It is forceful, yet respectful, and makes it clear to all just how serious Council is taking this matter. One editorial note: The phrase “…not withstanding despite…” in the fifth paragraph (beginning “Council’s view (none dissenting…”) needs to have the “despite” removed. Other than that, it’s good to go in my view. With regards to your questions: 1. As this is at its core a bit of an ICANN “constitutional crisis”, given that we are protesting the seating of a NomCom appointment to Council, I think JJ should be on the copy list. 2. I believe that we should compose an additional letter to Ms. Moll, if for no other reason than to assure her that we (Council) have no issue with her as an accomplished person; rather, our issue is (a) the NomCom’s ignoring explicit advice the ccNSO issued to them in 2012, which, had it been followed in this case, would have prevented this issue from arising in the first place, and (b) the imbalance this appointment causes within Council. Based on her Bio, I think she would be an asset in almost any volunteer position within the ICANN ecosphere, just not the slot she has just been appointed to. Thanks for your effort on this. No internet (“Very strange way to live, without it” she said), no power, and very little in the way of outside help and relief supplies. Who can nominate/second? Bylaw Article 10 – Section 10.4 (h) (https://www.icann.org/resources/pages/governance/bylaws-en/#article10) states: “(h) Any ccNSO member may nominate an individual to serve as a ccNSO Council member representing the ccNSO member's Geographic Region. Nominations must be seconded by another ccNSO member from the same Geographic Region. The selected hotels for ICANN61 are fine as well as the convention center which is currently use as a command center. Those of us with At&t have limited mobile services in the San Juan metropolitan area, as the rest of the island only have service if you are lucky enough to stand in front of a working tower. Only 15 - 20 % of 1600 towers are working. Information trickles down at this moment so you probably know more about our situation. I heard the US Navy posted a hospital ship and an aircraft carrier is in the vicinity to ensure safety and support. Both the US Army, Coast Guard, and National Guard are helping. Other State National Guards from the East Coast are arriving as I write this message. Kind regards, Emily GNSO Adoption of the Final Report of the Cross-Community Working Group Framework for the Use of Country and Territory names as TLDs Submitted by: Heather Forrest Seconded by: James Bladel Whereas The GNSO and ccNSO chartered the Cross-community Working Group Framework for the Use of Country and Territory names as TLDs (CWG UCTN) in March, 2014 (https://ccnso.icann.org/workinggroups/unct-framework-charter-27mar14-en.pdf…) The formation of a cross-community working group to evaluate the feasibility of developing an overarching framework on the use of country and territory names as TLDs was the principal recommendation of a preceding ccNSO Study Group (Final Report of 8 September 2013: https://ccnso.icann.org/workinggroups/unct-final-08sep12-en.pdf[ccnso.icann…) The CWG UCTN published an Interim Paper dated 9 February 2017 (https://ccnso.icann.org/workinggroups/ccwg-ctn-interim-paper-09feb17-en.pdf…) setting out the history and context of ICANN policy-making on country and territory names, and proposing four recommendations, with Recommendation 3 articulated in three alternatives. A public comment period on the Interim Paper was held from 24 February 2017 to 21 April 2017, with comments summarised in a report dated 3 May 2017 (https://www.icann.org/en/system/files/files/report-comments-cwg-uctn-interi…) In addition to comments submitted by individual GNSO stakeholders, the GNSO Registry Stakeholder Group, Business Constituency and Intellectual Property Constituency submitted comments supporting Recommendations 1, 2 and 4, as follows: 1. Close this CWG in accordance with and as foreseen in the charter. 2. Recommend that the ICANN community consolidate all policy efforts relating to geographic names (as that term has traditionally very broadly been defined in the ICANN environment to this point) to enable in-depth analyses and discussions on all aspects related to all geographic-related names. This is the only way, in our view, to determine whether a harmonized framework is truly achievable. 4. Recommend that future policy development work must facilitate an all-inclusive dialogue to ensure that all members of the community have the opportunity to participate. Again, we believe that this is the only way to determine whether a harmonized framework is truly achievable. Notably, no objections were raised in any submission during the public comment period to the above Recommendations 1, 2 and 4. A range of support was expressed for each of the alternative wordings of Recommendation 3, with all GNSO commenters expressing support for Alternative A, as follows: Alternative A Future work should take place with the authority of a policy development process under ICANN's Bylaws, with a clearly drafted Charter or scope of work that sets out how conclusions and recommendations will inform that policy development process. This addresses a key deficiency of this CWG, as it has not been made clear how the group's work can or will be incorporated in policy-making pursuant to ICANN's Bylaws. On 24 