Some Registrars are seeking an exemption from certain collection and/or retention requirements under the Data Retention Specification (the "Specification") of the 2013 RAA. Section 2 of the Data Retention Specification sets forth requirements regarding the written materials a Registrar must submit in support of its good faith determination that the collection and/or retention of any data element specified in the Specification violates applicable law, and provides that following notice to ICANN of the Waiver Request, ICANN and the applicable Registrar shall discuss the matter in good faith in an effort to reach a mutually acceptable resolution of the matter. An update on the 2013 RAA and the data retention waiver process can be found here: http://blog.icann.org/2014/02/update-on-2013-raa-and-data-retention-waiver-… ICANN understands that personal data should be treated in accordance with applicable data protection laws, which generally permit gathering and retention of personal data for legitimate purpose(s). ICANN also understands that the law may vary from country to country as to (i) what is considered a legitimate purpose, (ii) whether the personal data is adequate, relevant and not excessive in relation to the legitimate purpose for which they are collected and (iii) for how long certain data elements may be retained. In other words, what is considered a legitimate purpose for collection of certain data in one country may not be considered a legitimate purpose in another country. During ICANN's discussions in an effort to reach a mutually acceptable resolution of the matter, some Registrars have requested that ICANN (a) clarify and better define certain data elements described in the Data Retention Specification that the Registrars maintain are not clearly defined; and (b) describe potentially legitimate purposes for collection and retention of each data element that would help provide guidance for Registrars both as to whether such elements may be lawfully collected, and, if so, for how long such elements might lawfully be retained. In response to these requests from some Registrars, ICANN is posting for public comment a document seeking to clarify what is meant by certain data elements described in the Data Retention Specification and describing potentially legitimate purposes for collection and retention of those data elements. ATLAS II: algunas actualizaciones

Estimados, Como comentaba en otro hilo, estoy enviando algunas actualizaciones acerca del Grupo de Trabajo de ATLAS II y los distintos sub grupos que se han formado, mediante los cuales estamos trabajando para la reunión de Londres, concretamente para el Summit de todas las ALS de At-Large. Disculpas por el correo tan extenso, es necesario cubrir varias cuestiones. *Objetivos de ATLAS II*: Los objetivos [1] de ATLAS II son: -Fortalecer la estructura de abajo hacia arriba de la comunidad At-Large mediante la creación de capacidades y la toma de conciencia de las políticas de At-Large en el proceso que involucra a más de 150 ALS; -Seguir desarrollando capacidades de la Comunidad At-Large para la participación en ICANN mediante el aumento de su conocimiento y comprensión de los temas clave que enfrenta ICANN y de las funciones y responsabilidades de ICANN; -Hacer planes para la siguiente etapa de desarrollo de la comunidad At-Large/ALAC; - Permitir que ICANN demuestre al resto del mundo un componente clave del entorno multistakeholder de abajo hacia arriba en un momento crucial para ICANN y para el modelo de múltiples partes interesadas de Internet. *Charter:* Este grupo de ATLAS II tiene un Charter [2] que establece los grupos principales que se han formado para atender a todas las necesidades de la reunión de Londres. *Grupos de Trabajo:* ATLAS II, que es el "grupo grande" se ha sub-dividido en diferentes Sub-grupos de Trabajo [3] para una mejor organización del trabajo que es necesario realizar para llegar a la reunión de Londres con actividades programadas, ordenadas y concretas. *¿Quiénes pueden formar parte de esos Grupos de Trabajo?*: Todos los miembros de At-Large, ya sean delegados de las ALS o no, y que asistan a la reunión de Londres o no. Estos grupos son abiertos a la participación de cualquier interesado en colaborar con la organización de los eventos que tendrán lugar antes y durante la reunión de Londres. Aquí quisiera recordar que he enviado invitación para participar en estos grupos a todo LACRALO en varias oportunidades, tanto en la lista de correo como en las llamadas. La participación de miembros de LACRALO sigue siendo baja en comparación con otros RALOs. En la reunión de Singapur se volvió a insistir con la necesidad de que más miembros de nuestra región se involucren en estos grupos de trabajo, o que quienes aparecen como miembros en los diferentes grupos tengan realmente una participación activa. *¿Quiénes van a participar de la reunión de Londres?