on the NomCom? PRSP is part of ICANN’s Global Domains and Strategy (GDS) function. Our scope includes enabling informed participation in the ICANN multistakeholder model and helping to foster secure, stable, and universal operation of multilingual domain names and email addresses for Internet users around the world. We support the implementation of consensus policy recommendations for generic top-level domains (gTLDs) which includes the ongoing New gTLD Subsequent Procedures (SubPro) Operational Design Phase (ODP). This PRSP briefing provides status updates and progress reporting on the various communityfacing projects that we support, all in preparation for discussions during the upcoming ICANN75 meeting. Our hope is that these pre-ICANN meeting briefings will become a valuable resource for the community, and increase visibility and accountability for the many projects we support and lead on. The ccNSO secretariat is now initiating the selection process. Councillors eligible to vote are now expected to make a selection. The deadline for submitting your vote is Friday, 9 September 2022 (17 UTC). After 17 UTC that day, the ccNSO Secretariat will inform Council about the outcome of the selection process. A formal appointment will happen via an online decision (12-14 September). It is the understanding of Council that according to ICANN Bylaw Article 8.8, a person who serves on the NomCom may not be selected for the ccNSO Council by the members, while serving on the NomCom. 5. To ensure the interpretation is correct and to include a provision in the ccNSO internal procedure, post iCANN 75 ICANN legal will be asked to share their opinion on the interpretation on the scope of ICANN Bylaw Article 8.8 ( see below strawman for your consideration) 6. To avoid any issues, Chris has stepped down as ccNSO appointed delegate to the 2023 NomCom and the chair of the NomCom, has been informed accordingly. 7. The 2023 NomCom has not yet been convened. This is expected to take place after closure of ICANN75. All delegates to the NomCom, including the ccNSO appointed delegate are expected to attend the first NomCom meeting. 8. According to the procedures of the NomCom “Vacancies that may occur in the NomCom may be filled for the remainder of the term by the same means through which the position was initially filled.” (https://www.icann.org/resources/pages/nomcom2021-operating-procedures-2021-…) 9. This vacancy shall be filled by the ccNSO Council using the selection procedure as described above (emphasis added). 1. The Council discussed the possibility to select the second most preferred candidate, from the 2023 NomCom call for Expression of interest. However, the internal procedure states that a vacancy has to be filled using the general selection procedure. This could be mitigated if – as stated in section 9.2 of the Guideline - the procedure does not provide guidance and/or the impact is unreasonable to conduct the business of the ccNSO. However, the impact of using the procedure would effectively only increase fairness and the acceptability of the result. 2. Following section 8.1 of the same ccNSO internal procedure, the Council is expected to “initiate a process i.e. whenever a position needs to be filled, the ccNSO Council shall appoint a member of the secretariat to manage the process (the Process Manager) and adopt a timeline, which includes the major milestones. After the process is initiated, the ccNSO Council instructs the ccNSO Secretariat to issue the call for Expression of Interest for membership.” 1. To fill the vacancy after Chris’s resignation. on the 2023 NomCOm, the ccNSO Council will need to appoint the selection process manager and adopt a timeline and instruct the selection process manager to launch the call for expression of interest. 2. It is proposed to appoint Joke Braeken as selection process manager. 3. The following timeline is suggested: Pre-alert call for expression of Interest: 24 August 2022 (Secretariat, announcement to include note that Chris stepped down as ccNSO appointed delegate, note on requirements, including expectation that delegate is available during constitutive meeting of 2023 NomCom meeting. * Call for expression of Interest: from Friday 26 August until 2 September 2022 * Selection process Councillors: Monday 5- Thursday 8 September 2022 * Inform Council of results: Friday 9 September 2022 * Formal appointment: email decision 12- 14 September * Inform ICANN Org and Chair of NomCom: 15 September 2022. The ccNSO Council adopts the proposed timeline, starting with the call for expression of interest as the ccNSO appointed delegate on the 2023 NomCom, starting with the call for expression of interest on Friday 26 August 2023. ------------ Strawman draft letter to ICANN legal Dear John, Recently the ccNSO Council has run into the issue that one of its members was selected to serve on the NomCom and this person’s term on Council would end in March 2023 halfway through the expected term of service on the NomCom. As a result, and to avoid any potential issues when made aware of Article 8.8, this person stepped down from serving on the NomCom in the hope to be elected as Councillor again by the ccNSO membership. Further, in the past the ccNSO Council has selected a Councillor to serve, however that person’s term did not conclude while serving on the NomCom. Going forward, the ccNSO Council would appreciate your opinion on the scope of Article 8.8 to ensure the ccNSO internal selection procedure will be aligned with the Bylaws again, specifically, Would Article 8.8 preclude the selection of a Councillor to serve on the NomCom? Would it make a difference if this person was selected by the ccNSO members or appointed by NomCom? This report also reviews additional activities, looks