Update by ICANN’s Government Engagement team (Mandy Carver ICANN SVP, Government & IGO Engagement; Rebecca McGilley ICANN Organization Director Government and IGO Engagement, Alexey Trepykhalin, IGO engagement at ICANN; Nora Mari, Government & IGO Engagement; Elena Plexida, Vice President, Government & IGO Engagement) regarding Internet related public policy issues, including international / intergovernmental and national (municipal) normative, legislative and regulatory proposals that may impact ICANN’s technical mission, policies and processes. Session had a section focused on legal/regulatory developments in the Asia-Pacific region. Mandy Carver- general intro statements about relevant challenges / perceptions out there like potential capture of MSM model, activities by governments and IGOs like ITU in DNS space, among others Alexey Trepykhalin- IGO Activities: cybersecurity deliberations at UN; ITU Plenipotentiary 26 September will be most important. Election of SG will be significant. Also ITU-Plenipotenciary (ITU PP-22) to discuss several Resolutions (#101, 102, 130, 133, 180) that affect IP/DNS, IDNs, and the MSM model, therefore also ICANN’s Mission of security and interoperability of Internet. Nora Mari- Legislation update: EU: 1) Digital Services Act to come into force in 1/2024; 2)The Network and Information Security 2 (NIS2) Directive to achieve a high common level of cybersecurity across EU Member States to move forward in October. Elena Plexida: EU proposals on Geographical Indicators; AI Regulations; EU digital identity framework; Discussions about future legislation on “fair share” - “Fair share' is a proposal to make the most traffic-intensive platforms pay the cost of connectivity. The platforms call it an 'internet traffic tax'. BEREC (Body of European Regulators of Electronic Comms) discussing. Mandy Carver- APAC Developments: 1) China’s PIPL (Personal Information Protection Law) took effect Nov 2021 - similar to GDPR. 2) Several Indian developments (IT Act 2000, as amended & regs; 3) Personal Data Protection laws in Thailand, Japan, Sri Lanka, Vietnam, Bangladesh. Other: Vietnam & Cambodian acts/decrees on Internet use, management. -Queue opens- -All in person commenters were thankful and recognized good work of ICANN Orgs IGO engagement team to keep Community updated. -Online commenter from Russia criticized ICANNs characterization of ITU and Russian activities as negative and spoke at length about jurisdictional issues and supposed jurisdictional / extraterritorial ICANN overreach. Mandy Carver replied and defended that they are not interpreting anything; they are restating what is expressed in specific statements and resolutions. -African online commenter focused on alleged impacts of ICANN on digital sovereignty. -Discussions on need for Community to participate in IGF and other events, to be aware and impact “Internet fragmentation” and other relevant discussions. -EU Commission Rep to GAC: trying to address issues where we see them. Look out for the email sent by Kim with instructions regarding the mentimeter poll! Pensri 1. The ccNSO, in collaboration with UASG, should encourage ccTLDs to reach out to social media sites and platforms (e.g. Facebook, Line, Linked-in), ensuring support urls and emails in local languages 2. The ccNSO should organise sessions on UA readiness and practices for and by ccTLDs, e.g. at Tech Day or during ccNSO Members Meetings 3. The ccNSO should encourage ccTLDs to raise awareness about the importance and need for UA readiness among newcomers Anil 4. The ccNSO should raise awareness about the benefits of IDN ccTLD delegation to ccTLDs 5. The ccNSO should share working models 6. The ccNSO should activate the dedicated liaison for UASG activities 7. The ccNSO should create a dedicated group to assist ccTLDs with UA and Email Address Internationalisation (EAI) Dusan 8. The ccNSO should encourage ccTLDs to use and allow non-ASCII scripts in their own services, including email 9. The ccNSO should encourage ccTLDs to assist their registrars by offering promotions for IDNs 10. The ccNSO should encourage ccTLDs to reach out to developers (Microsoft, Apple, Linux), ensuring support in local languages 11. The ccNSO should encourage ccTLDs to cooperate with local authorities on creating demand for IDN domain names and the use of local languages/scripts Edmon 12. The ccNSO should set up a standing committee on IDN/UA a. To promote and advance IDN compliance and UA readiness b. To liaise and maintain communications with other relevant ICANN groups (e.g. UASG, GAC IDN WG, Board IDN/UA WG) 13. The ccNSO should coordinate with ccTLDs to develop IDN/UA Readiness case studies to highlight and share knowledge on current practices in IDN support, UA readiness roadmap, etc. 14. The ccNSO should encourage members and publish reports on EAI adoption in ccTLD zones (conducting studies and reporting on percentage of MX records supporting EAI extensions, as an indication of IDN/UA advancement) 15. Report on Internet Fragment , the DNS, and ICANN

-Report on Internet Fragmentation, the DNS, and ICANN Plenary Session- Highly attended Hybrid Plenary session (over 300 in person and over 240 online) provided an opportunity for ICANN Org and Community to have a dialogue and build upon a common understanding of the concept of “Internet fragmentation” and the challenge it can present to ICANN’s mission of global interoperability of the DNS. Moderators- Bruna Martins dos Santos Pari Esfandiari (ALAC) Intro- Ram Moham (SSAC) John Crain (ICANN Org) Discussants- Farzaneh Badii (NSG) James Bladel (RSG) Paul Wilson (ASO) Nigel Hickson - Virtual Moderator … Pari introduced issue- multilateralism v multistakeholderism; non-universal internet experience; alternate roots. John Crain started with a definition of concept- interoperability is the opposite of fragmentation. Fragmentation is not having a common DNS, a unique, single interoperable Internet. Ram: geopolitics and new tech can combine to shake the trust on the single interoperable DNS. DNS is a critical part of the infrastructure to secure that a user reaches the site she is looking for, regardless of whether it’s a URL search or a browser or an app. Users expect DNS “to just work”. Fragmentation -Internet islands without bridges to connect them- at DNS will create failures of the system and strand and isolate users. Also fragmentation shifts power from user to the “island builders”. This is about making sure that the protocols that ensure an trustable and predictable user experience remain in place. Paul Wilson: again used Ram’s metaphor of non connected “Internet Islands”. James Bladell: echoed previous comments, from industry perspective. We must defend multistakeholderism at all levels and outwardly. Also our MSM outcomes must be better, faster so that there’s no incentive for competing interest (anti multistakeholder forced) to work around us. Farzaneh: listed some of the same user-side problems caused by fragmentation; including an individual digital rights perspective (expression, privacy, etc). “When there’s no alternative to connect to the global Internet that’s fragmentation.” Discriminatory Internet access that judges who connects. Ram: impact on ICANN’s mission. ICANN receiving different pressures, from geopolitical to technological, to go against its main mission of DNS global interoperability, predictability of the user experience to get to where they want to go in Internet. Paul- made a point that IPv6 is not fragmentation. IPv6 is like transition of petrol cars to EVs- better tech using same infrastructure, enhancing the current paradigm, not backwalking the paradigm. Nigel: reported on chat Farzaneh- ICANN has a limited mission on keeping the global architecture. There are risks, but alternative offerings for Internet are no necessarily bad- John Crain- alternatives can cause confusion. Floor Queue Opened- Brazil Rep: fragmentation is there and its not good nor bad. Central state objectives (like Internet penetration, literacy, others) are important Jorge CANCIO, on a personal basis, not SWITZERLAND. Mentioned Global Digital Governance and need to engage there. ICANN’s role is making sure it keeps doing a good job in making the Internet work. There might be a need for an international agreement / treaty to protect multistakeholderism?