*: A la reunión de Londres van a asistir un representante de cada ALS acreditada en ALAC, que son las personas que han completado la encuesta que se les ha enviado y que han sido incluidos en la lista de discusión de ATLAS II Participants. En el caso de las ALS que tengan un representante que desempeñe el rol de miembro de ALAC elegido por la región (en el caso de nuestro RALO, Dev y yo) va a asistir el miembro de ALAC en representación de la ALS). En el caso de los miembros de ALAC apuntados por el NomCom (en nuestro caso León), ellos no se consideran representantes de la ALS (porque bien podría haberse elegido como miembro de ALAC apuntado por el NomCom alguien que no formara parte de alguna ALS acreditada en ALAC; en este caso coincide que León además forma parte de una ALS), y para esa ALS irá el delegado de esa ALS que se encuentra informado como tal (en el caso de ISOC México, ese delegado será Alejandro). *¿Cuál es la agenda de eventos que se está planeando para la reunión de Londres?:* Uno de los Grupos de Trabajo, el de Eventos [4] está trabajando en esta agenda de eventos, a cargo principalmente de Tijani. Pueden encontrar ese borrador al final de la Wiki. Aquí me gustaría hacer algunas aclaraciones. De este grupo de Eventos, como podrán ver en la Wiki, hay varios miembros de nuestra región. La Co-Chair de este grupo es Sylvia Leite (ella podrá compartir más información sobre este grupo). De este sub-grupo de Eventos, se desprendieron dos sub-grupos más: *Comunicaciones* [5] que está a cargo de Natalia, Carlos Aguirre y Maricarmen Sequera; y el *Grupo de Trabajo de Mentoreo* [6] que está a mi cargo, en el cual también se sumaron Natalia, José y Sylvia; un grupo encargado del *Contenido *de las actividades de Londres (esto se formó en la reunión de Singapur, todavía no tengo un enlace para compartirles) que está a cargo de Wolf y Evan; este grupo fue quien reformó las Sesiones Temáticas de la reunión de Londres. Por lo tanto, varias de las personas que formábamos el grupo de Eventos, nos separamos de este grupo para encargarnos de otros sub-grupos y poder dividir el trabajo que hay que realizar. Podrán solicitarles más información sobre cada sub-grupo a los encargados de los mismos. -Respecto del *Grupo del Programa de Mentoreo* [6], la semana pasada en Singapur se decidió que se van a hacer varios cambios. Estos cambios se van a estar publicando en la Wiki (en la sección que se refiere al borrador de este programa; el que se encuentra publicado actualmente va a ser modificado) y se va a enviar un correo en primer lugar a los miembros del grupo, para que realicen los ajustes correspondientes, y luego a todos los participantes de la reunión de Londres. El objetivo de este Programa es que todos los participantes de la reunión de Londres, especialmente quienes asisten por primera vez, puedan aprovechar eficientemente la reunión, no sólo las actividades planeadas para At-Large, sino la reunión general de ICANN. Hay que resaltar que la mayor cantidad de actividades de ATLAS II para esta reunión están planeadas principalmente para el primer fin de semana (sábado y domingo) y allí seguramente se van a superponer con otras sesiones de la reunión general. El resto de la semana tiene las actividades normales para At-Large, salvo el wrap-up del jueves. De todas maneras quienes se han comprometido a asistir a la reunión de Londres financiados por At-Large saben que su prioridad es participar de las actividades planeadas por y para ATLAS II ya que este es el objetivo de esta reunión. En el tiempo restante, cada asistente será libre de participar en las sesiones de la agenda general de la reunión de ICANN. -En complemento al Programa de Mentoreo, y para lograr una mejor y más informada participación en la reunión de Londres, el *Grupo de Trabajo de Creación de Capacidades* (del cual también formo parte) está organizando una serie de Webinars [7] enfocados también en las necesidades de la encuesta que se les envió a todos los participantes de la reunión de Londres, y que también han sido ajustados para atender a los recientes acontecimientos. Estos Webinars se van a comenzar a desarrollar en los próximos días, por lo tanto ya se les estará enviado información sobre días, horarios y forma de