ahead, and provides resources to enable sustained engagement on highlighted issues. ICANN75<https://75.schedule.icann.org/> is the ICANN Annual General Meeting, and will be held in Kuala Lumpur, Malaysia at the Kuala Lumpur Convention Centre, 17-22 September 2022. ccNSO Session at ICANN75: What to Expect During the ccNSO sessions, the country code top-level domain (ccTLD) community and others with an interest in ccTLD-related matters will discuss and receive updates on topics relevant to ccTLD managers. ICANN75 marks a milestone because for the first time, simultaneous interpretation will be available for a select number of ccNSO sessions. The enhanced language support will benefit the ccTLD community by deepening operational exchanges and advancing information-sharing. It is part of a pilot project that covers simultaneous interpretation in English, French, and Spanish for the next three ICANN Public Meetings. The ccNSO program begins on Saturday, 17 September. The Domain Name System (DNS) Abuse Standing Committee (DASC) and the Internet Governance Liaison Committee (IGLC) will hold working sessions. The ccNSO schedule will continue on Sunday, 18 September with other committee and working group sessions, including the Technical Working Group and the Strategic and Operational Planning Committee (SOPC). The third and fourth ccNSO policy development process (ccPDP) working groups will have their working sessions as well. The ccPDP3-Review Mechanism Working Group has developed a proposed mechanism for the review of the specific decisions on the delegation, transfer, revocation, and retirement of ccTLDs. The ccPDP3-Review Mechanism Working Group aims to perform stress-testing of its policy recommendations. On Tuesday, 20 September during the ccNSO Policy Update, the ccPDP3-Review Mechanism Working Group will present its proposals and seek input from the ccTLD community. Later that same day, it will evaluate the input received. Tech Day will take place on Monday, 19 September. Tech Day is a workshop open to all ICANN community members with an interest in technical, operational, and security topics. The ccNSO schedule will continue on Tuesday, 20 September, and will start with the ccNSO Policy Update, followed by a session that will explore the impact of legislative initiatives regarding geographical indications on ccTLD managers. The ccNSO will also hold joint sessions with the Governmental Advisory Committee (GAC) and the ICANN Board. On Wednesday, 21 September, during a ccNSO Governance Session, the Guidelines Review Committee (GRC) will present its proposals for ccNSO statement of interest and conflict of interest processes and seek input from the ccTLD community. The GRC will also alert the ccNSO membership about upcoming voting processes and work items. During a Universal Acceptance session, there will be a discussion on the role of the ccNSO and how to best serve the ccTLD community. ccTLD managers from different regions will share their experiences during a ccTLD News Session. Finally, on Thursday, 22 September, there will be a meeting of the ccNSO Council. The ccNSO program will conclude with a wrap-up session by the Meetings Program Committee. The ccNSO Rules have a direct impact on the governance structure of the ccNSO, specifically on the respective roles and responsibilities of the ccNSO Council and ccNSO members. On 2 June 2022, the most recent version of the ICANN Bylaws was published. Consequently, amendments to Article 10<https://www.icann.org/resources/pages/bylaws-2022-06-02-en#article10>, on the Country Code Names Supporting Organization (ccNSO), and Annex B<https://www.icann.org/resources/pages/bylaws-2022-06-02-en#annexB>, on the ccNSO Policy Development Process, became effective. The Bylaw change impacts on ccNSO existing rules and operating procedures, since IDN ccTLD managers are now eligible to become members of the ccNSO. A GRC subgroup<https://community.icann.org/x/VQDECQ> held various consultations with the ccNSO membership to identify issues, find solutions and to update about progress on the proposed changes to the Rules. Based on the feedback, the Group finalised its draft. The ccNSO Council adopted the proposed new Rules (in accordance with section 10.3(k) of the ICANN Bylaws) at its meeting on 18 August 2022. The proposed Rules are now ready to be put before the ccNSO membership for adoption. FAQ 02 | What are the major changes between the current Rules and the proposed new Rules? Firstly, the voting was adjusted: once the Rules come into effect, the concept of “one vote per ccTLD” will be replaced with “one vote per Territory”. Secondly, two new concepts were introduced: * Representative Each ccTLD manager may designate in writing a person, organization, or entity to represent the ccTLD manager in matters relating to the ccNSO (“Representative”). In the absence of such a designation, the person, organization, or entity listed as the administrative contact in the IANA database shall be deemed to be the designate of the ccTLD manager by whom the ccNSO member shall be represented. * Emissary the Representative selected by the ccTLD Manager in accordance with Section 10.4(e) of the ICANN Bylaws shall be the Territory’s emissary (“Emissary”) for the purpose of voting in the specific cases enumerated in Article 10 & Annex B of the ICANN Bylaws and the Internal Rules and Internal Procedures of the ccNSO. As per the current rules (See Section 2.2 and 4.1 of the April 2022 version of the April 2022 Rules), at least 57 ccNSO members (33% of the current membership) and at least three (3) members per ICANN Region need to cast their votes to pass the quorum threshold. If the vote is quorate, at least 66 % of the votes cast need to be in favour of the proposed amended rules.
