Public comment, GNSO Operating Procedures and ICANN

Dear all, On 1 December 2016, the GNSO Council directed ICANN Policy Staff to draft proposed language for any necessary modifications or additions to the GNSO Operating Procedures and, if applicable, those parts of the ICANN Bylaws pertaining to the GNSO as a result of the work of the GNSO Rights & Obligations under Revised Bylaws Drafting Team. This Drafting Team was tasked to identify the GNSO's new rights and obligations under the revised ICANN Bylaws which were adopted following the IANA Stewardship transition. A redline version of the GNSO Operating Procedures incorporating these changes, as well as the section of the ICANN Bylaws pertaining to the GNSO are now published for public comment. The ccTLD community was informed by the chair of the ccNSO (https://community.icann.org/display/ccnsowkspc/Fundamental+Bylaws+change%3A +reconsideration+process+responsibilities?preview=/64082399/66069523/%5Bccns o-members%5D%20ICANN%20Board%20adopted%20the%20proposed%20Bylaws%20change%20 (Sataki).pdf) ) of the intended amendment of a Fundamental Bylaw change and of the upcoming Approval Action Community Forum during ICANN 59. Following the letter of the chair, 33 ccTLD managers expressed their support for the amendment and one expressed its abstention. At the Approval Action Community Forum (27 June 2017) no objections were expressed to the amendment. At the ccNSO Session on the topic, the vast majority of the ccTLDs present supported the proposed Fundamental Bylaw amendment. Decision In accordance with section 6.1 (a) and Annex D section 1.4 (a) the ccNSO Council as one of the Decisional Participants, APPROVES the amendment of section 4.3 as proposed. This decision becomes effective 7 days after publication of this resolution on the ccNSO website. The chair of the ccNSO is requested to notify the Empowered Community Administration in writing of this decision as soon as possible and forward this notice to the Secretary.

An update on the action items was just sent out by Bart. 1. Overview inter-meeting Council decisions thanks for the answer: next council meeting in August. 1. Appointments 4.1 Appointment Vadim A. Mikhaylov (.su) PDP WG Retirement of ccTLDs Peter Van Roste wondered how ithe PDP-ret WG will avoid focussing on the specific .su issue but rather come to conclusions that are more abstract and take into account a broader range of issues. Nigel, as WG chair, promised to avoid those concerns. Bart: IANA database still contains .SU as a ccTLD manager. We made an exception in the charter itself, regarding specific members for the decision-making. everyone in favour of adding Vadim as a member 4.2 Progress ccNSO appointment NomCom FY 2018 4 candidates. We will need to run the online selection process, via e-mail. council will be asked to evaluate all candidates, and select 1. Nigel Roberts mentioned that at least one application did not include the background document requested. Bart Boswinkel: All material received will be sent to the council, once the nomination period closed. 4 Aug: deadline to announce the ccNSO candidate. we have at least 1 week to evaluate the applications received. 1. ccNSO as Decisional Participant Update 5.1 Approval Action Process update everything in place for FY18. no further ECA activities expected shortly. 5.2 Rejection Action Process update Regarding the change to the ICANN bylaws: the ASO has informed the ECA and ICANN that they are in support. GNSO as well. ccNSO has voted in favour, but has not yet finalised its decision. nothing yet from ALAC, or GAC. The approval period expires tomorrow morning, the 7-day review period of the council decision expires at midnight today. We have a window of 5 hours. 6) Update CSC charter review terms of reference of the upcoming review prepared with a small group. Need to be shared with the RySG. Main points: - scope is limited to the CSC charter itself. The effectiveness of the CSC and how it performs oversight on PTI is out of scope. It allows the review team to make suggestions to future reviews. PTI should appoint a liaison as well, if they chose to do so. Lightweight format, driven by the CSC itself. Byron: if there are specific questions, he is happy to answer them. Moved? Stephen Seconded? Byron Decision: we adopt the terms of reference for the review. Martin and Abdalla invited to stay on the review team. Chair will inform the RySG. adopted unanimously. 1. Final Paper of the Cross-community WG Use of Country and Territory Names as TLDs 4 options available: 1. reject recommendation 2. defer the decision 3. adopt final report, ask ccNSO appointed members to provide advice on the next steps 4. adopt the final report, and wait for further action from other communities Ben (as liaison to GNSO council) to brief on what is happening at the GNSO council: they are currently discussing a PDP process for the matter. They felt that there is an existing PDP which is relevant, the new gTLDs subsequent procedures PDP. Someone was wondering what the ccNSO thought about this. Young-eum: Annebeth suggests closing this WG, and try to find another way to move forward. The public forum in Johannesburg highlighted the differences between the viewpoints of the different communities. The ccNSO should try to cooperate with the GAC on this matter, regardless of what the GNSO will try to do. Peter Vergote: plea for option 3. GNSO is looking which position the ccNSO is in. To try to take into account the ccNSO position, so they have a better support for what they are trying to do, and potentially try to isolate the GAC. It is critical that the ccNSO has a clear view of what our members are thinking about this. 7.1 Discussion and or adoption final paper (https://ccnso.icann.org/workinggroups/ccwg-ctn-final-paper-15jun17-en.pdf ) agreement: - adoption of final paper - support recommendations 1,2,4 - close this WG - ask members to continue to be involved in future work, and provide guidance on next steps separate working track to be created by the GNSO to discuss these issues. As suggested and as part of this endorsement we assume to receive regular updates on actual expenditures as tracked against this adopted budget, as well as the status of WS2 activities. To structure the review process, the ccNSO Council and RySG agreed to define the terms of reference for the review. Both ccNSO and RySG will appointed 2 members to an ad-hoc group that now has proposed the terms of reference for the first review of the CSC charter. Decision The ccNSO Council adopts the Term of Reference as developed by the joint group of ccNSO and RySG: Terms of Reference Customer Standing Committee Charter Review version 1.0. The ccNSO Council request Abdalla Omari and Martin Boyle to remain member of the review team. The chair is requested to inform the RySG. 7) Final Paper of the Cross-community WG Use of Country and Territory Names as TLDs 7.1 Discussion and or adoption final paper (https://ccnso.icann.org/workinggroups/ccwg-ctn-final-paper-15jun17-en.pdf ) Introduction At the ccNSO members meeting in Johannesburg the recommendations of the CCWG Use of Country and Territory names to continue work on use of Country and Territory Names as TLDs were discussed and supported. However, the format to continue work is still under community discussion. Awaiting the outcome of that discussion the ccNSO Councils deferred the discussion and adoption of the final paper to the next meeting (July 2017). By adopting the recommendations in the final paper the ccNSO Council effectively closes the Cross-community Working group and supports the need for additional work in this area. However, following ICANN 59 the next steps on how future work on the use of names countries and territories as TLDs will be structured and how the ccTLD community could participate most effectively is not clear (yet). Moving forward with respect to the Final paper and the discussion there are 4 options: Reject recommendations (working group effectively continues) and request WG to provide clear direction and assist in resolving issues. Defer the decision, up and until there is more clarity on how to proceed with follow-up work. The cross-community working group is not closed. Adopt final report and request the ccNSO appointed members to provide advice on next steps. Adopt the report, and await further action from other communities. Draft Resolution Background At the ccNSO members meeting the recommendations of the CCWG Use of Country and Territory names to continue work on use of Country and Territory Names as TLDs were discussed and supported. However, the format to continue work is still under community discussion. Awaiting the outcome of that discussion the ccNSO Council defers the adoption of the final paper to the next meeting (July 2017). Decision The ccNSO Council adopts the Final Paper of and supports recommendation 1, 2 and 4: Close this CWG in accordance with and as foreseen in the charter. Recommend that the ICANN community consolidate all policy efforts relating to geographic names (as that term has traditionally very broadly been defined in the ICANN environment to this point) to enable in-depth analyses and discussions on all aspects related to all geographic-related names. This is the only way, in our view, to determine whether a harmonized framework is truly achievable. Recommend that future policy development work must facilitate an all-inclusive dialogue to ensure that all members of the community have the opportunity to participate. Again, we believe that this is the only way to determine whether a harmonized framework is truly achievable. The Council also request the ccNSO appointed members to the CWG to keep the Council abreast of the developments and advise the Council on next steps. The ccNSO Council thanks and congratulates the CWG and in particular its ccNSO appointed members and co-chair Annebeth Lange. 7.2 Discussion recommendation Study Group CTN Letter to the Board to request continued exclusion of country and territory names in subsequent new gTLDs rounds. For discussion and / or decision. Introduction In September 2014 the Study Group recommended Council: In light of the need for further work on the treatment of country and territory names, the complexity of the issue at hand and the aforementioned inconsistencies between various ICANN policies, it is also recommended that the ccNSO Council request that the ICANN Board extend the current rule in the new gTLD Applicant Guidebook regarding the exclusion of all country and territory names in all languages, for consecutive rounds of new gTLD applications. Council adopted this recommendation in 2014. Given the establishment of the CCWG UCTN, Council did not pursue this recommendation, awaiting the outcome of the deliberations and recommendations of the CCWG. Draft Resolution At the ccNSO members meeting in Johannesburg the recommendations of the CCWG Use of Country and Territory names to continue work on use of Country and Territory Names as TLDs were discussed and supported. This also included the recommendation of the Study Group. The provider should have technical knowledge in domain name or Internet server operations, or have experience working with the Root Server System Advisory Committee (RSSAC) or Root Server Operators. The provider should also have an understanding of the root server ecosystem and/or DNS protocol knowledge. The objective of this Request for Proposal (RFP) is to identify an independent examiner that can conduct a comprehensive assessment of RSSAC.