participar. -Respecto de las *Sesiones Temáticas*: las Sesiones Temáticas originales surgieron de una encuesta que se envió a los participantes de la reunión de Londres, y como les adelanté en un correo desde Singapur, debido a los recientes acontecimientos que afectan el Ecosistema de la gobernanza de Internet en general, estas Sesiones Temáticas han sido modificadas. Las nuevas Sesiones Temáticas [8] atienden a estos acontecimientos. Estas Sesiones Temáticas van a correr en paralelo, por eso se solicitó que se priorice en cuáles les interesaba participar (se superponen, no se puede participar en todas). Estoy consultando si se va a enviar una nueva encuesta para volver a elegir en cuáles Sesiones Temáticas se quiere participar o si se va a manejar mediante correos a las listas. Apenas tenga respuesta sobre este procedimiento, les informaré. [Actualización: me acaban de informar que están decidiendo de qué manera se van a elegir cómo participar en las nuevas Sesiones Temáticas]. En estos momentos, este *Grupo de Contenidos*, está buscando quién pueda liderar estas Sesiones Temáticas. Por lo tanto si algún miembro de nuestro RALO se siente capacitado para asumir este rol o colaborar en este rol, están invitados a sumarse a esta tarea. Pueden enviar un correo a Eduardo Díaz (eduardodiazrivera(a)gmail.com) quien es el Chair de ATLAS II indicando su interés en colaborar en esto. En el borrador de la agenda de la reunión de Londres está previsto trabajar en tres momentos diferentes en estas sesiones temáticas. Aquí también me gustaría compartirles una inquietud que he planteado en la reunión de Singapur. De estas cinco Sesiones Temáticas que van a correr en paralelo, solamente dos de ellas van a tener interpretación simultánea, y serán aquellas que tengan mayor cantidad de asistentes. El argumento es que las salas asignadas no tienen espacio para las cabinas de interpretación. Mi comentario en la reunión de Singapur fue que esto me parecía un despropósito, ya que si está reunión de At-Large se está realizando con la finalidad de lograr la inclusión de las ALS en At-Large y además se pretende crear capacidades en nuestras ALS, no me parece conveniente limitar desde el inicio la participación eficiente en todas las sesiones previstas, si no que se deba elegir participar en aquellas que brinden interpretación simultánea. La necesidad de interpretación no es solo para nuestra región de América Latina y Caribe, también la comparten muchas ALS de África que tienen como idioma principal el francés. Lamentablemente las palabras finales fueron que no hay espacio en todas las salas para las cabinas de interpretación y que sólo se va a brindar en las dos sesiones con la mayor cantidad de asistentes. Como verán hay mucho trabajo que se está realizando y todavía queda mucho por hacer. Por lo tanto todos los miembros de LACRALO, especialmente quienes vayan a participar de la reunión de Londres están invitados a sumarse a algunos de estos esfuerzos para colaborar y aportar lo que esté al alcance de cada uno. De mi parte estarán recibiendo información sobre el Programa de Mentoreo durante la próxima semana. Espero que hayan sido aclaradas varias de las dudas que estaban circulando. Estimados miembros de LACRALO. Antes que todo queríamos darle la bienvenida a esta nueva etapa de LACRALO. Estamos comenzando un nuevo mandato con nuevo Presidente y nuevo Secretario, y necesitamos vuestra colaboración y participación. Si bien lo haremos nosotros también, queremos que todos hagan lo posible para integrar a aquellas ALSs que están un poco alejadas. Hemos querido comenzar a trabajar desde el primer minuto y recordarles que las tareas a enfrentar en lo inmediato son las siguientes: 1.- Elección por parte del miembro de LACRALO de la Sesión temática ATLAS II, a la cual concurrirá. 2.- Sugerir que todos los participantes del Atlas II, deberían participar en los 7 webinars que se están preparando pre-Atlas II. Aunque no es obligatorio, se recomienda. 3.- Señalarles que en el Programa de Mentores, se va a asignar a cada representante un mentor el cual se comunicará antes y durante el encuentro. 4.- Queremos que todos los participantes, luego de cada sesión y/o participación, envíen un informe o lo depositen en la wiki que estará habilitada al respecto. Esto será muy importante para todos, dando continuidad y fundamentos a considerar en el trabajo de nuestra Región. 5.- Nosotros hemos comenzado a preparar la Asamblea General de Londres, donde trataremos de llegar con la mayor cantidad de acuerdos tomados, siempre contando con vuestra colaboración.
