ccNSO report on EPSRP

Dear Steve, In response to the June 2015 Board resolution, I am pleased to provide the Board the requested further guidance on and refinement of the methodology of second string similarity review process. For the Board’s convenience I have included the ccNSO Council’s resolution (Annex A) and an overview of the development of the requested guidance, including the interaction between the ccNSO Working Group, SSAC and the ccNSO Council (Annex B). In addition, I request the ICANN Board of Directors to discuss and adopt the ccNSO IDN ccTLD Policy Development Process (PDP). The proposed policy was submitted to the ICANN Board in September 2013. In parallel with this submission, the ccNSO requested the Board to introduce it first as part of the Fast Track Process to experiment with the methodology and two-panel mechanism. The Extended Process Similarity Review Panel was introduced in December 2013 and now, with conclusion of the 3rd review of the Fast Track process (March 2015) and the related proposed guidance on and refinement of the methodology, the ccNSO Council is of the view that the experimental Fast Track should be replaced by the overall policy. As stated in the proposal there are a number of significant overlaps between the work of the CCWG-Accountability and a standard ATRT review which would cause an important duplication of work between these two processes. The CCWG-Accountability simply wishes to ensure that the SO's and AC's are aware that if there is no request from the SO's and AC's to modify the scope of the ATRT3 review prior to its launch that it will proceed as a standard review. In its discussion of this issue the CCWG considered the following points: * Collision of topics between WS2 and ATRT3 - There is potential for significant overlap between WS2 topics and the scope of ATRT3 as 6 of the 9 WS2 topics are accountability and transparency issues ATRT3 could also consider. * Timing of the two activities - WS2 began in July 2016 with an objective of completing its work by the end of 2017. It would seem inefficient, at best, to have both of these activities working on the same topics independently, while drawing on the same pool of community volunteers. At worst, ATRT3 and WS2 groups could issue recommendations that are conflicting or duplicative. * Implementation of recommendations – The Bylaws for WS2 give CCWG recommendations greater weight when it comes to board consideration, relative to recommendations from an ATRT organized under the AoC. While in Helsinki, the CCWG concluded its preferred approach, as communicated in our 8-Aug-2016 letter <https://www.icann.org/en/system/files/correspondence/sanchez-et-al-to-icann…> to the Board of ICANN: Convene ATRT3 as soon as possible with the limited scope of assessing implementation of ATRT2 recommendations. Allow WS2 to handle new recommendations for accountability and transparency. The fourth ATRT would convene before 2022 and would assess all accountability and transparency topics and make recommendations The ICANN Board replied <https://www.icann.org/en/system/files/correspondence/crocker-to-sanchez-et-…> to the CCWG letter on 24-Oct-2016, saying, It is not up to the Board to dictate the scope of this important community review. While we share the concerns raised of avoiding duplication of resources, it is essential that the broader ICANN community have a voice in determining how the ATRT3 should be scoped in alignment with the Bylaws. The Board and the ICANN Organization stand ready to support the community’s direction. I am not sure why, but the WHO-command works for instance for the ccnso-council mailing list, but not for the ccnso-members mailing list … The password I am using is correct: subscriptions to that list work just fine. Since Hyderabad, CCWG-Accountability WS2 activity has made progress on several key items. The Rules of Procedure of the Independent Review Process are up for public comment until January 25th. Given the importance of the IRP, will the ccNSO council submit a response ? Public input will also shortly be sought on : - the Draft Human Rights Framework of Interpretation. - a fact finding questionnaire related to the hotly debated issue of Jurisdiction. There are strong positions against and in favor or ICANN’s legal incorporation in the State of California, USA that has caused debate in the legal and political implications of the geographic location. Draft recommendations of 2 other subgroups (Transparency, Guidelines for good faith in the process of Board director removal) are under review by the plenary. CCWG-Accountability should be able to report on these topics, and engage the ccTLD community, by Copenhagen. The ccNSO contribution to the SO/AC accountability questionnaire has been received, and very much appreciated. Analysis of the various contributions is in progress, as the last submissions are being received. Overall this progress (summarized monthly in a Dashboard available here : https://community.icann.org/display/WEIA/WS2+Dashboard[community.icann.org]<https://urldefense.proofpoint.com/v2/url?u=https-3A__community.icann.org_di…>) remains behind schedule. It is becoming increasingly unlikely that the work be completed by ICANN 59 as initially contemplated. A discussion on a more realistic timeline is under way and an update will be