June 2015, the GNSO adopted the Resolution on the Request for a Preliminary Issue Report on New gTLDs Subsequent Rounds. (https://gnso.icann.org/en/council/resolutions#201506[gnso.icann.org]) The Preliminary Issue Report, which identified the “requirements around geographic names” as meriting discussion, was adopted by the GNSO Council on 17 December 2015 (https://gnso.icann.org/en/council/resolutions#201512[gnso.icann.org]) The Preliminary Issue Report notably recommended that: “A potential PDP-WG on New gTLD Subsequent Procedures could consider collaborating with other parts of the ICANN community, such as the GAC or ccNSO in particular, in determining if strings described above should be allowed and if so, what requirements would be needed to govern that process. The PDP-WG should also consider the work of the Cross-Community Working Group on Use of Country/Territory Names as TLDs before reaching any conclusions.” (Preliminary Issue Report at page 59, https://gnso.icann.org/en/issues/new-gtlds/subsequent-procedures-prelim-iss…) The GNSO Policy Development Process on New gTLD Subsequent Procedures (“Subsequent Procedures PDP”) was chartered on 21 January 2016 to, inter alia: “Review whether geographic names requirements are appropriate.” (https://gnso.icann.org/en/issues/new-gtlds/subsequent-procedures-charter-21…) This issue formed part of Work Track 2, covering legal issues. Following two cross-community sessions led by the leadership of the Subsequent Procedures PDP WG at ICANN59 in Johannesburg on the topic of the use of geographic names, the formation of a new Work Track 5 was proposed to better facilitate broad community participation in the discussion of policy on geographic name use. Resolved, The GNSO Council adopts Recommendations 1, 2 and 4 of the Final Report of the Cross-Community Working Group Framework for the Use of Country and Territory names as TLDs. The GNSO Council adopts the underlying objective of Recommendation 3, and in particular supports Recommendation 3 Alternative A, recognizing that the use of geographic names as gTLDs is clearly within the GNSO's mandate as per ICANN's Bylaws, and also recognizing that this is a matter of interest for the ICANN community as a whole. The GNSO Council instructs the leadership of the Subsequent Procedures PDP to consider the Final Report of the Cross-Community Working Group Framework for the Use of Country and Territory names as TLDs, and to ensure continued collaboration with other parts of the ICANN community in addressing issues relating to the use of geographic names. The GNSO Council recognizes the significant contribution of the CWG UCTN to the ongoing development of policy on the use of geographic names in the DNS, and thanks the members of the CWG UCTN for their Final Report, which clearly documents the history and context of policy-making in relation to geographic names. Dear Katrina, When I was particpating in the Nom Com, I remember that we had a workshop with John Jeffrey about all the implication and legal issues about or selection work, specially the legal disabilities and no-no cases. What if we (you) write to John Jeffrey asking him why this could happen and what we would do in this situation, considering the stressfull situation that we are facing with this new appointee? The thing is, we can represent this wrong way to appoint this NOM COm ccNSO councilor to the NOM COM Chair and/or reject this selection and ask for the second elegible cantidate? FAQ by GAC underserved WG: all councillors are invited to verify the document. 3. Overview inter-meeting council decisions - participation in WT5 - adoption of final response (not "report", as erroneously stated) to the Board letter. Response was sent. ccNSO and SSAC remain available for a joint briefing, e.g. in Abu Dhabi. Someone from ccNSO approached SSAC members, and did not support the current response. This is against the ccNSO rules and procedures currently in place. 4. NomCom appointed a CIRA Board member (.ca), so now .ca has 2 ccNSO councillors. This is similar to what happened in 2008. NomCom appointee was employed by a ccTLD, not already respresented on the council. longstanding criteria are being violated: “To maintain the current balance the ccNSO Council strongly advises the Nominating Committee not to appoint members who are directly or indirectly associated with a ccTLD manager (either as a Board member, employee or advisor) nor Board member or employee of a Regional Organisation” The concern is aggravated by the additional fact that the relevant ccTLD manager is already represented on the ccNSO Council by a Member unanimously elected by ccNSO members from that particular region. Nigel suggest a letter to be written by the chair, not by entire council Debbie: elegibility criteria. their procedures are so vague, we should ask them to enhance the selection criteria. Stephen: 2012 guideline was requested by the then-chair of the NomCom. They requested guidance, we provided it. We should give the ccNSO chair the discretion to write a letter Peter: warning, we should be careful what we put in the letter. If we say the proposed appointment is unaccecptable to the ccNSO council, we would need to deny the appointee to participate in council meetings, votings etc. Make sure we do not have undesired consequences of our own words Katrina: we cannot refuse the appointment, but can address the process.