provided in Copenhagen. Meanwhile, expenses remain largely below budget, with very little Legal advice being requested for the moment. One of the topics discussed was the need to appoint a Working Party, post ICANN58 (Copenhagen meeting), and the need to start organizing the activities leading up to the review now, which includes a briefing call with relevant ICANN staff and a conversation with the Organizational Effectiveness Committee of the ICANN Board. At the 12 Jan call, the Council agreed that ultimately the working party should include: 5 Councillors appointed by the ccNSO members; 1 (former) NomCom appointed Councillor; 5 members form the broader ccTLD community - to be included post Copenhagen. So at this stage, and as agreed: * The ccNSO councilors are requested to nominate one member on a regional basis (one per region) * The NomCom appointed councilors are requested to nominate a (former) NomCom appointed Councillor. Next steps: Once the (former) Council members have put their names forward, the secretariat will organize a webinar between members and ICANN staff, in week 5 (between 30 January and 03 February), prior to the next Council call scheduled for 9 February. The purpose of this webinar is to explain the scope of the review, the process itself, the anticipated roles of the Council and Working Party and Independent Reviewer. We will launch a doodle poll to determine the preferred date of this webinar. In Copenhagen, the following activities will be organized: · Meeting with the OEC and relevant ICANN staff. For that meeting the ccNSO appointed ICANN Board members will be invited as well. · Session during the ccNSO Member Meeting, to engage the community. Current the session is scheduled at Tuesday 14 March, between 15:15 and 15:45 local time. Background: According to ICANN Bylaws section 4.4 (a) Section 4.4(a), calls for a periodic review “of the performance and operation of each Supporting Organization, each Supporting Organization Council, ….by an entity or entities independent of the organization under review.” As per the Bylaws, the goal of these reviews shall be “to determine: (i) whether that organization, council or committee has a continuing purpose in the ICANN structure, (ii) (if so, whether any change in structure or operations is desirable to improve its effectiveness and (iii) whether that organization, council or committee is accountable to its constituencies, stakeholder groups, organizations and other stakeholders”. These Organizational Review “shall be conducted no less frequently than every five years, based on feasibility as determined by the Board. Each five-year cycle will be computed from the moment of the reception by the Board of the final report of the relevant review Working Group.” The Organizational Effectiveness Committee of the Board (OEC), previously known as the Structural Improvements Committee (SIC), is engaged in the process from the Board side. It is the understanding that the 2nd ccNSO review will be kicked off at its earliest in July 2017. IANA Functions Customer Survey Results Available

Dear all, ICANN published the results of an annual survey that measures the perception of satisfaction among IANA functions customers regarding the services they receive. In the 2016 survey, which accounts for transactions completed between September 2015 and August 2016, 94 percent of respondents reported being "satisfied" or "very satisfied." The IANA Functions Customer Survey measures satisfaction in relation to documentation quality, process quality, transparency, timeliness, accuracy, reporting and courtesy. ICANN commissioned Ebiquity, a global reputation consultancy, to administer the survey. Those who make IANA functions transactions – top-level domain operators, protocol parameter and regional Internet registry managers, RFC authors, Internet Engineering Steering Group members, DNSSEC KSK ceremony participants and .INT domain registrants – were invited to take the survey. This year, ICANN issued 4,286 invitations and 10 percent of customers responded. About a year ago, we had some informal discussions with Xavier that was aimed at understanding the requirements on the Council for the allocation of resources for funding Council members and others to ICANN meetings. Strangely (to me) this turned out to not be predicated on on a budget, but on 'per seat' basis. Two questions arise from this answer :- - what requirement (e.g. from Finance or ICANN Board) is there on the ccNSO to allocate funds differentially between different classes of members - where does the differential between ccNSO number of seats and (e.g.) ALAC and GAC come from? This inquiry fell by the wayside. I wish to suggest a small informal meeting in CPH including Chair or one of the Vice-Chairs, and myself (since I've been doing the research) and one other Council Member (perhaps from LAC or Africa?). Situation has worked, by-and-large, this last few years, largely becuase of the support given from large registries who do not need travel support for their elected Councillors. But I can see it could inhibit good candidates from developing regions and also small registries in other regions. On the assumption Council continues to approve of this line of inquiry, I shall see if I can arrange something. Council is asked if it objects to this further inquiry
